The property is located on the southeast corner of Myers Street and B Street, at 331.5 Myers. Street in the Oroville area. APN 035-102-001 (File #UP 00-02) (SB) (VIDEO) A video of the site was shown. Mr. Betts gave a brief summary of the project. He said two nonconforming buildings have been removed. He said the applicant wants to replace the two structures with one larger structure. He said Condition 2 has been done and could be deleted. The hearing was opened to the public. Stephen Horton described the building he wants to install that he bought from Building Systems in Gridley. He said the building plans have been approved: Commissioner Mooney explained the building procedures. He said they need the local engineer to do the foundation. The hearing was closed to the public. It was moved by Commissioner Mooney, seconded by Commissioner Lambert and unanimously carried to approve the Use Permit, UP 00-02, for Stephen Horton, deleting Condition 2 and renumber the remaining conditions, subject to the findings and conditions listed below. I. Find that the project is Categorically Exempt from environmental review under a Class 3 Exemption. II. Approve Use Permit 00-02 for Stephen H. Horton, subject to the conditions found in Exhibit A and subject to the following findings: , A. The proposed use of the property will not impair the integrity and character of the zone in which the land lies, and that the use would not be unreasonably incompatible with, or injurious to, surrounding property, or detrimental to the health, safety and general welfare of the persons residing or working in the neighborhood, or to the general health, welfare and safety of the County because: The proposed structure will be for the personal use of the applicant. 2. The proposed structure will not cause an increase in vehicle traffic, noise, odors, or emissions. 3. The public alley behind the project site will help act as a buffer between the proposed structure and the residential zone to the rear of the site. B. The proposed change in nonconforming structures will not conflict with, impair, or be detrimental to, the uses both permitted and conditions of the zone in which it is located and/or adjoins because of the reasons stated in items 1 through 3 above. 0 BUTTE COUNTY PLANNING COMMISSION ■ MINUTES 0 OCTOBER 28, 1999 ■ C. The project is consistent with the C-2 (General Commercial) zone which allows residential accessory buildings with a Use Permit, and is consistent with Commercial General Plan land use designation which allows residential uses as a Secondary Use. Conditions of Approval: Planning Division 1. The project site shall be developed in accordance with the approved project site plan and the conditions contained herein. Said site plan is on file in the Planning Division, is identified as "Exhibit D" and dated August 31, 1999, and is incorporated herein by this reference. The new structure shall not exceed 900 sq. ft. in size and shall not be used for commercial purposes. Building Division 2. Building plans shall -be required for the new metal structure. Building plans shall be prepared by a registered or licensed engineer or architect approved to practice in the State of California. Public Works 3. Prior to the issuance of building permits obtain an encroachment permit for all new or existing driveway approaches and construct them to County standards, as specified in County Improvement Standards. Staff recommends approval of the Use Permit with conditions and findings. PROJECT DESCRIPTION/SITE CHARACTERISTICS: This is a proposal to allow the replacement of two 250 sq. ft. (approximate) nonconforming structures with a 900 sq. ft. (30 ft. X 30 ft.) metal building. The new structure will be located in the same area as the two existing outbuildings, but will be much larger in size and will cover much of the current open area on the site. The new structure will be located 5 feet from the side property line and will abut the rear property line. The proposed structure will be a garage for the applicant's personal vehicles. The garage door will face toward B Street. No commercial uses are proposed to be established in the proposed structure. ■ BUTTE COUNTY PLANNING COMMISSION AGENDA REPORT ■ PAGE 1 ■ The two existing outbuildings, one of which is used as a garage and the other for storage of tools, are nonconforming because they are located in the rear yard building setback. At the time they were constructed, there were no building setback requirements. The current C-2 zoning of the site does not require any side or rear yard building setbacks unless the property abuts a residential zoning district, and then a ten (10) foot building setback is required. The rear yard of the project site abuts a RN (Residential Nonconforming) zoning district. The 5,280 square foot parcel is developed with a dwelling and the two garages. The parcel is connected to public water and sewer services. The closest fire hydrant is located directly across B Street from the project site. Surrounding land use is primarily residential, with some commercial uses located across Myers Street from the site. An 18 -foot wide public alley is located to the rear of the site. ANALYSIS: The project site is designated as Commercial by the Land Use Element Map of the General Plan. Residential uses are allowed by the General Plan as secondary uses. The residential use on the property is a legal, nonconforming use, having been established prior to the property being designated for commercial uses. The project site is zoned C-2 (General Commercial). The C-2 Zoning District allows a residential use by Conditional Use Permit. The residential use on the property is a legal, nonconforming use, having been established prior to the property being rezoned to C-2. There is no maximum building coverage of a parcel located in a C-2 zone, nor are there any side or back yard building setbacks unless the parcel abuts a residential zoning district. The rear yard of the site does abut a residential zone and as such a 10 -foot building setback is normally required. Surrounding parcels are mostly the same size as the project site (5,280 sq. ft.) and are developed with single family dwellings. The parcels to the north, south, and west of the site are zoned C-2, but only the parcels to the west, across Myers Street, have a commercial use. The parcels to the east of the site are zoned RN and are developed with single family dwellings. This project will allow the new structure to be placed in the 10 -foot building setback, replacing the two existing nonconforming structures already located in the setback. It is not anticipated that the replacement of the two existing structures will create any conflicts with the residential uses located on the other side of the 18 -foot wide alley. Any new structure built on the project site has the potential to be used for commercial uses because of the C-2 zoning of the site. The proposed structure is intended for the personal use of the applicant, not for commercial uses. A condition of this project does not allow the proposed structure to be used for commercial uses. 0 BUTTE COUNTY PLANNING COMMISSION