(LP) (MUP98-01) Staff gave a brief summary of the project and a video of the site was shown. Chairman Lambert noted the comments received from the Ag. Commissioner who is concerned with day care facilities in an ag. area, recommending denial. The hearing was opened to the public. William Reed said they are running a small day care now. He said he is approved by the State for a large day care and all he needs is this Use Permit. He said a lot of the spraying is done at night. Commissioner Mooney said he is concerned with the spraying and the children: He said they need a process where the parents acknowledge the center is near an orchard that has some spraying. Mr. Reed said he is willing to have parents sign an acknowledgment regarding the spraying. Chairman Lambert said she would want signed notice of awareness of orchard and spraying. Mr. Reed said he was more than willing to do that. The hearing was closed. It was moved by Commissioner Leland, seconded by Commissioner Cage, and unanimously carried to approve this Minor Use Permit with the addition of two new conditions and adding a comma after apparatus in Condition 8 as follows: Section 1: Environmental Findings. A. This application for a Minor Use Permit to allow a large family day care facility is Categorically Exempt from environmental review; and B. This application for a Minor Use Permit to allow a Second Dwelling Unit is Categorically Exempt from environmental review; and Section.2: Zoning Ordinance Findings. A. The proposed location, size, design, and operating characteristics of the proposed use is in accordance with the purpose of Chapter 24 of the Butte County Code, the purpose of the zone in which the site is located, the Butte 0 Butte County Planning Commission Minutes - October 23, 1997 0 Page 9 0 County General Plan, and the development policies and standards of the County; and B. The proposed location, size, design, and operating characteristics of the proposed use will be compatible with and will not adversely affect, or be materially detrimental to adjacent uses, residents, buildings, structures or natural resources, with consideration given to: 1. Harmony in scale, bulk, coverage and density; 2. The availability of public facilities, services and utilities; 3. The harmful effect, if any, upon desirable neighborhood character; 4. The generation of traffic and the capacity and physical character of surrounding streets; 5. The suitability of the site for the type and intensity of use or development which is proposed; 6. Any other relevant impact of the proposed use. C. The proposed location, size, design, and operating characteristics of the proposed use and the conditions under which it will be operated or maintained will not be detrimental to the public health, safety and general welfare, or materially injurious to properties or improvements in the vicinity; and D. The proposed use will comply with each of the applicable provisions of Chapter 24, Section 265 and Section 280, of the Butte County Code. Section 3: Action. A. Subject to the findings indicated in Sections 1 and 2 of this Exhibit A, Minor Use Permit for William and Peggy Reed on APN 024-210-013 to allow a large family day care facility for up to 14 children is approved subject to the conditions listed herein. B. Minor changes may be approved administratively by the Directors of Development Services, Environmental Health, or Public Works upon receipt of a substantiated written request by the applicant and only as to those conditions or requirements recommended by their respective departments. Prior to such approval, verification shall be made by each Department or Division that the modification is consistent with the application, fees paid and environmental determination as conditionally approved., Changes deemed to be major or significant in nature shall require a formal application for amendment. The facility is a single-family residence that is the principal residence of the provider and the use is clearly incidental and secondary to the use of the property for residential purposes. 2. Large family day care homes shall meet the following traffic control measures: (a) Provide 2 additional off street parking spaces for a total of 6. (b) The present design of having,a circular driveway or other suitable turn around so vehicles will not have to back out -onto Metteer-Road shall be maintained. 3. One sign, not to exceed 3 square feet, shall be allowed. 4. The Large Family day care home shall be licensed by the California Department of Social Services, Community Care Licensing. 5. Meet all State Fire Marshall regulations pertaining to Large Family day care facilities. 6. The applicant must meet all other applicable State and local statutes, ordinances, and regulations. 7. Facilities not meeting the above standards shall require a Conditional Use Permit to operate. 8. Provide an all weather access to all structures, which is designed to carry a 40,000 pound fire apparatus, at least 10 feet wide with a 15 foot vertical clearance. 9. Obtain and keep on file for 1 year statements from parents acknowledging proximity of agricultural spraying. 10. Unless otherwise provided for in a special condition to this use permit, all conditions must be completed by the Permittee within 12 months of the delivery of the countersigned permit to the Permittee. 