The project is located on the north side of Cabrillo Drive, approximately 200 feet west of White Avenue, at 694 Cabrillo Drive, Chico. (MUP 99-06) (SB) The Planning Commission approved the Minor Use Permit for a large family day care facility for no more than 12 children for Karen Lee Vidauri, subject to the findings and conditions listed below: FINDINGS: Section 1: Environmental Findings. A. This application for a Minor Use Permit to allow a Large Family Day Care facility is Categorically Exempt from environmental review under Section 15303, Class 3, "New Construction or Conversion of Small Structures". Section 2: Zoning Ordinance Findings. A. The proposed location, size, design, and operating characteristics of the proposed use is in accordance with the purpose of Chapter 24 of the Butte County Code, the purpose of the zone in which the site is located, the Butte County General Plan, and the development policies and standards of the County; and B. The proposed location, size, design, and operating characteristics of the proposed use will be compatible with and will not adversely affect, or be detrimental to adjacent uses, residents, buildings, structures or natural resources, with consideration given to: 1. Harmony in scale, bulk, coverage and density; 2. The availability of public facilities, services and utilities; 3. The harmful effect, if any, upon desirable neighborhood character; 4. The generation of traffic and the capacity and physical character of surrounding streets; 5. The suitability of the site for the type and intensity of use or development which is proposed; 6. Any other relevant impact of the proposed use. C. The proposed location, size, design, and operating characteristics of the proposed use and the conditions under which it will be operated or maintained will not be detrimental to the public health, safety and general welfare, or injurious to properties or improvements in the vicinity; and D. The proposed use will comply with each of the applicable provisions of Chapter 24, Section 265, of the Butte County Code. Conditions of Approval: ■ BUTTE COUNTY PLANNING COMMISSION ■ MINUTES ■ MARCH 11, 1999 ■ The.facility should be maintained as a single-family residence that is the principal residence of the provider. The large family day care use shall be clearly incidental and secondary to the use of the property for residential purposes. 2. In addition to providing the two required parking spaces for the residential use, one off-street parking space for each employee of the facility and one off-street parking space/loading area shall be provided. The driveway area may be used to meet this requirement. 3. One sign, not,to exceed 3 square feet, shall be allowed. This sign shall not be placed in the front yard setback. 4. The Large Family day care home shall be licensed by the California Department of Social Services, Community Care Licensing. 5. The facility shall meet all State Fire Marshall regulations pertaining to Large Family day care facilities. 6. Prior to issuance of the Minor Use Permit, apply to the Building Division for a special inspection to complete a fire clearance inspection. A site and floor plan will be required. 7. The facility shall maintain the septic system in compliance with section 19-4 of the Butte County Code. 9. The applicant must meet all other State and local statutes, ordinances, and regulations. Failure to comply with the conditions specified herein as the basis for approval of application and issuance of Permit, constitutes cause for the revocation of said permit in accordance with the procedures set forth in the Butte County Zoning Ordinance, including Butte County Code Sec. 24-45.65. 2. Unless otherwise provided for in a special condition to this use permit, all conditions must be completed by the Permittee within 12 months of the delivery of the countersigned permit to the Permittee. 3. If any use for which a use permit has been granted is not established within one year of the date of receipt of the countersigned permit by the -Permittee, the permit shall become null and void and reapplication and a new permit shall be required to establish the use. 4. The terms and conditions of this permit shall run with the land and shall be binding upon and be to the benefit of the heirs, legal representatives, successors, and assigns of the Permittee. Minor changes may be approved administratively by the Directors of Development Services, Environmental Health, or Public Works upon receipt of a substantiated written request by the applicant and only as to those conditions or requirements recommended by their respective departments. Prior to such approval, verification shall be made by each Department or Division that the modification is consistent with the application, fees paid and environmental determination as conditionally approved. At that meeting no comments were received from the public regarding the project. The Planning Manager recommends that the Planning Commission approve the project. Exhibit "A" - Use Permit 