This fact was confirmed upon investigation. It was also discovered that the septic system was never upgraded in order to Y` validate the use permit. As of 5/6/02 the conditions set forth by this department have not been addressed. Pleas see enclosed letter. f f MSE/an/complainr/C1ineSkyway c rEHE AY 15 2002 BUTTE COUNTY PLANNING DIVISION L A N D O F N A T U R A L W E A L T H A N D BEAUTY RE: Courtesy Notice: AP# 064-670-016 Dear Mr. Cline: This is a courtesy notice to notify you that you are in violation of the Butte County Code (BCC) 19-4, as follows, at the above -referenced location: 1. On 5/3/02 a site inspection was conducted at that time it was discovered that gray water was draining from the above address onto Hidden Lake Drive. A PVC pipe was noted running from the property into the roadside drainage ditch. It is necessary to abandon said line and to provide proper connection to existing septic system. 2. It has also been determined that septic repairs set as a condition of UP 01-12 have not been completed. Please address above violations. A proper application and fees must be submitted to this office before work can be started. It is the County's goal to obtain voluntary compliance with the Butte County Code. However, you should be advised that Butte County has an active Code Enforcement Program which provides an effective means of enforcement if voluntary compliance is not obtained. Enforcement may be pursued through the issuance of citations, fines and the recording of a Notice of Violation including a description of the action necessary to abate the violation. You have THIRTY (30) DAYS to voluntarily comply with the above directions or to present an acceptable plan for abatement or convective actions to be taken by you. It is hard to envision his property as 2.5 acres, but if so, much of it is between his residence and Skyway, with the remainder,of the property presently occupied by a trailer home very close to. his house, and two rather. large sheds. Even with the trailer house removed, it is hard to see how another house can be built without being squeezed into a very small lot indeed. A fire hydrant is located on Skyway in front of the property. The site is within the Town of Paradise's Sphere of Influence. Surrounding parcels have a General Plan land use 'designation of Agricultural - Residential to the north and west, and Commercial to the south and southeast. This project is being processed under Butte County Code Section 24-95(c)(1), which requires a Use Permit for multiple residences on a parcel zoned AR -2.5. The project cannot be processed as a Minor Use Permit under Section 24-280 (Second Dwelling Units) because the property does not have twice the acreage of the AR -2.5 zone as required by this Section. Under Section 24-95(c)(1), the applicant is not required to reside on the property and both of the dwellings could be rented. ANALYSIS: The project site is zoned AR -2.5, which requires a minimum parcel size of 2.5 acres. The project will, exceed the density of the AR -2.5 zone because the parcel is only 1.28 acres in size. Butte County Code Section 24-95(c)(1) requires a Use Permit for multiple residences on a parcel zoned AR -2.5, subject to the density allowed by the General Plan. The project site is designated as Commercial by the Land Use Element Map of the General Plan, which allows, dwelling units as Secondary Uses. The Commercial land use designation does not specify a minimum parcel size, and the size of a parcel,is determined by the area needed for the use, setbacks, parking requirements, and the area needed for a septic system (if public sewer is not available). The site was zoned from A-2 to ARMH-3 in 1976, and then to AR -2.5 in 1998. The General Plan designation of Commercial on the site was adopted in 1979, after the parcel was zoned to ARMH-3. The AR -2.5 zoning of the site is not consistent with the site's General Plan designation of Commercial. The R-4 zone, which allows multiple dwellings on a parcel as a right, is listed as a consistent zone of the Commercial land use designation. This indicates that high density residential uses are acceptable on parcels with a Commercial General Plan land use designation. The project.will not cause an increase in vehicle traffic in the project area because the proposed second dwelling unit is already installed on the site. The only new construction needed to convert the temporary unit to a permanent second dwelling unit may be the installation of a permanent foundation placed under the manufactured home. The project site is within the Town of Paradise's Sphere of Influence, but the Town did not have any concerns and did not recommend any conditions. The project is not within the Paradise/Magalia Reservoirs Watershed Protection Overlay Zone. ACTIONS FOR CONSIDERATION: Staff recommends that the Planning Commission take the following actions: I. Determine the project to be Categorically Exempt from environmental review under Section 15303(a) of the California Environmental Quality Act.
