The Planning Division has six old projects that were deemed incomplete for various
reasons or were put on hold at the request of the applicant. These projects were received
in the years 1998 to 2001. No action has been taken by the applicants of these projects to
make their application complete or to give the Planning Division the go ahead to start
working on the project again. Letters were sent to each applicant and/or their
representative requesting they respond back to Planning Division staff as to how they
would like to proceed with their project. No written replies were received.
In order to close out these files, staff recommends that these six projects be denied
without prejudice. The project descriptions are provided below, along with a status of the
projects.
Michael Caprealian, Tentative Parcel Map to divide 21.52 acres into two parcels of
11.51 acres and 10.01 acres on property zoned FR -10 (Foothill Recreational — 10 acre
parcels). The property is located on the east side of Helltown Road, approximately two
miles north of Centerville. APN 011-400-039. File # TPM 00-12.
This project, which was received on February 23, 2000, was deemed incomplete
by the Environmental Health Division because test holes for soil testing were not
dug by the applicant. The areas where the test holes are required are not
accessible by a backhoe. A letter dated September 20, 2002, sent to the applicant
requesting the status of the project went unanswered. Another letter dated
January 31, 2003, sent to the applicant -also went unanswered. ' The
Environmental Health Division stated that they have had no recent contact with
applicant.
Staff spoke with the applicant who stated that the property owner who originated
this application, Gilbert Kinney, passed away several years ago. Janice Kinney
and the Estate of Gilbert Kinney sold the property in 2002.

The new owner of the project parcel, Grant Peterson, wrote a letter stating that
he would like the project to continue until he decides what to do. The letter is
attached to this memorandum. A copy of the letter was forwarded to County
Counsel for review.
Bryce M. Herndon, Certificate of Correction to change a map condition to delete the
mandatory home site locations on Lots 10, 22, 23, and 24 on property zoned "U"
(Unclassified), located on Walden Pound Road, west of Big Fir Road, Forbestown. APN
073-340-041, 042, 043, 044. File # COR 98-02.
This project, which was received on April 8, 1998, was deemed incomplete by the
Planning Division for errors and/or omissions in the application material
submitted with the project and because authorization from the California
Department of Fish and Game .to allow the proposed change was not received. A
letter dated September 24, 1999, sent to the applicant's representative requesting
status of the project went unanswered. Another letter dated January 31, 2003,
sent to the applicant's representative and to the applicant also went unanswered.
Champion. Christian School, Use Permit to expand an existing gymnasium at the
Champion Christian School from 5,400 sq. ft. to approximately 9,000 sq. ft. and to
increase the height of the ceiling from 20 feet to 30 feet, on property zoned P -Q (Public —
Quasi -Public), located on the north side of East Avenue, approximately 400 feet west of
Floral Avenue, at 1184 East Avenue (First Church of the Nazarene), Chico. APN 048-
300-049. File # UP 01-05.
This project, which was received on August 30, 2000, was put on hold at the
applicant's request on November 1, 2000, because the Environmental Health
Division required that the project site annex to the City of Chico or connect the
proposed upgraded facility to the City of Chico sewer system. A letter dated
January 31, 2003, sent to the church and to the church's representative went
unanswered. The Environmental Health Division stated that they have had no
recent contact with applicant.
Point BTA 79LLC (Silverbell), Minor Use Permit for collocating antennas at a height
of 70 feet on an existing 120 foot tower and connecting the antennas to
telecommunications equipment mounted to the wall within Suite 8 of the existing
adjacent building on property zoned C-2 (General Commercial), located at 3415
Silverbell Road, Suite 8, Chico. APN 007-390-001. File # MUP 02-06.
This project, which was received on August 3, 2001, was put on hold at the
applicant's representative's request. A letter dated August 19, 2002 sent to the
applicant and to the applicant's representative went unanswered. Another letter
dated January 31, 2003, also went unanswered. Since this project was submitted,
the tower on which the proposed antennas would be placed has been modified by
other antennas, and the site plan and radio frequency analysis submitted for this
project would have to be revised to reflect the changes to the tower.

