Copy of Use Permit / Variance to Planning Technician: Ordinance No: Adopted: Fish & Game Fees Paid: Yes No Chuck Merino (Butte County Fire Department) - proposed Negative Declaration regarding environmental impacts and Use Permit to allow a 1,913 square foot volunteer fire station, with an office and a bathroom, on a .5 acre lease area. The proposed fire station will be a galvanized metal building and will hold one water tender vehicle and one fire engine. The building will not initially be connected to electrical service, and will not contain a bathroom. These amenities, along with an office, will be added later when funding becomes available. The fire station will be located approximately 42 feet from the edge of Cherokee Road. The fire station use will not involve the storage of any hazardous materials or fuels. The station will normally be unmanned, with volunteer Firefighters only coming to the site to pick up the fire vehicles to respond to an emergency. Maintenance of vehicles will not occur on the site. The property is located on the east side of Cherokee Road, approximately 800 feet north of Patterson Lane/Tippytop Road, Cherokee. APN 041-500-010(SB) (UP00-11) (VIDEO) A video of the site was shown. Mr. Betts gave a brief summary of the project. Commissioner Mooney said he did not think the applicant would get a building permit without a toilet, and he did not think they would get a toilet without a septic permit. , Mr. Betts said that Environmental Health was aware that a bathroom would not be initially installed. The applicant did do soil testing and Environmental Health did approve it. Commissioner Mooney said there does not look like sufficient area for the 100 % leachline replacement requirement. He said the last fire station he did the County required two handicapped showers and a restroom. He said the Use Permit was the easy part. He said the well was not shown on the plot map. Mr. Betts said it is in the upper northwest corner of the property and is not shown on the map. Commissioner Mooney said this is a building with an occupancy requirement and will require handicapped restrooms. The hearing was opened to the public There was a representative here to answer questions. The hearing was closed. It was moved by Commissioner Mooney, seconded by Commissioner Lambert, and unanimously carried to approve the Use Permit for the Butte County Fire Department, UP00-11, to allow a volunteer fire station subject to the findings and conditions listed below: I. Adopt a Negative Declaration regarding environmental impacts as detailed in this agenda report with the following findings and authorize the Chair to sign. A. Find that an Initial Study was completed in compliance with the California Environmental Quality Act, that said study did not identify any potential significant environmental effects, and that a Negative Declaration is proposed. B. Find that the Planning Commission has considered the proposed Negative Declaration, together with comments received during the public review process. ■ BUTTE COUNTY PLANNING COMMISSION 0 MINUTES ■ JUNE 8, 2000 ■ C. Find, on the basis of the whole record before the Planning Commission, including the Initial Study and any comments received, that there is no substantial evidence that the Butte County Fire Department Use Permit project will have a significant effect on the environment. D. Find that the proposed Negative Declaration reflects the independent judgement and analysis of the County, which is the lead agency. II. The design of the proposed project improvements will not cause environmental damage to fish and wildlife or their habitat, and a "de minimus" exemption regarding impact to fish and wildlife or their habitat is approved because the .5 acre lease area has already been cleared and graded and does not contain any sensitive habitats. The collection of fees pursuant to Fish and Game Code Section 711.4(d)(3) and 14 CCR 753.5. is not required. III. Approve Use Permit 00-11 for the Butte County Fire Department, subject to the conditions found in Exhibit A, with the following findings: A. The proposed use of the property will not impair the integrity and character of the zone in. which the land lies, and that the use would not be unreasonably incompatible with, or injurious to, surrounding property, or detrimental to the health, safety and general welfare of the persons residing or working in the neighborhood, or to the general health, welfare and safety of the County because: 1. The proposed volunteer fire station will not cause a significant increase in noise, light, or vehicle traffic. 2. The proposed volunteer fire station does not involve the use. of any hazardous materials or the storage of fuels. 3. No vehicle repair will occur on the site. 4. The proposed volunteer fire station will decrease Fire Department response times. B. The project is consistent with the Unclassified zone which allows a public use with a Use Permit, and is consistent with the Agricultural -Residential General Plan land use designation which allows a public use as a Secondary Use. Conditions of Approval: The project site shall be developed in accordance with the approved project site plan and the conditions contained herein. Said site plan is on file in the Planning Division, is identified as "Exhibit E" and dated March 2, 2000, and is incorporated herein by this reference. 