The new equipment to be installed includes two booster pumps that will be contained within a new 384 square foot (16 feet x 24 feet) 12 -foot tall building, a 10 -foot tall 10,000 gallon water pressure tank, a diesel -powered generator with an attached 360 gallon tank, and underground water pipes. The purpose of the project is to supply pressurized water to parcels located in the upper elevations of the California Park Subdivision. The diesel -powered generator will be used for backup power during commercial power outages. The water pumping facility is a public use because the California Water Service Company is considered to be a public utility. The property is zoned "U" (Unclassified) and is located on the west side of Shady Brook Lane, approximately 425 feet north of Canyon Oaks Terrace, east Chico area. APN 011-030-064 (SB) (UP 01-04) (VIDEO) A video of the proposed project was shown. Mr. Betts gave a brief summary of the project. He also discussed both the noise and aesthetic impacts and stated that staff does not expect any significant impacts. Chairman Leland asked if the application included a second 500,000 gallon tank? Mr. Betts noted that the tank is shown on the site plan, however, it is proposed for the future and not a part of this project. The hearing was opened to the public. Chairman Leland asked if the applicant was present. The applicant was present. The hearing was closed to the public. Commissioner Cage said that the location of the project was great and that it is needed for the Chico area. It was moved by Commissioner Cage, seconded by Commissioner Lambert, and unanimously carried to approve the Use Permit for California Water Service Company, subject to the findings and conditions listed below: I. Adopt a Mitigated Negative Declaration regarding environmental impacts, with mitigation measures 1 through 2, as detailed in this agenda report, and authorize the Chair to sign, with the following findings: A. Find that an Initial Study was completed in compliance with the California Environmental Quality Act, that said study identified potential significant environmental effects and includes mitigation measures that would mitigate such effects below significant levels, and that a Mitigated Negative Declaration is proposed. B. Find that the Planning Commission has considered the proposed Mitigated Negative Declaration, together with comments received during the public review process. C. Find, on the basis of the whole record before the Planning Commission, including the Initial Study and any comments received, that there is no substantial evidence ■ BUTTE COUNTY PLANNING COMMISSION ■ MINUTES ■ DECEMBER. 14, 2000 ■ PAGE 4■ that the Use Permit project for California Water Service Company, as mitigated, will have a significant effect on the environment. D. Find that the proposed Mitigated Negative Declaration reflects the independent judgement and analysis of the County, which is the lead agency. II. The design of the proposed project improvements will not cause environmental damage to fish and wildlife or their habitat because the property does not contain any fish or wildlife habitat. Therefore, a "de minimus" impact of finding regarding fish and wildlife and their habitat is hereby made. The collection of fees pursuant to Fish and Game Code Section 711.4(d)(3) and 14 CCR 753.5. is not required. III. Approve Use Permit 01-04 for the California Water Service Company, subject to the conditions found in Exhibit A and subject to the following findings: A. The proposed use of the property will not impair the integrity and character of the zone in which the land lies, and that the use would not be unreasonably incompatible with, or injurious to, surrounding property, or detrimental to the health, safety and general welfare of the persons residing or working in the neighborhood, or to the general health, welfare and safety of the County because: 1. The project unit will not cause a significant increase in noise, light, odors, dust, or vehicle traffic. 2. The new facilities will not create a significant aesthetic impact because they will be mostly hidden from public view by an existing embankment and existing vegetation. The new structures are required to be painted a color to help blend in with the area. , B. The project is consistent with the Low Density Residential General Plan land use designation, which allows public uses as Secondary Uses. C. The project is consistent with the Unclassified zone, which allows public uses with a Use Permit. Conditions of Approval: The new pump building shall be of similar material and color as the existing pump building. The new 10,000 gallon pressure tank shall be painted a similar color as the existing pressure tank. (Mitigation Measure) 2. All new outdoor lighting shall be fully shielded to prevent glare and stray light on surrounding parcels. (Mitigation Measure) Prior to any soil disturbance and prior to issuance of a building permit, applicant shall submit an improvement plan with respect to fugitive dust and air pollution to the Butte County Air Quality Management District for review and determination of approval. Measures may include site and road watering and/or use of other acceptable soil palliatives. Measures determined to be acceptable by the Air Quality Management District shall be implemented during all development activities on the site. A copy of the approved plan shall be submitted to the Department of Development Services, Building Division and the Planning Division. (Mitigation Measure) 4. The project site shall be developed in accordance with the approved project site plan and the conditions contained herein. Said site plan is on file in the Planning Division, is identified as "Exhibit E", is date stamped August 21, 2000, and is incorporated herein by this reference. 