(LP) (MUP97-11) (VIDEO) (Continued open from 8/28/97) Mr. Parilo noted the comments submitted by Commissioner Cage. The hearing was opened to the public. Bill Harper said 2 '/ acre of the property is on the south side of Skyway. He said the remainder of the property is on the north side of Skyway and is cut in'/ by a canal. He said runoff can not cross the canal.. He said the. property is being cleaned up for fire protection purposes by removing the underbrush. He said the drainage goes toward the canal and will not get into the watershed area. Rene Harper, the applicant's daughter, said she wants her mother on the property with her and her husband. Commissioner Cage discussed adding a couple of rooms and a breezeway onto the house instead of a separate dwelling. Chairman Lambert said a temporary unit could be considered. Commissioner Mooney said it was a little late to change the application, that the temporary unit option should have been discussed with -the applicant already. Mrs. Velliquette said it is too late in the season to build a conventional house and she wants to put in the mobile home prior to the rainy season. Chairman Lambert asked Mrs. Velliquette about changing to a temporary dwelling. Mr. Parilo explained to the Commission that the applicant is advised at the counter of their alternatives. He said this application is in full compliance with the existing standards of the zone. He said if the Commission denies this permit, they must make the appropriate findings for denial. He said if the application is denied, the applicant can either appeal that decision to the Board of Supervisors or apply for an Administrative Permit for a temporary dwelling. There was a brief discussion on whether or not the applicant would have to pay another permit application fee. Mr. Parilo said they would handle the question if it became necessary. The hearing was closed. Commissioner Leland said he was inclined to approve this request. He did not see a basis for denying the request. BUTTE COUNTY PLANNING COMMISSION MINUTES - September 11, 1997 r . 1 0 Commissioner Cage was concerned with the watershed and setting a precedent by. allowing permanent second dwellings in the Upper Ridge area. She noted traffic, fire hazard, and access as concerns as well. Mr. Parilo said the Commission must restrict their actions to the standards in the existing County Code and not project future standards. Commissioner Mooney said he had no problems with this permit. Chairman Lambert said the impacts to the traffic and watershed are the same whether the dwelling is permanent or temporary. She said she would rather see this be a temporary dwelling, but would have a hard time making the findings for denial. Commissioner Cage said if the Upper Ridge allows this permanent second dwelling it will set a precedent and there will be cumulative impacts in the future. It was moved by Commissioner Mooney, seconded by Commissioner Leland, and carried to approve the Minor Use Permit for Rosella Veiliquette, deleting Condition 9 and renumbering Condition 10 to Condition #9, as follows: FINDINGS: Section 1: Environmental Findings. A. This application for a Minor Use Permit to allow a permanent second dwelling unit is Categorically Exempt from environmental review; and Section 2: Zoning Ordinance Findings. A. The proposed location, size, design, and operating characteristics of the proposed use is in accordance with the purpose of Chapter 24 of the Butte County Code, the purpose of the zone in which the site'is located, the Butte County General Plan, and the development policies and standards of the County; and B. The proposed location, size, design, and operating characteristics of the proposed use will be compatible with and will not adversely affect or be materially detrimental to adjacent uses, residents, buildings, structures or natural resources, with consideration given to: 1. Harmony in scale, bulk, coverage and density; 2. The availability of public facilities, services and utilities; 3. The harmful effect, if any, upon desirable neighborhood character; 4. The generation of traffic and the capacity and physical character of surrounding streets; 5. The suitability of the site for the type and intensity of use or development which is proposed; 6. Any other relevant impact of the proposed use. BUTTE'COUNTY PLANNING COMMISSION MINUTES - September 11, 1997 C. The proposed location, size, design, and operating characteristics of the proposed use and the. conditions under which it will be operated, or maintained will not be detrimental to the public health, safety and general welfare, or materially injurious to properties or improvements in the vicinity; and D. The proposed use will comply with each of the applicable provisions of Chapter 24, Section 280, of the Butte County Code. Section 3: Action. A. Subject to the findings indicated in' Sections 1 and 2 of this Exhibit A, Minor Use Permit for Rosella Velliquette on APN 065-010-054 to allow a permanent second dwelling unit is approved subject to the conditions listed herein. B. Minor changes may be approved administratively by the Directors of Development Services, Environmental Health, or Public Works upon receipt of a substantiated written request by the applicant and only as to those conditions or requirements recommended by their respective departments. Prior to such approval, verification shall be made by each Department or Division that the modification is consistent with the application, fees paid and environmental determination as conditionally approved. Changes deemed to be major or'significant in nature shall require a formal application for amendment. C. Conditions of Approval: The Second Unit shall not exceed 1200 square feet. 2. Provide two additional'off-street parking spaces. 