Point BTA 79 LLC (Nord Avenue), Minor Use Permit to collocate six panel antennas
on an existing monopole tower at a height of 98 feet and to connect the antennas to
telecommunications equipment within an existing building. The antennas will be used
for digital cellular communications systems on property zoned C-1 (Light Commercial).
The property is located within a 1.9 acre parcel northeast of and adjacent to State Route
32 (Nord Avenue), approximately'/4 mile northwest of Sacramento Avenue, Chico. APN
043-200-005. File # MUP 02-07.
This project, which was received on August 3, 2001, was put on hold at the
applicant's representative's request. A letter dated August 19, 2002 sent to the
applicant and to the applicant's representative went unanswered. Another letter
dated January 31, 2003, also went unanswered. Since this project was submitted,
the monopole on which the proposed antennas would be placed has been modified
by other antennas, and the site plan and radio-frequency analysis submitted for
this project would have to be revised to reflect the changes to the tower.
Thomas Reed, Tentative Parcel Map dividing a 40 acre parcel into two parcels of 15
acres and 25 acres each on property zoned SR -3 (Suburban Residential — 3 acre parcels)
and M-1 (Light Industrial). The property is located on the east side of Cohasset Road
immediately south of Plummers Lane, north of Chico. APN 048-010-066 and 067. File
# TPM 99-17.
This project, which was received on June 7, 1999, was deemed incomplete by the
Environmental Health Division because winter groundwater monitoring is
required. The required tests have not been completed. A letter dated September
20, 2002, requesting status of the project and sent to the applicant's engineer and
the applicant went unanswered. Another letter dated January 31, 2003, to these
two individuals also went unanswered. The Environmental Health Division stated
that they have had no recent contact with applicant.
All of the above projects have been around for a long period of time and the applicants
are not actively seeking getting their projects to hearing. Denying these projects without
prejudice would allow Planning Division staff to close out the projects, but still allow the
applicants to resubmit their projects at any time. A new application would have to be
submitted, along with the normal processing fee, if an applicant wanted to resubmit their
application.
As noted above, letters were sent to the applicants and/or their representatives requesting
the status of the project. No written replies were received. Additionally, the applicants
and/or their representatives were notified of the August 14, 2003, Planning Commission
meeting. Public notices of the meeting were placed in the appropriate newspapers and
notices were sent to property owners in the project areas.

Recommendation
Staff recommends that the Planning Commission take the following action:
I. Find that the denial of these projects is statutorily exempt from the requirements
of the California Environmental _Quality Act (CEQA) under Sections 15270(a)
and (b) of Title 14, California Code of Regulations, Chapter 3 (Guidelines for
Implementation of the California Environmental Quality Act). These sections
state that CEQA does not apply to projects for which a public agency rejects or
disapproves.
II. Deny the following projects without prejudice based upon the following findings:
a. Denial of these projects is for one or more of the following reasons:
1. The project was deemed incomplete by County staff due to errors
or omissions in the application materials submitted with the
proj ect;
2. The project was deemed incomplete by County staff because
required soil testing for on-site sewage disposal systems was not
completed;
3. The project was put on hold at the applicant's request and nothing
has been heard from the applicant in over a year or more.
b. The applicants of these projects have not made any attempt to go forward
with their projects.
C. The applicants of these projects were notified several times of their
project's status, but no written reply has been received from the
applicants.

APN 048-300-049: A consistency review for the expansion of a church gymnasium
facility located.on the north side of East Avenue between Ceres and Floral Avenues,
southeast of the Chico Municipal Airport. The current zoning is Public/Quasi-Public
(PQ) and the General Plan is Public.
FOR: Airport Land Use Commission Meeting of August 16, 2000
SUMMARY: Staff recommends AL UC find the project consistent with the 1978 Chico Municipal
Airport CL UP as amended on October 21, 1998, and December 29, 1999.
ANALYSIS: The project site is located southeast of the airport on the north side of East Avenue
between Ceonothus and Cactus Avenues. The property is in the unincorporated area, within the City
of Chico's sphere of influence. The General Plan and Zoning permit Public uses outright and permit
Quasi Public uses subject to a Use Permit. The full list of allowed uses are attached as Exhibit "C."
Approximately 3 acres of the 5.6 -acre site is presently developed as a church facility including
classrooms, multi-purpose room, and a gymnasium. The property owners are interested in expanding
the existing gymnasium from 5,400 square feet to 9,000 square feet. The expansion will make room
for a regulation size basketball court and improved spectator seating. The new structure will also
increase the ceiling height from 20 feet to 30 feet to accommodate volleyball matches. The applicant
has stated that the expansion will not result in more events being held in the gymnasium, but indicate
that the number of spectators may increase from a current level of approximately 120-150 to about
200.
The church facility was originally approved in 1965 and was constructed during the late 60's and early
70's. The building permit for the gymnasium was issued in 1971. In 1986, a Use Permit was
approved to allow an adult. daycare facility in a portion of the existing structure.
According to the 1999 Chico Airport Land Use Plan amendment, Safety Zone Map "6-1," the project
site is located in Safety Zone 7, Airport Area of Influence (refer to Exhibit E). The allowed density.
and development limitations are listed below.

