Summary 2"d Residence 2540 Cactus Ave. AP# 48-760-011 To comply with the County Code(s) a Minor Use Permit is requested to build a 480 square foot 2nd residence on my property. The residence has one bedroom, one bathroom and a small kitchen. The building was actually built in 1986 by a contractor and permits apparently were never obtained. This was discovered during a recent permit application for a pool. I currently use the building to do my engineering work in the evenings which is permitted under the current Section 24-165.B.2. without a use permit however, I've been told that a office with a kitchen is considered a residence and therefore I must obtain a Minor Use Permit or remove the kitchen facilities. My intent is to move my 73 year mother into the residence in the fall of 1999 or spring of 2000. It is a very cozy little house that would only accommodate one or two people at the most. As it is in our backyard, we have no intention to ever let anyone other than family stay there. It will continue to be used for my evening work until either of our folks need it. Currently there is a little ("lean to") storage shed attached to this 2nd residence on the North side, it will be removed due to the fact that I've been advised that it will not comply with County Code(s). 1 Most of all, I want to comply with the County Code(s) whatever they are. I only need be told what is required to be done and I will comply with it. I would like to retain this building on the property as it is a simple, low maintenance little residence. In addition, my neighbor on the North has a 2"d residence on his property which he uses for his business so, this is not uncommon in this immediate area. Off street parking is not a problem, I don't know the size of an official parking space but, you can easily fit four cars in our driveway without blocking ingress or egress to any of them. I've met with Cliff Bottenfield from Butte County Environmental Health, he inspected our existing leach field after I exposed them to verify there exact location. It appears that I can comply with his concerns by adding additional leach field (200')and replacing (56') some that needs to be abandoned. There is adequate area remaining for a full replacement field. The pool permit mentioned above was obtained and the pool is complete and a Final inspection was performed. The pool has approximately 20,000 plus gallons of water less than 75' away from the 2"d residence. I mention the pool due to the Fire Department may need additional water in this area and there are no fire hydrants in this neighborhood. We have a 1.5 inch gas water pump that puts out a 1.5"stream of water, it shoots out the end about 8'. I don't know how much, but it is a lot of water. The front of the 2"d residence is only 168 feet from the centerline of Cactus Avenue, our Breezeway I believe provides adequate access to both the rear of our house and the 2nd residence. In addition our garage has garage doors on both sides so a full size Dodge 3/< ton 4 wheel drive vehicle (not a Fire truck)`could drive through into the back yard. There is also a 13' swing gate on the North side of the garage that could allow vehicle access to the back yard. I have submitted plans to both environmental health and the building department but those are on hold until I receive a use permit. Please issue any refund that may be due me, to the address listed below. We are withdrawing this application due to the dwelling is going to be converted to a "Guest House." By converting it to a Guest House we understand that; 1. Butte County Environmental Health (Mike Hueta) will be able to authorize their portion of the permit process. 2. A Use Permit is not required. 3. A Variance is not required. 4. By removing the Cook Stove from the dwelling it will qualify as a "Guest House." We've spoken to the Butte County Building Department (Linda.) They indicated that if the Cook Stove was removed that it would be considered a Guest House and, they stated that there is no difference between a guest house and a hobby room as far as they were concerned. I don't like to assume anything but, my assumption is that a Variance is not required for a Guest House, is that correct? My intent to convert this dwelling back to a 2nd Residence will be dependent on the Nitrite regulations in the future, should the regulations change favorably I may reapply for the 2nd Residence at that time. In the mean time I'm trying to comply with the current regulations that hopefully will allow me to keep this structure.