2. Building permits shall be obtained for the fire station. Plans shall be prepared by a licensed or registered architect or engineer authorized to practice in the State of California. The structure shall be designed in accordance with the 1998 California Building Code and shall meet the requirements of the Essential Services Building Act. ■ BUTTE COUNTY PLANNING COMMISSION ■ MINUTES ■ JUNE 8, 2000 ■ 3. A septic permit shall be obtained prior to installation of a bathroom. Fire Department 4. Construction, installation or development of structures or facilities on the parcels/lots shall comply with the latest California Fire Safe Regulations, (Public Resources Code 4290), and all other applicable State and County codes, ordinances and regulations in effect at the time of application for improvement permits.. 5 Building identification and/or addresses shall be installed in conformance with Public Resources Code 4290 and shall be posted at the beginning of building construction and maintained continuously thereafter. 6. Prior to the issuance of building permits obtain an encroachment permit for a public road approach and construct it to County standards providing adequate sight distance, as specified in County Improvement Standards. 7. Prior to the issuance of building permits a plan for a permanent solution for drainage shall be submitted to and approved by the Department of Public Works. The drainage plans shall specify how drainage waters shall be detained on-site. and/or conveyed to the nearest natural or publicly maintained drainage channel or facility, and shall provide that there shall be no increase in the peak flow runoff to said channel or facility. Butte County Air Quality Management District S. Applicant shall implement measures to prevent fugitive dust emissions during all construction activities. Measures may include site and driveway watering and/or the use of other acceptable soil palliatives. , 9. The applicant estimates that the proposed fire station will respond to emergencies 30 to 50 times per year. Currently, fire protection services for the Cherokee/Table Mountain area must come from fire stations at Jarbo Gap, Oroville, and Durham. Leasing of land usually requires that a parcel map be approved and recorded. However, a parcel map is not required to be filed for this project because conveyance of land to a public entity is not considered a division of land (California Subdivision Map Act, Section 6426.5). Additionally, Section 66428(a)(2) states that a parcel map is not required when land is conveyed to a government agency or public entity. The project site is zoned Unclassified and has a General Plan Land Use designation of Agricultural - Residential. Surrounding parcels range in size from 1 to 42 acres. Land use on surrounding parcels is predominantly rural residential. The Cherokee Cemetery is located just to the west of the site. The project parcel is 12.68 acres in size, but the project will be contained within the .5 -acre lease area. The .5 -acre lease area has been cleared of most vegetation and has been rough graded. The lease area is mostly level. The lease area is developed with a large water storage tank and a well. A small memorial to a firefighter is also located on the lease area. Vegetation on the lease area consists of grasses, some brush, and a few scattered trees along the boundaries. No drainages are found on the site. The site is located in an area that has a very high fire hazard. ANALYSIS: The proposed fire station is a public use. The Unclassified zone allows a public use with a Use Permit (Butte County Code Section 24-230(c)(5). The Agricultural -Residential General Plan land use designation allows a public use as a Secondary Use. The proposed volunteer fire station will not cause a significant increase in noise, light, or vehicle traffic in the project area. Construction activities on the site will generate noise, but is not expected to be significant. After the fire station is constructed, the only noises that will be generated will be from the occasional arrival and departure of vehicles belonging to the volunteer firefighters, and from the arrival and departure of the fire trucks. Fire trucks departing the site on an emergency run may have their sirens on, which may cause a temporary impact to nearby residents. The applicant states that sirens are not normally used when departing a station in a rural area. The number of emergency runs is expected to be limited due to the rural nature of the area served by the proposed fire station. Due to the low number of emergency runs, and because the sirens are not normally used, the noise from any use of the sirens is not expected to create a significant impact to residents in the project area. ■ BUTTE COUNTY PLANNING COMMISSION AGENDA REPORT ■ PAGE 2 ■ The project will generate a few additional vehicle trips on Cherokee Road during site development, but this increase is not expected to cause an impact to vehicle circulation. After construction of the fire station, no impacts are expected to vehicle circulation due to the infrequent use of the proposed volunteer fire station. There is adequate site distance of Cherokee Road in both directions from the site driveway. The Public Works Department requests that 30 feet of right-of-way from the centerline of Cherokee Road be deeded to Butte County to allow for future expansion of this roadway. The Butte County Fire Department, as the lessee, cannot deed the land to the County - only the landowner can deed the land. Staff does not recommend that the project be conditioned to include the Public Works request to deed the 30 -foot