The property is located on the west side of West Biggs Gridley Road, between Peach Street and Spruce Street, at 1683, West Biggs Gridley Road, Gridley. ' A_ PN 022-260-006 (SB) (UP 01-01) Mr. Wilson gave a brief summary of the project. The hearing was opened to the public No one was present to speak on this project. The hearing was closed. It was moved by Commissioner Mooney, seconded by Commissioner Lambert, and unanimously carried to approve the Use Permit for Frank M. Stenzel subject to the findings and conditions listed below. I. Determine the project to be Categorically Exempt from environmental review under Section 15303(a) of the California Environmental Quality Act. This section states that the construction of a second dwelling unit in a residential zone is exempt from environmental review. II. Approve Use Permit 01-01 for Frank M. Stenzel, subject to the conditions found in Exhibit A and subject to the following findings: ' A. The proposed use of the property will not impair the integrity'and character of the zone in which the land lies, and that the use would not be unreasonably incompatible with, or injurious to, surrounding property, or detrimental to the health, safety and general welfare of the persons residing or working in the neighborhood, or to the general health, welfare and safety of the County because: The proposed permanent second dwelling unit will not cause an increase in noise, odors, dust, or vehicle traffic. 2. There is adequate area on the project site for the new leachfield required for the proposed permanent second dwelling unit. B. The project is'consistent with the Medium Density General Plan land use designation, which allows multiple dwelling structures as Primary Uses. The project will not exceed the density allowed by the Medium Density General Plan land use designation. C. The project is consistent with the density requirements of the S -R zone, which allows a minimum parcel size of 6,500 square feet when connected to a public sewer system. D. The project is consistent with the policies of the Gridley Urban Reserve because the project will result in a density of approximately one dwelling unit per ten acres. E. The project is consistent with a proposed rezone of the site to SR -5 and with proposed changes to the policies of the Gridley Urban Reserve because the project will result in a density of approximately, one dwelling unit per ten acres. ■ BUTTE COUNTY PLANNING COMMISSION ■ MINUTES ■ OCTOBER 26, 2000 ■ F. The temporary manufactured home to be converted into a permanent second dwelling unit is a 1999 unit, which is consistent with the requirements of the S -R zone. Conditions of Approval: Planning Division: 1. Prior to issuance of the Use'Permit for the second dwelling unit, the property owner shall execute and record a covenant running with the land. A copy of the recorded covenant shall be submitted to the Planning Division and the Building Division. The covenant shall be on a form approved by the Department of Development Services and shall: (a) Stipulate the occupancy requirement of Condition 2, below. (b) Prohibit any land division, merger, or lot line adjustment that results in a parcel containing the two dwellings, which is less than twice the minimum parcel size requirement of the zone. (c) Stipulate that any land division proposing to place the dwellings on separate parcels must meet all the zoning and development requirements for dividing land in Butte County, including, but not limited to: lot size, lot configuration, septic requirements, and setback standards of the zone in which the parcel is located. (d) Stipulate that if all such zoning and development requirements cannot be met, the parcel shall not be divided. 2. The owner of the parcel or lot must occupy either the main dwelling or the Second Dwelling Unit. 3. Two (2) off-street parking spaces shall be provided for the Second Dwelling Unit. The spaces shall be in addition to the existing off-street parking requirements for the main dwelling unit. 4. The project site shall be developed in accordance with the approved project site plan and the conditions contained herein. Said site plan is on f le in the Planning Division, is identified as "Exhibit E", and is incorporated herein by this reference. Butte County Fire Department/CDF Building identification and/or addresses shall be installed in conformance with Public Resources Code 4290 and shall be posted at the beginning of building construction and maintained continuously thereafter. 6. Provide an all weather access to all structures. The access shall have a minimum 10 -foot width and 15 -foot vertical clearance, and be able to accommodate a 40,000 pound fire apparatus. Environmental Health Division 7. Prior to issuance of the Use Permit, applicant shall meet the requirements of the Butte County Environmental Health Division for the installation of septic systems. Other Conditions 8. Conditions of Approval: Planning Division: 1. Prior to issuance of the Use Permit for the second dwelling unit, the property owner shall —� execute and record a covenant running with the land. A copy of the recorded covenant shall be submitted to the Planning Division and the Building Division. The covenant shall be on a form approved by the Department of Development Services and shall: • (a) Stipulate the occupancy requirement of Condition 2, below. (b) Prohibit any land division, merger, or lot line adjustment that results in a parcel containing the two dwellings, which is less than twice the minimum parcel size requirement of the zone. (c) Stipulate that any land division proposing to place the dwellings on separate parcels must meet all the zoning and development requirements for dividing land in Butte County, including, but not limited to: lot size, lot configuration, septic requirements, and setback standards of the zone in which the parcel is located. (d) Stipulate that if all such zoning and development requirements cannot be met, the parcel shall not be divided. 