It was moved by Commissioner Leland, seconded by Commissioner Cage, and carried unanimously to approved the Consent Agenda. This application for a Minor Use Permit to allow a large family day care facilit- is Categorically Exempt pursuant to Section 15303, Class 3 of CEQA; and Section 2: Zoning Ordinance Findings. A. The proposed location, size, design, and operating characteristics of the proposed use is in accordance with the purpose of Chapter 24 of the Butte County Code, the purpose o l the zone in which the site is located, the Butte County General Plan, and the development policies and standards of the County; and B. The proposed location, size, design, and operating characteristics of the proposed use will be compatible with and will not adversely affect, or be materially detrimental to adjacent uses, residents, buildings, structures or natural resources, with consideration given to: 1. Harmony in scale, bulk, coverage and density; 2. The availability of public facilities, services and utilities; 3. The harmful effect, if any, upon desirable neighborhood character; 4. The generation of traffic and the capacity and physical character of surrounding streets; 5. The suitability of the site for the type and intensity of use or development which is proposed; 6. Any other relevant impact of the proposed use. C. The proposed location, size, design, and operating characteristics of the proposed use and the conditions under which it will be operated or maintained will not be detrimental to the public health, safety and general welfare, or materially injurious to properties or improvements in the vicinity; and D. Large family daycare homes shall meet the following traffic control measures: (a) Provide 2 additional off street parking spaces for a total of 4. (b) Provide and maintain a circular driveway or other suitable turn around so vehicles will not have to back out onto Dakota Avenue. 3. One sign, not to exceed 3 square feet, shall be allowed. This sign shall not be placed it the front yard setback. 4. The Large Family day care home shall be licensed by the California Department of Social Services, Community Care Licensing. Meet all State Fire Marshall regulations pertaining to Large Family day care facilities. 6. Provide an all weather access to all structures, which is designed to carry a 40,000 pound fire apparatus, at least 10 feet wide with a 15 foot vertical clearance. 7. Obtain statements from the parents of the children who attend the large family day care acknowledging that the premises is in proximity of agricultural spraying activities and operations. Such statements shall be kept on file at all times during the extent of the operation of the day care facility. 8. Limit spraying, on orchard owned by the applicant, to times when children are not outdoors. 9. Facilities not meeting the above standards shall require a Conditional Use Permit to operate. 10. ITEM FOR CONSIDERATION JoAnna Thomsberry - (Item determined to be Categorically Exempt from environmental Review) Minor Use Permit to allow a Large Family Day Care Facility on property zoned SR -1 (Suburban Residential -1 acre parcels) located at 286 Dakota Avenue, identified as AP 022-180-104, Biggs. (LP) (MUP99-01) The hearing was opened to the public noting that the applicant not was present. JoAnna Thornsberry said she had no problems with the conditions. The hearing was closed. Mr. Doody recommended to the Planning Commission that the Minor Use Permit for JoAnna Thornsberry be approved subject to the findings and conditions listed in the Agenda Report and the item be scheduled for the September 10, 1998, Planning Commission Consent Agenda. If the Planning Commission concurs with the recommendation, the Minor Use Permit can be issued. II. The application meets the requirements of Section 24-265 of the Zoning Code. The planning division recommends approval for this request. 1. This request is for a Large Family Day Care Facility for up to 14 children. 2. The parcel is located in the Biggs area, on the north side of Dakota Avenue, lying south of the Biggs city limits. The parcel is located in a rural country setting with orchards and fields surrounding the property. 3. Domestic water for the project site is obtained from a well. Sewage disposal for the residence is served by a septic system. 4. The project site is zoned SR -1, along with the parcels to the east and west, A-5 to the south, R-1 to the north. 5. Surrounding parcel sizes range from one to ten acres. Applicable regulations: Approval of the Minor Use Permit is subject to Butte County Code Section 24-41 including the California Environmental Quality Act, Butte County General Plan, and Butte County Zoning Ordinance. Butte County Code Section 24-41(D) (1,2,3,4) states the following findings shall be made before granting the permit: 1. The proposed location, size, design, and operating characteristics of the proposed use is in accordance with the purpose of Chapter 24 of the Butte County Code, the purpose of the 0 Butte County Department of Development Services Agenda Report 0 Page 1 0 zone in which the site is located, the Butte County General Plan, and the development policies and standards of the County; and 2. The proposed location, size, design, and operating characteristics of the proposed use will be compatible with and will not adversely affect, or be materially detrimental to adjacent uses, residents, buildings, structures or natural resources, with consideration given to: 1. CEQA issues: This application for a Minor Use Permit to allow a Large Family Day Care facility is Categorically Exempt from environmental review under Section 15303, Class 3. "New Construction or Conversion of Small Structures". Analysis: The applicant is the owner of the property, resides on the premises, and is currently operating a day care facility for up to 6 children. Public Works requests the applicant provide a tum around area to prevent vehicles from backing out into Dakota Avenue when dropping off and picking up children. Environmental Health requests the applicant keep the septic system maintained to prevent failure or nuisance. These concerns have been addressed in the project conditions. This property is located on rural agricultural land, where the possibility of insecticides being sprayed on adjoining parcels may be of significance. In a previous application in the south county where an applicant's parcel was located directly within an agriculturally active area, the Planning Commission required the applicant keep on file for 1 year statements from the parents acknowledging the fact they were aware of agricultural spraying in the area. This has been added as a project condition of approval. Recommendation/Action: Staff recommends that the Planning Commission make findings pursuant to Section 24-41(D) (1,2,3,4) of the Butte County Code and approve the Minor Use Permit for JoAnna Thornsberry on 022-180-104, including the conditions listed in Exhibit "A". The terms and conditions of this permit shall run with the land and shall be binding upon and be to the benefit of the heirs, legal representatives, successors, and assigns of the Permittee. Minor changes may be approved administratively by the Directors of Development Services, Environmental Health, or Public Works upon receipt of a substantiated written request by the applicant and only as to those conditions or requirements recommended by their respective departments. Prior to such approval, verification shall be made by each Department or Division that the modification is consistent with the application, fees paid and environmental determination as conditionally approved. She has indicated to us that she closed the large day care facility allowed by that Minor Use Permit in October 2003. Ms. Lang moved to another parcel on the same street. (331 Dakota Avenue) and she is in the process of obtaining a new Minor Use Permit (File # MUP 04-04) for a large family day care facility at her property. A review of the day care licensees issued by the California Department of Social Services shows that you have not reestablished the large family day care facility use at 286_Dakota Avenue. Pursuant to Butte County Code Section 24-41(f)(4), a Minor Use Permit shall expire and the permit shall thereafter be of no further force or. effect if the use for which the Minor Use Permit was issued terminates or ceases operation for a continuous period of time in excess of 180 calendar day.