5. Maintain the existing vegetation on the berm in a healthy condition 6. Prior to use of this project, the applicant shall contact the Planning Division for afield inspection to verify all conditions of approval and ordinance requirements have been met. Public Works Dea2artmen 7. Prior to the issuance of building permits a plan for a permanent solution for drainage shall be submitted to and approved by the Department of Public Works. The drainage plans shall specify how drainage waters shall be detained on site and or conveyed to the nearest natural or publicly maintained drainage channel or facility and shall provide that there shall be no increase in the peak flow runoff to said channel or facility. Butte County Fire Department/CDF ' 8. Construction, installation or development of structures or facilities on the parcels/lots shall comply with the latest California Fire Safe Regulations, (Public Resources Code 4290), and all other applicable State and County codes, ordinances and regulations in effect at the time of application for improvement permits. The use granted by this permit must be established within 24 months of the delivery of the countersigned permit to the Permittee. 3. Minor changes may be approved administratively by the Directors of Development Services, Environmental Health, or Public Works, or their respective designee, upon receipt of a substantiated written request by the applicant,. Prior to such approval, verification shall be made by each Department or Division that the modification is consistent with the application, fees paid and environmental determination -as conditionally approved. Changes deemed to be major or significant in nature shall require a formal application for amendment. 4. If any use for which a use permit has been granted is not established within two years of the date of receipt of the countersigned permit by the Permittee, the permit shall become null and void and reapplication and a new permit shall be required to establish the use. 5. The terms and conditions of this permit shall run with the land and shall be binding upon and be to the benefit of the heirs, legal representatives, successors, and assigns of the Permittee. Conditions of Approval: IV • 1. The new pump building shall be of similar material and color as the existing pump building. The new 10,000 gallon pressure tank shall be painted a similar color as the existing pressure tank. (Mitigation Measure) 2. All new outdoor lighting shall be fully shielded to prevent glare and stray light on surrounding parcels. (Mitigation Measure) 3. Prior to any soil disturbance and prior to issuance of a building permit, applicant shall submit an improvement plan with respect to fugitive dust and air pollution to the Butte County Air Quality Management District for review and determination of approval. Said plan shall include measures to control fugitive dust emissions from all civil construction associated with development of the site. Measures may include site and road watering and/or use of other acceptable soil palliatives. Measures determined to be acceptable by the Air Quality Management District shall. be implemented during all development activities on the site. A copy of the approved plan shall be submitted to the Department of Development Services, Building Division and the Planning Division. (Mitigation Measure) 4. The project site shall be developed in accordance with the approved project site plan and the conditions contained herein. Said site plan is on file in the Planning Division, is identified as "Exhibit E", is date stamped August 21, 2000, and is incorporated herein by this reference. 5. Maintain the existing vegetation on the berm in a healthy condition. 6. Prior to use of this project, the applicant shall contact the Planning Division for a field inspection to verify all conditions of approval and ordinance requirements have been met. 7. Prior to the issuance of building permits a plan for a permanent solution for drainage shall be submitted to and approved by the Department of Public Works. The drainage plans shall specify how drainage waters shall be detained on site and or conveyed4to the nearest natural or publicly maintained drainage channel or facility and shall provide that there shall be no increase in the peak flow runoff to said channel or facility. 8. Construction, installation or development of structures or facilities on the parcels/lots shall comply with 'the latest California Fire Safe Regulations, (Public Resources Code 4290), and all other applicable State and County codes, ordinances and regulations in effect at the time of application for improvement permits. 2 9. Prior to issuance of building permits, submit a Hazardous Materials Release Response Plan to Butte County Environmental Health. 10. Obtain the necessary building permits. 