694 Cabrillo Drive, Chico B. Zoning/General Plan Map C. Site Plan STAFF COMMENT A Minor Use Permit is required for a large family day care facility in a R-1 zone. The project meets the large day care facility requirements of the Butte County Code. Staff recommends that the Planning Manager recommend approval of this project to the Planning Commission. PROJECT DESCRIPTION/SITE CHARACTERISTICS: The proposed large family day care facility will be operated out of an existing 1,365 sq. ft. single-family dwelling unit, in which the applicant/provider resides. The applicant/provider currently operates a state -licensed small day care facility (six or less children). There i's one employee who does not live on the property. The project site is located in an area that consists mostly of single-family dwellings at urban densities. A large mobile home park is located adjacent to the site, with a wall located on the common property line. The site is located at the end of a dead-end street which serves seven parcels. Domestic water supply is obtained from a public water system and sewage disposal is handled by an on-site septic system. A paved driveway on the property can accommodate two vehicles. An unpaved driveway also on the property, underlaid with railroad ties, can accommodate two vehicles. Ar Butte County Department of Development Services Agenda Report or Page 1 a CEQA ISSUES: This application for a Minor Use Permit to allow a large family day care facility is Categorically Exempt from environmental review under Section 15303, Class 3, "New Construction or Conversion of Small Structures." ANALYSIS: The dwelling is the principal residence of the applicant/provider and the large family day care facility is incidental and secondary to the use of the property for residential purposes. No other large day care centers are known to be operating within 500 driving feet of the project site. Cabrillo Drive is a public road and is paved. The site has two existing driveways that can accommodate a total of four vehicles. This number of off-street parking spaces meets Butte County Code requirements. The increase in traffic will be minor and will not have a significant impact to vehicle operations on Cabrillo Drive or on White Avenue. However, the increase in vehicle traffic may be noticeable to the residents on Cabrillo Drive. The proposed large family day care facility will result in a minor increase in the noise level in the immediate project area. The additional vehicle trips generated by the proposed use will temporarily increase the noise level as children are dropped off and picked up. Children playing in the side and back yards of the facility will generate noise. Due to the parcel configuration of the site, and because of the solid wall adjacent to the mobile home park, only the parcel to the west of the site may be affected by noise from children playing. The Butte County Environmental Health Division did not object to this project and recommends that the septic system on the property meet County standards. This has been added as a condition of approval. The Butte County Public Works Department did not object to the project and did not recommend any conditions. The Butte County Building Division requests that the applicant apply for a special inspection to complete a fire clearance inspection. The Butte County Fire Department/CDF requests that the facility meet the requirements of the Butte County Building Code (UBC) and the State Fire Marshall. Comments were requested from the State of California Department of Social Services, Community Care Licensing, but none were received. RECOMMENDATION/ACTION: Staff recommends that the Planning Manager recommend approval to the Planning Commission of the Minor Use Permit for a large family day care facility for no more than 12 children for Karen Lee Vidauri, subject to the findings below and the conditions listed in Exhibit "A". FINDINGS: Section 1: Environmental Findings. A. The project meets the large day care facility requirements of the Butte County Code. Staff recommends that the Planning Manager recommend approval of this project to the Planning Commission. PROJECT DESCRIPTION/SITE CHARACTERISTICS: The proposed large family day care facility will be operated out of 'an existing 1,365 sq. ft. single-family dwelling unit, in which the applicant/provider resides. The applicant/provider currently operates a state -licensed small day care facility (six or less children). There is one employee who does not live on the property. The project site is located in an area that consists mostly of single-family dwellings at urban densities. A large mobile home park is located adjacent to the site, with a wall located on the common property line. The site is located at the end of a dead-end street which serves seven parcels. Domestic water supply is obtained from a public water system and sewage disposal is handled by an on-site septic system. A paved driveway on the property can accommodate two vehicles. An unpaved driveway also on the