SEC. 3. Soct Ion 6$780 is added to the Government Code, to read:
667M (a) The I,,;gislature finds that decisions involving the
estabUhment or expansion of solid waste:facilities should be guided
by an .effective planning process, including, meaningful public and
private solid waste industry participt don.
(b) `it is, therefore, the policy of the state and the intent of the
Legislature that solid waste Management plans prepared pursuant to
this chapter shall be consistent with the generai plan required by
Articles (comrtaencing with Section 65300) of Chapter 3 of Division
of Title 7, and that these solid waste management plans shall

,(I) identify and reserve sites for the establishment or expansion
of solid waste facilities.
(2) Ensure that land uses adjacent to or near those sites are
compatible with the solid waste facilities:
(c) Tlte. Legislature further declares that it is the policy of the

local agency cotacerned with the solid waste facility planning and
siting process involve the public through public hearings and

Legislature that each state, regional, and local agency concerned
with the solid waste facility planning and siting process involve the

SEC. 4. Section 66780.2 is added to the Coverniment Code, to

66780.2, (a) Notwithstanding tiny other provision of law, the
board shall not approve a county solid waste management plan or
approve a revision or amendment to the Plan, unless the county, dA

site, or as a potential site, for any solid waste facility, makes a finding
that the plan, together with the plans provisions for its
implementation, is consistent with all -applicable city or county

plan as a site or as it potential site for a solid waste facility, are
compatible with the establishment or expansion of the site.
SEC. 5. Section 66784,1 of the Covetnment Code is amended and
renumbered to read:
66784,2. In addition to the requirements of Section 66784, no
person shall establish sites for solid waste disposal without a finding
by the city or county In which the site is located that the distance
from the site to the nearest residential structures is in compliance
with all of the state minimum standards for solid waste management,
and especially that the distance of residences frorn the site is
sufficient to permit adequate control of noise'levels, odor nuisances,
traffic congestion, litter nuisances and vectors.
SECS 6. Section 66784.1 is added to the Covernment Code, to
read:
66784,1, (a) The board shall not.concur ;n the issuance of a
permit, as provided in subdivision (d) of Section 66796.32, for the
establishment or expansion of o site for any solid waste facility unless
the city or county in which the site is located makes a finding that
the establishment or, expansion of the site is consistent with the
applicable general plan of the city or county in which the site is
loct,►ed, This finding shall not be made unless the city or county has
adopted it general plan which complies with the provisions of Article
5 (commencing with Section %301) of Chapter 3 of Division 1 of
Title 7.
(b) A site for any solid waste facility shall be found to be consistent
with the general plan only if both of the following requirements ore
met,
(1) The site is designated in the applicable city or county general
plan as it site for any solid waste facility or as a potential site fora solid
waste faacility,,except that if an area is zoned for the siting of a solid
Waste facllity which is designed to produce an alternative' source of
energy through tlae conversion of .solid waste material into energy,
synthetic fuels, or reusable materials and if the zoning of the area is
consistent with the applicable city or county general plan, the city
or county 'shall deem this area to be in conyphance with this
