The property is located at 13290 Meadow Springs Road, approximately 600 feet north of Hoffinan Road, Concow. APN 058-330-007. (DD) QAUP 99-09) Mr. Wilson gave a brief summary of the project. He noted that this application is being processed under the old second dwelling regulations. Commissioner Cage asked if this property could be spit? Mr. Wilson said no, the applicant is under the regulations of the old ordinance where double the acreage was not required. The hearing was opened to the public. Kristine Harhen said she was concerned about what the applicant plans to do with the second dwelling. She is against this being a rental. She asked if this could be rented or does it have to be used for a relative? Commissioner Lambert said the applicant could do either. She said the second unit could become a rental, but the property owner must live in one of the dwellings. Ms. Harhen said there has been a problem with renters in the Concow area in the past. Commissioner Lambert explained the code for permanent dwellings and temporary dwellings. Ms. Harhen said she was told she could not put a second dwelling on her property. She said she was agEinst this project. She said this is a private road. Commissioner Cage asked about flooding in the area. Ms. Harhen said the majority of the ten acres is in a meadow and does flood. She again said she was agzinst this being a rental. The hearing was closed. Commissioner Cage asked if this site needs to be on a cul-de-sac for fire safety purposes and a sprinkler system? Mr. Wilson said fire safety is addressed in,the condition which talks about the 4290 fire safe regulations. It was moved by Commissioner Lambert, seconded by Commissioner Cage, and unanimously carried to approve the Minor Use Permit, MUP 99-09, for Gerald A. and Jewell A. Lunde as follows: I. Find that this application for a Minor Use Permit to allow a permanent dwelling unit is Categorically Exempt from environmental review. II. Approve Minor Use Permit MUP 99-09 for Gerald A. and Jewell A. Lunde on APN 058-330-007 subject to the conditions found in Exhibit A with the following findings: ■ BUTTE COUNTY PLANNING COMMISSION ■ MINUTES ■ AUGUST 11, 1999 ■ A. That the proposed location, size, design, and operating characteristics of the proposed rise is in accordance with the purpose of this Ordinance, the purpose of the zone in which the site is located, the Butte County General Plan, and the development policies and standards of the County because: Project conditions of approval have been applied to this project pursuant to the applicable requirements of Section 24-280 (B) "Standards and Conditions for Second Dwelling Units" of the Butte County Zoning Code, the Butte County Environmental Health Department and Butte County Fire Department. The project is in accordance with the purpose of the zor_e in which the land lies and the Butte County General Plan because the project site is designated Foothill Area Residential and zoned FR -10. The purpose of the Foothill Area Residential =and use designation is to provide land for single-family dwellings at rural densities. Secondary Uses also include dwellings. The FR -10 zone allows one single'family dwelling per parcel and a second unit upon approval of a Minor Use Permit. B. That the location, size, design, and operating characteristics of the proposed use will be compatible with, and will not adversely affect,'or be detrimental to adjacent uses, residents, buildings, structures, or natural resources, with consideration given to: 1. Harmony in scale, bulk, coverage, and density: The project is in harmony with scale, bulk, coverage, and density because .he additional dwelling will not cause over coverage of the parcel or exceed the density of the Butte County General Plan. The project site is 10 acres which is large enough to accommodate the proposed second dwelling, the existing primary dwelling and the proposed garage. Also, the new unit is 1,152 sq. ft. in size. This size can be characterized as not being overly bulky and its scale should be compatible with other rural residences in the vicinity. 2. The availability of public facilities, services and utilities: The additional dwelling will only create a minor need for new public facilities, servic :s and utilities because telephone and electrical services already extend :to the projevt parcel. The Environmental Health Department requires that a new septic system be installed for the second unit and that it meet County Code requirements. The Bute County Fire Department is requiring compliance with Public Resources Code Section 4290 and 4291 for fire protection as conditions of approval. The additional dwelling should not significantly affect fire protection services upon compliance with these fire safe requirements. Butte County Fire Station 38 is located 1 mile from the project site which enhances fire safety by allowing a faster response. The harmful effect, if any, upon desirable neighborhood character: The additional dwelling utilizes a traditional architectural style that is of a character- consistent with a rural residential neighborhood and should be compatible with surrounding dwellings. 