Vandegrifto District Attorney Subject: Division of Lots by Mr. Gilbert Vanzandt Your inter -Departmental Memorandum dated May 16, 1963 was delivered to our oafice on May 21,_1963, with the request for an immediate reply. I have been in Court all day yesterday, and today in a,jury trial and was unable to give this matter any earlier attention. From the information presented to our office in your memorandunt Nye would appear to have no sound basis for a orlintnal prose- caution. We would want a full report made of all of the circum- stances involved relative to the alleged criminat acts. Unless it can, in fact$ be demon e; trat e d by competent ovidence that the proposed defendant by his own acts or omiosiolis violated -the law, we could not proceed. From the inforiwation you have supplied, it is not clear that Mr. Gilbert Vanzaridt has any interest in the property deeded to his son, Norman Vanzandt. As I understand the law, from our earlier discussions, it -Lppears that if, in fact, Norman Vanzandt is the true owner of Pallcel 4 he would be entitled -to further divide his Barrel, into four additional units. To show that he has no true financial interest and -that, in -fact, the property belongs to Gilbert Vanzandt might be quite difficult and would certainly require 'rU:rthL:' investigation.. Before we would suggest filing a criminal complaint and have a warrant issued, or have the defendant cited into Courtt we would suggest that statements be obtained from witnesses who could definitely -testify as to the continued finhncial interest of Gil'oert Vanzandt in the property. It may also be possible that -the Vanzandts have discussed this matter with other persons and in such disciissions made admissions as to their attempt -to violati the law and -their -scheme to do so. The regular meeting of the Butte County Planning Commission was held on June 12, 1963- I RC'TZ CALL: Present: Commissioners Andersonp Cooperp F'uller9 Meiss, Stotts Rypkema9 Walsh and Chairman Watson Absents Commissioner Dennis Also present. Messrs Tom Joness Glanderg Toussaint & Chan Visitors present; Messrs. A. Jq Boradorri and Walter Grimes II MINUTES: The minutes of the regular meeting of May 228 1963 were read and approved with the following corrections Page 79 VIr B0 delete all of Be Visitor.: A. J. Boradorri Mr. Chan stated that Mr. Boradorri was biterested in sideyard requirements and variances. In any area zoned "R" we ask for a 5" sideyardo In past weeks we have had requests for variances of 1" and 2°'s which have been granted. Because of lack of a specific definition on the sideyardg the Land Use Committee has recommended that wo define what the sideyard requirements ares and adhere to those requirements. The Land Use ConwIttee suggest a 11 overhang be ptAnitted which Mould be 40 from the property line, Mr, Glander stated that he would recommend a 20 eave overhang be permitted, Mr, Walter Grimes* Civil Engineer, suggested that the fowidation be set- back 5" from the property line and that no overhang be closer than 3' from the property line Motion was made by Commissioner Walshp seconded by Commissioner Meisss unanimously cw„ried (Commissioners Andersons Cooper, Fuller; Mei.ss9 Stott§ Rypkemas Walsh and Chairman Watson) that we have legal counsel.prepare an amendment to the existing Ordinance defining s,deyards for tho same o and as defined in the proposed Comprehensive Zoning Ordinance Chairman Watson asked Tom. IIS CONSIDERATION OF SUBDIVISIONS-. AA Bonanza Subdivision (22 lots)p Pentz Road, E. of Skyway, Paradise Motion was made by Commissioner Andersonp seconded by Commissioner Stotto unanimously carried (Commissioners Audersong Coopers Fullorg Aoiest Rypkemap Stottq Wal.sh9 and Chairman Watson) that the tentative map of the subdivision be approved subject: to the requirements of the Department o,t Public Works and the Health Department D Belwood Estates (20 lots)`s Feather Avenueg Thermalito Mr. Glander stated the subdivider propo es to run storm drainage water onto the existing Feather kc-gnue and m in an open ditch to the creek. Recommends the subdivision be denied subject to the subdivider working out a solution of disposing of water. Mr. 'Toussaint stated that water will. be provided to the subdivision by the Thermalito Irrigation District. Health Department recommends approval subject to soil tests being submitted. Motion was made by Commissioner Sto,tp seconded by Commissioner Rypkema that the tentative map of the subdivision be approved subject to drainage conditions being worked out to the satisfaction of the Health Department and the Department of Public Works, Commissioner Walsh stated that before we can approve a tentative map of a subdivision we should hwve the approval of the Department of, Public Works and the Health Departments Mre Chart suggested that we table the matter until the next Plaming Commission meeting so that the subdivider can, work out these problems with the said departments.
