(SH) (MUP 01-12) It was moved by Commissioner Mooney, seconded by Commissioner Lambert, and unanimously carried to approve the Minor Use Permit for Kelly Ann Pagenkopp subject to the findings and conditions listed below: I. Find that the project is Categorically Exempt from environmental review pursuant to CEQA Section 15305 (Class 5), which states that minor alterations in land use limitations can be approved in areas with an average slope of less than 10 percent and that do not result in any change in land use, and pursuant to CEQA Section 15300.2(a), which allows for Class 5 exemptions upon consideration of where the project is located and ensuring that the project is not located in any particularly sensitive environment, as supported by the following: A. The project involves a modification to the uses permitted within a Agricultural - Residential zone, does not involve a change in land use, and, therefore, qualifies as a minor alteration of a land use limitation. B. The proposed expansion of the current land use, from a small day care facility to a large day care facility, constitutes a minor alteration in land use, but does not result* in any change in land use. C. The property's slope is level and does not exceed 20 percent. D. The project is not located in an area of any particularly sensitive environment. II. Approve a Minor Use Permit for Kelley Ann Pagenkopp for a large family day care facility for 12 or fewer children, MUP 00-12, on AN 036-113-033, subject to the conditions found in Exhibit "A" and based on the following findings: A. That.the location, size, design, and operating characteristics of the proposed use will be compatible with, and will not adversely affect, or be detrimental to adjacent uses, residents, buildings, structures, or natural resources, with consideration given to: Harmony in scale, bulk, coverage, and density: The project is in harmony with scale, bulk, coverage, and density because the large family day care facility will not create a need for any new structures or an alteration to any existing structures. 2. The availability of public facilities, services and utilities: The large day care facility will not create a need for new public facilities, services and utilities because water, telephone, gas, and electrical services already extend to the project parcel. The Butte County Fire Department requires compliance with State Fire Marshall requirements for large day care facilities. 3. The large day care facility may lead to a minor increase in noise levels due to children playing outside, and due to the increase in vehicle traffic, but this will not be significant. 4. The generation of traffic and the capacity and physical character of surrounding streets: The proposed large day care facility will not significantly increase vehicle traffic in the area, nor will it create any vehicle circulation impacts. The suitability of the site for the type and intensity of use or development which is proposed: The site has adequate area for off-site parking spaces for the residents of the dwelling and for employees of the large family day care facility. There is also adequate parking for an off-street loading area. 6. Any other relevant impact of the proposed use: The Planning Division has circulated the proposed large family day care facility application to County Agencies and has received no evidence that the use will cause any other relevant impact. C. The proposed location, size, design, and operating characteristics of the proposed use and the conditions under which it would be operated or maintained will not be detrimental to the public health, safety, or welfare, or injurious to properties or improvements in the vicinity. D. The proposed use will comply with each of the applicable provisions of the Chapter 24, Section 265, of the Butte County Code. . Conditions of Approval: 1. The facility is a single family residence that shall be the principal residence of the provider and the large day care facility shall be clearly incidental and secondary to the use of the property for residential purposes. 2. Meet all California Building Code regulations pertaining -to large family day care facilities, including, but not limited to, the installation .of smoke detectors, a device for sounding alarm, fire extinguishers, and exit doors operable from the inside without the use of a key or any special knowledge or effort.. 6. Prior to use of the large day care the facility shall be inspected by the Butte County Fire Department/CDF and the State Fire Marshal. 7. Building permits shall be required for any change of occupancy. Prior to issuance of the Minor Use Permit, applicant shall obtain any necessary building permits. 