Steve spoke with Gerardo Se (brother of Mr. Uribe) and explained the
situation of incompleteness of the application for drainage issues.
Mr. Uribe's August 12, 2008 letter (in response to DDS letter of
August 7, 2008) asked that DDS not take action to move to denial
without prejudice, due to poor economic conditions. Mr. Se will
contact Mike Evans (agent) to see what it would take to reactive the
project.

Dear Mr. Uribe:
Our records show that on February 1, 2006, the Butte County Inter -Departmental Review
Committee (IDR) reviewed the above referenced project for compliance with County regulations. It
was determined that the project was incomplete for the following reasons:
Public Works
Provide information demonstrating how storm drainage will be managed so that
there is no increase in peak runoff from the fully developed parcels above the
current pre development levels. Also provide information with respect to the
location of existing and proposed drainage facilities.
The Department of Development Services seeks to process projects in a timely manner to avoid
them persisting in the system for long periods of time without progress towards completion. From
the Department's perspective, there are three options that you have on the project:
1. Withdraw the application;
2. Submit a preliminary drainage plan to Public Works for review and approval; or
3. If we do not receive the information in #1 or #2 from you by October 7, 2008, the project
will be moved forward to the Planning Commission for action with a recommendation of
denial.

On February 1, 2006, the Butte County Inter -Departmental Review Committee (IDR) reviewed
the above referenced project for compliance with County regulations. It was determined that the
project is incomplete for the following reasons:
Public Works
Provide information demonstrating how storm drainage will be managed so that there is no
increase in peak runoff from the fully developed parcels above the current pre development
levels. Also provide information with respect to the location of existing and proposed drainage
facilities.
This project will remain in an incomplete status until such time as Public Works has received and
reviewed the above requested information, and rescinded the incomplete status. No further
processing of this project will occur until such time as the required materials are received. The
timelines pursuant to the California Permit Streamlining Act are suspended until such time as
this project is deemed complete.

Article VI. Design Standards
20-136 Private easement as approved access.
The advisory agency may approve a building -free legal access easement as approved access for
divisions of one (1) parcel into two (2) lots where the providing of approved access required by
this chapter would prevent development of the proposed lot abutting the existing approved
access to the property, or where existing development on the proposed lot abutting the existing
approved access did not leave enough area to provide approved access to the other lot.
Such approval shall be subject to the following conditions:
(1) The property shall, prior to division, be within an urban area as designated on appendix I of
the design standards.
(2) The easement shall serve only one (1) single-family dwelling.
(3) A building -free turning area shall be provided on the lot or parcel served by the easement.
(4) Maximum length of the easement shall be no more than two hundred (200) feet.
(5) The minimum width of the easement shall be twenty (20) feet to be improved as follows:
a. Sixteen (16) feet of gravel roadway with an SC -250 prime coat minimum.
b. Four (4) feet reserved for utilities.
(6) There shall be a building -free setback of ten (10) feet, measured from the edge of the
easement, unless the zoning district in which the property lies requires a greater setback.
(7) The parcel abutting the existing approved access shall have a frontage on the existing
approved access of a minimum of seventy-five (75) feet.
(8) Where possible, the easement shall be located adjacent to the existing driveways on
neighboring parcels.
(9) A statement shall be placed on the map indicating that the parcel to be served by the
easement cannot be divided until an easement or right-of-way is provided, as set forth in section
20-134. (Ord. No. 3188, § 1(Exh. A), 3-14-95)

Enclosed please find 10 copies of a REVISED map wherein we request
consideration of the following modifications to the project design:
1) Access easement to be private driveway as per Section 20-136 of the. County
Code allowing acce3ss to a single parcel. Please note our request considers
the lack of space for a standard 60 foot wide- easement and 20 foot setback.
The existing house will require a variance to any easement wider than 45'.
2) The required turning area in lieu of a cul de sac serving only one parcel.
3) Prohibition of further division of Parcel 4 served by said private easement.
4) Increase of lot sizes fronting 14th Street.
5) Reduction of size of drainage retention basin due to less paving.
We believe this design is a superior design and may be allowed under the
requirements of Section 20-136. Please let us know if you need additional copies.

