The 700 square foot addition is applied for under Building Permit B06-2719. The proposed addition will remain subject to the conditions of approved Use Permit 01-06, which are attached. This determination is based on the following findings: 1. The proposed addition is incidental and accessory to the existing church and is not an expansion of the operational characteristics of the existing church; and, 2. Copy of Use Permit / Variance to Planning Technician:' Gridley Assembly of God, Dwight Denton, proposed Negative Declaration with mitigation measures regarding environmental impacts and Use Permit to allow the expansion of a church. The expansion will add 1,764 square feet to the existing structure, and will contain four classrooms, two bathrooms, a kitchen, and a storage area. Sewage disposal will be handled by an on-site septic system. Domestic water will be obtained from an existing on-site well. Access to the site is from Humble Way on property zoned A-5 (Agricultural - 5 acre parcels). The property is located on the east side of Humble Avenue, approximately 960 feet south of East Gridley Road, at 1526 Humble Avenue, east of Gridley. APN 024-010-111 (SB) (UP 01-06) (VIDEO) A video of the.proposed project was shown. Mr. Betts gave a brief summary of the project and said that staff does not'expect any significant impacts. The hearing was opened to the public. Chairman Leland asked if the applicant was present. Chairman Leland noted that the applicant was not present and that no one was present to speak. The hearing was closed to the public. It was moved -by Commissioner Mooney, seconded by Commissioner Lambert, and unanimously carried to approve the Use Permit for the Gridley Assembly of God Church, subject to the findings and conditions listed below: I. Adopt a Negative Declaration regarding environmental impacts, with no mitigation measures, as detailed in this agenda report, and authorize the Chair to .sign, with the following findings: A. Find that an Initial, Study, was completed. in compliance with the California Environmental Quality Act, that said study did not identify any potential significant environmental effects, and that a Negative Declaration is proposed. B. Find that the Planning Commission has considered the proposed Negative Declaration, together with comments received during the public review process. C. Find, on the basis of the whole record before the Planning Commission, including the Initial Study and any comments received, that there is no substantial evidence that the Use Permit project for the Gridley Assembly of God church will have a. significant effect on the environment. D. Find that the proposed Negative Declaration reflects the independent judgement and analysis of the County, which is the lead agency. II. The design of the proposed project improvements will not cause environmental damage to fish and wildlife or their habitat:because the area to be developed does not contain any fish or wildlife habitat. Therefore, a "de minimus" impact of finding regarding fish and wildlife and their habitat is hereby made. Approve Use Permit 01-06 for the Gridley Assembly of God, subject to the conditions found in Exhibit A and subject to the following findings: A. The proposed use of the property will not impair the integrity and character of the zone in which the land lies, and that the use would not be unreasonably incompatible with, or injurious to, surrounding property, or detrimental to the health, safety and general welfare of the persons residing or working in the neighborhood, or to the general health, welfare and safety of the County because: 1. The project unit will not cause a significant increase in noise, light, odors, . dust, or vehicle traffic. 2. A drainage plan must be submitted to and approved by the Public Works Department that provides for no increase in storm water runoff caused by the proj ect. B. The project is consistent with the Agricultural -Residential General Plan land use designation, which allows quasi -public uses as Secondary Uses. C. The project is consistent with the A-5 zone, which allows quasi -public uses with a Use Permit. D. The project will not have an impact on agricultural operations because the proposed structure will not use any land currently under agricultural production and is located over 400 feet from the agricultural operation on the parcel to the east of the site. Conditions of Approval: Lighting of outdoor play area shall be shielded from adjacent properties and restricted from use beyond 10:00 p.m. (condition from Use Permits 85-40 and 90-11) 2. Maintain a 300 foot setback from the orchard on the east for major buildings as long as the adjacent property remains in agricultural production, 150 foot setback from food concession stands, and 100 foot setback for dugout and other open sports related structures. (condition from Use Permits 84-2, 85-40 and 90-11) The project site shall be developed in accordance with the approved project site plan and the conditions contained herein. Said site plan is on file in the Planning Division, is identified as "Exhibit F", is date-stamped September 1, 2000, and is incorporated herein by this reference. 4. Building -identification and/or addresses shall be installed in conformance with Public Resources Code 4290 and shall be posted at the beginning of building construction and maintained continuously thereafter. 6. Provide an all weather access to all structures. The access shall have a minimum 10 -foot width and 15 -foot vertical clearance, and be able to accommodate a 40,000 pound fire apparatus. 7. Meet the requirements of Butte County Fire Marshal. 