AGENDA REPORT ■ PAGE 2 ■ The Butte County Environmental Health Division has no comments on the project. The El Medio Fire Department did not respond to a request for comments, but it not anticipated that the proposed structure will create an impact to fire protection services. The Butte County Public Works Department requests that encroachment permits be obtained for all new or existing driveway approaches and construct them to County standards. The City of Oroville did not respond to a request for comments. ACTIONS FOR CONSIDERATION: Section 24-35.20 of the Butte County Zoning Ordinance states that the Planning Commission may approve a Use Permit if an existing nonconforming use is changed to another nonconforming use, expanded, enlarged, extended, reconstructed, or structurally altered. The Planning Commission must find that the change, expansion,' enlargement, extension, reconstruction, or structural alteration of such use will not conflict with, impair, or be detrimental to, the uses both permitted and conditions of the zone in which it is located and/or adjoins. This finding must be in addition to the findings required by Section 24-45.10 of the Zoning Ordinance. Staff recommends that the Planning Commission take the following actions: I. Find that the project is Categorically Exempt from environmental review under a Class 3 Exemption. II. Approve Use Permit 00-02 for Stephen H. Horton, subject to the conditions found in Exhibit A and subject to the following findings: A. The proposed use of the property will not impair the integrity and character of the zone in which the land lies, and that the use would not be unreasonably incompatible with, or injurious to, surrounding property, or detrimental to the health, safety and general welfare of the persons residing or working in the neighborhood, or to the general health, welfare and safety of the County because: 1. The proposed structure will be for the personal use of the applicant. 2. The proposed structure will not cause an increase in vehicle traffic, noise, odors, or emissions. 3. The public alley behind the project site will help act as a buffer between the proposed structure and the residential zone to the rear of the site. B. Prior to the issuance of building permits, the plans, incorporating all applicable conditions of approval shall be submitted to the Planning Division to verify compliance with said conditions of approval. —3. Trash receptacle areas shall be enclosed by a 6 foot high solid masonry wall with view obstructing gates and a solid or semi -open shade cover. Plans to be reviewed and approved by the Planning Division prior to construction. 4. Prior to any use of the project site or business activity being commenced thereon, pursuant to this permit, conditions of approval contained herein shall be completed to the satisfaction of the Planning Division. —5. All electrical and mechanical equipment, including but not limited to air conditioning units, electrical boxes, transformers, and backflow preventers, shall be screened from public view. Screening shall be to the satisfaction of the Planning Division and in compliance with the Building Division. K. LANDSCAPING A detailed landscape and irrigation plan consistent with the project site plan shall be submitted to and approved by the Planning Division prior to the issuance of building permits. 2. A plan of the existing on-site mature trees, located in any area proposed for buildings and vehicular access, shall be provided to and approved by the Planning Division prior to the issuance of building permits and/or prior to grading or vegetation removal. The applicant shall minimize the removal of mature trees, where possible. A mature tree shall be defined as a tree with a trunk measuring 4 inches in diameter, 4 feet from ground level. Mature trees removed shall be replaced by planting replacementtrees of equal number and not less than _ gallon size. All landscaped areas shall be maintained in a healthy and thriving condition, free from weeds, trash, and debris, during the term of this permit. All graded slopes, over 5 feet in height, or on slopes greater than _%, shall be seeded, planted, mulched or hydroseeded or otherwise protected to prevent erosion. A permanent irrigation system shall be installed for non-native vegetation. A one year Faithful Performance bond shall be posted to guarantee installation and established growth. 5. In parking lots of commercial and industrial development, trees of not less than 15 gallon size shall be provided to reduce heat gain from the paved surface and to soften the visual impact of the paved area. Such trees shall be planted at a minimum density of one tree every three parking spaces. Tree species shall be approved by the Planning Division prior to planting. 6. Prior to the commencement of grading and/or construction activity, all individual or groups of oak trees which are to be retained as part of the project, shall be fully protected through the use of root protection zones (RPZ). During construction, RPZs shall be established using protective fencing enclosing an area with a radius 1.5 times the distance from the trunk to the dripline. Within this protective buffer, no grading, trenching, fill, or vegetation alteration of any kind shall be allowed. The RPZs shall be maintained after the completion of construction in order to continue to protect the oak trees, but the fencing shall be removed. L. GRADING 1. During construction, should any archaeological artifacts be discovered, the Planning Division shall be notified immediately, and all work shall cease until a qualified archaeologist has examined the artifacts and the site and submitted his or her findings to the Planning Division, and recommended clearance to continue. Recommencement of construction shall be upon the approval of the Planning Division. Archaeological artifacts are defined as follows: Prior to any clearing, grading and/or construction in a Federal or State identified 100 year floodplain and/or streambed the following entitlements must be obtained: a California Fish and Game 1604 Streambed Alteration permit and an Army Corps 404 permit or exemption certificate. M. ADDITIONAL APPROVALS 1. Prior to the issuance of building permits payment of the North Oroville/Thermalito Traffic Impact Fees shall be made. —2. Prior to the issuance of a building permit for each new or additional living unit the applicant shall execute the Oroville Area Traffic Mitigation Fee Agreement and pay the established fee. Prior to the issuance of the Use Permit, to insure the maintenance and continuance of the orchard or other agricultural use of the property, the property owner shall enter into the County approved Orchard Management Agreement. The agreement shall terminate in 10 years or upon a rezoning of the parcel/lot to a zone other than A-5 through A-160. The agreement shall be recorded and recording fees paid by the applicant. —4. Approval of this request shall not waive compliance with all sections of the Zoning Ordinance and all other applicable State and County laws and regulations in effect at the time of building permit application. —5.