STREETS
❑ 1. Prior to or concurrently with the recordation of the Parcel/Final Map, provide a
fully executed road maintenance agreement for all non -publicly maintained access
roads on the County approved form. A note shall be placed on a separate
document which is to be recorded concurrently with the map or on an additional
map sheet of the Parcel/Final Map stating: "In accordance with Civil Code
Section 845, maintenance of the road as shown hereon shall be shared by those
properties with a legal interest in it."
❑ 2. All access rights shall be reserved by deed per County Ordinance, offered for
dedication, and depicted on the Parcel/Final Map. For each private access within
the map boundary, place the following note on the Parcel/Final Map: "approved
road name is a non-exclusive easement for ingress, egress, road and public
services purposes, to be reserved in deeds and is hereby offered for dedication to
the County of Butte."
❑ 3. Prior to the recordation of the Parcel/Final Map, demonstrate to the Department of
Public Works that there is approved access conforming to County Code to each
parcel from a publicly maintained road.
❑ 4. Prior to or concurrently with the recordation of the Parcel/Final Map, Deed to
Butte County in fee simple feet of right-of-way from the centerline of

❑ 7. Prior to final road inspection, install all necessary traffic safety signs including
stop signs. A note shall be placed on a separate document which is to be recorded
concurrently with the map or on an additional map sheet of the Parcel/Final Map
stating: "No public entity shall be responsible for the maintenance of the traffic
safety signs including stop signs. In accordance with Civil Code Section 845,
maintenance of the traffic safety signs shall be shared by those properties with a
legal interest in them."
❑ 8. Prior to recordation of the Parcel/Final Map, obtain an encroachment permit and
improve all new and existing driveway approaches to publicly maintained roads
as specified in the County Improvement Standards and the terms of the
encroachment permit.

❑ 16. Street lighting shall be provided in accordance with Butte County requirements,
accepted design criteria, and recommendations of Pacific Gas & Electric
Company. If the developer chooses to install the streetlights and pay energy costs
through a County Service Area (CSA), he/she must complete the formation of the
CSA prior to recordation of the Final Map. The CSA formation process will
require the Developer to fund the service until the beginning of the first fiscal year
in which service charges can be collected for the CSA, and agree to an annual
maximum service charge to ensure continued operation of the facilities.
B. DRAINAGE
❑ 1. Prior to recordation of the Parcel/Final Map, a plan for a permanent solution for
drainage shall be submitted to and approved by the Department of Public Works.
The drainage plans shall detail existing drainage conditions and shall specify how
drainage waters shall be detained or retained on- site and/ or conveyed to the
nearest natural or publicly maintained drainage channel or facility and shall
provide that there shall be no increase in the peak flow runoff to said channel or
facility.
❑ 2. Prior to final improvement inspection by the Department of Public Works, all new
drain inlets shall be labeled with the county approved drain marker per County
Standard S-40. Improvement plans shall show and/or note the requirements for
labeling inlets pursuant to Butte County Standard S-40.
❑ 3. Prior to recordation of the Parcel/Final Map, establish 100 year flood plain
elevations and the lowest floor elevations for any structures, in accordance with
Butte County Code §26-25. Show on the additional map sheet the elevations (by
contours) and the location of an accepted NGVD29 (National Geodetic Vertical
Datum of 1929) benchmark and a temporary benchmark on-site.
❑ 4. Prior to, or concurrently with the recordation of the Parcel/Final Map, pay the
applicable drainage fees in effect at the time of recordation of the Parcel/Final
Map for the drainage area. (The current fee is now $
/acre.)
❑ 5. Prior to grading, a Construction Storm Water Permit will be required by the State
Water Resources Control Board if the project results in a disturbance (including
clearing, excavation, filling, and grading) of one or more acres. The Permit must
be obtained from the State Water Resources Control Board prior to construction.
If a Construction Storm Water Permit is required, place a note on an additional
map sheet that states: "The development of this Parcel/Final Map requires a
construction storm water permit. Construction activities that result in a land
disturbance of less than one acre, but which are part of a larger common plan of
development, also require a permit. Development of individual lots may require
an additional permit(s)."
C. PARCEL/FINAL MAP
❑ 1. Show all easements of record on the Parcel/Final Map.
❑ 2. Prior to or concurrently with the recordation of the Parcel/Final Map, pay in full
any and all delinquent, current and estimated taxes and assessments as specified

