The project also proposes to allow two existing mobile homes approved for use as real estate offices to be used as dwelling units for two years after approval of the Use Permit. Fifty-six enclosed storage spaces will be provided, along with 39 outdoor storage spaces for vehicles. According to the applicant the enclosed storage spaces are primarily intended for the storage of vehicles, but any items may be stored in these spaces. The mini - storage structures will be 91/2 feet tall at the rear, with a 21/2 foot high parapet, and gradually sloping to a height of eight feet at the front. The applicant proposes to paint the structures a red rust color, with off-white doors. The roofs of the structures will be galvanized metal. The mini -storage structures will abut the property line on the north and south sides. There will be a ten foot building setback from the west property line. Hours of operation will be daily from 7:00 a.m. to 9:00 p.m. One of the mobile homes will be used as the office for the mini -storage business and as the residence for a caretaker. The property is zoned H -C (Highway Commercial) and is located on the west side of Skyway, approximately 100 feet south of Fir Haven Drive, at 14435 Skyway, Paradise Pines. APN 064-660-012 (SB) (UP 01-16) (VIDEO) A video of the project site was shown. Mr. Betts gave a brief summary of the project. Commissioner Mooney said -on Condition 19 it is unusual to state all structures shall be made accessiAe to the disabled. He said there is usually a percentage stated. Mr. Wilson suggested modifying the condition to delete "All" and add "as required by the applicable law." after "disabled." The hearing was opened to the public. Dan Kennedy asked that the condition state "applicable laws at the time the buildings are constructer.." The hearing was closed. It was moved by Commissioner Mooney, seconded by Commissioner Marin, and unanimously carri-,d to approve the Use Permit for Dan Kennedy subject to the findings and conditions listed below, modifying Condition 19 deleting "All" and add to the end of the sentence "as required by applicable law." Mr. Wilson explained the 10 day appeal period. I. Adopt a Mitigated Negative Declaration regarding environmental impacts, with mitigation measures 1 through 6, as detailed in this agenda report, and authorize the Chair to sign, with the following findings: A. Find that an Initial Study was completed in compliance with the California Environmental Quality Act, that said study identified potential significant environmental effects and incl. -ides mitigation measures that would mitigate such effects below significant levels, and that a Mitigated Negative Declaration is proposed. B. Find, on the basis of the whole record before the Planning Commission, including the Initial Study and any comments received, that there is no substantial evidence that the Use Permit project for Dan Kennedy, as mitigated, will have a significant effect on the environment. D. Find that the proposed Mitigated Negative Declaration reflects the independent judgement and analysis of the County, which is the lead agency. II. The design of the proposed project improvements will not cause environmental damage to fi,;h and wildlife or their habitat because the property does not contain any significant amounts of wildlife habitat and the area where the mini -storage business will be located has been already been cieared of vegetation. Therefore, a "de minimus" impact of finding regarding fish and wildlife and their habitat is hereby made. The collection of fees pursuant to Fish and Game Code Section 711.4(d)(3) and 14 CCR 753.5. is not required.- III. equired: III. Approve Use Permit 01-16 for Dan Kennedy, subject to the conditions found in Exhibit A and subject to the following findings: A. The proposed use of the property will not impair the integrity and character of the zone in which the land lies, and that the use would not be unreasonably incompatible with, or injurious to, surrounding property, or detrimental to the health, safety and'general welfare of the persons residing or working in the neighborhood, or to the general health, welfare and safety of the County because: All outside lighting at the mini -storage unit will be fully shielded. 2. Measures are required to be taken during construction activities to prevent fugitive dust emissions. 3. The times of construction activities are limited to prevent significant noise impacts to adjacent residents and an adjacent church. After construction, the project will not create any significant noise impacts. 4. Skyway has the capacity to handle the increase in vehicle traffic generated by the project. 