3. If any use for which a use permit has been granted is not established within one year of the date of receipt of the countersigned permit by the Permittee, the permit shall become null and void and reapplication and a new permit shall be required to establish the use. 4. The terms and conditions of this permit shall run with the land and shall be binding upon and be to.the benefit of the heirs, legal representatives, successors, and assigns of the Permittee. PROJECT CHARACTERISTICS: This project is a request to allow for a large family day care facility subject to a Minor Use Permit as required by Butte County Code 24-265. The parcel is 10.3 acres in size and is surrounded by Walnut Orchards. Metteer Road lies north of Riviera Road which is in Sutter County, and is on the east side of Larkin Road in rural farm land. Domestic water for the project site is obtained from a well. Sewage disposal for the residences is served by a septic system. The project site, as well as the surrounding parcels, are zone) A-40 and have a General Plan designation of Orchard & Field Crop. ANALYSIS: The applicant is the owner of the property, resides on the premises, and i3 presently operating a day care facility for up to 6 children. Recently, The Department of Socia.l Services has.raised the maximum occupancy for Small Family Day Care Facilities from 6 to ? children and Large Family Day Care Facilities from 12 to 14 children. Due to requests from citizens for the service, the applicant is applying to increase the occupancy to 14 children Pursuant to Butte County Code Section 24-265, large family day care facilities shall meet all of the following minimum standards and conditions, as well as State licensing and Fire Marshall requirements: ■ Butte County Department of Development Services ■ Planning Division ■ . • • The facility is a single family residence that is the principal residence of the provider and the use is clearly incidental and secondary to the use of the property for residential purposes. 2. Properties proposed for Large Family day care shall be located at least 500 feet driving distance from any other Large Family day care property and the granti-Ig of the permit shall not result in any residence being bounded on more than one side by a Large Family day care. 3. Large Family day care homes shall meet the following traffic control measures: (a) In addition to providing the required number of parking spaces for the residential use, one off-street parking space for each employee of the facility and one off-street parking space/loading area shall be provided. The driveway area may be used to meet this requirement. (b) Large Family day care homes located on principal or minor arterial roacs as designated by the General Plan Circulation Element shall provide drop- off and pick-up areas which prevent vehicles from backing onto such roads. (c) Properties proposed for Large Family day care homes shall have frontage on and access off a paved road. Roads that are constructed for tha purpose of meeting this requirement shall meet the RS -4C standard as contained in the Butte County Improvement Standards contained in Chapter 20 of the Butte County Code. 4. One sign, not to exceed 3 square feet, shall be allowed. This project meets the above requirements to allow a large family day care facility in a A-40 zone. The facility will be subject to agricultural operations surrounding the parcel site; i.e. the use of fertilizers, pesticides and dust. The number of children, limited to 14, will not significantly impact the neighborhood. The existing home is approximately 1482 sq. ft. and is where the present day care facility is being operated. There are no other day care facilities within 500 feet of the project site. Metteer Road is a local road (graveled) and does not carry significant amounts of traffic. There will be an increase in the number of vehicle trips on Metteer Road in; the a.m. and p.m. due to this project. This increase in peak hour vehicle trips will not cause any significant impacts to the local streets. Vehicles can exit, drop off and pick up the children safely and ample parking space is available. This request is consistent with the intent and requirements of Section 24-265, (Day Care Facilities), of the Butte County Code, Upon review of this licensed day care application, staff has determined that the proposed d9 ycare will not significantly impair the integrity of the zone ■ Butte County Department of Development Services ■ Planning Division ■ 2 0 in which it lies, nor will it be detrimental to the health, safety, and welfare of the intended occupants or the immediate neighborhood. This project is located in Supervisorial District 4. RELATED ITEMS: None FOR: Director"s meeting of September 22, 1997. ABSTRACT: This is a Minor Use Permit request for a large family day care facility for no mare than 14 children. The proposal conforms to the zoning and the General Plan. No significant impacts will occur as a result of this project. Staff recommends approval of this application. PROJECT CHARACTERISTICS: This project is a request to allow for a large family day care facility subject to a Minor Use Permit as required by Butte County Code 24-265. The parcel is 10.3 acres in size and is surrounded by Walnut Orchards. Metteer Road lies north of Riviera Road which is, in Sutter County, and is on the east side of Larkin Road in rural farm land. Domestic water for the project site is obtained from a well. Sewage disposal for the residences is served by a septic system. The project site, as well as the surrounding parcels, are zoned A-40 and have a General Plan designation of Orchard & Field Crop. ANALYSIS: The applicant is