a. Insure financing of operation, repair and maintenance.
b. Provide qualified individuals and operational procedures for .facility
operations, repair and maintenance.
C. Provide adequate resources to comply with all monitoring and other
Regional Water Quality Control Board Waste Discharge Requirements.
d. Provide adequate resources for facility inspections and reports.
e. Provide adequate resources and/or mechanisms to insure adequate funding
of a major sewage treatment and disposal facility replacement or
reconstruction if necessary.
f. Provide a liability risk assessment for review by the County of Butte.

g. Indemnify the County of Butte and community services district or `other

sewage disposal facilities.
❑ 3. Prior to recordation of the final map, when a homeowner's association is required,
obtain approval of the By-laws and CC&Rs by Butte County Environmental
Health, and, if required, by the California State Regional Water Quality Control
Board. Approval shall be obtained prior to recordation of the Final Map.
a. Bylaws, Articles of Incorporation, etc., relating to wastewater authority
and financing cannot be changed without approval of Board of
Supervisors and Regional Board (exception: wastewater authority and
financing may be assumed by a public entity at any time).
b. Association cannot terminate its existence without approval of Board of
Supervisors and Regional Board. Note: Sacramento County has covered
the above two points by requiring Associations to include the County
Board of Supervisors in the Association's name.
C. Membership in Association is mandatory for all lots (perhaps by deed
restriction).
d. Association shall have power to inspect, monitor and report on the
operation of all kinds of individual and collective wastewater facilities
(including ground water monitoring wells).
e. Association shall have power to maintain above wastewater facilities,
including, but not limited to, pumping septage, discharging to alternate
leachfields, repairing and replacing septic tanks, discharge lines and
leachlines.
f. Association shall have power to construct, or order construction, of new
leachfields on same property or common property.
g. Association shall have power to construct collective wastewater facilities
if individual systems threaten public health or water quality.
h. Association shall have power to raise money to do all of the above by
dues, liens, service charges or mortgages.
i. Association shall have power to do all of the above (except construction of
collective systems) by action of. Board rather than majority of
homeowners.
J_ Association shall discharge monitoring and maintenance requirements
with appropriately qualified personnel (wastewater treatment certificates
or registered sanitarian) by contract or its own employees.
k. Association shall provide for short and long-term reliability of treatment
systems by:
i. including reserve leachfield areas.
ii. including easements for sewers.
iii. including immediate reserve funds for operations until sufficient

J. COMMUNITY SEWER SPECIAL NITRATE AREA
❑ 1. Prior to recordation of the final map, in accordance with the Chico Area Nitrate
Compliance Plan, provide for a connection to the public sewer, if practical and
feasible. A determination that connection is not practical and feasible shall be
made with the concurrence of the Central Valley Regional Water Quality Control
Board and the Environmental Health Division. Note: Board staff is currently
requiring a density of no greater than one equivalent residential unit per acre for
development on septic tanks where sewer is not available.
❑ 2. Prior to recordation of the final map, when connection to a public sewer is not
feasible:
a. Provide the minimum required sewage disposal area as required by the
Butte County Subdivision Ordinance and the Nitrate Compliance Plan.
b. In conformance with the City of Chico Sanitary Sewer Master Plan, dated
December 20, 1985, construct dry line sewer mains to serve the project