11.. PROJECT DESCRIPTION/SITE CHARACTERISTICS: This is an application for a Use Permit for an expansion of a water pumping facility. The new equipment to be installed includes two booster pumps that will be contained within a new 384 square foot (16 feet X 24 feet) .12 -foot tall building, a 10 -foot tall 10,000 gallon water pressure tank, and a diesel -powered generator with an attached 360 gallon fuel tank, and underground water pipes. The purpose of the project is to supply pressurized water to parcels located in the upper elevations of the California Park Subdivision. The diesel -powered generator will be used for backup power during commercial power outages. The water pumping facility is a public use because the California Water Service Company is providing public service. They are also regulated by the California State Public Utility Commission. The project site is zoned U (Unclassified) and has a General Plan Land Use designation of Low Density Residential. Surrounding parcels range in size from .5 to 2.7 acres. Land use on surrounding parcels is suburban residential. The parcels to the north, south, and east of the site are located in the City of Chico and are zoned for suburban residential uses. ■ BUTTE COUNTY PLANNING COMMISSION AGENDA REPORT ■ PAGE I ■ 0 • The project site is .715 acres in size and is developed with a water pumping facility, which includes a well, two booster pumps and a diesel -powered generator enclosed inside a building, a 10,000 gallon pressure tank, a 30 -foot tall 500,000 gallon water tank, a 500 gallon diesel fuel tank, and underground water pipes. Several antennas are mounted on top of the pump building. The site is normally unmanned. The site is surrounded by a six-foot high chain link fence topped with three strands of barbed wire. A tall berm, which is planted with numerous trees, surrounds most of the site. Access to the site is from Shadybrook Lane via a paved driveway. A locked gate provides access into the site. Use'Permit 91-09 was approved in 1991 to allow the expansion of a pre-existing nonconforming water pumping facility on the property. ANALYSIS: The Unclassified zoning district allows public uses with a Use Permit. The project is consistent with the Butte County General Plan Low Density Residential land use designation, which allows public uses as a Secondary Use. The site is located within the City of Chico's Sphere of Influence. A request for comments regarding this project was sent to the City of Chico Planning Department, which did not respond. The project site is surrounded by five parcels, ranging in size from .5 to 2.7 -acres, which are developed with single family dwelling units. Due to the closeness of the dwellings to the site, the potential exists that the noises from the additional facilities on the project site may cause an impact to the residents of the dwelling units. The existing water booster pumps and generator, which are located inside the existing pump building, generate noise, but according to the applicant this noise cannot be heard off-site. Installation of the proposed 384 square foot pump building, the booster pumps, the 10,000 gallon pressure tank, the generator, and underground water pipes will generate noise, mostly from heavy machinery, such as backhoes, and from vehicles entering and departing the site. These noises will be temporary in nature and are not expected to create significant impacts. Additionally, the existing berms on the site will help block the noise generated during construction activities. The proposed diesel -powered generator will produce noise when it is in operation. The generator will only be operated during rare commercial power outages and during two 30 -minute tests per month. The applicant submitted noise data from the generator manufacturer that shows the generator will create sound pressure levels from 69.5 to 74 dB(A) at a distance of 23 feet from the center of the generator. The generator will be placed approximately 27 feet from the closest property line. The generator is equipped with a muffler. The berm surrounding the project site will help prevent generator noise from leaving the site. However, the 500,000 gallon water tank may act as a noise reflector, and direct noise from the generator off-site. This is not expected to be significant due to the very occasional use of the generator. The two booster pumps will be enclosed inside the new pump building. The pumps are not in continuous use and according to the applicant the pumps will be barely audible outside of the building. The building will be vented to the outside, but special acoustic louvers will be installed ■ BUTTE COUNTY PLANNING COMMISSION AGENDA REPORT ■ PAGE 2 0 to help prevent noise from emanating from the building. No significant noise impacts are anticipated due to the use of the booster pumps. The project will add a 384 square foot (16 feet X 24 feet) 12 -foot tall pump building, a generator, and a 10 -foot tall 10,000 gallon water pressure tank. The top of the new pump building and the 10,000 gallon pressure tank will extend slightly above the berm. The applicant stated that the new building will be of the same material and the same color as the existing building, which is constructed of adobe color slumpstone and a burnt sienna blend color fiberglass shingle roof. Also, according to the applicant, the 10,000 gallon pressure tank will be painted the same color as the existing pressure tank, which is an