3. An attached or detached garage or carport with- a maximum exterior dimension 20' by 24' is permitted. 4. Adequate sewer and potable water facilities shall be provided under permit as determined by the Butte County Environmental Health Division. 5. Either the existing single family dwelling or the Second Unit shall be owner occupied. Certification of ownership shall be required prior to permit issuance and annually thereafter by submittal of a declaration in a form specified by the Director of Development Services or designee. 6. No permits for any additional dwelling may be approved unless the Second Unit is first removed. - . 7. (LP) (MUP97-11) (VIDEO) A video of the site was shown. Mr. Sanders gave a brief summary of the project. Mr. Sanders said the condition for fire sprinklers can be deleted according to the Butte County Fire Department. He said this property has a flume running along side the property. Commissioner Cage said there is very little chance of drainage running through the flume. Mr. Crawford, CDF, said there is no provision to require sprinklers in second dwelling units in the County. There was a brief discussion on deleting the sprinkler requirement. The hearing was opened to the public. Rosella Velliquette asked that the sprinkler requirement be deleted because it would be a financial burden. She said the underbrush will be removed. She said the second dwelling will only be 50 ft. from the main house. She said she has two .excellent wells on the property and she will have a sprinkler system on the roof. Mr. Crawford said the roof sprinklers would assist in keeping the danger down. Jean Crist said she was concerned with protecting the watershed. She said this property was adjacent to the Hendrick Canal and within 100 ft. of the Little Butte Creek. She was in favor of the sprinkler requirement. She said this hearing should be put off until after the discussion later on the watershed. Ednamae Faircloth submitted a letter. She said the Upper Ridge is under the impression there would be no more second dwellings. She said this is a high fire hazard area. She said the lack of access is a problem. There is one road in and one road out. She was against the project. Chairman Lambert asked staff about development in the Upper Ridge area. Mr. Sanders said they are not allowing any new subdivision. Second Dwellings are- Cat. Exempt and impacts are not being discussed. He said this was a 20 acre parcel with a 20 acre zone. Jane Davis, Gridley, said she was concerned that this would be a hardship if it was not built. _ Ms. Velliquette said the second dwelling is for her. She said the house is far from Little Butte Creek. It was moved by Commissioner Cage, seconded by Commissioner Leland and carried to continue open this hearing to September 11, 1997, at 9:00 a.m. to allow the Commission - time to discuss second dwellings and the watershed later in this meeting. Commissioner Leland noted that even if the hearing is postponed, the laws" that apply today, will apply then. Commissioner Cage said the Commission needs a CEQA report. APN 065- 010-054: A request for a Minor Use Permit for a permanent second dwelling unit under the provisions of Butte County Code Section 24-280. The property is zoned TM -20/W -P (Timber Mountain, 20 acre minimum and Water Protection overlay zone), and is located on Cassierra Drive off Skyway approximately 1.3 miles north of Centerville Road, at 76 Cassierra Drive, in the Magalia area. This project is located in Supervisorial District 5. RELATED ITEMS: None. FOR: Planning Commission Hearing for August 28, 1997. SUMMARY: This request is for a Minor Use Permit for a permanent second dwelling unit no larger than 1200 sq. ft. The proposal conforms to the zoning and the General Plan. The application meets the requirements of Section 24-280 of the Zoning Code. PROJECT CHARACTERISTICS: This request is for a Minor Use Permit to allow a Second Unit pursuant to Butte County Code Section 24-280 as amended by Ordinanfce 3176. The size of the project parcel is 20.5 acres, the current zoning is TM -20. The Land Use Element Map of the Butte County General Plan designates the property as Agricultural -Residential. A 3,507 sq. ft. conventionally built house is located on the property. Domestic water for the residence is obtained from a private well and an on-site septic tank and leachfield system handles sewage disposal for the dwelling unit. Surrounding parcels are zoned TM -20 to the West, East, and , South, with a General Plan designation of Agricultural Residential and TPZ-160 to the North with a General Plan designation of Timber Mountain, ranging in size from 20 to 160 acres. ANALYSIS: This project will allow a 1,200 square foot home as a permanent second dwelling unit. The proposed location of the second dwelling is outside of the required, setbacks for the TM 20 zone. There is adequate space for two off-street parking spaces for the second dwelling unit. New vehicle traffic generated by the second dwelling unit will be minimal and will not have an impact on the roads in the project area. The proposed permanent second dwelling unit will have access to Cassierra Drive via the existing driveway. The applicant proposes to utilize a septic tank leachfield system for the second unit. The California Department of Forestry will require that all new structures comply with the California Fire Safe Regulations and be "properly identified pursuant to PRC 4290. ■ Butte County Department of Development Services ■ :J 0 Butte County Code Section 24-41 addresses the required findings for approval of a Minor Use Permit. There are six areas that must be considered for approval of a Minor Use Permit: Harmony in scale, bulk, coverage and density - The existing dwelling unit is a conventionally built house and the permanent second dwelling unit will be a 1,200 square foot conventionally built home. The two dwelling units will be in harmony with each other because the main dwelling unit is larger and the second dwelling unit will be clearly subordinate. The coverage and density of the project parcel will increase due to the addition of permanent second dwelling unit. However, the increase will be minor due to the 20.5acre size of the project parcel. 