This project is to divide an existing 1.75 acre parcel with a single family home
known as #1437 Feather Ave. into four parcels. The land slopes slightly to the west and
has several old ornamental trees and shrubs around the house. A well and several small
sheds also sit on the site.
The parcels will be 6900, 7475, and 14375 square feet and 1.01 acres each
respectively. The home is served by all utilities including Thermalito Irrigation District
sewer and water. A will -serve letter has been provided. The home is currently under
renovation.
A proposed new street will serve the westerly parcel and will be built to private
road standards.
The surrounding area is single family homes on individual parcels of 6500 square
feet to more than 5 acres. To the east are several small rental homes on one parcel of
approx. 2 acres.
No unusual circumstances or historical or scenic aspects affect this property.

3. Roberto Uribe shall reimburse the District for its fees and costs to monitor
their installation, and to inspect, test and accept them. Please review TID's Policy 7165;

As required by law, this statement is our notice to buyers and sellers of the new State of
California withholding law. Starting in January, 2003, buyers of California real estate must
withhold 3-1/3 percent of the sales price from the seller and send it to the Franchise Tax
Board, according to the Franchise Tax Board
For real estate sales closing after December 31, 2002, the new law (AB 2065) requires
buyers of California real estate to withhold income taxes and send them to the FTB.
Bidwell Title & Escrow Company will withhold the funds if you wish for us to. The penalty
for not complying is the greater of $500 or 10 percent of the withholding amount.
There are some exceptions in the law. Withholding is. not required if the total sales price is
$100,000 or less, or for principal residences held for more than 2 years, sales resulting in
a taxable loss, like kind exchanges, and some involuntary conversions. Also.exempted are
sales where the seller is tax exempt or a California corporation or partnership. .
The new law includes all individuals- residents and nonresidents. Unlike the current law,
the FTB will not grant individuals a waiver or reduced rate of withholding for sales with
small taxable gains. The FTB estimates this law impacts 300,000 real estate sales each
year.
Tax withholding is a prepayment of state taxes that sellers who profit from their real estate
sales will owe. It is much like the wage withholding that employees have deducted from
their paychecks. California, like the federal government, has a "pay as you go" tax system,
meaning taxes are due as you earn income, not after the end of the year when you file
your tax return. Real estate withholding will, in many cases, save the seller from having to
make an estimate payment to cover the tax from the real estate sale's gain.

AFFIDAVIT OF SELLER, BUYER, AND/OR OWNER
BEFORE ME, personally appeared ("Affiant"), who having been duly sworn, deposes and says that:
Affiant is the owner of, or intends to own, real property located in Butte County, California, described in
the Preliminary Title Report, attached hereto.
2. Affiant is, or will be, in exclusive possession of the Property, and no other party has any right or claim of
possession or use of the Property, except as set forth in Exhibit "B" or Rent Statement attached hereto.
There are no recorded or unrecorded easements, covenants or restrictions affecting the Property, other
than those listed in Preliminary Title Report for the above referenced Escrow, attached hereto.
4. There are no judgments, assessments,. tax liens or other liens against Seller or the Property remaining
unpaid, and the Property is free and clear of all encumbrances except as set forth on the Preliminary Title
Report, attached hereto.
There have been no improvements made to the Property within the 90 day period immediately preceding
the execution hereof, and there are no bills, statements or other invoices for labor, materials or services
applicable to or affecting the Property or any improvements thereon, remaining unpaid.
6. To the best of Affiant's knowledge, there are no suits or matters pending against Affiant that could give
rise to a lien that would attach to the Property prior to the recordation of the documents applicable to this
transaction.
7. To the best of Affiant's knowledge, there are no bankruptcy or insolvency proceedings, voluntary or
involuntary, threatened or pending against Affiant and there are no grounds upon which any such
proceeding could be filed against Affiant.
Affiant has not executed and will not execute any instrument that would adversely affect the title to or