5. The project will not create a significant aesthetic impact because commercial structures are normally found in the Highway Commercial zone and because trees are required to be planted on the west side of the site, which will help shield the mini - storage structures from adjacent residential uses. B. The mini -storage use and the residential use are consistent with the Highway Commercial zone, which allows commercial uses and multiple family residences with a Use Permit. C. The project is consistent with the Commercial General Plan land use designation, which lists commercial uses as a Primary Use and dwellings as a Secondary Use. Conditions of Approval: ■ BUTTE COUNTY PLANNING COMMISSION ■ MINUTES ■ APRIL 26, 2001 ■ PAGE 12■ Planning Division Evergreen trees shall be planted in the ten -foot building setback area on the west property line io help shield the mini -storage structure from the adjacent parcels. A plan showing the location and type of each tree planted shall be submitted to and approved by the Planning Division prior to the isEuance of a Building Permit. The plan shall depict the irrigation method. The trees shall be installed prior to the Issuance of a Certificate of Occupancy for the first building installed or shall be bonded for an amount determined by the Director of Development services or his or her designee. The trees shall be maintained in a healthy condition and replaced as necessary in order to maintain the visual shield. (Mitigation Measure) 2. All outdoor lights associated with the mini -storage use shall be fully shielded. Lights shall be directed downward and contained on-site. Direct light shall not be allowed on adjoining properties and roads. No lights shall be placed on the rear of the mini -storage structures. (Mitigation Measure) 3. Measures shall be taken to control fugitive dust emissions from all civil construction associated with development of the site. Standard Mitigation Measures to prevent or reduce fugitive dust emi,,sions can be obtained from the Butte County Air Quality Management District. (Mitigation Measu_e) 4. Prior to the issuance of building permits a plan for a permanent solution for drainage shall be submitted to and approved by the Department of Public Works. The drainage plans shall speci4 how drainage waters shall be detained on site and or conveyed to the nearest natural or publicly maintained drainage channel or facility and shall provide that there shall be no increase in the peak -flow runoff to said channel or facility. A copy of the approved plan shall be submitted to the Planning. Division and the Building Division. (Mitigation Measure) 5. Maintenance of vehicles stored on the site shall not be allowed. The applicant shall place language into the rental agreement that states vehicle maintenance is not allowed. Prior to issuance of bui=ding permits, the applicant shall provide a copy of the rental agreement to the Planning Division for review and approval. (Mitigation Measure) 6. Development activity shall be limited to 7:00 a.m. to 6:00 p.m. Monday through Friday, and 10 a.m. to 6 p.m. Saturday and holidays. No site development activity shall occur on Sundays. (Mitigation Measure) 7. The project site shall be developed in accordance with the approved project site plan and the conditions contained herein. Said site plan is on file in the Planning Division, is date-stamped February 6, 2001, and is incorporated herein by this reference. 8. No hazardous or explosive materials shall be stored in the storage unit facility. Hazardous mate_ials are defined as any substance or material that, by.reason of its toxic, caustic, corrosive, abrasive, or otherwise injurious properties, may be detrimental or deleterious to the health of any person handling or otherwise coming into contact with such material or substance. The property owner shall place language in the rental agreement for each storage unit stating that storage of hazardous or explo Sive material is prohibited. Prior to establishment of the use, a copy of the proposed rental agreement shall be submitted to and approved by the Planning Division to verify compliance with this condition. ■ BUTTE COUNTY PLANNING COMMISSION ■ MINUTES ■ APRIL 26, 2001 ■ PAGE 13■ 9. The hours of operation shall be restricted to the hours between 7:00 a.m. and 9:00 p.m. 10. Prior to use of this project, the applicant shall contact the Planning;Division for a field inspection to verify all conditions of approval and ordinance requirements have been met. 11. Use of the two mobile homes as residential uses shall be allowed for only two years after approval of the Use Permit. The two mobile homes shall be removed from the site no later than two. years from approval of the Use Permit. Public Works Department 12. Prior to the issuance of building permits obtain encroachment permit for standard S-18 road approach and construct it to County standards, as specified in County Improvement Standards. 13. Prior to the issuance of building permits deed to Butte County, in fee simple, 40 feet of right-of-way from the centerline of Skyway. The right of way shall be sufficient for the installation of standard No. S-5 at all street intersections. 