established quarter section corner on the south

AN ORDINANCE A14ENDSNG CHAPTER 19 OF THE BUTTE COUNTY
CODE
1 The Board of Supervisors of the county of Butte, State
2 of California, O ORDAIN, as follows:
3 SECTION 1.. Section 1:9-21 of the Butte County Code is
4 hereby added to read as :Follows:
5 Section 19-21 -- Requirements in a Watershed Protection
6 Zone (WP)
7 a. The exception allowed for minimum separation
8 distances for lots or parcels creat0d prior to April 4f 1974,
9 in Section 19-11 Table TT shall hot apply in a Watershed
Ill Protection Zone (WP)
1.1 b. The followinct additional requirements are applicable
12 to all development in a 'Watershed Protection (WP)zone where
13 septic tanks and leachfields are to be uti3.lizedo The required
14 minimum _areas shall be computed_

California, under and pursuant to Chapter ,24-29 of the Butte County Code of

4 SECTION 11. Section 24-196 of the Butte County Code is hereby

Purpose and Intent
This district classification is intended to be utilized as an
9 overlay zone which shall be overlaid onto other zoning districts to
10 establish 'the boundaries of a watershed, and for the following purpos,ess
11 �
1. To protect the County's surface and ground water resources.
12 I` 2. To reduce future governmental costs b:
y preserving. public
13 water supplies.
14 3. To recognize the essentially public nature of the land and
15 water resources of a watershed, and that their continued vitality is
1.6 directly related to the social and economic welfare of the County and its
17 ! communities.
18 �. 4. To protect the public health, safety and welfare by requiring
19 such additional testrictiotis upon the use of land as are necessary to retain
20 I the natural balance and. integrity of a watershed.
21 5. To recognize the uniqueness of each watershed by basing the
g2 selection of the most effective measures for their protection upon an
23evaluation of the soils, climatic conditions: topogi:'aphY, vegetation,
24 drainage patterns, and any other specific conditions unique to the watershed:

l ;1 6. To allow the County or its citizenry to identify watersheds

2 Il where a natural or man -induced imbalance in the environmental system occurs
3 , and provide a means for repairing or restoring the natural functions of {
4 these watersheds.

6 1. in recognition of the unique characteristicsof each
7 watershed and the need for individual evaluation, the policies, procedures
and star,<dattds for each watershed shall be adopted on an individual basis by
9 resolution of the Board of Supervisors following the adoption of an
10ordinance establishing the "WP' zone for a watershed.

11 ' 2= At such time as the Planning Commission holds a public
12 hearing in accordance with the provisions of So;ction 24-27 of this Chapter
13 for the purposes of establishing a ''WP" Zone, the proposed' resolution
establishing policies procedures and

le subject to the same notice and hearing requirements as tale zoning amendment,
17 including the requirement for a deposit to cover the estimated publishing

20 decision in the form of a written recommendation to the $oard of 'Supervisors
21 in accordance with the provisions of Section 24-28 of this Chapter on the
22 establishment of a "WP" zone, they shall also render their recormip-ndation on t
23 the content of the resolution and may 'recommend the inclusion, deletion or
24 any change whatsoever in the contents of the resolution.
