Approval of Renewal for a Temporary Second Dwelling for James E.
Hoopes, AP 72-14-41 for Violet R. Hoopes and Site .Plan Review in a
C-C Zone for Acme-Wiley Corporation on AP 7128-41.
COMMISSIONER PEABODY WAS ABSENT AT THIS TIME.
Hoopes - Temporary Second Dwelling.
Staff recommended that the Commission pull the Site Plan review from the
consent agenda to discuss separately:
Staff stated that the occupant of the temporary mobile home for Hoopes
was the same as last. year.
It was moved by Commissioner Lambert, seconded by Commissioner Forbes,
and carried for approval for Violet Its Hoopes as follows;,

Acme -Wiley Corporation - Site Plan Review in a C -C Zone.
Staff provided a memo to the Commission dated 1-20-87, Staff Was
concerned with the number of signs that could oc-ur in the area,
COMMISSIONER PEABODY WAS PRESENT AT THIS TIME.
Charles Moore, representative for the applicant, stated that the sign.
was needed to change the name of Montgomery Wards to VOcUs. They also
wanted it message board on the sign. He stated that it would be the only
Pole sign rt; the shopping center, He stated that it was a 4 ft, sign,
Commissioner. Lambert was concerned with the proposed annexation to the
CItY of Chico and this not conforming with the City's standards.
Mr, Moore chid not have a problem with changing the sign to comply With
City regulations if' this was annexed to the City,
Commissioner'Lambert discussed the new sign ordinance and the potential
for 49 signs of this kind in the futi:re
Commissioner Forbes fe7,t that if this was allowed for Wards other stores
would request free standing signs. He was concerned with the potential
fo- 49 free standing signs.
Staff stated that this site plan was reviewed on its own merit as well
as with the new ordinance. Staff commented that the Commission must
review this plan on its own merit and have the authority to impose a!�y
restrictions the Commission deems appropriate,

Vice Chairman Lynch asked if this required a building permit and staff
stated only if the sign is electric.
Vice Chairman 'Lynch questioned any requiremi;nt"s regarding wind
resistance. He felt that it was unclear as to how the sign was located
rei,ative to the setback. He suggested acondition "No patt of the sigh

Commissioner Peabody suggested thwy put the new Wall .mounted sign where
the Wards sign is now and not add a new sign.
CoWnissioner Lambert stated that there was a request to change the Wards
sign before to put it -flat against the building.
Staff stated that the City of Chico's regulations call for not more than
24 ft high and no flags.
Mr. Moore stated that the flags were metal and a permanent part of the
sign with a message board below. He stated that the sign anis message
board would be elecrical and lighted and would require building permits.
Vice Chairman Lynct• stated that the metal flags added six feat to the
sign, making a total of 35 feet in height.
Commissioner Lambert had reservations with allowing this ,ign, She was
concerned with it not meeting the City's regulations and %ith the
potential for 49 more signs.
Commissioner Forbes felt that it would make more sense to have a Mall
sign with a message board for the whole mall. He shared Commissioner
Lambert's concerns.
Vice Chairman Lynch stated that in the proposed zoning ordinance
serious consideration will be given to agencies comments when a project
is in their sphere of influence as this one is in the City of Chico's
Spherei lie was concerned with the City of Chico being against this
project; He suggested that the applciant get together w
Chico and work out a sate plan that woith the City of,
uld be agreeable with the City.
It was moved by Commissioner Lambert, seconded by Commissioner Forbes,
and unanimously carried for denial of the site plan for AcmeyWiley to
allow a 30 ft. high pole sign located at the North Valley Plaza Malt (AP
7-241).