14. Prior to the issuance of building permits a plan for a permanent solution for drainage shall be submitted to and approved by the Department of Public Works. Construction, installation or development of structures or facilities on the parcels/lots shall ccmply with the latest California Fire Safe Regulations, (Public Resources Code 4290), and all other applicable State and County codes, ordinances and regulations in effect at the time of application for improvement permits. 16. Building identification and/or addresses shall be installed in conformance with Public Resources Code 4290 and shall be posted at the beginning of building construction and maintained continuously thereafter. 17. A pressurized community water system is required for fire protection. The specific locations and fire flow requirements shall be in accordance with the Fire Department specifications and b the satisfaction of the County Fire Warden. Minimum fire flow is 2,000 gallons per minute. Minimum fire hydrant size is six (6) inches. Minimum fire hydrant spacing is 300 feet. Submit plans to the Fire Department for review and approval prior to construction of facilities. One new fire hydrant shall be installed at the southern side of the driveway on the Skyway. Building Division 18. Building Permits Required. Prepare 4 sets of construction plans and make an application for permit. Construction shall comply with federal, state, and local regulations. Structures shall be made accessible to the disabled . Disabled accessible parking and an accessible path of travel shall be provided. 20. Proposed improvements shall comply with Use Permit conditions applicable to construction. 21. Proposed improvements shall comply with Public Resources Code 4290 Fire Safe Construction standards. 22. Development fees for the proposed residential or non-residential improvements shall be paid prior to the issuance of building permits. The fees shall be those in effect at time of application, and shall include, but not be limited to, School Fees, Park and Recreation District fees, Water and Sewer Service Fees, Permit and Plan Check fees, and Fire Protection Fees. To make it short, two of the three mobile homes on this parcel were approved for office use (under Use Permits 75-82 & 90-29), not for residential use. Dan Kennecy received a Use Permit (Use Permit 01-16) on this parcel for a mini -storage business and to allow the use of the two mobile homes for residential use for a period of two (2) years after approval of the Use Permit. The condition is as follows: 11. Use of the two mobile homes as residential uses shall be allowed for only two years after approval of the Use Permit. The two mobile homes shall be removed from the site no later than two years from approval of the Use Permit. The Use Permit was approved on April 26, 2001, and became void on April 26, 2003 since Mr. Kennedy did not establish the storage business by that time. The two mobile homes being used for residential purposes were not to be used for such purposes after April 26, 2003. I spoke to Mr. Kennedy on June 16 regarding this issue and have not heard back from him. I told him that Use Permit. 0 1 -16 was void and that that continued use of the two mobile homes for residential purposes was a violation of th-3 Use Permits that allowed them to only be used for office uses. The two mobile homes can continued to be used for office purposes. I don't know if your issuance of a repair per -nit depends on the actual use of the mobile homes. If they were being utilized for office purposes it would not be a problem to issue a repair permit since they are allowed for that type of, use. Unfortunately, I haven't had the time to follow up on this issue, but it looks like I will have to make time now since here is a significant problem. As I already stated, I did tell Mr. Kennedy that continued use of the mobile homes for residential uses is not allowed. If you can't issue a repair permit, and sewage continues to be a problem, maybe fou and/or Code Enforcement can shut down the residential use? I hope this helps you out. Subject: RE: 14435 Skyway AP# 064-660-012 Mike, I was out of the office unexpectedly all of last week, so I apologize for the delay in getting back to you Anyway, I sent an e-mail to Cliff on June 17 regarding this issue. To make it short, two of the three mobile homes on this parcel were approved for office use (under Use Permits 75-82 & 90-29), not for residential use. Dan Kennedy received a . Use Permit (Use Permit 01-16) on this parcel for a mini -storage business and to allow the use of the two mobile horres for residential use for a period of two (2) years after approval of the Use Permit. The condition is as follows: 11. Use of the two mobile homes as residential