4. ' The generation of traffic and the capacity and physical character of surrounding streets: ■ BUTTE COUNTY PLANNING COMMISSION ■ MINUTES 0 AUGUST 11, 1999 0 The Planning Commission has evidence indicating Meadow Springs Drive is too narrow and that cars meeting each other on the road requires one car to back up the road to a driveway turn -out in order to allow the other car to pass. Fire vehicles may not gain access to the property in the event of a fire emergency if another vehicle is on Meadow Springs Drive. As previously indicated in finding sub -section (b) this project was reviewed by the Butte County Fire Department. Their comments requred compliance with Public Resources Code Section 4290 and 4291. Also, Butte Co--inty Fire Station 38 is located 1 mile from the project site. While the road is narrow,, this is not expected to impact fire protection services. The Planning Commission has evidence indicating that during winter storms, Hof£nan Road sometimes may not be passable due to high flows from Concow Creek. This forces residents to access their properties through nearby Camelot Lane and the Camelot Subdivision. The Planning Commission fmds that the second dwelling unit will only add approximately 6-8 additional vehicle trips per day to Hoffinan Read. While Hoffinan Road may become impassible during winter storm events, this i3 an infrequent and temporary inconvenience. The additional dwelling will only create a minor amount of traffic and will not over burden the designed carrying capacity of -this road. Also, the additional vehicle trips should not change the character of traffin in the area. The Butte County Department of Public Works has evaluated the second dwelling and has not required any project improvements. The suitability of the site for the type and intensity of use or development which is proposed: The project site is 10 acres in size and is adequate in area for an additional dwelling and for the intensity of the proposed use,'which is rural residential. 6. Any other relevant impact of the proposed use: The Planning Division has circulated the proposed second dwelling application to County Agencies and has received no evidence that the use will cause any other relevant impact. C. That the proposed location, size, design, and operating characteristics of the proposed use and the conditions under which it would be operated or maintained will not be detrimental to the public health, safety, or welfare, or materially injurious to properties or improvements in the vicinity: There is no substantial evidence that the proposed location, size, design, and operating characteristics of the proposed use and the conditions under which it would be operated or maintained will be detrimental to the public health, safety, or welfare, or materiF-lly injurious to properties or improvements in the vicinity. Fire safety and road access have been addressed in sub -sections (b) and (d). The additional dwelling will only cause a minor -md incremental increase in traffic and the fire protection services. D. That the proposed use will comply with each of the applicable provisions of the Chapter 26, Section 280, of the Butte County Code. Conditions of Approval: 1. An attached or detached garage or carport with a maximum exterior dimension 20' by 24' is permitted. 4. Either the existing single family dwelling or the Second Unit shall be owner occupied. Certification of ownership shall be required prior to permit issuance and annually thereafter by submittal of a declaration in a form specified by the Director of Development Services or designee. 5. No permits for any additional dwelling may be approved unless the Second Unit is first removed, or a Use Permit be approved by the Planning Commission. 6. Construction, installation or.development of structures or facilities on the parcels/lots shall comply with the latest California Fire Safe Regulations, (Public Resources Code 4290), and all tither applicable State and County codes, ordinances and regulations in effect at the time of application for improvement permits. 7. Building identification and/or addresses shall be installed in conformance with Public Resou ces Code 4290 and shall be posted at the beginning of building construction and maintained continuously thereafter. 8. Prior to the issuance of a Building Permit for the second dwelling unit, meet the requirements of the Butte County Department of Environmental Health for sewage disposal systems. 9. Second dwelling unit applications submitted to the Planning Division prior to the Board's adoption of the new ordinance will be processed under the existing Zoning Code. This Minor Use Permit was processed pursuant to the current (old) Zoning Code requirements for a second dwelling unit. The subject property is zoned FR -10 (Foothill Recreational, 10 acre minimum parcel size). The Zoning Code permits one dwelling per parcel in this zoning district. The present code allows a second dwelling unit in the FR -10 zone upon approval of a Minor Use Permit. The project site is designated Foothill Area Residential by the Butte County General Plan. The General Plan states that the Primary Use of this land use designation is single-family dwellings at rural densities. Secondary Uses include agricultural uses, home occupations and dwellings. Butte County Code Section 24-41 et. seq. addresses the required findings for approval of a Minor Use Permit. The following analysis discusses this project's consistency with Section 24-41et. seq. That the proposed location, size; design, and operating characteristics of the proposed use is in accordance with the purpose of