(LP) (MUP99-02) (VIDEO) A video was shown of the site. Mr. Doody gave a brief summary of the project. He said the applicant wants to clear up the building code violations. He said staff is recommending approval. Chairman Lambert said since this is an existing building, they should delete "at the beginning of building construction" from Condition 8 and delete "before starting construction" in the second line of the NOTE on the Minor Use Permit form. There was a brief discussion on whether or not this property could be split. The hearing was opened to the public. Commissioner Nelson asked Mr. Southerland if the property could be split. Mr. Southerland said yes. -He said the applicant agrees to the conditions. The hearing was closed. It was moved by Commissioner Mooney, seconded by Commissioner Leland, and unanimously carried to approve the Minor Use Permit, #MUP99-02, for Glen M. Cosby, on AP 069-470-019, deleting "at the beginning of building construction" from Condition 8_ and deleting "before starting construction" from the NOTE on the Minor Use Permit, as follows: Section 1: Environmental Findings. A. This application for a Minor Use Permit to allow a second dwelling no larger than 1,200 sq.ft. is Categorically Exempt from environmental review; and Section 2: Zoning Ordinance Findings. A. The proposed location, size, design, and operating characteristics of the proposed use is in accordance with the purpose of Chapter 24 of the Butte County Code, the purpose of the zone in which the site is located, the Butte County General Plan, and the development policies and standards of the County; and B. The proposed location, size, design, and operating characteristics of the proposed use will be compatible with and will not adversely affect, or be detrimental to adjacent uses, residents, buildings, structures or natural resources, with consideration given to: 1. Subject to the findings indicated in Sections 1 and 2, approve Minor Use Permit 99-02 for Glen M. Cosby on APN 069-470-019 to allow a permanent second dwelling unit subject to the conditions listed below: Conditions of Approval: 1. The second dwelling unit shall not exceed 1,200 square feet. 2. Provide two additional off-street parking spaces. 3. An attached or detached garage or carport with a maximum exterior dimension of 20' by 24' is permitted. 4. Adequate sewer and potable water facilities shall be provided under permit as determined by the Butte County Environmental Health Division. 5. Either the existing single family dwelling or the Second Unit shall be owner occupied. Certification of ownership shall be required prior to permit issuance and annually thereafter by submittal of a declaration in a form specified by the Director of Development Services or designee. 6. No permits for any -additional dwelling may be approved unless a Use Permit is granted by the Planning Commission. r' 7. Construction, installation or development of structures or facilities on the parcels/lots shall comply with the latest California Fire Safe Regulations, (Public Resources Code 4290), and all other applicable State and County codes, ordinances and regulations in effect at the time of application for improvement permits. 8. G.P.: Agricultural Residential Zoning: AR -1 (Agricultural Residential - 1 acre) APN: 069-470-019 Location: On the southwest corner of Olive Highway and Apica Avenue, at 6 Apica Ave., Oroville Parcel Size: 5 acres Zone date: 02-28-87 Supervisor District: 1 Applicable Regulations: Butte County Code: Section 24-95 (Agricultural Residential Zones), Section 24-41(D.2)(Minor Use Permits) and Section 24-280(Second Units). SUMMARY: The proposed project meets the criteria of the zoning code for second units. Staff recommends approval. PROJECT DESCRIPTION/SITE CHARACTERISTICS: The 5 acre parcel contains a 2,580 sq.ft. dwelling with a built-in swimming pool, a 420 sq.ft. pool house described as a guest house on the site plan, an exercise room adjacent to the pool and a 1,200 sq.ft. building. converted into a second dwelling. CEQA ISSUES: This application for a Minor Use Permit to allow a permanent second dwelling unit is Categorically Exempt from environmental review under Section 15303, Class 3, "New Construction or Conversion of Small Structures". ANALYSIS: The applicant has an existing 1,200 sq.ft. shop building which has a bathroom.. In 1985 the applicant was granted a building permit for a swimming pool with a 420 sq.ft. exercise room and a screened room. Later the applicant moved the exercise equipment into the shop building, and began using the exercise room as a pool house. The applicant also added carpet and minor alterations to the shop building. Later a stove and refrigerator were added to the shop, converting it into a dwelling unit. After completing the conversion, the applicant attempted to refinance their house. At this time, it was discovered the conversions were built without obtaining building permits. Therefore, the applicant ■ BUTTE COUNTY PLANNING COMMISSION ■ AGENDA REPORT ■ PAGE 1 ■ desires to resolve possible building code violations related to the property by obtaining a Minor Use Permit for a permanent second dwelling. The zoning for this parcel would allow for up to five dwellings. The applicant is the owner of the property and resides in the main dwelling. The proposed project is consistent with the neighborhood character and will not be detrimental to adjacent uses. RECOMMENDATION/ACTION: Staff recommends that the Planning Commission make the findings and take the action listed below to approve Minor Use Permit 99-02 for Glen M. If any use for which a use permit has been granted is not established within one year of the date of receipt of the countersigned permit by the Permittee, the permit shall become null and void and reapplication and a new permit shall be required to establish the use. 4. The terms and conditions of this permit shall run with the land and shall .be binding upon and be to the benefit of the heirs, legal representatives, successors, and assigns of the Permittee. 5. Minor changes may be approved administratively by the Directors of Development Services, Environmental Health, or Public Works upon receipt of a substantiated written request by the applicant and only as to those conditions or requirements recommended by their respective departments. Prior to such approval, verification shall be made by each Department or Division that the modification is consistent with the application, fees paid and environmental determination as conditionally approved. BUILDING PERMITS 1. The Second Unit may be attached to the primary residence or may be a separate, on-site detached dwelling. 2. The attached second unit shall be architecturally compatible with the primary residence and the appearance of the building shall be that of a single family dwelling. 3. The size of the attached second unit shall not exceed 640 square feet or 30% of the size of the primary dwelling, whichever is greater, in no case shall the second unit exceed 1200 square feet. A detached second unit shall not exceed 1200 square feet. The parcel or lot upon which the Second Unit is to be located must meet the minimum acreage requirements for which the parcel or lot is zoned. 5. In addition to the off-street parking required for the primary dwelling, one off-street parking space shall be provided for second units of 640 square feet or less; two additional off-street parking spaces shall be provided for larger units. 6. An attached or detached garage or carport with a maximum exterior dimension of 12' by 20' is permitted for second units of 640 square feet or less. A garage or carport with a maximum dimension of 20' x 24' is permitted for larger second units. Adequate sewer and potable water facilities shall be provided as determined by the Butte County Environmental Health Division. 8. A second unit may not be placed on a parcel or lot where a temporary mobile home, in accordance with Section 24-295 and 24-295.20, has been approved or on a lot that has more than one dwelling located upon it. 9. Either the existing single family dwelling or the second unit shall be owner occupied. Verification of ownership shall be required prior to permit issuance and annually thereafter by submittal of a declaration in a form specified by the Director of Development Services or designee.