uses shall be allowed for only two years after approval of the Use Permit. The two mobile homes shall be removed from the site no later than two years from approval of the Use Permit. The Use Permit was approved on April 26, 2001, and became void on April 26, 2003 since Mr. Kennedy did not establish the storage business by that time. The two mobile homes being used for residential purposes were not to be used fcr such purposes after April 26, 2003. I spoke to Mr. Kennedy on June 16 regarding this issue and have not heard back from him. I told him that Use Permit 01-16 was void and that that continued use of the two mobile homes for residential purposes was a violation of the Use Permits that allowed them to only be used for office uses. The two mobile homes can continued to be used for office purposes. I don't know if your issuance of a repair permit depends on the actual use of the mobile homes. If they were being utilized for office purposes it would not be a probAem to issue a repair permit since they are allowed for that type of use. Unfortunately, I haven't had the time to follow up on this issue, but it looks like I will have to make time now since these is a significant problem. As I already stated, I did tell Mr. Kennedy that continued use of the mobile homes for residential uses is not allowed. If you can't issue a repair permit, and sewage continues to be a problem, maybe you and/or'Code Enforcement can shut down the residential use? I hope this helps you out. I will get a letter out to Mr. Kennedy today regarding this issue, with a cc to the EHD Chico office. He told me that EHD would not issue him a septic permit on this parcel. He did not know who at your office was working this issue, which is why I am contacting you. Mr. Kennedy was issued Use Permit*01-16 on 6/29/01 for a minkstorage facility on this parcel. His Use' Permit -br the mini - storage use also allowed him to use two mobile homes on the parcel for a residential use for two years. There were are three mobile homes on this parcel, but two of them were originally to, be used for real estate offices, which were allowed by Use Permits 75-82 and 90-29. The third mobile home is a dwelling which is an allowed use. Mr. Kennedy's Use Permit for the mini -storage use is void, since he did not establish the use within two years of being issued the Use Permit. The Use Permit said that the, use of the two real estate mobile homes as dwellings was good for only two years from approval of the Use Permit. Those two years has already passed. So, it appears that the two mobile homes that were permitted as real estate offices are no longer legal to use as dwellings. Let me know who to talk to about this issue. Minor changes may be approved administratively by the Directors of Development Services, Environmental Health, or Public Works, or their respective designee, upon receipt of a substantiated written request by the applicant. Prior to such approval, verification shall be made by each Department or Division that the modification is consistent with the application, fees paid and environmental determination as conditionally approved. Changes deemed to be major or significant in nature shall require a formal application for amendment. 4. If any use for which a use permit has been granted is not established within two years of the date of receipt of the countersigned permit by the Permittee, the permit shall become null and void and reapplication and a new permit shall be required to establish the use. The terms and conditions of this permit shall run with the land and shall be binding upon and be to the benefit of the heirs, legal representatives, successors, and assigns of the Permittee. Conditions of Approval: Conditions of Approval: Planning Division 1. Evergreen trees shall be planted in the ten -foot building setback area on the west property line to help shield the mini -storage structure from the adjacent parcels. A plan showing the location and type of each tree planted shall be submitted to and approved by the Planning Division prior to the issuance of a Building Permit. The plan shall depict the irrigation method. The trees shall be installed prior to the Issuance of a Certificate of Occupancy for the first building installed or shall be bonded for an amount determined by the Director of Development services or his or her designee. The trees shall be maintained in a healthy condition and replaced as necessary in order to maintain the visual shield. (Mitigation Measure) 2. All outdoor lights associated with the mini -storage use shall be fully shielded. Lights shall be directed downward and contained on-site. Direct light shall not be allowed on adjoining properties and roads. No lights shall be placed on the rear of the mini -storage structures. (Mitigation Measure) 3. Measures shall. be taken to control fugitive dust emissions from all civil