this Ordinance, the purpose of the zone in which the site is located, the Butte County General Plan, and the development policies and standards of the County because: Project conditions of approval have been applied to this project pursuant to the applicable requirements of Section 24-280 (B) "Standards and Conditions for Second Dwelling Units" of the Butte County Zoning Code, the Butte County Environmental Health Department and Butte County Fire Department. The project is in accordance with the purpose of the zone in which the land lies and the Butte County General Plan because the project site is designated Foothill Area Residential and zoned FR -10. The purpose of the Foothill Area Residential land use designation is to provide land for single-family dwellings at rural densities. Secondary Uses also include dwellings. The FR -10 zone allows one single family dwelling per parcel and a second unit upon approval of a Minor Use Permit. 2. The Environmental Health Department requires that a new septic system be -installed for the second unit. The Butte County Fire Department is requiring compliance with Public Resources Code Section 4290 and 4291 for fire protection as conditions of approval. The additional dwelling should not significantly affect fire protection services upon compliance with these fire safe requirements. Additionally, Butte County Fire Station 38 is located 1 mile from the project site which enhances fire safety by allowing a faster response. C. The harmful effect, if any, upon desirable neighborhood character: The additional dwelling utilizes a traditional architectural style that is of a character consistent with a rural residential neighborhood and should be compatible with surrounding dwellings. d. The generation of traffic and the capacity and physical character of surrounding streets: Staff has been contacted by a neighbor with concerns about Meadow Springs Drive being too narrow for cars to pass. Cars meeting each other requires one car to back up the road to a driveway turn -out in order to allow the other car to pass. The concern was that fire vehicles could not gain access to the property in the event of a fire emergency if another vehicle was on Meadow Springs Drive. As previously indicated in sub -section (b) this project was reviewed by the Butte County Fire Department. Their comments required compliance with Public Resources Code Section 4290 and 4291. Also, Butte County Fire Station 38 is located 1 mile from the project site. While the road is narrow, this is not expected to impact fire protection services. Staff has also been contacted by a neighbor with concerns that during winter storms, Hoffman Road sometimes may not be passable due to high flows from Concow Creek. The neighbor indicated a culvert on Hoffman Road is often overtopped which forces residents to access their properties through Camelot Lane and the nearby Camelot Subdivision. Staff has determined that the second dwelling unit will only add approximately 6-8 additional vehicle trips -per -day to Hoffman Road.•.While Hoffman Road -may become impassible during winter storm events, this is an infrequent and temporary inconvenience. The additional dwelling will only create a minor amount of traffic and will not over burden the designed' carrying capacity of this road. Also, the additional vehicle trips should not change the character of traffic in the area. The suitability of the site for the type and intensity of use or development which is proposed: The project site is 10 acres in size and is adequate in area for an additional dwelling and for the intensity of the proposed use, which is rural residential. f. Any other relevant impact of the proposed use: The Planning Division has circulated the proposed second dwelling application to County Agencies and has received no evidence that the use will cause any other relevant impact. That the proposed location, size, design, and operating characteristics of the proposed use and the conditions under which it would be operated or maintained will not be detrimental to the public health, safety, or welfare, or injurious to properties or improvements in the vicinity. There is no substantial evidence that the proposed location, size, design, and operating characteristics of the proposed use and the conditions under which it would be operated or maintained will be detrimental to the public health, safety, or welfare, or injurious to properties or improvements in the vicinity. Fire safety and road access have been addressed in sub -sections (b) and (d). The additional dwelling will only cause a minor and incremental increase in traffic and the fire protection services. That the proposed use will comply with each of the applicable provisions of the Chapter, except for an approved Minor Variance. This request does not involve a minor variance and is consistent with the intent and requirements of Section 24-280 of the Butte County Code. Upon review of this second unit application, staff has determined that the proposed second unit will not significantly impair the integrity of the zone in which the land lies. The proposed location of the second dwelling will be outside of the required setbacks of 30' for fire safety. Additionally, there is adequate space for two off-street parking spaces for the second dwelling unit. Staff recommends that the Planning Commission take the following actions: I.