property, underlaid with railroad ties, can accommodate two vehicles. Ar Butte County Department of Development Services Agenda Report Ar Page 1 Ar CEQA ISSUES: This application for a Minor Use Permit to allow a large family day care facility is Categorically Exempt from environmental review under Section 15303, Class 3, "New Construction or Conversion of Small Structures." ANALYSIS: The dwelling is the principal residence of the applicant/provider and the large family day care facility is incidental and secondary to the use of the property for residential purposes. No other large day care centers are known to be operating within 500 driving feet of the project site. Cabrillo Drive is a public road and is paved. The site has two existing driveways that can accommodate a total of four vehicles. This number of off-street parking spaces meets Butte County Code requirements. The increase in traffic will be minor and will not have a significant impact to vehicle operations on Cabrillo Drive or on White Avenue. However, the increase in vehicle traffic may be noticeable to the residents on Cabrillo Drive. The proposed large family day care facility will result in a minor increase in the noise level in the immediate project area. The additional vehicle trips generated by the proposed use will temporarily increase the noise level as children are dropped off and picked up. Children playing in the side and back yards of the facility will generate noise. Due to the parcel configuration of the site, and because of the solid wall adjacent to the mobile home park, only the parcel to the west of the site may be affected by noise from children playing. The Butte County Environmental Health Division did not object to this project and recommends that the septic system on the property meet County standards. This has been added as a condition of approval. The Butte County Public Works Department did not object to the project and did not recommend any conditions. The Butte County Building Division requests that the applicant apply for • a special inspection to complete a fire clearance inspection. The Butte County Fire Department/CDF requests that the facility meet the requirements of the Butte County Building Code (UBC) and the State Fire Marshall. Comments were requested from the State of California Department of Social Services, Community Care Licensing, but none were received. RECOMMENDATION/ACTION: Staff recommends that the Planning Manager recommend approval to the Planning Commission of the Minor Use Permit for a large- family day care facility for no more than 12 children for Karen Lee Vidauri, subject to the findings below and the conditions listed in Exhibit "A". FINDINGS: Section 1: Environmental Findings. A. This application for a Minor Use Permit to allow a Large Family Day Care facility is Categorically Exempt from environmental review under Section 15303, Class 3, "New Construction or Conversion of Small Structures". Section 2: Zoning Ordinance Findings. A. Harmony in scale, bulk, coverage and density; 2. The availability of public facilities, services and utilities; 3. The harmful effect, if any, upon desirable neighborhood character; 4. The generation of traffic and the capacity and physical character of surrounding streets; 5. The suitability of the site for the type and intensity of use or development which is proposed; 6. Any other relevant impact of the proposed use. C. The proposed location, size, design, and operating characteristics of the proposed_use and the conditions under which it will be operated or maintained will not be detrimental to the public health, safety and general welfare, or injurious to properties or improvements in the vicinity; and D. The size of the attached second unit shall not exceed 640 square feet or 30% of the size of the primary dwelling, whichever is greater, in no case shall the second unit exceed 1200 square feet. A detached second unit shall not exceed 1200 square feet. 4. The parcel or. lot upon which the Second Unit is to be located must meet the minimum acreage requirements for which the parcel or lot is zoned. 5. In addition to the off-street parking required for the primary dwelling, one off-street parking space - shall be provided for second units of 640 square feet or less; two additional 6ff-street parking spaces shall be provided for larger units. 6. An attached or detached garage or carport with a maximum exterior dimension of 12' by 20' is permitted for second units of 640 square feet or less. A garage or carport with a maximum dimension of 20' x 24' is permitted for larger second units. —7. Adequate sewer and potable water facilities shall be provided as determined by the Butte County Environmental Health Division. 8. A second unit may not be placed on a parcel or lot where a temporary mobile home, in accordance with Section 24-295 and 24-295.20, has been approved or on a lot that has more than one dwelling located upon it. 9. Either the existing single family dwelling or the second unit shall be owner occupied.
