Grubbs Road, Palermo area. EXISTING ZONING: A-5 , ZONING HISTORY: Zoned A-5 Jul. 29, 1957 Ord. 595 SURROUNDING ZONING: A-5 SURROUNDING LAND USE: Scattered residential uses at rural , densities, open land,, orchard remnants GENERAL PLAN DESIGNATION: Agricultural Residential ' APPLICABLE REGULATIONS: Butte County Code.Section 24-47; 24-72 and 24-304 ' COMMENTS RECEIVED-.- ECEIVED:The TheButte County Department of Public Works, the Environmental_Health. Department, and the Butte County Fire.Department had no objections or comments other than the conditions listed below. ANALYSIS: This project is,a request to place a temporary mobile home as a second dwelling on property"located on the west side of Van .Zant-Avenue approximately 700 feet north,of Reservoir -Road, east of Palermo south of Oroville. The temporary mobile home will'be located approximately 100 feet west of Van .Zant Avenue, between' the road and the" -..existing home and should not -cause any undue hardship on the neighboring properties. The applicant states that his mother-in-law will be the sole occupant of. the temporary mobile home. Water will be supplied by a well on site and sewage disposal will be by a septic tank and leach field. Power and BUTTE COUNTY PLANNING COMMISSION STAFF FINDING - December 6, 1984 Page 2 phone lines are to the existing dwelling.- Butte welling: Butte County Code Section 24-304 provides for removal of the mobile home within -120 days of the time that it is no longer being occupied pursuant to the code section. The code also makes provision for the County requiring a bond or deposit at the time of application of sufficient size to cover the removal expense of the mobile home. This is to insure that the taxpayers at large (via the General fund) are not charged those expenses should the County be forced to remove the mobile home pursuant to the code. Of course, if the applicant removes this. mobile home voluntarily, then the bond or deposit would be returned. Similarly, if the County removes the mobile home, then only charges actually incurred would be reimbursed from the bond or deposit with the remainder being returned to the applicant. A survey of several mobile home dealerships in Butte County has indicated a rather wide range of estimated costs of removal. Cost, of course, would vary due to installation of landscaping, decks, awnings, and physical site characteristics. Taking the median figures and adding a small amount for administrative costs and storage costs, it appears that a reasonable deposit would be $1,000 per single wide and $1,500 for a double wide mobile home. These amounts seem reasonable to insure that the mobile home is removed at no cost to the County or the taxpayers. The applicant proposes to place a single wide mobile home on the property. This project is categorically exempt from environmental review and appears to conform to the requirements of Butte County'Code Section 24-304 regarding the placement of temporary mobile homes. RECOMMENDATIONS: A. Note that -this project is categorically exempt from environmental review; and B. Find that this proposed use of the property will not impair the integrity and character of the zone in which the land lies and'that the use would not be unreasonably incompatible with,'or injurious to surrounding properties or detrimental to the health and general welfare of the persons residing or working in the neighborhood or to the general health, welfare and safety of the County; and C. Approve the Use Permit to allow a temporary mobile home as a second dwelling on AP 27-10-05 (Lance Van Zant) subject to the following conditions: 1. Occupancy of the mobile home is limited to a close friend or relative.by blood or marriage. 2. No rent is to be charged to the occupant of the'mobile home. 3. The temporary mobile home is to be connected to the existing septic tank and water well. BUTTE COUNTY PLANNING COMMISSION STAFF FINDING - December 6, 1984 Page 3 4. The mobile home is.to be a temporary use on the property pursuant to the requirements of Section 24-304 of'the Butte County code. 5. The -Use -Permit shall expire two years from the date of issuance of the Use Permit. Upon application, the Planning Commission, may grant an extension of the Use Permit not e:aceeding one year. 6. In the event that the.appli.cant who is residing within the mobile home or the conventional residence, for any reason, moves to another location or is deceased, then in that event, the Use.Permit granted herein shall automatically expi,r•e and the mobile home shall be removed within one hundred twenty (120) days. In the event.the mobile home is not removed within one hundred twenty (120) days pursuant to the terms of the Use Permit, the County shall remove the mobile home and store it at the owner's expense. 7.• The'applicant to pay a deposit or post a bond to cover the cost of. removal in the amount of $1,000. 8. Meet the requirements of the Building Division of the Butte County Department of Public Works., 9.
