Mr. Brown recommended that the mine be, set away from high wat4 s. He said they need to
do drilling as proposed in the EMIL to establish ground water 1evcls. :;:,.ir. Brown said the drilling
Would take 6 months to a year:
The hearing was opened, to the public,
Roger Green said he has operated this mine since 1986. He said there are some ,problems with
water lines breaking, and a problem with dust. He said he has 'mitigated some, of the noise. He
wanted to be a goodneighbor. He said he is trying to d a good job.
Commissioner Lambert asked how 100g would it take to complete the removal of the material?
Mr. Green did not know.
Commissioner Os.trowski asked what the rock,'was used for?
Mr. Green said the rock is used by the'railroad for ballast for new lines and resurfacing.

MINUTES - October 25, 1990
Commissioner Lynch said you could have a situation where an engineer can want to build
a hydroelectric project: on a creek that is not cost effective. He asked if he engineer' would
be guaranteed a return on their investment?
Staff said they did not know, that the County was guaranteeing anyone a return on 'their
investment.
Commissioner Lynch said the Forks of the Butte hydroelectric project was made this
guarantee, He said that the 'law protects hydroelectric plants by requiring buy back .of the
power at a certain rate.
Staff suggested they add in Fish and Game to.,implementation Item 36-5a and this was'
agreeable with the Commission.
Commissioner Lynch asked for a provision that it be economical for a hydroelectric plant to
be placed on a river or stream.
Staff stated that this would not be in the Commission's jurisdiction.
Solar Projects.
Staff said there needs to be a definition for solar projects.
Commissioner Ostrowski said the 6perative word is project: He wanted this defined as to'
whether it was a solar panel in a house or a full blown project: He did not think that a solar
panel in a house would constitute a project. There was a brief discussion ° on different types
of solar projects.
Staff said they would ask the Consultant to come up with a definition for solar projects.
Staff said that 3-8.1 talks shout solar farms, which implies a major project. Staff said this
shows a definite need fora clear definition.
Commissioner rstrowski said there should be, a similar `definition for bothsolar projects and
Wind: projects:
Commissioner Lynch said the Consultant needs to clarify wind projects as well as solar.

trowski asked about the 'recommended section regarding fossil, fuel: lie
agreed that"there`should be a'section on fossil 'fuels.

Staff said that this project is in the D2N Planning Area and the Board preferred alternative
was: consistent 'with this request.
Commissioner Lambert asked if these standards are adopted, will they apply to the entire 32
acres? Staff said this is correct.
Commissioner Lynch said if Phis is adopted the property owners would not need a use permit
for the uses listed, but would need a use permit for other uses listed under the M4. zoning.

Commissioner Lynch asked why the conditions imposed were so restrictive compared to the
all uses in the M-1 zone?'
Staff said that the uses 'are being limited because of soil constraints and- Prnvronmental '

Betty Vassar asked that this hearing be postponed until after the decision was made on the Energy,
Natural Resource and Recreation Element. She also asked that this ;decision be postponed until;
after there is a. final; decision on the alignment of, Highway 70. She said it is imperative that staff`
meet with the property owners in this area. She said 'the Commission needs to consider the
economic crisis facing the County when considering this rezone: She said her committee has only
been able to meet once with staff. She said her committee does not believe that Urban Reserve
policies are appropriate for the south County area. She asked for a continuance to the 1st of the
year. She submitted a letter on behalf of a neighbor from the ^Office of the Governor regarding,.
affordable housing;

Staff said that one of the problems is that the property owners need to 'identify what specific
zoning they want for their property, and thi9 has not been done, Staff said the Commission might
want to wait for a, decision on the alignment of Highway, 70 and the adoptions of the Energy,
Natural Resource and Recreation Element before making adecision on this regone. Staff said:
they would like to see a draft of the Committee's proposed Dural Reserve Policies.
Commissioner Lambert said she had no problem continuing this hearing.
Commissioner Lynch agreed tom continuance. He commented on the requirement for "affordable
}lousing", he said everybody wants it, but no one wants it next door to ahem. He said that the State'.
needs to pay for the services needed for afforda.blei housing projects; _
Commissioner Lambert asked staff about a specific plan for the area to help recoup the cost, of
services.
Staff said that the area is too large to lend itself to a specific plan. Staff, said that a specific plan„
is a method in which to recoup cost for development of°'a specific plan fora small area.
Xt was moved, by Commissioner Lambert; seconded. by Commissioner Lynch, and ,unanimously
carried to continue this hearing to September, 73, 1990 at 1.:30` p,m.'

Vice Chairman Matson said he was and still is a member of the Waste Water Task Force for the
Upper Ridge Area, He said that when the Watershed Protection Overlay Zone was aiiopted, there
was also a provision to appeal the decision made pursuant.. to this overlay zone. ;He said the Vine
Street property was approved: by the Health Departm