right-of-way. ACTIONS FOR CONSIDERATION: Staff recommends that the Planning Commission take the following actions: Adopt a Negative Declaration regarding environmental impacts as detailed in this agenda report with the following findings and authorize the Chair to sign. A. Find that an Initial Study was completed in compliance with the California Environmental Quality Act, that said study did not identify any potential significant environmental effects, and that a Negative Declaration is proposed. B. Find that the Planning Commission has considered the proposed Negative Declaration, together with comments received during the public review process. C. Find, on the basis of the whole record before the Planning Commission, including the Initial Study and any comments received, that there is no substantial evidence that the Butte County Fire Department Use Permit project will have a significant effect on the environment. D. Find that the proposed Negative Declaration reflects the independent judgement and analysis of the County, which is the lead agency. II. The design of the proposed project improvements will not cause environmental damage to fish and wildlife or their habitat, and a "de minimus" exemption regarding impact to fish and wildlife or their habitat is approved because the .5 acre lease area has already been cleared and graded and does not contain any sensitive habitats. The collection of fees pursuant to Fish and Game Code Section 711.4(d)(3) and 14 CCR 753.5. is not required. III. The proposed volunteer fire station will not cause a significant increase in noise, light, or vehicle traffic. 2. The proposed volunteer fire station will decrease Fire Department response times. B. The project is consistent with the Unclassified zone which allows a public use with a Use Permit, and is consistent with the Agricultural -Residential General Plan land use designation which allows a public use as a Secondary Use. Building permits shall be obtained for the fire station. Plans shall be prepared by a licensed or registered architect or engineer authorized to practice in the State of California. The structure shall be designed in accordance with the 1998 California Building Code and shall meet the requirements of the Essential Services Building Act. A septic permit shall be obtained prior to installation of a bathroom. 4. Construction, installation or development of structures or facilities on the parcels/lots shall comply with the latest California Fire Safe Regulations, (Public Resources Code 4290), and all other applicable State and County codes, ordinances and regulations in effect at the time of application for improvement permits. The project may result in a very minor increase in vehicle emissions in the project area due to the vehicle trips generated by volunteer firefighters driving to and from the site, and by the two fire trucks stationed at the site. Some fugitive dust emissions may occur during site development, but it is not expected to be significant because very little grading will be necessary due to the level topography of the lease area. A condition of the project requires that measures be taken to prevent fugitive dust emissions during site development activities. The Butte County Air Quality Management District requests that measures, such as site and driveway watering and/or use of other acceptable soil palliatives, be incorporated during development activities on the site. A condition of project approval will require that measures be taken to prevent fugitive dust emissions during development activities. d. No sensitive receptors, such as schools or hospitals, are located near the project site. e. The project will not create any odors. After the fire station is constructed, the only noises that will be generated will be from the occasional arrival and departure of vehicles belonging to the volunteer firefighters, and from the arrival and departure of the fire trucks. Fire trucks departing the site on an emergency run may have their sirens on, which may cause an impact to nearby residents. The applicant states that sirens are not normally used when departing a station in a rural area. The number of emergency runs is expected to be limited due to the rural nature of the area served by the proposed fire station, with approximately 30 to 50 runs per year. Due to the low number of emergency runs, and because the sirens are not normally used, the noise from the any use of the sirens is not expected to create a significant impact to residents in the project area. e. - f. License. Subject to the provisions hereof, Licensor hereby grants License to Licensee to construct, reconstruct, maintain and use a Fire Station hereinafter referred to as "facility", upon the hereinafter described property of Licensor, herein referred to as "premises", in the County of Butte, State of California: 1/2 acre of the Southwest corner of Licensor's property described as Assessor's Parcel # 041-50-0-010-0 in the County of Butte, Township 21 North, Range 4 East South half of the North half of the South half of the Southeast quarter of Section 28 2. Term. The term of this License is for fifty years (50) from July 27, 1993 to July 27, 2043 ; provided, however, that notwithstanding the foregoing, Licensee may terminate this agreement at any time by giving Licensor sixty (60) days notice. 3. Rent. Licensee agrees to pay to Licensor as rent, at 36 Crystal Pines Rd., Oroville, CA 95965 the sum of $1.00 per year, in advance. 4. Taxes. Licensee shall pay as additional rent, before they become delinquent, all taxes and assessments imposed on the premises by reason of Licensee's activities or by reason of the facility or any improvement or personal property located on the premises by or on behalf of Licensee. Licensor may pay such taxes or assessments, and such payments will be repaid by Licensee on demand. Licensor shall have a lien on the - 1 - facility and any other Licensee -owned improvements as security for repayment of said amount. In addition, Licensee shall pay, as additional rent, any privilege, sales, gross income or other tax (other than tax on net income) imposed on or measure by rents to be paid by Licensee hereunder. 5. Use. A. Qualifications on Use. Licensee shall neither use nor permit any use of the premises for any purpose other than that set forth in Section 1 hereof. This License is subject to all easements, leases, liens, conditions, restrictions, encumbrances and claims of title which may affect the premises. Licensee accepts the premises (including, without limitation, Licensor -owned improvements), if any, in their present conditions and without any representation or warranty by Licensor as to the condition of such premises or improvements, and Licensor shall not be responsible for any defect or change of conditions in the premises or such improvements, any damage occurring thereto or for the existence of any violation of any municipal, county, state or federal law, order, rule, regulation or ordinance. Licensee shall not (1) prospect for minerals, including petroleum and natural gas, upon, within or underlying the premises, (2) mine or remove any minerals, if found, (3) quarry or remove stone therefrom, (4) commit any waste thereon, or (5) permit others to commit any of said acts. Licensee shall not do or suffer to be done in or upon said premises any act or thing which is or may be a nuisance. Licensee shall not use or permit others to use the premises for any unlawful or immoral purposes. The premises shall not be used for displaying signs and notices other than those connected with the use of the premises contemplated by this License. B. Maintenance and Repair. Licensee shall, at its expense and to the satisfaction of Licensor, keep and maintain the premises, the facility and any other improvements in good order and repair and in a neat and safe condition, and promptly make all repairs and replacements that may become necessary to the premises or the facility or other improvement or appurtenances thereto, whether structural or nonstructural, ordinary or extraordinary. Licensee or Licensor's agents, representatives or employees shall have the right, at reasonable times, to enter the premises for the purposes of inspecting, posting of notices of nonresponsibility, determining whether agreements in this License are being complied with, maintaining, repairing or altering the land, or showing the premises to prospective lessees, licensees, purchasers, mortgagees -2- 0 .• or beneficiaries under deeds of trust. C. Construction, Alterations and Liens. Licensee shall construct, reconstruct, maintain and operate the facility'in a good, safe and workmanlike manner consistent with he use made of said premises. Licensor shall have the right to post notices of nonresponsibility upon the premises, and to otherwise notify, actually or constructively, any entity or persons supplying services or materials to the premises that Licensor is not responsible of the cost thereof. Licensee covenants and agrees to hold Licensor and the premises harmless from any mechanic's or materialmen's liens claimed by any person, firm or corporation employed by Licensee. In the event of the filing of any such lien, Licensee shall cause such lien to be released within 5 days after Licensor's written notice to do so. Licensee shall indemnify an*d defend Licensor against all liability, cost and expense (including attorney fees) incurred by Licensor as a result of any such lien. 6. Utilities. Licensee agrees to pay all water service charges and water standby charges on, or assessed against, the premises during the term of this License. Licensee agrees to pay for all utilities installed at Licensee's request and for all utility services furnished to Licensee on the premises. 7. Indemnification. A. General. Licensee agrees to release, indemnify. and defend Licensor harmless from and against all liability, cost and expense (including, without limitation, attorneys' fees in addition to costs of suit and judgment) for loss of or damage to any property or loss of the use thereof or for injury to or death of any person when arising or resulting from: 1) The use of the premises or the facility or improvements by Licensee, its agents, employees, or invitees or 2) Licensee's breach of any provision of this license. -3- i 0 B. Environmental Impairment Licensee shall, at its expense,comply with all applicable laws, regulations, rules and orders, regardless of when they become or became effective, including without limitation those relating to health, safety, noise, environmental protection, waste disposal, and water and air quality, and furnish satisfactory evidence of such compliance to Licensor upon request. Should any discharge, leakage, spillage, emission, or pollution of any type occur upon that portion of the premises the subject of this license which is the result of Licensee's acts of negligence, Licensee, at its expense, shall be obligated to clean the premises to the satisfaction of Licensor and any governmental body having jurisdiction thereover. Licensee agrees to indemnify, hold harmless and defend Licensor against all liability, cost and expense (including without limitation attorneys' fees) incurred by Licensor as a result of leakage, spillage, emission or pollution due to Licensee's use and occupancy, unless such liability, cost or expense is proximately caused by the active negligence of Licensor. 8. Destruction of Facility or Premises. If all or part of the facility or premises are damaged or destroyed by fire or other peril, Licensee shall, without abatement in rent, restore the facility and/or premises to their condition immediately prior to such fire or other peril unless, within fifteen (15) days after such fire or peril, Licensee has given Licensor written notice of its desire to terminate this license, effective on the date of such notice. If Licensee so elects to terminate this license, the provisions of Section 10 shall apply. 9. Condemnation. In the event all or any portion of the premises of Licensor shall be taken or condemned for public use (including conveyance by deed in lieu of or in settlement of condemnation proceedings), this license shall terminate on the sooner of the order of possession or the date of the final order of condemnation. Licensee shall receive compensation only for the taking and damaging of Licensee's improvements. Any other compensation or damages arising out of such taking or condemnation awarded to Licensee shall be assigned by Licensee to Licensor. -4- • 10: termination or Expiration. A. General. Termination or expiration of this license shall not release either party from liability resulting from an event which occurred prior to such termination or expiration. If Licensor terminates this license for a reason other than Licensee's default, Licensor shall, upon request, refund rent which has been paid and which is allocable to the period after termination (if more than $25). B. Surrender of Premises. Upon termination of this license, Licensee shall discontinue the use of the facility and, within sixty (60) days, remove the facility and all otRer personal property of Licensee from the premises of Licensor. Licensee shall restore said premises as nearly as possible to the condition in which they existed prior to the construction of said facility. Property of Licensee not removed from said premises within sixty (60) days after the termination of this agreement shall become the property of Licensor. Licensee agrees to reimburse Licensor for the cost and expense incurred by Licensor in restoration of the premises and disposing of said property of Licensee not so removed. If Licensee fails to surrender possession of the premises upon termination of this License (or expiration if Licensor does not consent to renewal) Licensor shall have the right, to the extent permitted by law, to reenter the premises and remove Licensee and any person or entity claiming through Licensee from the premises. 11. Default. Licensee shall be in default under this license if Licensee fails or refuses to pay rent or any other amount when due or if Licensee fails or refuses to perform any other covenant or condition. BACKGROUND Frank and Jeanette Fowler have offered one half acre of land in the community of Cherokee to the Butte County Fire Department for use as a fire station. The site is ideally located adjacent to Cherokee Road (parcel map attached). The Fowlers wrote a letter donating the site(attached) but a more formal agreement is needed to protect all parties. The Agreement for Fire Station Use was approved by David McClain of the County Counsel's Office. His memo is attached and his recommended changes were made. The Agreement provides the Fire Department with one half acre of land for use for a period of SO years. The County agrees, if approved, to pay the Fowlers $1.00 (one dollar) each year for the life of the agreement. Terms of withdrawal and site restoration are included. The cost of fire station construction will be funded through donations and fund raising. In June of 1993, Butte County Fire Department ran a title search on the parcel and found there to be no encumbrances of liens. All electrical and mechanical equipment, including but not limited to air conditioning units, electrical boxes, transformers, and backflow preventers, shall be screened from public view. Screening shall be to the satisfaction of the Planning Division and in compliance with the Building Division. K. LANDSCAPING A detailed landscape and irrigation plan consistent with the project site plan shall be submitted to and approved by the Planning Division prior to the issuance of building permits. A plan of the existing on-site mature trees, located in any area proposed for buildings and vehicular access, shall be provided to and approved by the Planning Division prior to the issuance of building permits and/or prior to grading or vegetation removal. The applicant shall minimize the removal of mature trees, where possible. A mature tree shall be defined as a tree with a trunk measuring 4 inches in diameter, 4 feet from ground level. Mature trees removed shall be replaced by planting replacement trees of equal number and not less than _ gallon size. All landscaped areas shall be maintained in a healthy and thriving condition, free from weeds, trash, and debris, during the term of this permit. All graded slopes, over 5 feet in height, or on slopes greater than _%, shall be seeded, planted, mulched or hydroseeded or otherwise protected to prevent erosion. A permanent irrigation system shall be installed for non-native vegetation. A one year Faithful Performance bond shall be posted to guarantee installation and established growth. 5. In parking lots of commercial and industrial development, trees of not less than 15 gallon size shall be provided to reduce heat gain from the paved surface and to soften the visual impact of the paved area. Such trees shall be planted at a minimum density of one tree every three parking spaces. Tree species shall be approved by the Planning Division prior to planting. 6. Prior to the commencement of grading and/or construction activity, all individual or groups of oak trees which are to be retained as part of the project, shall be fully protected through the use of root protection zones (RPZ). During construction, RPZs shall be established using protective fencing enclosing an area with a radius 1.5 times the distance from the trunk to the dripline. Within this protective buffer, no grading, trenching, fill, or vegetation alteration of any kind shall be allowed. The RPZs shall be maintained after the completion of construction in order to continue to protect the oak trees, but the fencing shall be removed. L. GRADING 1. During construction, should any archaeological artifacts be discovered, the Planning Division shall be notified immediately, and all work shall cease until a qualified archaeologist has examined the artifacts and the site and submitted his or her findings to the Planning Division, and recommended clearance to continue. Recommencement of construction shall be upon the approval of the Planning Division. Archaeological artifacts are defined as follows: 2. Prior to any clearing, grading and/or construction in a Federal or State identified 100 year floodplain and/or streambed the following entitlements must be obtained: a California Fish and Game 1604 Streambed Alteration permit and an Army Corps 404 permit or exemption certificate.. M. ADDITIONAL APPROVALS 1. Prior to the issuance of building permits payment of the North Oroville/Thermalito Traffic Impact Fees shall be made. 2. Prior to the issuance of a building permit for each new or additional living unit the applicant shall execute the Oroville Area Traffic Mitigation Fee Agreement and pay the established fee. 3. Prior to the issuance of the Use Permit, to insure the maintenance and continuance of the orchard or other agricultural use of the property, the property owner shall enter into the County approved Orchard Management Agreement. The agreement shall terminate in 10 years or upon a rezoning of the parcel/lot to a zone other than A-5 through A-160. The agreement shall be recorded and recording fees paid by the applicant. 4. Approval of this request shall not waive compliance with all sections of the Zoning Ordinance and all other applicable State and County laws and regulations in effect at the time of building permit application. This Conditional Use Permit is granted for a period of month(s) at the end of which time it shall expire (unless the approving authority has held a hearing.thereon and granted an extension. In connection with such an extension the approving authority may add, change, or delete conditions. 6. Approval of this Conditional Use Permit shall become null and void if the use for which it has been granted is not established within two calendar year from the date of approval. No formal cancellation or revocation action by the County will be necessary. The developer shall display a current County Zoning and County Land Use Map in the sales office at all times, and/or suitable alternatives. 8. Approval of this application does not become effective unless, prior to 4:00 p.m. on _, 199_, the applicant shall sign and file with the Department of Development Services an Indemnity Agreement in a form satisfactory to the County Counsel. 9. Prior to the issuance of a building permit or prior to the issuance of a Use Permit for a Mobile Home Park the Sheriff Facilities Impact Fee shall be paid, pursuant to the provisions of Chapter 3, Article II of the Butte County Code. PROJECT DESCRIPTION/SITE CHARACTERISTICS: The proposed fire station will be a galvanized metal building and will hold one water tender vehicle and one fire engine. The building will not initially be connected to electrical service, and will not contain a bathroom. These amenities, along with an office, will be added later when funding becomes available. The fire station use will not involve the storage of any hazardous materials or fuels. The station will normally be unmanned, with volunteer firefighters only coming to the site to pick up the fire vehicles to respond to an emergency. Maintenance of vehicles will not occur on the site. In 1993, the County signed a 50 -year agreement, which runs with the land, that allows the. County to place a fire station on the site. The agreement allows the use of .5 acres of land located on the southwestern corner of the property for $1.00 per year. . ■ BUTTE COUNTY PLANNING COMMISSION AGENDA REPORT ■ PAGE 1 ■ The proposed fire station will provide fire protection services and emergency aid to the Cherokee/Table Mountain area, encompassing an area of 44 square miles. The applicant estimates that the proposed fire station will respond to emergencies 30 to 50 times per year. Currently, fire protection services for the Cherokee/Table Mountain area must come from fire stations at Jarbo Gap, Oroville, and Durham. Leasing of land usually requires that