the owner of the property, resides on the premises, and is presently operating a day care facility for up to 6 children. Recently, The Department of Social Services has raised the maximum occupancy for Small Family Day Care Facilities from 6 to 7 children and Large Family Day Care Facilities from 12 to 14 children. Due to requests from citizens for the service, the applicant is applying to increase the occupancy to 14 children. Pursuant to Butte County Code Section 24-265, large family day care facilities shall meet all of the following minimum standards and conditions, as well as State licensing and Fire Marshall requirements: ■ Butte County Department of Development Services ■ Planning Division ■ The facility is a single family residence that is the principal residence of the provider and the use is clearly incidental and secondary to the use of the property for residential purposes. 2. Properties proposed for Large Family day care shall be located at Ieast.500 feet driving distance from any other Large Family day care property and the granting of the permit shall not result in any residence being bounded on more than one side by a Large Family day care. 3. Large Family day care homes shall meet the following traffic control measures: (a) In addition to providing the required number of parking spaces for the residential use, one off-street parking space for each employee of the facility and one off-street parking space/loading area shall be provided. The driveway area may be used to meet this requirement. (b) Large Family day care homes located on principal or minor arterial roads as designated by the General Plan Circulation Element shall provide drop- off and pick-up areas which prevent vehicles from backing onto such roads. (c) Properties proposed for Large Family day care homes shall have frontage on and access off a paved road. Roads that are constructed for the purpose of meeting this requirement shall meet the RS -4C standard as contained in the Butte County Improvement Standards contained in Chapter 20 of the Butte County Code. 4. One sign, not to exceed 3 square feet, shall be allowed. This project meets the above requirements to allow a large family day care facility in a A-40 zone. The facility will be subject to agricultural operations surrounding the parcel site; i.e. the use of fertilizers, pesticides and dust. The number of children, limited to 14, will not significantly impact the neighborhood. The existing home is approximately 1482 sq. ft. and is where the present day care facility is being operated. There are no other day care facilities within 500 feet of the project site. Metteer Road is a local road (graveled) and does not carry significant amounts of traffic. There will be an increase in the number of vehicle trips on Metteer Road in the a.m. and p.m. due to this project. This increase in peak hour vehicle trips will not cause any significant impacts to the local streets. Vehicles can exit, drop off and pick up the children safely and ample parking space is available. This request is consistent with the intent and requirements of Section 24-265, (Day Care Facilities), of the Butte County Code. Upon review of this licensed day care application, staff has determined that the proposed daycare will not significantly impair the integrity of the zone ■ Butte County Department of Development Services ■ . Planning Division ■ E in which it lies, nor will it be detrimental to the health, safety, and welfare of the intenced occupants or the immediate neighborhood. ENVIRONMENTAL DOCUMENTATION: This application has been determined to be categorically exempt from the provisions of CEQA under a Class 3 exemption. The generation of traffic and the capacity and physical character of surrounding streets; 5. The suitability of the site for the type and intensity of use or development which is proposed; 6. (LP) (MUP98-01) Commissioner Mooney was concerned with the proximity of the walnut orchards to the house. He was concerned with the day care when the orchards are being sprayed. Mr. Sanders said the house is less than 100 ft. from the property line. Commissioner Cage discussed requiring a disclosure statement for the parents of the children being put in the day care if this is approved. Mr. Sanders said it is obvious the house is located in an ag. area because it is surrounded by walnut orchards. He noted that there is a day care there now. Commissioner Leland suggested posting a sign to tell parents of the spraying. Chairman Lambert asked when a day care requires a full Use Permit and not a Minor Use Permit? Mr. Sanders said for over 14 children a full Use Permit would be required. He said there are no restrictions against a daycare in the ag. zones. Commissioner Nelson said the Commission needs to discuss protecting the children. Commissioner Cage said she wants the parents notified of the dangers. Mr. Sanders said in order for the Commission to add conditions, they need to pull this item from the Consent Agenda and publish it for a public hearing. SECOND UNITS 1. The Second Unit may be attached to the primary residence or may be a separate, on-site detached dwelling. 2. The attached second unit shall be architecturally compatible with the primary residence and the appearance of the building shall be that of a single family dwelling. 3. The size of the attached second unit shall not exceed 640 square feet or 30% of the size of the primary dwelling, whichever is greater, in no case shall the second unit exceed 1200 square feet.