The hearing was closed.
Commissioner Lambert questioned how many parcels were involved.
Staff stated that this would not create any new parcels. There were two
parcels involved; this, was to 'take a small part of one out of the
preserve and put it with the other parcel.
VieA Ohairman Lynch stated that this was a minor change to incorporate a
rectangle Into the other parcel,
Commissioner Lambert did not have a problem with this, but; she
questioned the knoll.
Vice Chairman Lynch suggested a condition for "no structure on 100 x 220
ft4 parcel being annexed to the other property."
Staff stated that the Commission has not normally talked about
development on rezones of this nature except for deer herd purposes and
staff would caution the Commission against doing it now.

for property located the west side of 12th 'Street,
approximately 215 feet south of Nelson Avenue; identified as

allowed mobiles) to A -R (which only
allows mobiles made after 1.976)

Vice Chairman Lynch asked staff if they could make a motion of intent to
approve the rezone with conditions to be met by the applicant prior to
this going forward to the Board of Supervisors and staff stated yes.
The suggested conditions were as follows:
1. One dwelling unit per parcel except with'A use permit.
2. All heavy equipment, inoperative vehicles, traileLs, tank, etc.,
must be removed or stored within a building or behind a
sight -obscuring fence within 90 days,

Staff did not believe Condition S would be necessary, Staff requested a
time frame for this hearing to be continued,
The hearing was re -opened.
Mr. Steed stated that 90 days or better would be acceptable,
Vice Chairman Lynch stated that tAb applicant could apply for a property
split at any time with or without the rezoning. He stated that the
mobiles were fine on the property as long as they were not being
occupied. He did not have a problem with the A$MH zone, but felt that
they needed to abate the zoning violation firsE,
Mr. Steed stated he was worried about the zoning. He stated that 90
days was reasonable and he would remove all the equipment he could in

it was moved by Vice Chairman Lynch, seconded by Commissioner Forbes,
and unanimously carried for a motion of intent to recommend approval as
follows:
A. Find that this project is categorically exempt from environmental
review (Class 3e); and
B. Find that the proposed rezone would be compatible with existing
devWJopment and proposed development in the community, conforms to
thea Low Density Residential General Plan and Housing Element because

The Commission waived the reading of the Staff Findings.
The hearing was opened to the public.
William Almas, representing Spring Valley Minerals., was present to
answer questions. He stated that he had one question on a condition in
the staff findings regarding access road improvement,
Vice Chairman Lynch stated he would have to contact Public Works for the
Specifics on this condition.
Staff explained about public road approaches: -
Vice Chairman Lynch asked about the number of trips Mr, Almas would
estimate they would make per day. Staff asked the applicant about the
amount of blasting.
Mr. Almas stated that they would be blasting the entrances to existing
tunnels for no longer than a month and a half. He stated that he would
need to respond.in Writing to the total amount of explosives. lie also
stated that there would not be many trips per day.
Commissioner Peabody discussed the type o material and the amount of
explosives. He dial not feel it would take that much expl6sives.
Mr. Almas did not know the mathematics on the size of the charges

mine as it is today with a caretaker. The mines are closed at present
and the property is fenced. He stated that there are two fuel tanks on
the property, one for gas and one for diesel,

are negative.
Mr. Almas stated that they are trying to decide What by do with the
tanks. He stated that they will discuss this with the Health
Department,

Commissioner Lambert questioned the permit already being issued by the
Regional Water Quality Control Board (RWQCB) for Condition 4.
Mro Almas stated that in 1983 they applied to RWQCB to discharge water
into ponds and these ponds are totally enclosed He stated that they
reuse the water.
Vice Chairman Lynch asked if any surplus water was washed down. into Dry
Creek.
Mr. Almas stated that the water inot discharged into the creek, .

recycled. He. stated that they use surface water, but do not discharge
into the surface water.
Vice Chairman Lynch suggested that Condition 10 be worded so residents
within a l mile radius be contacted at least 1 hour before blasting.
Mr. Almas agreed to this addition. He stated that they were quite a
distance from the neighbors,
Commissioner Peabody asked if the portal faces the northwest and Mr.
Almas stated yes. Commissioner Peabody stated that there were not.-,
many residefttea in that direction.
Commissioner Lambert save Mr. Almas a copy of the letter received ftor
William and Sheila Fass. Mr. Almas stated that there will be no
_- blasting at night and that this will be a limited operatic_,, limited'
existing mine tunnels.
Commissioner Forbes asked, if the tunnels ran beneath neighboring
properties.
Mr. Almas did not know, but he did not think they went under anyone
else's property, He stated that this area has been mined over many;
man!, years. He did not have the information with 'him on how close to
the property lines the tunnels are, He felt that the mining would be
good for the area.
Commissioner Lambert discisssed putting a time
this permit, limit of 6 to 8 months on
Mr. Almas stated that 8 mouths would be acceptable, but he would li
the time to start from the date they start operation, ke
Commissioner Lambert felt that this would be difficult to administer,
but they could put on one year from the date of approval.