CALIFORNIA LAND TITLE ASSOCIATION STANDARD COVERAGE POLICY - 1990
EXCLUSIONS FROM COVERAGE
The following matters are expressly excluded from the coverage of this policy and the Company will not pay loss or damage, costs, attorneys' fees or
expenses which arise by reason of:
1. (a) Any law, ordinance or governmental regulation (including but not limited. to building and zoning laws, ordinances, or regulations) restricting,
regulating, prohibiting or relating to (i) the occupancy, use, or enjoyment of the land; (ii) the character, dimensions or location of any improvement
now or hereafter erected on the land; (iii) a separation in ownership or a change in the dimensions or area of the land or any parcel of which the
land is or was a part; or (iv) environmental protection, or the effect of any violation of these laws, ordinances or governmental regulations, except
to the extent that a notice of the enforcement thereof or a notice of a defect, lien or encumbrance resulting from a violation or alleged violation
affecting the land has been recorded in the public records at Date of Policy.
(b) Any governmental police power not excluded by (a) above, except to the extent that a notice of the exercise thereof or a notice of a defect, lien or
encumbrance resulting from a violation or alleged violation affecting the land has been recorded in the public records at Date of Policy.
2. Rights of eminent domain unless notice of the exercise thereof has been recorded in the public records at Date of Policy, but not excluding from
coverage any taking which has occurred prior to Date of Policy which would be binding on the rights of a purchaser for value without knowledge.
3. Defects, liens, encumbrances, adverse claims or other matters:
(a) whether or not recorded in the public records at Date of Policy, but created, suffered, assumed or agreed to by the insured claimant;
(b) not known to the Company, not recorded in the public records at Date of Policy, but known to the insured claimant and not disclosed in writing to
the Company by the insured claimant prior to the date the insured claimant became an insured under this policy;
(c) resulting in no loss or damage to the insured claimant;
(d) attaching or created subsequent to Date of Policy; or
(e)' resulting in loss or damage which would not have been.sustained if the insured'claimant had paid value for the insured mortgage or the estate or
interest insured by this policy.
4. Unenforceability of the lien of the insured mortgage because of the inability or failure of the insured at Date of Policy, or the inability or failure of
any subsequent owner of the indebtedness, to comply with applicable doing business laws of the state in which the land is situated.
5. Invalidity or unenforceability of the lien of the insured mortgage, or claim thereof, which arises out of the transaction evidenced by the insured
mortgage and is based upon usury or any consumer credit protection or truth -in -lending law.
6. Any claim, which arises out of the transaction vesting in the insured the estate or interest insured by this policy or the transaction creating the interest
of the insured lender, by reason of the operation of federal bankruptcy, state insolvency or similar creditors' rights laws.
EXCEPTIONS FROM COVERAGE — SCHEDULE B, PART I
This policy does not insure against loss or damage (and the Company will not pay costs, attorneys' fees or expenses) which arise by reason of:
1. Taxes or assessments which are not shown as existing liens by the records of any taxing authority that levies taxes or assessments on real property or
by the public records.
Proceedings by a public agency which may result in taxes or assessments, or notices of such proceedings, whether or not shown by the records of such
agency or by the public records.
2. Any facts, rights, interests or claims which are not shown by the public records but which could be ascertained by an inspection of the lanu or which may
be asserted by persons in possession thereof.
3. Easements, liens or encumbrances, or claims thereof, which are not shown by the public records.
4. Discrepancies, conflicts in boundary lines, shortage in area, encroachments, or any other facts which a correct survey would disclose, and which are
not shown by the public records.
5. (a) Unpatented mining claims; (b) reservations or exceptions in patents or in Acts authorizing the issuance thereof; (c) water rights, claims or title to
water, whether or not the matters excepted under (a), (b) or (c) are shown by the public records.