a parcel map be approved and recorded. However, a parcel map is not required to be filed for this project because conveyance of land to a public entity is not considered a division of land (California Subdivision Map Act, Section 6426.5). Additionally, Section 66428(a)(2) states that a parcel map is not required when land is conveyed to a government agency or public entity. . The project site is zoned Unclassified and has a General Plan Land Use designation of Agricultural - Residential. Surrounding parcels range in size from 1 to 42 acres. Land use on surrounding parcels is predominantly rural residential. The Cherokee Cemetery is located just to the west of the site. The project parcel is 12.68 acres in size, but the project will be contained within the .5 -acre lease area. The .5 -acre lease area has been cleared of most vegetation and has been rough graded. The lease area is mostly level. The lease area is developed with a large water storage tank and a well. A small memorial to a firefighter is also located on the lease area. Vegetation on the lease area consists of grasses, some brush, and a few scattered trees along the boundaries. No drainages are found on the site. The site is located in an area that has a very high fire hazard. ANALYSIS: The proposed fire station is a public use. The Unclassified zone allows a public use with a Use Permit (Butte County Code Section 24-230(c)(5). The Agricultural -Residential General Plan land use designation allows a public use as a Secondary Use. The proposed volunteer fire station will not cause a significant increase in noise, light, or vehicle traffic in the project area. Construction activities on the site will generate noise, but is not expected to be significant. After the fire station is constructed, the only noises that will be generated will be from the occasional arrival and departure of vehicles belonging to the volunteer firefighters, and from the arrival and departure of the fire trucks. Fire trucks departing the site on an emergency run may have their sirens on, which may cause a temporary impact to nearby residents. The applicant states that sirens are not normally used when departing a station in a rural area. The number of emergency runs is expected to be limited due to the rural nature of the area served by the proposed fire station. Due to the low number of emergency runs, and because the sirens are not normally used, the noise from any use of the sirens is not expected to create a significant impact to residents in the project area. ■ BUTTE COUNTY PLANNING COMMISSION AGENDA REPORT ■ PAGE 2 ■ The project will generate a few additional vehicle trips on Cherokee Road during site development, but this increase is not expected to cause. an impact to vehicle circulation. After construction of the fire station, no impacts are expected to vehicle circulation due to the infrequent use of the proposed volunteer fire station. There is adequate site distance of Cherokee Road in both directions from the site driveway. The Public Works Department requests that 30 feet of right-of-way from the centerline of Cherokee Road be deeded to Butte County to allow for future expansion of this roadway. The Butte County Fire Department, as the lessee, cannot deed the land to the County - only the landowner can deed the land. Staff does not recommend that the project be conditioned to include the Public Works request to deed the 30 -foot right-of-way. ACTIONS FOR CONSIDERATION: Staff recommends that the Planning Commission take the following actions: I. Adopt a Negative Declaration regarding environmental impacts as detailed in this agenda report with the following findings and authorize the Chair to sign. A. Find that an Initial Study was completed in compliance with the California Environmental Quality Act, that said study did not identify'any potential significant environmental effects, and that a Negative Declaration is proposed. B. Find that the Planning Commission has considered the proposed Negative Declaration, together with comments received during the public review process. C. Find, on the basis of the whole record before the Planning Commission, including the Initial Study and any comments received, that there is no substantial evidence that the Butte County Fire Department Use Permit project will have a significant effect on the environment. D. Find that the proposed Negative Declaration reflects the independent judgement and analysis of the County, which is the lead agency. II. The design of the proposed project improvements will not cause environmental damage to fish and wildlife or their habitat, and a "de minimus" exemption regarding impact to fish and wildlife or their habitat is approved because the .5 acre lease area has already been cleared and graded and does not contain any sensitive habitats. The collection of fees pursuant to Fish and Game Code Section 711.4(d)(3) and 14 CCR 753.5. is not required. III. Approve Use Permit 00-11 for the Butte County Fire Department, subject to the conditions found in Exhibit A, with the following findings: ■ BUTTE COUNTY PLANNING COMMISSION AGENDA REPORT m PAGE 3 ■ A. The proposed use of the property will not impair the integrity and character of the zone in which the land lies, and that the use would not be unreasonably incompatible with, or injurious to, surrounding property, or detrimental to the health, safety and general welfare of the persons residing or working in the neighborhood, or to the general health, welfare and safety of the County because: 1. The proposed volunteer fire station will not cause a significant increase in noise, light, or vehicle traffic. 