Commissioner Lambevt discussed the explosives being kept in metal
magazines and under double locks. She suggested putting this in the
conditions
Louis Camenzind, Jr., 2194 Oro -Chico Highway, Durham, was in favor of
approving this permit. He felt the Commission should encourage mining
in Butte County. He felt that the blasting condition should be
flexible. He stated if the properties were patented mining properties,
then the people would have a vested right to mine,
Mr. Almas thought that portions were patented, but was not sure about
the whole property. He said he would find -out
Carol Foster stated that her house water comes from a spring in the area
and she was concerned With the water in the spring being affected.
Mr. Almas stated that the blasting was restricted to existing
underground workings and blasting would be limited to the owner's
property,
Mrs, Foster stated she owned adjoining property and she was concerned
with the blasting and her water supply, She stated that the spring is a.
short dAstance from the property Line:
Commissioner Lambert asked what distance for the blasting from the
property line would Mrs. Foster be comfortable with?
Mrs. Faster stated she would have to ask an expert, She stated that the
spring is covered and piped to her house. She was concerned with the
water table in the area.
Commissioner Peabody was concerned with the output of the spring. He
did not want Mrs. foster to suffer any damages.
Mr, Almas stated that he iloW.d be happy to me:St with Mrs. Foster when
they know where the blasting will take place. He is r�il�.int to work
with the Fosters regarding the water.

Commissioner Forbes asked if other property owners were drawing water
from this spring and staff stated that there was no information at this
time,
Vice Chairman Lynch discussed limiting the number of shots in the area,

Hughes requested approval of this use permit.
Commissioner Lambert questioned the dike and sump for spillovers going into the
ground._
Mr. Hughes stated that the 8t.41p pumps would be used to pick up fuel out of
contaminated areas and put the fuel into another tank.

that the traffic was a regional problem, more so that: a site specific problem
and is something that the applicant can not address.

Vice Chairman Lynch stated that they have a reluctant agreement on the part of
the applicant to continue for one week, and the commissioner from Paradise does
not feel this is sufficient time. He asked if the Commission wanted to nct on
this today or continue the hearing;
Commissioner Peabody wac concerned with the vacant lots in the Paradise Pines
area. He did not want to create more problems with traffic. He indicated that
at the time of the original development there were 5500 lots of_which ,there are
1300 vacant today.
Staff stated that: the original tentative approval was in the A-2 Zone. This
required zoning after the fart, as one of the conditions of approval was to apply
for and diligently pursue appropriate zoning. Some of the parcels that had been
tentatively approved were less than 1/2 acre minimum. Staff discussed the
potential ror more than 9 additional parcel-, with the smaller acreage
requirement
Vice Chairman Lynch asked, if the Commission does not approve this application,
what is their status with the fair share of traffic controls, etc?
Staff stand that the applicant still has tyle opportunity to subdivide into the
112 acre minimums. The requirement for subdivision time and for the pro rata

Mr. Frost had a copy of the tentative map filed with Planning. He stated he was
willing to have a recorded restriction to not allow future division of parcels.
He discussed the traffic analysis on Pages 2 and 3 of the 12-11-86 staff

Louise A;hart stated that she owned a 1440 acre cattle ranch in the rezone area.
She stated that there is a problem with the subdivision on the west side of
their property. She sees a need for controlled growth in the area: She was
concerned with preserving agri ultural land. She would like to see, the zoning
go to as large a minimum parce-L site as possible. She was opposed to the 5 acre
parcels.
Vice Chairman Lynch discussed the abatement ordinance for nuisances.
Sharon Harvey, Oroville, stated she had 1 acre on Middle Honcut. She was
complaining about people and junk in the area decreasing her property values:
