Ms. Schons discussed intimidation by 'But.,e County .employees and Code Enforcement
Officers;
Commissioner Lambert was present at this time.
Ms. Schons said 80% of 'the County employees treat her with respect and, she treats
them the same way. She said its the 20% that are disrespectful` that, are hard to deal
with. She said the Code Enforcement Officers fall into the disrespectful category, She
said there is a junk problem that needs to be settled, but itis a matter tliat needs to be
handled with more respect for others. She wanted the County to do something about
the lack of respect from the Code 'Enforcement Officers. She said if the Officers had
a different ;attitude, this item; migN not need to be discussed.
Commissioner Nelson said the Commission is listening to, the public's input. He. said
there have been several, h,;arings. He said he did not appreciate people mocking the
Commission (Vern Chadwick, dressed as Santa and saying he waspresent as Santa
Claus)o He said the Commission needs -respect from. the public also;
Roy Plaster said he also blames the Code Enforcement Officers for their attitude. He
said he was out of the State and was turned over to I?MV because he had too many
cars. He said a drug task force was sent to his ,house; He said b'is rights were violated;
The bearing was closed'.
Neil McCabe said one of the reasons the Citizens' Committee was farmed was for an'
exchange of ideas: He said he was involved a preparing the original Ordinance. He
said if he had it to do over again, he would not; write the Ordinance the same way, after
hearing all the input, 1-16 said, if t le Commission feels the same way, he would suggest
xe-writing the Qrdinance. Re' said they, are wiser, about .some of the concerns 'and
P roblems in the County at this time:

Mr Honeycutt said his priority is to annex to DID, but if this is a problem he will have
to ;consider a community water system;
Jan Holman, Garden,Road said she has doneresearch on the Durham House. She said.
the house is important to the community and should be :preserved. She was in favor of
thf project,
Susan Murphy, Nelson Road, said it would be an asset to the community to restore the
Durham House. She said the County needs to treat all of rurham and the whole D2N
area with respect. She said she hopes the Commission will continue to look at what the
Durham Advisory Committee wanted,, which was to infill and to work
out from the
center of Durham. She said the Durham House was located near the center of town.
She said Durham does not have a good history with planned unit developments and she
expected to hear a request for Ral zoning. She discussed rezoning, a larger area than
just this property. She said she was in favor of the project.
Louis C,:amenzind, Jr. said he was in favor of this restoration. He said as farm the

Commissioner Lambert said she does not agree that if the property owners are not willing
to give the °'applicant test results that it is necessarily good news.
Discussion was confined to the Commission.
Commissioner Nelson asked about the testimony regarding the project?
Staff said that most of 'the- input was through the earlier hearings.
Commissioner Nelson asked if we could, condition the, zoning? He said he was not'
comfortable unless the conditions could be met. I e' said he would want something stating ;
that it could be legally ,taken away, if the conditions were 'not met.
Staff said we would have to continue_ the hearing so staff could prepare a new motion with
those conditions.
Commissioner Lambert said the staff findings state those criterias must: be met.
Staff, said those are for adopting zonings less than 20 acres in the Agricultural :Residential
General Plan designation,
Commissioner Lambert said she did -not agree with l ac. parcel sizes and maybe a larger
zoning would deal With. the criteria of the General Plan.
Commissioner Lynch said there is some commercial activity in La Porte, Challenge,
Strawberry 'alley and 'Clipper Mills, He said students go to school in :Marysville: He
said it should be. rezoned to, TM -2, with a condition for proof of adequate water.

Commissioner Lambertsaid existing property owners are concerned that they will have to pay
for services they either `don't want or are already receiving. She said they!would approve of
the project if they didn't have to pay for the extra services.
Mr, ,everenz said the indication from the environmental document was that both the Butte
County Sheriff's Officeand the Fire Department are saying that they are not providing;
adequate .response time to this area now. He, said it is not, a question of paying for this
project. He said thus project will definitely impact the area. He said this may, not deal with

of Supervisors ultimately say, I -Ie said it is addressed in the document, as well as their
concerns and how that is going to be mitigated as far as fees and busing and other items. He
said as far as building, new schools; in the existing service area, a benefit zone could be.
created and the people just in that area could be charged separately, if and when additional
services are foreseen. ,
Commissioner Lynch asked if the Paradise Unified School District is assessing development
fees and if these lots would pay those development fees just as the lots in downtown Paradise
would? He said it makes sense to him regarding: the CSA for snow removal, because, if the;
County, in any budget year decides they arerot going to provide the service any longer, the
service would be needed.
Mr. Leverenz said at that point, the CSA could he plugged in to provide that service:
Commissioner Lynch said there is a 'legal constraint that you can not charge people for'

stated the Butte Meadows/lonesville fire fighters have worked hard for the volunteers to
build the ,firehouse. He salt, lie and his wife arc-, summer residents. He said, the summer,
residents in Butte Meadows are upset about a story they read lit:a Chico newspaper, He said
the article stated that the service area was going to cost $1.30,00 per parcel, He said. Since
he owns.2 lots, he would have to pay $260.00 per year,

to Parcel 1 and the wine cellar sei^ue - as an amenity, to Parcel 2. The distance.between-
the pool house and the concrete cap roof on the wine cellar is 10 feet; Sle said the
proposed parcel division is located 6 feet from the pool house wall, which is `5 feet from
the retaining wall, and 4 feet from the wine cellar concrete .cap, The AR-1 ;zone
requires a side yard setback of 10 feet. The structures have been in place about 8 years,
and if the division of this parcel is to occur and a Variance is not granted, one of the
following options will apply: 1. redesign; the parcel configuration so it includes the wine
cellar plus 10 ft.. o£ setback, or 2, Destroy the wine cellar, Ms. Jones said the AR -I
zoning came in after the construction of, the buildings.
