Mike Curd stated that he would like to encourage the Commission to go to the site and take a look at the situation. He also expressed concern thatparents have to make a':,U- turn in the middle of Hicks Lane after delivering or dropping,off the ;children at the proposed day care facility, creating a traffic hazard. Commissioner Lsmbert stated that she had been to the site and agreed that thur6, is no place to turn -around. Chairman Forbes asked if the_ applicant or representative would like to' make additional comments.' Jay Lyman 'stated that according to the information he received, theproposed day care facility was not a_ major change in the land use and that they do not propose to make a major change in the appearance of the structure or in the traffic patterns. He stated that 36 cars would not be at the site atone time. He also stated that staff could park across the street if necessary. He felt that they were being misread. He felt that the portion of the building that will be occupied by the`children would be safer than any residencein Cldico, as they built fire walls, have smoke detectors in each room, and would have regular fire drills. Mr. Lyman asked the Commission what they would like them to do to alter their proposal; to meet the requirements necessary to go forward, and stated that they are willing to work with staff to devetope at plan that would be acceptable: 81 BUTTE COUNTY PLANNING COMMISSION MINUTES - January 25, 1990 Chairman Forbes asked if the Commission could remove the portion that is in'the proposed 'So. Paradise Rezone for the; Lime Saddle District and handle it separately, Staff said the Commission could not at this time expand this hearing to include the entire Lime Saddle Community Service District: Ther Commission could remove that area under the District's jurisdiction from this consideration and hold h at a later time for consideration. Staff recommended letting the Lime Saddle District initiate the action for an Urban Reserve because this has to be addressed environmentally, and becomes a policy statement of the General Plan: Staff said it would be appropriate for the District to initiate that action. Commissioner -Lynch said there were three choices, to leave the proposal as it is, to delete the" District portion from theproposed zoning and handle it separately or to delete the area and allow Lame Saddle to come in with an application for the whole' Lime Saddle Community District. Staff said the majority` of the people in the District have certain,wants and are willing to pay for them: Chairman Forbes said the danger of Lime Saddle being deleted is that, Lime Saddle could. come back with: different conditions. He recommended the Commission deal with the total. South Paradise 'Rezone and allow Ume'Saddle to initiate ;hearings on the balance of the, District`s property. Staff said the language and zoning proposed is "not what the Lime Saddle District wants. Mr Lane said it Would be easier for "fhem if the Commission would tell them what they want and the District could come back with a'proposal'. Commissioner Lynch said the simplest way would be to delete the Lune Saddle District portion from the South Paradise Rezone proposal. Chairman Forbes, said fhe Commission might want to; removo, the Lime Saddle District4d from the rezone: Staff said; if the; project is initiatedby the Counfy it could take some tinYe. Lee Cage, Paradise Planning Commission, said 11 she believes Ccs€�anxa.�sioner Lynch is correct, Commis- 6 as far as recognizing; the survey that was done, but she also bieved that, the Urban Reserve should be agreed upon at this time because of the fact that services. for this area. would come from, the Town of Paradise. She also believed that the General Plan for the Butte County Area as well as 4he CI-neral Plan :for Paradise is in need of updating. Chairman Forbes said the Commission gets any number of recommendations from staff; `committees, and from d"tizens. Ife said the Commission recognizes that their judgement is based upon consideration of the information that has come before thein. Commissioner Lambert said the Urban Reserve is a reserve for urban development some time in the future, trying to pian for and decide "how they are going to finance and do the' infrastructure that, goes with thatdevelopment. She said the Urban Reservewould not stop growth or development,'' but is to n;ake development possible with the infrastructures that go" with 'it. Staff said that the hearing is closed, butLeeCage represents the Town of Paradise as a advisory member of this Commission. Commissioner Lynch said ,he did not like .the word urban because .most people think of 4.dty with all the improvements of a city. Staff said that when talking about urban development, it is the ultimate goal to have urban infrastructures. Chairman Forbes suggested using the wording on Page 6 of the4.25-89 staff, finding for the motion: Staff asked fora ;Motion of Intent. . Commissioner Lynch asked the; Chairman to appoint a two Commissioner committee to work with staff to come up with the findings for the General Plan!Resolution., Chairman Forties appointed Commissioners Matson and lynch to get with staff to develop language for the notion of intent. It was moved by Commissioner Lambert, seconded by Conr�missioner O''trorvski ` and unanimously carried for approval of, the Urban Reserve.policies and instruct staff, along with the committee, to' draft the final motion and the 'findings. • w BUZTE COUNTY PLANNING COMMISSION AGENDA - January 11, 1990 Staff said l acre or, larger parcels. Staff, said there are no sewer districts in -the area, generally individual septics and wells. The hearing was opened to the public. Jill Bachman, representing all three properties, said the timing for subdivision maps a.s; unknown. She said 2 ,of the parcels may.develop 1h.a year or two; the other parcel will be further down the line..'She said the property issurrounded by Sk-1 zoning. She said an all weather road through an orchard being farmed is not acceptable, She said the condition is to meet the requirements of the Fire Department and does not state an all weather road. Commissioner Ostrow ski asked if all theproperties were currently orchards. Mrs. Bachman said yes. She asked fora 30 day continuance to allow the applicants time to review, the zoning agreements with their lawyers: Staff said if the Commission is going to continue these hearings, the hearings should reinain .open; Commissioner )Lynch asked if the Agreements were between the applicant and Butte 'County, Staff said yes. Staff said the location of the'access 1o,klghway'99 is lmited.to the southerly corner_ of the Muselt property. Comrnissioa er Lambert discussed widening iof the bridge.