2. The proposed volunteer fire station does not involve the use of any hazardous materials or the storage of fuels. 3. No vehicle repair will occur on the site. 4. The proposed volunteer fire station will decrease Fire Department response times. B. The project is consistent with the Unclassified zone which allows a public use with a Use Permit, and is consistent with the Agricultural -Residential General Plan land use designation which allows a public use as a Secondary Use. Unless otherwise provided for in a special condition to this use permit, all conditions must be completed prior to or concurrently with the establishment of the granted use. The use granted by this permit must be established within 24 months of the delivery of the countersigned permit to the Permittee. 3. Minor changes may be approved administratively by the Directors of Development Services, Environmental Health, or Public Works upon receipt of a substantiated written request by the applicant, or their respective designee. Prior to such approval, verification shall be made by each Department or Division that the modification is consistent with the application, fees paid and environmental determination as conditionally approved. Changes deemed to be major or significant in nature shall require a formal application for amendment. 4. If any use for which a use permit has been granted is not established within two years of the date of receipt of the countersigned permit by the Permittee, the permit shall become null and void and reapplication and a new permit shall be required to establish the use. The terms and conditions of this permit shall run with the land and shall be binding upon and be to the benefit of the heirs, legal representatives, successors, and assigns of the Permittee. Said site plan is on file in the Planning Division, is identified as "Exhibit E" and dated March 2, 2000, and is incorporated herein by this reference. 2. Building permits shall be obtained for the fire station. Plans shall be prepared by a licensed or registered architect or engineer authorized to practice in the State of California. The structure shall be designed in accordance with the 1998 California Building Code and shall meet the requirements of the Essential Services Building Act. 3. A septic permit shall be obtained prior to installation of a bathroom. 4. Construction, installation or development of structures or facilities on the parcels/lots shall comply with the latest California Fire Safe Regulations, (Public Resources Code 4290), and all other applicable State and County codes, ordinances and regulations in effect at the time of application for improvement permits. Building identification and/or addresses shall be installed in conformance with Public Resources Code 4290 and shall be posted at the beginning of building construction and maintained continuously thereafter. , 6. Prior to the issuance of building permits obtain an encroachment permit for a public road approach and construct it to County standards providing adequate sight distance, as specified in County Improvement Standards. 7. Prior to the issuance of building permits a plan for a permanent solution for drainage shall be submitted to and approved by the Department of Public Works. The drainage plans shall specify how drainage waters shall be detained on-site and/or conveyed to the nearest natural or publicly maintained drainage channel or facility, and shall provide that there shall be no increase in the peak flow runoff to said channel or facility. 8. Applicant shall implement measures 'to prevent fugitive dust emissions during all construction activities. The project will allow the construction of a 1,913 square foot structure to be used for a volunteer fire station. The structure will be a galvanized metal building. A condition of the project requires that all outside lighting be fully shielded and contained on-site to prevent light from causing an impact on adjacent properties. The Conservation Element's Expansive Soils Map indicates that the project site has a low expansive soil designation. No impact is anticipated. e. Sewage disposal will be handled by an on-site septic system. The Butte County Environmental Health Department inspected the soils on the site and indicates that the soils are adequate to support a septic system for the proposed fire station. After the fire station is constructed, the only noises that will be generated will be from the occasional arrival and departure of vehicles belonging to the volunteer firefighters, and from the arrival and departure of the fire trucks. Fire trucks departing the site on an emergency run may have their sirens on, which may cause an impact to nearby residents. The applicant states that sirens are not normally used when departing a station in a rural area. The number of emergency runs is expected to be limited due to the rural nature of the area served by the proposed fire station, with approximately 30 to 50 runs per year. Due to the low number of emergency runs, and because the sirens are not normally used, the noise from the any use of the sirens is not expected to create a significant impact to residents in the project area. • e. - f. The project is not located in the vicinity of an airstrip or within an airport land use plan. No impact will be incurred. Mitigation Measure: None required. 12. POPULATION AND HOUSING.