2. PROJECT DESCRIPTION/SITE CHARACTERISTICS: This is an application for a Use Permit to convert a 1,146 square foot temporary manufactured home ("Aunt Minnie") to a permanent second dwelling unit. The existing temporary manufactured home, which is a 1999 model, was approved on August 20, 1999, with Administrative Permit 00-01. The occupants of the temporary manufactured home are the applicant's daughter, who has a temporary medical condition, and the daughter's family. After the applicant's daughter regains her health the temporary manufactured home must be removed from the site as required by Butte County Code. The project site is zoned S -R (Suburban Residential) and has a General Plan Land Use designation of Medium Density Residential. The site is developed with a two-story single family dwelling, the temporary manufactured home, a garage, a shop, a barn, and approximately three acres of pasture and fourteen acres of kiwi orchards. Additionally, a drainage ditch and a water canal traverse the property. The temporary manufactured home is located approximately 70 feet from the main dwelling unit. Access to. the two dwelling units is from West Biggs Gridley Road via a shared driveway. Sewage disposal for the two dwellings is handled by individual septic tanks and a shared ■ BUTTE COUNTY PLANNING COMMISSION AGENDA REPORT ■ PAGE I ■ leachfield. Water is obtained from an on-site well. The site is adjacent to the City of Gridley and is within the City of Gridley's Sphere of Influence, the Gridley Urban Area, and the Gridley Urban Reserve. The project site is located within the Gridley Urban Area and the proposed permanent second dwelling unit is subject to the provisions of Section 24-280(b) of the Second Dwelling Ordinance. Two of the provisions of this section require that a permanent second dwelling unit be attached to the main dwelling unit and that a second dwelling unit cannot exceed 640 square feet. The proposed second dwelling unit will not be attached to the main dwelling unit and exceeds the 640 square foot maximum size. Because the proposed permanent second dwelling unit does not meet these standards a Use Permit is required (Butte County Code Section 24-280(b)4). ANALYSIS: The project site is designated as Medium Density Residential by the Land Use Element Map of the General Plan, which allows a minimum net parcel size of 6,500 square feet and a maximum density of 13 units per acre. With the second dwelling unit, the project site will have a density of approximately one dwelling unit per ten acres, which is well within the density allowed by the General Plan. The project site is zoned S -R (Suburban Residential), which allows a minimum parcel size of 6,500 square feet when public sewer service is provided. The project will not exceed the density of the S -R zone. The area required for a parcel in the S -R zone when sewer service is not provided is determined by the area required for a septic system. Normally, the Butte County Environmental Health Division requires a parcel size of at least one acre when septic systems are utilized, with the actual parcel size determined by soil conditions, slope, and groundwater depth. The County is currently considering rezoning the project site from SR to SR -5 to prevent subdividing the site into urban -sized parcels until such time as adequate services are available and the need for conversion to urban residential is appropriate. Additionally, policy changes to the Gridley Urban Reserve are being considered to prevent the creation of parcels less than five acres. Public hearings on these proposed changes have not yet been scheduled. The approximate 10 -acre density of the site, with the proposed second dwelling, is consistent with the proposed SR -5 zone. There is sufficient distance between the main dwelling unit and the proposed second dwelling unit to place each unit on a separate five acre parcel. A condition of the project requires the applicant to record a covenant, which runs with the land, that prohibits any land division, merger, or lot line adjustment that results in a parcel containing the two dwellings, which is less than twice the minimum parcel size requirement of the zone. No impacts are expected to occur to the agricultural uses established on the site. The existing temporary manufactured home is located near the primary dwelling unit, and not in the kiwi orchard or the area used for pasture. The project will not cause an increase in vehicle traffic in the project area because the proposed second dwelling unit is already installed on the site. The only new construction needed to convert the temporary unit to a permanent second dwelling unit will be the installation of a leachfield and possibly a permanent foundation placed under the manufactured home (not required per the Building Division). ■ BUTTE COUNTY PLANNING COMMISSION AGENDA REPORT ■ PAGE 2 ■ Sewage disposal for the temporary manufactured home is handled by a septic tank and a leachfield shared with primary dwelling unit. The Butte County Environmental Health Division requires that a separate