8. (SH) (MUP 01-12) Mr. Hackney gave a brief summary of the project. Mr. Wilson asked if there were other day care facilities in this general area. Mr. Hackney said there is a large care facility for the elderly located off Lower Wyandotte Road to the southwest of this property, approximately 1,650 feet driving distance from the subject property west on Oro Bangor and then south on Lower Wyandotte. He said there is another application by the same operator of the other facility for an additional day. care for elderly on property that is zoned commercial which would provide for this. He said it is also located on Lower Wyandotte, but again in excess of 500 feet driving distance. The hearing was opened to the public. Kathleen Gile, 5589 Lower Wyandotte Road, said she was concerned that if this is approve it would affect her second care facility she is planning on expanding from 5597 Lower Wyandotte Road, to the adjacent C-2 land. Mr. Hackney said the parcel is over 1,000 feet driving distance. He said the C-2 zone provides for the kind of facility that Ms. Gile is describing without a Use Permit. He said there is no conflict. The hearing was closed. The two (2) required residential spaces may not be used for employees. (c) One (1) off-street parking space/loading area. 3. One sign, not -to exceed 3 square feet, is allowed. This sign shall not be placed in the front yard building setback. 4. The large family day care home shall be licensed by the California Department of Social Services, Community Care Licensing. - 5. PROJECT DESCRIPTION/SITE CHARACTERISTICS: This is a proposal to convert an existing small family day care facility to a large family day care facility. Approval of a Minor Use Permit will allow the applicant to care for 12 or fewer children. Per Butte County Zoning Code Section 24-265(b) small family day care centers are limited to six (6) or fewer children and large family day care centers may have up to twelve (12) children. The state law changed recently setting new limits of eight (8) children for small day care centers and fourteen (14) for large family day care centers. The County Code has not been changed to reflect these new limits. This proposal is being processed under the existing County Code and at such time as the code is revised to the new state standards the limits on the number of children allowed may be administratively adjusted for existing small and large child care centers. The project site is located at 3366 Oro -Bangor Highway, in the Oroville area. The parcel is developed with a single family home, approximately 2100 square feet in size, on a non -urban sized residential lot of approximately 2.48 acres. The property has dual fencing. There is a field fence around the entire property boundaries. There is an internal 6 foot high cyclone fence surrounding the house, yard areas, and driveway. The project is located on an arterial street, Oroville Bangor Highway, in a neighborhood ■ BUTTE COUNTY PLANNING MANAGER ■ AGENDA REPORT ■ PAGE 1 ■ • characterized by semi -urban, rural residential development. There are similar sized parcels bordering the property on the east and north. Parcels varying from '/z acre to 2 '/z acres are located to the west. The project site is bordered on the south by a mobile home park. Access to the dwelling is from Oroville-Bangor Highway. Domestic water is supplied by an on-site well. The dwelling has a septic system. The applicant lives in the residence and is currently the primary care provider, taking care for a small day care center. With approval for a large day care facility, the applicant proposes to have as many as fourteen (12) children, with two additional full-time employees. The surrounding parcels are developed with single family homes on parcels sized from 2 '/2 acres to mobile home park sized lots. The residential neighborhood in which the project is located is bordered by Oroville-Bangor Highway on the north, Monte Vista Avenue on the south, and Lower Wyandotte Road on the west. The project site is not located in a 100 year floodplain. There is adequate parking in the front of the residence, with approximately 40+ feet depth from the right-of-way on Oroville- Bangor Highway, with approximately 170 foot distance along the frontage. The following information is the result of additional research of the project & property: • The applicant is currently conducting a Small Day Care operation; and • The residential lots along Oroville-Bangor Highway have developed out over a number of years into one-third to 2 '/z acre lots; and • The Building Division's Permit sheet identifies the structure as Single Family Dwelling. ANALYSIS: The property is zoned A -R (Agricultural -Residential) and has a General Plan land use designation of LDR (Low Density Residential). The A -R zoning classification allows large family day care facilities with approval of a Minor Use Permit and subject to the requirements of Section 24-265 of the Zoning Code. The General Plan states that the Primary Use of the Low Density Residential land use designation is single family homes at urban densities. Secondary Uses include group quarters and care homes. Butte County Code Section 24-265(e)(2) requires that new large family day care centers be located at least 500 feet driving distance from any other large family day care center. Staff conducted an analysis of the location of other large family day care centers in the area of the project and determined that there are no other such facilities in the area. This facility will not cause any residence to be bounded on more than one side with a large family day