2. The right to take the land by condemning it, unless:
• a notice of exercising the right appears in the public records on the Policy Date
• the taking happened prior to the Policy Date and is binding on you if you bought the land without knowing of the taking
3. Title Risks:
• that are created, allowed, or agreed to by you
• that are known to you, but not to us, on the Policy Date - unless they appeared in the public records
• that result in no loss to you .
• that first affect your title after the Policy Date -this does not limit the labor and material lien coverage in Item 8 of Covered Title Risks
4. Failure to pay value for your title.
5. Lack of a right:

5. invalidity or unenforceability of the lien of the insured mortgage, or claim thereof, which arises out of the transaction evidenced by the insured
mortgage and is based upon usury or any consumer credit protection or truth in lending law.
6. Any statutory lien for services, labor or materials (or the claim or priority of any statutory lien for services, labor or materials over the lien of the
insured mortgage) arising from an improvement or work related to the land which is contracted for and commenced subsequent to Date of Policy
and is not financed in whole or in part by proceeds of the indebtedness secured by the insured mortgage which at Date of Policy the insured has
advanced or is obligated to advance.
7. Any claim, which arises out of the transaction creating the interest of the mortgagee insured by this policy, by reason of the operation of federal
bankruptcy, state insolvency, or similar creditors' rights laws, that is based on:
(i) the transaction creating the interest of the insured mortgagee being deemed a fraudulent conveyance or fraudulent transfer; or

On February 1, 2006, the Butte County Inter -Departmental Review Committee (IDR) reviewed
the above referenced project for compliance with County regulations. It was determined that the
project is incomplete for the following reasons:
Public Works
Provide information demonstrating how storm drainage will be managed so that there is no
increase in peak runoff from the fully developed parcels above the current pre development
levels. Also provide information with respect to the location of existing and proposed drainage
facilities.
This project will remain in an incomplete status until such time as Public Works has received and
reviewed the above requested information, and rescinded the incomplete status. No further
processing of this project will occur until such time as the required materials are received. The
timelines pursuant to the California Permit Streamlining Act are suspended until such time as
this project is deemed complete.

Parcels 1, 2, and 3 are required to connect to community water.
Parcel 4 has an existing well, if they intend to use it they do not need to connect to TID. However, if they do
connect to TID, they can either abandon the well, or maintain it in accordance with Bulletin 74-81 Section 21
which states that: "the owner shall properly maintain the well in such a way that:
1. The well has no defects which will allow the impairment of quality of water in the well or in the
water -bearing formations penetrated.
2. The well is covered such that the cover is watertight and cannot be removed except with the aid
of equipment or the use of tools.
3. The well is marked so that it can be clearly seen.
4. The area surrounding the well is kept clear of brush or debris.".

Code, Federal Law, and other applicable codes and regulations -governing the
design, construction and operation of the facilities.
❑ 2. Prior to the final map, provide a community services district or other legal
(government) entity adequate to insure the operation, maintenance or repair of the
sewage collection, treatment and disposal facilities.. At a minimum, creation of
the entity shall:
a. . Insure financing of operation, repair and maintenance.
b. Provide qualified individuals and operational procedures for facility
operations, repair and maintenance.
C. Provide adequate resources to comply with all monitoring and other
Regional Water. Quality Control Board Waste Discharge Requirements.
d. Provide adequate resources for facility inspections and reports.
e. Provide adequate resources and/or mechanisms to insure adequate funding
of a major sewage treatment and disposal facility replacement or

f. Provide a liability risk assessment for review by the County of Butte.