Development in Safety Zone 7 is also subject to a number of conditions and criteria as follows:
Criterion "C": Caretaker residences are a compatible use within all CNEL ranges, provided
that they are ancillary to the primary use of a property, intended for the
purpose of property protection or maintenance, and subject to the condition
that all residential units be designed to limit intruding noise such that interior
noise levels do not exceed 45 CNEL, with windows closed, in any habitable
room.
Criterion "D": Measures to achieve an interior noise level of 45 CNEL must be incorporated
into the design and construction of portions of buildings where the public is
received, office areas, and other areas where people work or congregate.
Criterion "H": Communication Towers (Excluding airport related facilities):
Prohibited in all safety zones except Zone 7.
Free Standing Towers:
1. Alternative orange and white paint starting at 30 feet above the
ground.
2. Strobe lighting at the top of the tower and shielded from striking the
ground for one mile.
Towers with Guy Wires:
1. Starting at 30 feet above the ground:
a. Blinking lights along length of tower and guy wires at 20 foot
intervals.
b. Three feet in diameter orange safety markers attached at 20
foot intervals on tower and guy wires.
Criterion "I": Public and Quasi -Public:
Prohibited Uses: Churches, nursing care facilities, hospitals, colleges and universities,
elementary and secondary schools, child care facilities and similar aggregations of
people.
Under Criterion I, churches, schools, and similar aggregations of people are prohibited in Safety Zone
7, Airport Area of Influence. This criterion appears to conflict with the adopted table which states

that there is limitation on density in Safety Zone 7. Read literally, the 1999 CLUP amendment to the
1978 Chico Airport Environs Plan prohibits church facilities at the present location. However, the
church and gymnasium already exist and are a non -conforming use with respect to the CLUP.
Neither the 1978 Airport Environs Plan nor the 1999 CLUP amendment provides a guiding policy
to address the expansion or replacement of legally established, pre-existing, non -conforming uses.
The applicants have offered to utilize an enhanced structural design to increase the load capacity of
the roof purlins. This will provide an increased measure of impact resistance should an aviation -
related accident occur to the roof. The commission may wish to consider whether additional wall
reinforcement is appropriate given the proposed use.
Another mitigating factor is ascertaining that the events -related occupancy of the gymnasium will not
take place concurrently with either school or worship activities. This would help reduce the the
overall intensity of persons on the site.
Based on the fact that the use is already established on the site, the 1978 Airport Environs Plan and
the 1999 CLUP amendment are silent on the expansion of non -conforming uses, an enhanced building
design will be used to strengthen the roof, and the gymnasium will not be used for events concurrently
with either school or church activities, the subject application can be found consistent with the 1999
CLUP amendment. .
Consistency with the draft 2000 CLUP: Since the Commission appears to have reached some
consensus on the Draft 2000 CLUP, staff has included an analysis for a consistency finding relative
to the provisions of this Draft. At this time, only a preliminary review is possible along with the
understanding that the proposed plan is in a state of flux and may change significantly. The Draft
CLUP shows this parcel in Compatibility Zone "C" (Traffic Pattern Zone). For institutional and
commercial uses, the "C" zone allows an average intensity of up to 100 people per acre with a
maximum density of 300 people on a single'acre. However, some uses are still prohibited in Zone
C even though they meet the intensity criteria. Appendix "D" of the plan provides compatibility
guidelines for specific land uses. Churches are listed in this appendix are prohibited in this zone.
Additionally, expansion of a pre-existing non -conforming use, in size or intensity, is prohibited by
policy 2.4.4 b.2 of the Draft CLUP.
Airspace Protection and Safety: The topography of the site is generally level. The site elevation is
approximately 220 feet above sea level. The project site is located under the horizontal surface which
has an elevation of 388 feet above sea level. With approximately 168 feet between the ground and
horizontal surface, there should not be an airspace conflict for a 35 foot high structure. If approved,
the execution of an avigation easement is recommended to protect future airport operations.
The 1978 CLUP for the Chico Municipal Airport, as amended on October 21, 1998, contains
diagrams which depict the locations of potential aircraft -related accidents for the facility based on
general accident scatter information presented in the 1993 Airport Land Use Planning Handbook
(refer to Exhibit D - CIC -17). The highest concentration of both departure- and arrival -related
aircraft accidents takes place within the Runway Protection Zone and Approach Surface. Due to the