leachfield be installed for the proposed second dwelling unit. There is adequate area for a new leachfield on the project site. ACTIONS FOR CONSIDERATION: , Staff recommends that the Planning Commission take the following actions: I. Determine the project to be Categorically Exempt from environmental review under Section 15303(a) of the California Environmental Quality Act. This section states that the construction of a second dwelling unit in a residential zone is exempt from environmental review. II. Approve Use Permit 01-01 for Frank M. Stenzel; subject to the conditions found in Exhibit A and subject to the following findings: A. The proposed use of the property will not impair the integrity and character of the zone in which the land lies, and that the use would not be unreasonably incompatible with, or injurious to, surrounding property, or detrimental to the health, safety and general welfare of the persons residing or working in the neighborhood, or to the general health, welfare and safety of the County because: The proposed permanent second dwelling unit will not cause an increase in noise, odors, dust, or vehicle traffic. 2. There is adequate area on the project site for the new leachfield required for the proposed permanent second dwelling unit. B. The project is consistent with the Medium Density General Plan land use designation, which allows multiple dwelling structures as Primary Uses. 'The project will not exceed the density allowed by the Medium Density General Plan land use designation. C. The project is consistent with the density requirements of the S -R zone, which allows a minimum parcel size of 6,500 square feet when connected to a public sewer system. D. The project is consistent with the policies of the Gridley Urban Reserve because the project will result in a density of approximately one dwelling unit per ten acres. E. As a result of my daughter's illness with a brain virus that left her hospitalized for 6 months, her husband in nursing school, and . the care of their 2 year old daughter, we sought housing nearby our home in Gridley. Rentals were unacceptable, so we pursued a "modular' unit to be installed in our backyard. While commuting to the hospital daily, we purchased a 1999 model that was 26' by 46'. The Executive Homes personnel were very helpful and said, "Take care of your daughter. We will obtain all necessary permits and "paperwork". The home was installed in Aug. 1999 and in June 2000 we had it explained to us that this "Aunt Minnie" permit meant that the home would need to be removed when our daughter's health permitted her to move and her family no longer needed our care and assistance. After all the costs involved with the septic tank, electrical and gas installation, landscaping, fencing, sidewalk, and the projected cost of over $5,000 to move the home, we would like to retain it as a guest house, or move into it ourselves upon retirement. To help off -set the medical and housing costs, we may need to use it as a rental in the future. Our 20- acre parcel has been in the family for 4 generations. We would like to retain this building on our property. We would like to exercise our options to use this building at our discretion, which the "Aunt Minnie" permit does not allow. Parilo, Director of Development Services DATE: July 27, 1999 FILE: 00-01 PURPOSE: Administrative Permit on AP# 022-260-006 for a temporary second dwelling to be located at 1683 W. Biggs Gridley Rd., Gridley, CA, in the S -R (Suburban Residential) zone. PERMIT REQUIREMENTS: Approval for a temporary second dwelling is subject to the following requirements. 1. A mobile home certified under the 1974 National Mobile Home Construction and Safety Standards Act. Occupancy of the mobile home shall be limited to Mr. & Mrs. James Morton. An affidavit attesting to. the relationship of the involved parties was submitted with the permit application. Z. No refit is to be charged to the occupant of the mobile home. 3. The temporary mobile must meet the requirements of the Butte County Environmental Health Department for domestic water supply and sewage disposal. The granting of this permit does not remove the requirement of obtaining the appropriate permits from other Divisions, Departments or Districts. 4. The siting of the mobile home shall be exempt from the site requirements of the residential zoning district, except as required by Butte County Code Chapter 24, and the Butte County Code Chapter 28A- 5. The mobile home is declared to be a temporary use on the property, accessory to the primary unit, and shall not be placed on a permanent foundation. Additionally, a temporary mobile home shall not be permitted on a lot or parcel where there is an approved Second Unit. 6. The permit shall be granted for a term of two years. Extensions of the term for the permit, not exceeding one year for each extension, may be granted if the application for the extension is filed, with the Planning Division, within 60 calendar days prior to the date of expiration. 7. The mobile home shall be vacated upon expiration, or revocation, of the Permit and removed within one hundred twenty (120) days after expiration of the Permit. If it is not removed within one hundred twenty (120) days, the County shall remove said mobile home and store it at the owner's expense. 8. The Permit may be revoked if any of the terms or conditions of the Permit are violated or if any acts or omissions of the permittee in connection with the use authorized by said Permit constitute a public nuisance. 9.