g. Indemnify the County of Butte and community services district or other
government entity for all claims and liability that may occur relative to the
sewage disposal facilities.
❑ 3. Prior to recordation of the final map,.when a homeowner's association is required,
obtain approval of the By-laws and CC&Rs by Butte County Environmental
Health, and, if required, by the California State Regional Water Quality Control
Board. Approval shall be obtained prior to recordation of the Final Map.
a. Bylaws, Articles of Incorporation, etc., relating to. wastewater authority
and - financing cannot be changed without approval of Board of
Supervisors and Regional Board (exception: wastewater authority and
financing may be assumed by a public entity at any time).
b. Association cannot terminate its existence without approval of Board of
Supervisors and Regional Board. Note: Sacramento County has covered
the above two points by .requiring Associations to include the County
Board of Supervisors in the Association's name.
C. Membership in Association is mandatory for all lots (perhaps by deed
restriction).
d. Association shall have power to inspect, monitor and report on the
operation of all kinds of individual and collective wastewater facilities
(including ground water monitoring wells).
e. Association shall have power to maintain above wastewater facilities,
including, but not limited to, pumping septage, discharging to alternate
leachfields, repairing and replacing septic tanks, discharge lines and
leachlines.
f. Association shall have power to construct, or order construction, of new
leachfields on same property or common property.
g. Association shall have power to construct collective wastewater facilities
if individual systems threaten public health or water quality.
h. Association shall have power to raise money to do all of the above by
dues, liens, service charges or mortgages.
i. Association shall have power to do all of the above (except construction of
. _ collective systems) by action of Board rather, than majority_, of
homeowners.
j.. Association shall discharge monitoring and maintenance requirements
with appropriately qualified personnel (wastewater treatment certificates
or registered sanitarian) by contract or its own employees.
k. Association shall provide for short and long-term reliability of treatment
systems by:
i. including reserve leachfield areas.

COMMUNITY SEWER SPECIAL NITRATE AREA
1. Prior to recordation of the final map; in accordance with the Chico Area Nitrate
Compliance Plan, provide for a connection to the public sewer, if practical and
feasible. A determination that connection is .not practical and feasible shall be
made with the concurrence of the Central Valley Regional Water Quality Control
Board and the Environmental Health Division. Note: Board staff is currently
requiring a density of no greater than one equivalent residential unit per acre for
development on septic tanks where sewer is not available.

Prior.to recordation of the final map, when connection to a public sewer is not
feasible:
a. Provide the minimum required sewage disposal area as required by the
Butte County Subdivision Ordinance and the Nitrate Compliance Plan.
b. In conformance with the City of Chico Sanitary Sewer Master Plan, dated
December 20, 1985, construct dry line sewer mains to serve the project
and stubbed out to the property line for future public sewer connection.
C. Provide a community services district or other legal (government) entity
adequate to ensure the maintenance: of the dry sewer main and, when
necessary, the activated sewer main.
d.. Place the following notes on the additional map sheet or document to be .
recorded concurrently with the Final Map:
"Butte County permit for the installation of individual septic systems shall
require the construction of sewer laterals for. future public sewer
connection." "Lots within this subdivision are subject to sewage flow
restrictions that preclude high water use business activities."
"The discharge of wastewater, other than domestic sewage, into individual
sewage disposal systems requires approval of the California State
Regional Water Quality Control Board, Central Valley Region."
e. Provide CC&Rs for the project that specify maximum allowable domestic
sewage flows per lot or parcel approved by the California Regional Water
Quality Control Board, Central Valley Region. Within the CC&Rs,
provide for changes to be with the concurrence of the California Regional
Water Quality Control Board, Central Valley Region.

Parcel 4 has an existing well, if they intend to use it they do not need to connect to TID. However, if they do
connect to TID, they can either abandon the well, or maintain it in accordance with Bulletin 74-81 Section 21
which states that: "the owner shall properly, maintain the well in such a way that:
1. The well has no defects which will allow the impairment of quality of water in the well or in the
water -bearing formations penetrated.
2. The well is covered such that the cover is watertight and cannot be removed except with the aid
of equipment or the use of tools.
.3. The well is marked so that it can be clearly seen.
4. The area surrounding the well is kept clear of brush or debris."
All parcels are required to connect to community sewer. There is a 50' setback from any sewer lines to the well.

