(LP) (MUP99-03) Mr. Doody summarized the Agenda Report. He said the primary dwelling unit is proposed to be the new unit of approximately 1540 square feet. The existing dwelling unit of 1050 square feet will become the second unit. He recommended deleting the last portion of Condition 6, retaining only: "No permits for any additional dwellings may be approved." Chairman Lambert asked why the applicants chose to apply for a Minor Use Permit. Mr. Doody said the process for a Minor Use Permit is faster and cheaper than the Use Permit process. Commissioner Cage said there is concern on the Upper Ridge about additional traffic impacts due to the second dwelling. Mr. Doody said there is concern about traffic from further subdivision of lands, and the Commission should be concerned if this was a request to divide the property, however this request is only for a second dwelling unit. There will be a minor incremental increase to traffic from this project.' -If this was a proposal for a subdivision, the wider scope of the situation would have to be looked at more closely regarding traffic. Chairman Lambert noted that the Minor Use Permit process has more restrictions than the Use Permit process would have had. The hearing was opened to the public. Terry Taylor, the applicant was present with Kathy Leveroni, the real estate agent. Mr. Taylor said there will be no increase in vehicles, since his daughter's car is already on the property. Ms. Leveroni said the applicant preferred to have a stable foundation under his dwelling and that was a reason to apply for the Minor Use Permit. Dawn Senna, 14185 Nimshew, was in support of the request. The hearing was closed. It was moved by Commissioner Cage, seconded by Commissioner Leland, and carried unanimously for approval of the Minor Use Permit for Terry Taylor, MUP 99-03, subject to the findings and conditions of the staff report, with the modification to Condition 6. FINDINGS: Section 1: Environmental Findings. A.. This application for a Minor Use Permit to allow a second dwelling unit no larger than 1,200 sq. ft. is Categorically Exempt from environmental review; and ■ BUTTE COUNTY PLANNING COMMISSION ■ MINUTES ■ NOVEMBER 25, 1998 Section 2: Zoning Ordinance Findings. A. The proposed location, size, and design of the proposed use is in accordance with the purpose of Chapter 24 of the Butte County Code, the purpose of the zone in which the site is located, the Butte County General Plan, and the development policies and standards of the County; and ' B. The proposed use will be compatible with and will not adversely affect, or be materially detrimental to adjacent uses, residents, buildings, structures or natural resources, based on the following: 1. Harmony in scale, bulk, coverage and density: The parcel is double the requirements of the zone. 2. The availability of public facilities, services and utilities: Available to the property. 3. The harmful effect, if any, upon desirable neighborhood character: None, as the use is residential. 4. The generation of traffic and the capacity and physical character of surrounding streets: Minimal increase of traffic to the upper ridge and there are no direct effects to the local circulation system. 5. The suitability of the site for the type and intensity of use or development which is Proposed; See #1 & #3. 6. Any other relevant impact of the proposed use. None. C. The proposed location, size, design, and operating characteristics of the proposed use and the .conditions under which it will be operated or maintainedwill not be detrimental to the public health, safety and general welfare, or materially injurious to properties or improvements in the vicinity; and D. Conditions of Approval: The second dwelling unit shall not exceed 1,200 square feet. 2. Provide two additional off-street parking spaces. 3. An attached or detached garage or carport with a maximum exterior dimension of 20' by 24' is permitted. 4. Adequate sewer and potable water facilities shall be provided under permit as determined by the Butte County Environmental Health Division. Location: On the north side of SUMMARY: The proposed project meets the criteria of the zoning code for second units. Staff recommends approval. PROJECT DESCRIPTION/SITE CHARACTERISTICS: The 7 acre parcel contains a 1,050 sq.ft. dwelling unit. CEQA ISSUES: This application for a Minor Use Permit to allow a permanent second dwelling unit is Categorically Exempt from environmental review under Section 15303, Class 3, "New Construction or Conversion of Small Structures". ANALYSIS: Applicant proposes a manufactured second dwelling approximately 1,540 sq.ft. in size. This unit is proposed to become the primary dwelling unit. Access to the. property from Nimshew Road comes off Skyway. The upper ridge already has traffic congestion problems in this area. However, the addition of this second unit will only result in a small and incremental increase in traffic on the Skyway. The project is also located within a high fire hazard area. The second unit shall comply with the applicable requirements of PRC 4290. Also a fire evacuation plan has been recently prepared by the Paradise Fire Department and distributed to the upper ridge residents. Domestic water for the residence will be obtained from an. existing private well. Sewage disposal will be handled by an on-site septic system. RECOMAMNDATION/ACTION: Staff recommends that the Planning Commission make the findings and take the action listed below to approve the Minor Use Permit for Terry Taylor at 14175 Nimshew Road, including conditions in Exhibit "A". If any use for which a use permit has been granted is not established within one year of the date of receipt of the countersigned permit by the Permittee, the permit shall become null and void and reapplication and a new permit shall be required to establish the use. 4. The terms and conditions of this permit shall run with the land and shall be binding upon and be to the benefit of the heirs, legal representatives, successors, and assigns of the Permittee. 5. Minor changes may be approved administratively by the Directors of Development Services, Environmental Health, or Public Works upon receipt of a substantiated written request by the applicant and only as to those conditions or requirements recommended by their respective 'departments. Prior to such approval, verification shall be made by each Department or Division that the modification is consistent with the application, fees paid and environmental determination as conditionally approved. Changes deemed to be major or significant in nature shall require a formal application for amendment. Conditions of Approval: 1. The second dwelling unit shall not exceed 1,200 square feet. 2. SECOND UNITS The Second Unit may be attached to the primary residence or may be a separate, on-site detached dwelling. 