off-white color. In order to ensure that the new structures placed on the site do not create a significant visual impact, a mitigation measure is recommended that requires the new building to be of the same material and color as the existing building, and that the new pressure tank be painted the same color as the existing pressure tank. Additional outdoor lighting may be necessary due to the additional structures placed on the site. These lights, especially if mounted above the top of the berm, may create excess light and glare on surrounding parcels. A mitigation measure is recommended that requires all new outside lighting be fully shielded and not create glare or stray light on surrounding parcels. ACTIONS FOR CONSIDERATION: Staff recommends that the Planning Commission take the following actions: I. Adopt a Mitigated Negative Declaration regarding environmental impacts, with mitigation measures 1 through 2, as detailed in this agenda report, and authorize the Chair to sign, with the following findings: A. Find that an Initial Study was completed in compliance with the California Environmental Quality Act, that said study identified potential significant environmental effects and includes mitigation measures that would mitigate such effects below significant levels, and that a Mitigated Negative Declaration is proposed. B. Find that the Planning Commission has considered the proposed Mitigated Negative Declaration, together with comments received during the public review process. C. Find, on the basis of the whole record before the Planning Commission, including the Initial Study and any comments received, that there is no substantial evidence that the Use Permit project for California Water Service Company, as mitigated, will have a significant effect on the environment. D. The design of the proposed project improvements will not cause environmental damage to fish and wildlife or their habitat because the property does not contain any fish or wildlife habitat. Therefore, a "de minimus" impact of finding regarding fish and wildlife and their habitat is hereby made. The collection of fees pursuant to Fish and Game Code Section 711.4(d)(3) and 14 CCR 753.5. is not required. III. Approve Use Permit 01-04 for the California Water Service Company, subject to .the conditions found in Exhibit A and subject to the following findings: A. The proposed use of the property will not impair the integrity and character of the zone in which the land lies, and that the use would not be unreasonably incompatible with, or injurious to, surrounding property, or detrimental to the health, safety and general welfare of the persons residing or working in' the neighborhood, or to the general health, welfare and safety of the County because: 1. The project unit will not cause a significant increase in noise, light, odors, dust, or vehicle traffic. 2. The new facilities will not create a significant aesthetic impact because they will be mostly hidden from public view by an existing embankment and existing vegetation: The new structures are required to be painted a color to help blend in with the area. B. The project is consistent with the Low Density Residential General Plan land use designation, which allows public uses as Secondary Uses. C. Prior to such approval, verification shall be made by each. Department or Division that the modification is consistent with the application, fees paid and environmental determination as conditionally approved. Changes deemed to be major or significant in nature shall require a formal application for amendment. 4. If any use for which a use permit has been granted is not established within two years of the date of receipt of the countersigned permit by the Permittee, the permit shall become null and void and reapplication and a new permit shall be required to establish the use. 5. The terms and conditions of this permit shall run with the land and shall be binding upon and be to the benefit of the heirs, legal representatives, successors, and assigns of the Permittee. Prior to any soil disturbance and prior to issuance of a building permit, applicant shall submit an improvement plan with respect to fugitive dust and air pollution to the Butte County Air Quality Management District for review and determination of approval. Said plan shall include measures to control fugitive dust emissions from all civil construction associated with development of the site. Measures may include site and road watering and/or use of other acceptable soil palliatives. Measures determined to be acceptable by the Air Quality Management District shall be implemented during all development activities on the site. A copy of the approved plan shall be submitted to the Department of Development Services, Building Division and the Planning Division. (Mitigation Measure) 4. The project site shall be developed in accordance with the approved project site plan and the conditions contained herein. Prior to use of this project, the applicant shall contact the Planning Division for a field inspection to verify all conditions of approval and ordinance requirements have been met. 7. Prior to the issuance of building permits a plan for a permanent solution for drainage shall be submitted to and approved by the Department of Public Works. The drainage plans shall specify how drainage waters shall be detained on site and or conveyed to the nearest natural or publicly maintained drainage channel or facility and shall provide that there shall be no increase in the peak flow runoff to said channel or facility. 