2. The availability of public facilities, services and utilities - Telephone and electrical services already extend to the project parcel. The parcel is presently utilizing a septic system and well and the second unit will utilize the existing well and install an independent septic system. 3. The harmful effect, if any, upon desirable neighborhood character - None, the Planning Commission approved an application for a second dwelling on a parcel to the west in 1992. 4. The generation of traffic and the capacity and physical character of surrounding streets - The second dwelling unit will add approximately 6-8 additional vehicle trips per day to the roads in the project area. The parcel has direct access to Skyway. 5. The suitability of the site for the type and intensity of use or development which is proposed - There is sufficient room on the project site for the permanent second dwelling unit and for a second septic system as discussed above. The site is within a high fire hazard area and is 2 miles from the nearest fire station. An interior fire sprinkler system should be required for this project. 6. Any other relevant impact of the proposed use - The parcel is located within the Paradise Reservoir watershed, it will have no adverse effectes on the water quality within the lake. The soils on the site are deep and well drained. Significant amounts,of additional surface water runoff will not be generated and all runoff is intercepted by the PG&E flume that traverses the property. Water in this flume flows to De Sabla Reservoir and is released into Butte Creek watershed. This request is consistent with the intent and requirements of Section 24-280 of the Butte County Code. Upon review of this second unit application, staff has determined that the proposed second unit will not significantly impair the integrity of the zone in which it lies. ENVIRONMENTAL DOCUMENTATION: This application has been determined to be categorically exempt from the provisions of CEQA under a Class 3 exemption. ■ Butte County Department of Development Services ■ 2 PUBLIC NOTICE AND COMMENTS: This application requires that a public hearing be held. Notices of the hearing will be mailed to the nearest 10 property owners. RECOMMENDATION: Staff recommends that the Planning Commission approve the Minor Use Permit for Rosella Velliquette on APN 065-010-054, File # MUP 97-11. The terms and conditions of this permit shall run with the land and shall be binding upon and be to the benefit of the heirs, legal representatives, successors, and assigns of the Permittee. FINDINGS: Section 1: Environmental Findings. A. This application for a Minor Use Permit to allow a permanent second. dwelling unit is Categorically Exempt from environmental review; and Section 2: Zoning Ordinance Findings. A. The proposed location, size, design, and operating characteristics of the proposed use is in accordance with the purpose of Chapter 24 of the Butte County Code, the purpose 1 of the zone in which the site is located, the Butte County General Plan, and the development policies and standards of the County; and B. The proposed location, size, design, and operating characteristics of the proposed use will be compatible with and will not adversely affect or be materially detrimental to adjacent uses, residents, buildings, structures or natural resources, with'consideration given to: 1. Harmony in scale, bulk, coverage and density; 2. The availability of public facilities, services and utilities; 3. The harmful effect, if any, upon desirable neighborhood character; 4. The generation of traffic and the capacity and physical character of surrounding streets; 5. The suitability of the site for the type and intensity of use or development which is proposed; 6. Any other relevant impact of the proposed use. C. The proposed location, size, design, and operating characteristics of the proposed use and the conditions under which it will be operated, or maintained will not be detrimental to the public health, safety and general welfare, or materially injurious to properties or improvements in the vicinity; and D. Prior to.such approval, verification shall be made by each Department or Division that the modification is consistent with the application, fees paid and environmental determination as conditionally approved. Changes deemed to be major or significant in nature shall require a formal application for amendment. C. Conditions of Approval: 1. The Second Unit shall not exceed 1200 square feet. 2. At this point in time; until the Upper Ridge is nolonger' a cul-de-sac and we have another road to egress and ingress, there has to be a hold put on lot splits, and second dwellings on the Upper Ridge,. no matter -how large the -parcel may be.. . (1) Upper Ridge, has a traffic problem,- and if a Second Unit is allowed on this parcel ,others will be sure to follow. Then there would be a impact on traffic: It would be hard to grant a. use permit for one person and not others. There are: a lot of TMl to TM160 in the Watershed Protection Zone. that. would like to have a Second Unit built for whatever reason.