8. Prior to the issuance of building permits a plan for a permanent solution for drainage shall be submitted to and approved by the Department of Public Works. The drainage plans shall specify how drainage waters shall be detained on site and/or conveyed to the nearest natural or publicly maintained drainage channel or facility and shall provide that there shall be no increase in the peak flow runoff to said channel or facility. 9. Building permits required. .Plans and calculations shall be prepared by a registered or licensed design professional authorized to practice in the State of California. 10. Prior to issuance of a building permit the applicant shall meet the requirements for a sanitation clearance from the Butte County Environmental Health Division. This shall require the permitting of an expanded septic system; 11. Furthermore, drainage requirements of the Butte County Public Works Department are anticipated to mitigate any significant Impact. Disruption, displacement, compaction, and overcovering of the soil Is considered to be relatively minor due to the relatively flat terrain of the project site and minimum amounts of earthwork necessary for the proposed development. Humble Avenue Is a narrow, gravel roadway with no shoulders and one single travel lane. The property Is accessed by crossing a single lane wooden bridge over an existing Irrigation canal. * The existing circulation system Is substandard to s'.ipport a quasi -public land use and the resulting traffic generated. Traffic generation for houses of worship on worship day are 40.9 trips per 1000 square feet gross floor area. It Is estimated approximately 350-400 vehicle trips would be made on the worship day. Traffic generation figures for schools are one trip per student per day. Existing ADT Is estimated at 36 and projected to be 69. Traffic generation Is significant. Additional traffic on this road will create congestion and safety hazards. In order to mitigate the traffic Impacts, It will be necessary to upgrade Humble Avenue to the Department of Public Works Standards RS - 3B pursuant to Chapter 20 of the Butte County Code. In addition, the parking areas should be paved. 14a: The proposed project will necessitate an Increase In fire services to the project site. Fire protection In Butte County Is In Jeopardy at. this time due to fiscal constraints being experienced by Butte County. The proposed project would Increase service demands on the County's fire department beyond that which It can provide or expect to meet under current funding levels. Long term dedicated funding Sources for fire protection must be Identified to provide a minimum level of fire protection service. Adherence to the uniform fire code, 1988 edition, could substantially reduce the service demand Impacts on the Butte County Fire Department/California Department of Forestry fire protection. It Is anticlpr.ted strict compliance to the uniform fire code will mitigate the Identified Impacts to a less than significant level. 14b: The Butte Count,, Sheriff's Department Is responsible for law enforcement and protection In the project area. Rapid development in rural areas and the restricted budgets have reduced the department's capacity for preventative patrolling and rapid response to emergency calls. 17b: The prune orchard on the east side Is sprayed with Malathlon. A 300 ft. setback from the common property line was made a condition of the previous use permit In order to mitigate the potential conflict In the agricultural land use versus quasi -public land use. Gridlev Assembly of God Church Inc - proposed Negative Declaration regarding environmental impact and Use Permit to allow the expansion of an existing church by the development of a 50 ft. x 80 ft. auditorium on property zoned A-5 (Agricultural - 5 acre parcels) located on the east side of Humble Avenue, approximately 350 feet south of East Gridley Road, identified as AP 024 -010 -III and 112, Gridley. The Commission waived the reading of the Staff Findings. Staff submitted a revised Staff Findings dated 12/27/89. Staff said that builJing permits were never taken out on the 1985 approved Use permit, and, therefore, the 1985 Use Permit is not valid. Staff has recommended that the 1985 conditions that were applied to that Use Permit by the Board of Supervisors, be applicable to this new permit. This hearing was continued until after the Beatty hsr-'•,g to allow time for the applicant to read the revised staff findings. Gridlev Assembly of od Church, Inc - continued from earlier in the meeting. Gary Kuykendall said that there was nothing done with the 1985 Use Permit and it has expired. He stated that the 1983 Use Permit for the office and school was exercised and he would lit•:e the present requested permit to allow an 80 ft. x 50 ft. auditorium on the north end of the property. He said there ir: a drainage ditch on the east, north and south sides of the property. He said he did not know if these ditches were sufficient to tneet the code. He said the church has property down town which it would like to sell to pay for this building, but he needs to know that the Use Permit is appruved before they put the down town building up for sale. He said the Church might have to sell the 4.77 acre parcel to pay for a new road and he asked if this would be affected by the Use Permit. Staff said the Use Permit is for the physical location of the structure. Staff said that nothing would prohibit the applicant from subdividing the property. Chairman Lambert said the applicant has a year to comply with the conditions of the Use Permit. Mr. Kuykendall said the south end of the property is planned for development. Chairman Lambert said the appiicant could sell the 4.77 acre parcel if it was legally created and staff said this is correct. Commissioner Lynch suggested Mr. Kuykendall contact Robert Millington. Secretary of Drainage District #I, to get the requirements of easements for the drainage