project sites location in an overflight zone, approximately 10,500 feet away from the southerly end
of runway 31R, the risk of aircraft -related accidents is not considered significant.
Environmental Documentation: No environmental documentation has been prepared for this project.
RECONEWENDATION: Staff recommends that the Butte County Airport Land Use Commission
find ALUC File No. A00-06 (Champion Christian School- Expansion of a church gymnasium from
5,400 square feet to 9,000 square feet, APN 048-300-049) consistent with the 1978 Comprehensive
Land Use Plan for the Chico Municipal Airport, as amended 'on October 21, 1998, and December 29,
1999.

CONSISTENCY FINDINGS FOR:

The Airport Land Use Commission has prepared.the following findings based on data contained in
the 1978 Comprehensive Land Use Plan (CLUP) for the Chico Municipal Airport, as amended on
October 21; 1998, and December 29, 1999; the 1993 Airport Land Use Planning Handbook; and the
Butte County Airport Facilities Manual. These data are based on the findings of a number of studies,
documents, and reports generated by individuals, firms, and agencies recognized as having expertise
in the field of Airport Land Use Planning and land use compatibility (refer to Exhibit B, List of
References).
The following findings have been prepared at the direction of the ALUC and are for the consideration
of the Lead Agency (County of Butte) when making a decision on the project.
SECTION 1: ENVIRONMENTAL FINDINGS
A. No environmental documentation was submitted at the time of project review
SECTION 2: PROJECT REQUIREMENTS FOR CONSISTENCY
A. The proposed project will be consistent with the 1978 Comprehensive Land
Use Plan (CLUP) for the Chico Municipal Airport, as amended on October
21, 1998, and December 29, 1999, if the requirements in Section 3 are applied
as conditions of the building permit or Use Permit.
B. Approval of the project without implementation of the requirements in
Section 3 would necessitate the adoption of Overriding Findings by a 2/3 vote
of the governing body. Overriding Findings by the governing body can only
be made based on substantiated facts and must be supported by new
substantial factual evidence introduced into the public record that the
proposed action is consistent with the State Aeronautics Act as stated in
Section 21670. Overriding Findings cannot be adopted as matters of opinion,
heresay, or upon the unsubstantiated fears and desires of the governing body.
SECTION 3: PROJECT FINDINGS
According to the newly adopted Chico Airport Environs Plan, Safety Zone Map "6-
1", the project site is located within the Airport Area of Influence, Safety Zone 7, with
restrictions as follows:

1. Based on the fact that the use is.already established on the
site, the 1978 Airport Environs Plan and the 1999 CLUP
amendment are silent on the expansion of non -conforming
uses, an enhanced building design will be used to strengthen
the roof, and the gymnasium will not be used for events
concurrently with either school or church activities, the subject
application can be found consistent with the 1999 amendment,
subject to the conditions below:
a. The structural design shall incorporate methods to
increase the roof purlin load capacity to provide a
measure of impact resistance.
b. Either as a condition of a Use Permit or prior to the
issuance of a Building Permit, the property owner shall
sign an avigation easement granting the City of Chico
the right of continued use of the Chico Municipal
Airport in the airspace above the subject parcel and
acknowledging any and all existing or potential airport
operational impacts.
B. Airspace Protection
1. The Commission finds that, due to the topography of the
project, there are no transitional surface problems. The
subject property is located slightly lower than the airport
surface and there is approximately 168 feet between the
ground level and the horizontal surface. Approach surfaces
would not be affected due to topography or future
development.
C. Safety
Accident scatter information adopted as part of the October
21, 1998, . Chico Municipal Airport CLUP Amendment,
Exhibit D (Hodges and Shutt -1993 and UC -Berkeley,
Institute of Transportation Studies - 1993) indicates that the
highest concentration of both departure- and arrival -related
aircraft accidents takes place within the Runway Protection
Zone and Approach Surface, off the ends of the runway and
on either side of the runway. Due to the project site's location
approximately 10,500 feet beyond the end of runway 31R,
there is only a very slight likelihood for aircraft -related
accidents to occur within the project boundary. Conditions.

accomplished in a manner that reduces the hazards with

Champion Christian Schoot is proposing to expand its gymnasium facility from its currca sin of 5400 sE to
a building of approximately 9000 sf. This expansion will provide sufficient space to allow for a rr&-dation
size basketball court as well as improved spectator seating. The ceiling heigla is being increased from 20' to
30' to better accommodate srolleyball matches.
The current structure is a prefabricated metal building. The new, structure will be of similar construction, with
an increase in the roof purftrt capacity to provide a measure ofimpact resistance.
No change cif use, in terms ofquantity of events is anticipated, although it is probable that some increase .in .
the number of fans (50-80) at these events wiU occur. After expansion we esdmate. 200 spectators total. it
should be noted that the vast majority of these events do nog occur during sc l hours, so they do create
an increase in the number of persons on the property. The school sures the facility with the Nazarene
Church whose functions also do not coincide with the use of the gym facility.
When completed this structure will be reopened as the Matt Dailey Memorial Gymnasium. Matt was a
student at Champion when he- passed away last year after a heroic and fife -long battle with cancer. His
positive attitude and faith endeared him to many in the community who have expressed a readiness to assist
Matt's school in constructing this facility in his memory.

satisfaction of the County Fire Warden. Average required hydrant spacing _ feet, hydrant size _

6. In lieu of hydrant installation, payment may be made into the hydrant fund at a cost of $1.72

B. DRAINAGE

drainage shall be submitted to and approved by the Department of Public Works. The drainage plans
shall specify how drainage waters shall be detained on site and or conveyed to the nearest natural or
publicly maintained drainage channel or facility and shall provide that there shall be no increase in
the peak flow runoff to said channel or facility.
2. Prior to the issuance of building permits establish 100 year floodplain elevations and the lowest floor
elevations for any structures. Show on the site plan map for building permits the elevations (by
contours) and the location of an accepted NVGD benchmark and a temporary benchmark on-site.
C. LEGAL LOT STATUS
1. Prior to the issuance of the Use Permit, prove, to the satisfaction of the Director.of Public Works, that

Champion Christian School is proposing to expand its gymnasium facility from its current size of 5400 sf. to
a building of approximately 9000 sf. This expansion will provide sufficient space to allow for a regulation
size basketball court as well as improved spectator seating. The ceiling height is being increased from 20' to
30' to better accommodate volleyball matches.
The current structure is a prefabricated metal building. The new structure will be of similar construction with
an increase in the roof purlin capacity to provide a measure of impact resistance.
No change of use, in terms of quantity of events is anticipated, although it is probable that some increase in
the number of fans (50-80) at these events will occur. After expansion we estimate 200 spectators total. It
should be noted that the vast majority of these events do not occur during school hours, so they do not create
an increase in the number of persons on the property. The school shares the facility with the Nazarene
Church whose functions also do not coincide with the use of the gym facility. .
When completed this structure will be reopened as the Matt Dailey Memorial Gymnasium. Matt was a
student at Champion when he passed away last year after a heroic and fife -long battle with cancer. His
positive attitude and faith endeared him to many in the community who have expressed a readiness to assist
Matt's school in constructing this facility in his memory.