construction associated with development of the site. Standard Mitigation Measures to prevent or reduce fugitive dust emissions can be obtained from the Butte County Air Quality Management District. (Mitigation Measure) 4. Prior to the issuance of building permits a plan for a permanent solution for drainage shall be submitted to and approved by the Department of Public Works. The drainage plans shall specify how drainage waters shall be detained on site and or conveyed to the nearest natural or publicly maintained drainage channel or facility and shall provide that there shall be no increase in the peak flow runoff to said channel or facility. A copy of the approved plan shall be submitted to the Planning Division and the Building Division. (Mitigation Measure) 5. Maintenance of vehicles stored on the site shall not be allowed. The applicant shall place language into the rental agreement that states vehicle maintenance is not allowed. Prior to issuance of building permits, the applicant shall provide a copy of the rental agreement to the Planning Division for review. and approval. (Mitigation Measure) 6. Development activity shall be limited to 7:00 a.m. to 6:00 p.m. Monday through Friday, and 10 a.m. to 6 p.m. Saturday and holidays. No site development activity shall occur. on Sundays.- (Mitigation Measure) 7. The project site shall be developed in accordance with the approved project site plan and the conditions contained herein. Said site plan is on, file in the Planning Division, is date- stamped February 6, 2001, and is incorporated herein by this reference. 8. No hazardous or explosive materials shall be stored in the storage unit facility. Hazardous materials are defined as any substance or material that, by reason of its toxic, caustic, 2� corrosive, abrasive, or otherwise injurious properties, may be detrimental or deleterious to the health of any person handling or otherwise coming into contact with such material or substance. The property owner shall place language in the rental agreement for each storage unit stating that storage of hazardous or explosive material is prohibited. Prior .to establishment of the use, a copy.of the proposed rental agreement shall be submitted to and approved by the Planning Division to verify compliance with this condition. 9. The hours of operation shall be restricted to the hours between 7:00 a.m. and 9:00 p.m. 10. Prior to use of this project, the applicant shall contact the Planning Division for a field inspection to verify all conditions of approval and ordinance requirements have been met. 11. Use of the two mobile homes as residential uses shall be allowed for only two years after approval of the Use Permit. The two mobile homes shall be removed from the site no later than two years from approval of the Use Permit. Public Works Department 12. Prior to the issuance of building permits obtain encroachment permit for standard S-18 road approach and construct it to County standards, as specified in County Improvement Standards. 13. Prior to the issuance of building permits deed to Butte County, in fee simple, 40 feet of right- of-way from the centerline of Skyway. The right of way shall be sufficient for the installation of standard No. S-5 at all street intersections. 14. Prior to the issuance of building permits a plan for permanent solution for drainage shall be submitted to and approved by the Department of Public Works. The drainage plans shall specify how drainage waters shall be detained on site and or conveyed to the nearest natural or publicly maintained drainage channel or facility and shall provide that there shall be no increase in the peak flow runoff to said channel or facility. Construction, installation or development of structures or facilities on the parcels/lots shall comply with the latest California Fire Safe Regulations, (Public Resources Code 4290), and all other applicable State and County codes, ordinances and regulations in effect at the time of application for improvement permits. 16. Building identification and/or addresses shall be in in conformance with Public Resources Code 4290 and shall be posted at the beginning of building construction .and maintained continuously thereafter. 17. A pressurized community water system is required for fire protection. The specific locations and fire flow requirements. shall be in accordance with the Fire Department specifications 3 and to the satisfaction of the County Fire Warden. Minimum fire flow is 2,000 gallons per minute. Minimum fire hydrant size is six (6) inches. Minimum fire hydrant spacing is 300 feet. Submit plans to the Fire Department for review and approval prior to construction of facilities. One new fire hydrant shall be installed at the southern side of the driveway on the Skyway. Building Division 18. Building Permits Required. Prepare 4 sets of construction plans and make. an application for permit. Construction shall comply with federal, state, and local regulations. Plans shall be prepared, sealed and signed by a California Licensed Architect or Registered Engineer for non-residential buildings and certain residential buildings. 