ditches. Staff said the building permits for the new building could be issued immediately. Mr. Kuykendall asked if he could start building the building and then start on the road later t.nd staff said yes. The State has bought a few parcels along the proposed route, one of them being adjacent to the project site for about 115 feet from the south end of the property (see enclosed Assessor's Map). It is unclear from the Assessor's map exactly where the right of way for Humble Road is. Enclosed for your information is a reduced size Caltrans right of way map showing the parcels the State has acquired and the parcel owned by the church. If an interchange for East Gridley Road were constructed with this project, the Caltrans right of way would include a triangular piece of the church property (as indicated on the right of way map). This section would include about 130 feet across the north property line (i.e. from the northwest corner to a point almost 800 feet south of the northwest corner, then along the west property line). In addition, the right of way for an expressway is access controlled so an ample collector local street will be needed to provide access to the individual properties along Humble Avenue. PROJECT DESCRIPTION/SITE CHARACTERISTICS: This is an application for a Use Permit to allow the expansion of a church. The expansion will add 1,764 square feet to the existing structure, and will contain four classrooms, two bathrooms, a kitchen, and a storage area. Sewage disposal will be handled by an existing on-site septic system. Domestic water will be obtained from an existing on-site well. Access to the site is from Humble Way. The project parcel is 13+ acres in size and is developed with a 7,940 square foot church, a mobile home used as a caretaker's home, a septic system, a well, and a parking lot. Vegetation on the site consists of trees and shrubs around the church and mobile home, trees along the north property line, and riparian vegetation along a drainage ditch on the east property line. Most of the 13 -acre parcel' consists of plowed fields. The site is level. Use Permit 84-2 was approved in 1984 for the church and a Christian school. Two additional Use Permits have been approved on the site since then: Use Permit 85-40 for an expansion, and Use ■ BUTTE COUNTY PLANNING COMMISSION AGENDA REPORT ■ PAGE 1 ■ Permit 90-11 to add a 4,000 square foot auditorium. According to the applicant, the church is not used for the christian school. The project site is zoned A-5 (Agricultural, 5 -acre minimum parcel size) and has a General Plan Land Use designation of Agricultural -Residential. Surrounding parcels range in size from .7 to 25 acres, and have land uses of orchards, pastures, row crops, and dwellings at rural densities. ANALYSIS: The A-5 zoning district allows quasi -public uses with a Use Permit. A church is considered a quasi - public use. The church is consistent with the Butte County General Plan Agricultural -Residential land use designation which allows quasi -public uses as a Secondary Use. The site is located within the Gridley Urban Reserve but is not within the City of Gridley's Sphere of Influence. The 1,764 square foot expansion will be used for Sunday school purposes and for the preparation of food. The church does not offer a day school program, and is not proposing to use the new classrooms for a day school use. The expansion will not increase the seating capacity of the existing sanctuary, so there will not be an increase in the number of vehicle trips currently generated by the church use. The project will create new impervious surfaces, but a drainage plan is required to be submitted to and approved by the Butte County Department of Public Works. The drainage plan must provide for no increase in the peak flow runoff from the project site. Road improvements required by the previous Use Permits on the site have been completed and no new road improvements are required. A condition of the pervious Use Permits prohibits any major structures from being placed within 300 feet of the east property line. The proposed structure will be located approximately 468 feet from the east property line. ACTIONS FOR CONSIDERATION: Staff recommends that the Planning Commission take the following actions: I. Adopt a Negative Declaration regarding environmental impacts, with no mitigation measures, as detailed in this agenda report, and authorize the Chair to sign, with the following findings: A. Find that an Initial Study was completed in compliance with the California Environmental Quality Act, that said study did not identify any potential significant environmental effects, and that a Negative Declaration is proposed. B. Find that the Planning Commission has considered the proposed Negative Declaration, together with comments received during the public review process. C. Therefore, a "de minimus" impact of finding regarding fish and wildlife and their habitat is hereby made. The collection of fees pursuant to Fish and Game Code Section 711.4(d)(3) and 14 CCR 753.5. is not required. III. Approve Use Permit 01-06 for the Gridley Assembly of God, subject to the conditions found in Exhibit A and subject to the following findings: A. The proposed use of the property will not impair the integrity and character of the zone in which the land lies, and that the use would not be unreasonably incompatible with, or injurious to, surrounding property, or detrimental to the health, safety and general welfare of the persons residing or working in the neighborhood, or to the general health, welfare and safety of the County because: The project unit will not cause a significant increase in noise, light, odors, dust, or vehicle traffic. 