8. Construction, installation or development of structures or facilities on the parcels/lots shall comply with the latest California Fire Safe Regulations, (Public Resources Code 4290), and all other applicable State and County codes, ordinances and regulations in effect at the time of application for improvement permits. Construction equipment, such as backhoes and grading equipment, will generate emissions when they are in operation. Emissions will be also generated by the vehicles carrying workers to and from the site. These emissions are not expected to be significant due to the limited amount of construction needed to develop the site. Additional emissions will be generated when the diesel -powered generator is operated. This is not expected to be significant because the generator will only be operated during commercial power outages and during testing, which will occur twice a month for 30 minutes. The Butte County Air Quality Management District requires that the applicant submit an application for an authority to construct permit. and will ensure that all expected air emissions meet air quality regulations. d. The 350 gallons of diesel will be stored in a tank attached to the generator. The additional diesel stored on the site is not expected to cause any impacts due to the minor amount of fuel involved. The Environmental Health Division requires that the applicant submit a Hazardous Material Release Plan prior to issuance of a building permit. e. - g. The property is not located within the vicinity of an airport, airport land -use plan, private airstrip, or interfere with an adopted emergency response plan or emergency evacuation plan. No impact is anticipated. h. The project is not located within a State Response Area for wildland fires. The nearest County fire stations are Station # 42, located approximately 5.25 miles to the northwest of the site (on Cohasset Road) and Station # 44, 'located approximately 5.5 miles to the southwest of the site (on Fair Street). A City of Chico fire station is located approximately 2.6 miles to the north of the site at the intersection of Manzanita Avenue and Wildwood Avenue. The Butte County Fire Department/CDF does not object to this project and recommends that development of the site comply with the latest California Fire Safe Regulations (Public Resources Code 4290) and all other applicable Sate and County regulations. The existing water booster pumps and generator, which are located inside the existing pump building, generate some noise, but this noise cannot be heard off-site and is not considered significant. Installation of the proposed 384 square foot pump building, the booster pumps, the 10,000 gallon pressure tank, the generator, and underground water pipes will generate noise, mostly from grading equipment and backhoes, and from vehicles entering and departing the site. These noises will be temporary in nature and are not expected to create significant impacts. Additionally, the existing berms on the site will help block the noise generated during construction activities. The proposed diesel -powered generator will produce noise when it is in operation. The generator will only be operated during rare commercial power outages and during two 30 -minute tests per month. The applicant submitted noise data from the generator manufacturer that shows the generator will create sound pressure levels from 69.5 to 74 dB(A) at a distance of 23 feet from the center of the generator. The generator will be placed approximately 27 feet from the closest property line. The generator is equipped with a muffler. The berm surrounding the project site will help prevent generator noise from leaving the site. However, the 500,000 gallon water tank may act as a noise reflector, and direct noise from the generator off-site. This is not expected to be significant due to the very occasional use of the generator. The two booster pumps will be enclosed inside the new pump building. The pumps are not in continuous use and according to the applicant the pumps will be barely audible outside of the building. The building will be vented to the outside, but special acoustic louvers will be installed to help prevent noise from emanating from the building. The California Water Service Company currently operates s,500,000 gallon water storage tank and well at the project site. It is proposed to build an additional 590,000 gallon water storage tank. a 10,000 gallon pressure tank, a pump building approximately 18' x 29' which will house three pumps and a generarttor, and an above ground 500 gallon fuel storage tank. The proposed project site is zoned 'Unclassified' which allows the proposed use as a conditional use. The proposed project is also listed as a secondary use under the General Plan dea;rriation of Agricultural -Residential, which provides for public and quasi -public uses. The proposed site for the project is compatible in relationship to the site situation and surrounding land uses. The proposed fuel storage tank will be located next to the pump house just off of the parking area. The tank will be installed on a concrete foundation surrounded by a concrete retention berm.