19. Structures shall be made accessible to the disabled as required by applicable law. Disabled accessible parking and an accessible path of travel shall be provided. ' 20. Proposed improvements shall comply with Use Permit conditions applicable to construction. 21. Proposed improvements shall comply with Public Resources Code 4290 Fire Safe Construction standards. 22. Development fees for the proposed residential or non-residential improvements shall be paid prior to the issuance of building permits. The fees shall be those in effect at time of application, and shall include, but not be limited to, School Fees, Park and Recreation District fees, Water and Sewer Service Fees, Permit and Plan Check fees, and Fire Protection Fees. Environmental Health Division 23. , Under County permit and prior to issuance of building permits, upgrade and repair septic systems for existing mobile homes 24. On-site drinking well water must pass a potable water test administered by Environmental Health or connect to a municipal water system. 25. PROJECT DESCRIPTION/SITE CHARACTERISTICS: This is an application for a Use Permit to allow a mini -storage business with outdoor vehicle and boat storage. The project also proposes to allow two existing mobile homes approved for use as real estate offices to be used as dwelling units for two years after approval of the Use Permit. Fifty-six enclosed storage spaces will be provided, along with 39 outdoor storage spaces for vehicles. According to the applicant the enclosed storage spaces are primarily intended for the storage of vehicles, but any items may be stored in these spaces. The mini -storage structures will be 9'h feet tall at the rear; with a 2'/z foot high parapet, and gradually sloping to a height of eight feet at the front. The roofs of the structures will be galvanized metal. The chain link fence that will be installed will have green slats. The mini -storage structures will abut the property line on the north and south sides. There will be a ten foot building setback from the west property line because the parcels to the west are zoned for residential use. The outside storage area and all driving surfaces will be graveled. Hours of operation will be daily from 7:00 a.m. to 9:00 p.m. One of the mobile homes will be used as the office for the mini -storage business and as the residence for a caretaker/night watchman. A chain link fence with a gate will be installed on the east end of the mini -storage structures. Access to the storage units will be via the existing driveway on the south side of the property. Sewage disposal for the existing residence and offices is handled by on-site septic systems. Domestic water supply for the site is provided by the Del Oro Water Company. The 1.2 -acre project parcel is developed with three mobile homes, one of which is. used as a dwelling and the other two as real estate offices. The two real estate offices are allowed under Use Permit 75- 82 and Use Permit 90-29. Vegetation on the site consists of scattered pines, some oaks, and dogwoods. The area where the storage units will be located is cleared and graded. No drainages are found on the site. The project site has a very gentle slope to the northwest. Fire hydrants are located along Skyway. The project site is zoned H -C (Highway Commercial) and has a General Plan Land Use designation of Commercial. Surrounding parcels are zoned H -C to the north, south, and east (across Skyway) and R-1 to the west. Surrounding parcels range in size from .27 acres to 1.5 acres. Land uses on surrounding parcels include single family dwellings to the west, commercial uses to the north and east (across Skyway), and a church to the south. The storage units will abut the church parking lot. The project site is not located within the Firhaven Creek, Paradise Reservoir, and Magalia Reservoir. Watershed Protection Zone. ANALYSIS: The project site is zoned H -C (Highway Commercial), which requires a Use Permit for commercial uses. The project parcel is designated by the Land Use Element Map of the Butte County General Plan as Commercial, which lists commercial uses as a Primary Use. Residential Use The applicant proposes to convert the two real estate offices, which are operated out of two mobile homes on the site, to a residential use for two years after approval of the Use Permit. The applicant stated that the reason for the residential use is to bring in some income on the property until the mini- storage business is constructed. The Highway Commercial zone allows multiple single family residences with a Use Permit (Butte County Code section 