❑ 1. Construction, installation or development of buildings and/or roads, driveways,
gates and bridges on parcels/lots shall comply with the latest California Fire Safe
Regulations—Public Resources Code 4290, 4291 and current Butte County
Improvement Standards, whichever is stricter.
❑ 2. Prior to construction, a pressurized community water system for fire protection is
required. Bonding may be allowed with the approval of the County Fire Chief.
Average required hydrant spacing is feet, hydrant size inches, and
residual fire flow of GPM. Fire hydrant identification, road reflectors
or post reflectors acceptable to the County Fire Chief shall be installed or bonded,
prior to Parcel or Final map recordation. Submit plans to the Fire Department for
review and approval prior to construction.
X 3. Place a note on a separate document and recorded concurrently with the Parcel,
Final map or an additional map sheet stating that "Fire suppression sprinkler
systems shall be installed in all new, residential dwellings in accordance with
NFPA Standard 13D, unless a pressurized community water system with hydrants
that meet Fire Department specifications serves the property." A note stating
"Automatic Fire Sprinklers conforming to NFPA Standard 13D required" is to be
added to all affected building plans.
❑ 4. In lieu of hydrant installation, prior to recordation of the Parcel or Final map,
payment shall be made into the hydrant fund at the current rate per
lineal foot of street frontage.
X 5. Prior to building construction, provide an all weather access of at least 10 feet
wide and vertical clearance of 15 feet that, will allow for ingress and egress and
accommodate a 40,000 -pound fire apparatus to within 150 feet of all structures.

A NEGATIVE DECLARATION WITH A COPY OF THE PROPOSED NEGATIVE
DECLARATION AND INITIAL STUDY ATTACHED.
The affected parcels are located within the boundaries of the following local agencies:

Please consider the following comments concerning the project described above.
The project area is located in the Oroville Urban Area and the City of Oroville Sphere of Influence.
Consultation with the City (as described in County General Plan Land Use Element Policies 1.2,
1.5, 1.6) is encouraged to promote coordinated planning within the Sphere and ensure
development is consistent with City of Oroville standards. LAFCO policies discourage urban
development without annexation to a city that can provide a full range of urban type services. If
a LAFCO action is required to implement this project (such as annexation toffomtation of, a
district), strong consideration will be given to the ability of the project to conform to City standards
and regulations.
2. The project is located within CSA No. 26 (Thermalito Drainage) which is empowered to provide
drainage services to the greater Thermalito area. Will on-site drainage be coordinated with CSA
26 functions and maintained through the use of CSA 26? If the CSA 26 drainage services will not
be utilized for this project, an analysis of this decision will need to be provided as a part of any
requests to form a new CSA to provide drainage services.

3. LAFCO, is aware of several other development proposals in the Thermalito area for which
annexations to, or formations of, GSA's are being considered. The County should provide a
cumulative analysis of the delivery of urban services within. the Thermalito area that demonstrates
.the .County has a comprehensive plan for the delivery of urban services in this developing area
as, recommended in General Plan Land Use Element Policies 1.6 and 1.7.
4. If urban type services (e.g. street lighting, landscaping, drainage, fire protection, etc.) for the new
development are proposed to be provided through annexation to an existing local agency or by
a formation of a new local agency such as a county service area (CSA) or a community service
district (CSD), LAFCO as the authorizing, agency, should be consulted early to allow for a
meaningful analysis of the issue prior to County consideration of the development application.
This early coordination will allow for the anticipated LAFCO action to be fully integrated into the
project review process and should result in the proposal being:
A. Fully described in the project description; and
B. Fully addressed in the appropriate environmental documents; and
C. Circulated to LAFCO for review as an agency with an approval role; and
D. Fully integrated into the public hearing process.
The absence of this early coordination and failure to address the LAFCO related issues as
described, will require additional environmental review and related studies at such time an
annexationfformation is requested resulting 'in unnecessary costs and delays. It should be
understood that such a request would be reviewed based on state law and local LAFCO policies
which are clearly directed at maximizing service efficiencies, minimizing the creation of new
governmental entities, limiting urban *sprawl and directing new development to areas with existing
urban service providers. ,