2. The attached second unit shall be architecturally compatible with the primary residence and the appearance of the building shall be that of a single family dwelling. The size of the attached second unit shall not exceed 640 square feet or 30% of the size of the primary dwelling, whichever is greater, in no case shall the second unit exceed 1200 square feet. A detached second unit shall not exceed 1200 square feet. The parcel or lot upon which the Second Unit is to be located must meet the minimum acreage requirements for which the parcel or lot is zoned. SUNEVIARY: The proposed project meets the criteria of the zoning code for second units. Staff recommends approval. PROJECT DESCRIPTION/SITE CHARACTERISTICS: The 7 acre parcel contains a 1,050 sq.ft. dwelling unit. CEQA ISSUES: This application for a Minor Use Permit to allow a permanent second dwelling unit is Categorically Exempt from environmental review under Section 15303, Class 3, "New, Construction or Conversion of Small Structures". ANALYSIS: Applicant proposes a manufactured second dwelling approximately 1,540 sq.ft. in size. This 'uriit is proposed to become the primary dwelling unit. Access to the property from Nimshew Road comes off Skyway. The upper ridge already has traffic congestion problems in this area. However, the addition of this second unit will only result in a small and incremental increase in traffic on the Skyway. The project is also located within a high fire hazard area. The second unit shall comply with the applicable requirements of PRC 4290. Also a fire evacuation plan has been recently prepared by the Paradise Fire Department.and distributed to the upper ridge ro residents. Domestic water for the residence will be obtained from an existing private well. Sewage disposal will be handled by an on-site septic system. RECOMAMNDATION/ACTION: Staff recommends that the Planning Commission make the findings and take the action listed below to approve the Minor Use Permit for Terry Taylor at 14175 Nimshew Road, including conditions in Exhibit "A". FINDINGS: Section 1: Environmental Findings. A: This application for a Minor Use Permit to allow a second dwelling unit no larger than 1,200 sq.ft. is Categorically Exempt from environmental review; and Section 2: Zoning Ordinance Findings. A. The proposed location, size, and design of the proposed use is in accordance with the purpose of Chapter 24 of the Butte County Code, the purpose of the zone in which the site is located, the Butte County General Plan, and the development policies and standards of the County; and B. The proposed use will be compatible with and will not adversely affect, or be materially detrimental to adjacent uses, residents, buildings, structures or natural resources, based on the following: 1. Harmony in scale, bulk, coverage and density: The parcel is double the requirements of the zone. 2. The availability of public facilities, services and utilities: Available to the property. 3. The harmful effect, if any, upon desirable neighborhood character: None, as the use is residential. 4. The generation of traffic and the capacity and physical character of surrounding streets: Minimal increase of traffic to the upper ridge and there are no direct effects to the local circulation system. 5. The suitability of the site for the type and intensity of use or development which is proposed; See #1 & #3. 6. Any other relevant impact of the proposed use. None. C. The proposed location, size, design, and operating characteristics of the proposed use and the conditions under which it will be operated or maintained will not be detrimental to the public health, safety and general welfare, or materially injurious to properties or improvements in the vicinity; and D. The proposed use will comply with each of the applicable provisions of Chapter 24, Section 280, of the Butte County Code. Section 3: Action. A. Subject to the findings indicated in Sections 1 and 2, approve this Minor Use Permit 99-03 for Terry Taylor at 14175 Nimshew Road to allow a permanent second dwelling unit subject to the conditions listed in Exhibit "A". Failure to comply with the conditions specified herein as the basis for approval of application and issuance of Permit, constitutes cause for the revocation of said permit in accordance with the procedures set forth in the Butte County Zoning Ordinance, including Butte County Code Sec. 24-45.65. 2. Unless otherwise provided for in a special condition to this use permit, all conditions must be completed by the Permittee within 12 months of the delivery of the countersigned permit to the Permittee. 3. If any use for which a use permit has been granted is not established within one year of the date of receipt of the countersigned permit by the Permittee, the permit shall become null and void and reapplication and a new permit shall be required to establish the use. 4. The terms and conditions of this permit shall run with the land and shall be binding upon and be to the benefit of the heirs, legal representatives, successors, and assigns of the Permittee. Minor changes may be approved administratively by the Directors of Development Services, Environmental Health, or Public Works upon receipt of a substantiated written request by the applicant and only as to those conditions or requirements recommended by their respective departments. Prior to such approval, -verification shall be made by each Department or Division that the modification is consistent with the application, fees paid and environmental determination as conditionally approved. Changes deemed to be major or significant in nature shall require a formal application for amendment. Conditions of Approval: 1. The second dwelling unit shall not exceed 1,200 square feet. 2. Provide two additional off-street parking spaces. 3. An attached or detached garage or carport with a maximum exterior dimension of 20' by 24' is permitted. 4. Adequate sewer and potable water facilities shall be provided under permit as determined by the Butte County Environmental Health Division. 5. Either the existing single family dwelling or the Second Unit shall be owner occupied. Certification of ownership shall be required prior to permit issuance and annually thereafter by submittal of a declaration in a form specified by the Director of Development Services or designee. 6.