2. A drainage plan must be submitted to and approved by the Public Works Department that provides for no increase in stormwater runoff caused by the proj ect. B. The project is consistent with the Agricultural -Residential General Plan land use designation, which allows quasi -public uses as Secondary Uses. C. The project will not have an impact on agricultural operations because the proposed structure will not use -any land currently under agricultural production and is located over 400 feet from the agricultural operation on the parcel to the east of the site. Project Description: This is an application for a Use Permit to allow the expansion of a church. The expansion will add 1,764 square feet to the existing structure, and will contain four classrooms, two bathrooms, a kitchen, and a storage area. Sewage disposal will be handled by an existing on-site septic system. Domestic water will be obtained from an existing on-site well. Access to the site is from Humble Way. 6. Location of property: The property. is located on the east side of Humble Avenue, approximately 700 feet south of East Gridley Road, at 1526 Humble Avenue, east of Gridley. 7. Setting: The project parcel is 13+ acres in size and is developed with a 7,940 square foot church, a mobile home used as a caretaker's home, a septic system, a well, and a parking lot. Vegetation on the site consists of trees and shrubs around the church and mobile home, trees along the north property line, and riparian vegetation along a drainage ditch on the east property line. Most of the 13 -acre parcel consists of plowed fields. The site is level. The existing church was constructed at a time that a Use Permit was not required. Several Use Permits have been approved for expansion of the church: Use Permit 85-40 for an expansion, and Use Permit 90-11 to add a 4,000 square foot auditorium. The project site is zoned A-5 (Agricultural, 5 -acre minimum parcel size) and has a General Plan Land Use designation of Agricultural -Residential. Surrounding parcels range in size from .7 to 25 acres. Land uses on surrounding and nearby parcels include orchards, pastures, row crops, and dwellings at rural densities. 8. These lights are not expected to create a significant impact due to the distance of the new building from property lines. The soils on the site have a Soil Conservation Service Classification of I soils, which are considered prime agricultural soils (Butte County Master Environmental Assessment, Table LU -4). The proposed addition to the church will not lead to a loss of agricultural land. A condition of Use Permit 90-11 on the site requires a 300 -foot building setback from the east property in order to protect what was then a prune orchard on the adjacent parcel and to protect worshipers and students from the impacts caused by the orchard use. The proposed structure will be located over 400 feet from the east property line and is consistent with the condition of the previous Use Permit. The expansion of the church will not have an impact on agricultural uses. Mitigation Measure: None required. 3. AIR QUALITY. Where available, the significance criteria established by the applicable air quality management or air pollution control district may be relied upon to make the following determinations. No significant fugitive dust emissions are expected during construction because the area where the proposed addition is located is already level and a minimum amount of earthwork will be required. d. No impact is anticipated from instability, landslide, lateral spreading, subsidence, liquefaction or collapse. d. The Conservation Element's Expansive Soils Map indicates that the project site has a low expansive soil designation. No impact is anticipated. e. Sewage disposal for the restrooms and the kitchen in the proposed structure will be handled by an on-site septic system. The Butte County Environmental Health Division does not object to the use of a septic system. The Environmental Health Division states that the applicant must meet the requirements for a sanitation clearance prior to issuance of a building permit. The Fire Department/CDF also requests that the project meet Butte County Fire Marshal requirements. These recommendations will be added as a conditions of project approval. Humble Avenue was constructed to the required standard. The Butte County Public Works Department is not requiring any improvements to Humble Avenue. The expansion of the church is not expected to cause a significant increase in the number of vehicle trips generated by the church use. The addition will be used for a classroom for Sunday school. No additional area is being added to the church sanctuary, which could lead to an increase in the number of worshipers attending the church. Peak hours of vehicle traffic generated by the church will be weekdays 10:00 a.m. to noon and 7:00 p.m. to 11:00 p.m., Saturdays 5:00 p.m. to 8:00 p.m., and Sundays 9:00 a.m. to 1:00 p.m. These peak hours of vehicle traffic generated by a church use do not coincide with normal vehicle traffic peak hours (7:00 a.m. to 9:00 a.m. and 4:00 p.m. to 6:00 p.m., Monday through Friday). Caltrans has been acquiring parcels on the west side of Humble Avenue for a future realignment of Highway 99 around the City of Gridley. According to Caltrans, the proposed realignment had been downgraded from a freeway to a two-lane expressway with at -grade intersections (11/21/00 phone conversation with Terri Pencovic, Caltrans). The project is not expected to have an impact to this potential realignment because the project site is not located in the proposed right-of-way corridor. f. The addition to the church will not impact the existing parking areas. The addition is not expected to create the need for any additional parking spaces. However, there is sufficient area on the site to provide additional off-street parking spaces if needed.