care center. There is sufficient area for off-street parking for the residents of the dwelling, for one or more employees, and for drop-off and pick-up of children. Located on a standard arterial, the project site provides a measure of traffic safety during drop-off and pick-up times that a grid -type street does not provide. The site access road, Walnut Glen Court, is a County -maintained road, which serves the project site and the neighboring residences. The Butte County Environmental Health Department recommends approval without any Environmental Health conditions because the residence is on municipal water and sewer. The Butte County Fire Department requires State Fire Marshal inspection and approval prior to opening the large day facility. ■ BUTTE COUNTY PLANNING MANAGER ■ AGENDA REPORT ■ PAGE 2 ■ The large day care facility may lead to a minor increase in noise levels due to children playing outside and due to a minor increase in vehicle traffic. Noise from children playing outside will constitute an incremental increase in noise as compared with the present day care facility. The vehicle traffic generated by the proposed large day care facility will also result in an incremental increase in noise levels because of the additional number of vehicle trips that will be generated by the large family day care facility. CEQA ISSUES: This application for a Minor Use Permit to allow a large family day care is Categorically Exempt from environmental review under Section 15305(Class 5). Staff recommends that the Planning Manager take the following actions: I. Find that the project is Categorically Exempt from environmental review pursuant to CEQA Section 15305 (Class 5), which states that minor alterations in land use limitations can be approved in areas with an average slope of less than 10 percent and that do not result in any change in land use, and pursuant to CEQA Section 15300.2(a), which allows for Class 5 exemptions upon consideration of where the project is located and ensuring that the project is not located in any particularly sensitive environment, as supported by the following: A. The project involves a modification to the uses permitted within a Agricultural - Residential zone, does not involve a change in land use, and, therefore, qualifies as a minor alteration of a land use limitation. B. The proposed expansion of the current land use, from a small day care facility to a large day care facility, constitutes a minor alteration in land use, but does not result in any change in land use. C. The property's slope is level and does not exceed 20 percent. D. The project is not located in an area of any particularly sensitive environment. II. Recommend approval to the Planning Commission for a Minor Use Permit for Kelley Ann Pagenkopp for a large family day care facility for 12 or fewer children, MUP 00-12, on AN 036-113-033, subject to the conditions found in Exhibit "A" and based on the following findings: A. That the location, size, design, and operating characteristics of the proposed use will be compatible with, and will not adversely affect, or be detrimental to adjacent uses, residents, buildings, structures, or natural resources, with consideration given to: 1. The availability of public facilities, services and utilities: The large day care facility will not create a need for new public facilities, services and utilities because water, telephone, gas, and electrical services already extend to the project parcel. The project site is provided with municipal water and sewer facilities. The Butte County Fire Department requires compliance with State Fire Marshall requirements for large day care facilities. The harmful effect, if any, upon desirable neighborhood character: The proposed large day care facility will not change the traditional architectural style that is of a character consistent with an urban residential neighborhood. The large day care facility may lead to a minor increase in noise levels due to children playing outside, and due to the increase in vehicle traffic, but this will not be significant. 4. The generation of traffic and the capacity and physical character of surrounding streets: The proposed large day care facility will not significantly increase vehicle traffic in the area, nor will it create any vehicle circulation impacts. 5. The suitability of the site for the type and intensity of use or development which is proposed: The site has adequate area for off-site parking spaces for the residents of the dwelling and for employees of the large family day care facility. There is also adequate parking for an off-street loading area. 1 6. Any other relevant impact of the proposed use: The Planning Division has circulated the proposed large family day care facility application to County Agencies and has received no evidence that the use will cause any other relevant impact. C. The proposed location, size, design, and operating characteristics of the proposed use and the conditions under which it would be operated or maintained will not be detrimental to the public health, safety, or welfare, or injurious to properties or improvements in the vicinity. D.