24-155(c)(1)). No significant impacts are expected to occur due to the temporary residential use. A condition of this project requires that the residential use of the two real estate offices terminate no later than two years from approval of the Use Permit. The applicant intends to remove the two mobile homes at that time. The third mobile ■ BUTTE COUNTY PLANNING COMMISSION AGENDA REPORT 0 PAGE 2 ■ home on the site, which is currently used as a dwelling unit, will be used as the office for the mini - storage business and as a caretaker's/night watchman's residence. Aesthetic Concerns The project site is zoned Highway -Commercial and commercial structures, such as the proposed mini -storage business, are normally found in this zone.. Commercial structures are located on the adjacent parcel to the north of the site, a mini -storage business is located across Skyway from the project site, and a church is located on the adjacent parcel to the south of the project site. The project site is not located along a County or State designated scenic highway. The mini -storage structures will be 9'/z feet tall at the rear, with a 2'/z foot high parapet, and gradually sloping to a height of eight feet at the front. The applicant proposes to paint the structures a red rust color, with off-white doors. The roofs of the structures will be galvanized metal. The mini -storage structures will sit back approximately 110 feet from the edge of Skyway. The view from the surrounding parcels, especially from the residential -zoned parcels to the west of the site, will be altered due to the project. Because the project site abuts a residential zone on the west side, a ten foot building setback is required. A mitigation measure is recommended that requires the ten -foot setback area be planted with evergreen trees to help shield the mini -storage structures from view on the adjacent parcels to the west. The view from the parcel to the north of the site will not be significantly impacted because this parcel is already developed with a large commercial structure which lies next to the property line. The view from the church parking lot on the adjacent parcel to the south of the project site will be altered. The mini -storage structure will abut the wood fence that lies on the common property line, and will extend approximately six feet above the fence. Because no building setback is required by the H -C zone (unless it abuts a residential zone, which in this instance is does not), there is no area where trees could be planted to.help shield the structure from view from the church. While the view from the church parking lot will change, it will not cause a significant visual impact because the proposed mini -storage structure will not block a scenic vista or view. The mini -storage business may have nighttime lighting for security and safety reasons. In order to prevent lighting from causing glare and excess light on adjacent parcels, a mitigation measure is recommended that requires all outside lighting be fully shielded and contained on-site to prevent light from causing an impact on adjacent properties. The mitigation measure also prohibits placing lights on the rear of the mini -storage structures. Noise Impacts Temporary and single event noise levels will be created during the construction phase. Grading equipment and installation of the mini -storage structures will generate the most noise. Due to the project site's location adjacent to a residential zone, significant noise impacts may occur. Additionally, construction activity occurring on Sunday may generate noise levels that could cause a significant impact to. worshipers at the church on the adjacent parcel. In order to limit construction ■ BUTTE COUNTY PLANNING COMMISSION AGENDA REPORT 0 PAGE 3 m noise impacts to the nearby residents and to the church, a mitigation measure is recommended that limits construction activity from 7:00 a.m. to 6:00 p.m. Monday through Friday, and 10 a.m. to 6 p.m. Saturday and holidays. No construction activity will be allowed on Sundays. After the mini -storage business is constructed, the primary noise that will be generated will be from vehicles arriving and departing the site. The opening and closing of the doors on the storage units will also -generate some noise. These noises are not expected to create a significant impact due to the low number of vehicle trips that the mini -storage business will generate and due to the low number of units available for rent. Traffic Circulation Impacts Access to the site is proposed to be from an existing driveway onto Skyway. The vehicle speed on Skyway at the site is 35 MPH. There is excellent site vision of Skyway in both directions from the site driveway. Skyway at the site is two lanes with a center turning lane. Based upon the number of enclosed storage units proposed (56), the proposed mini -storage business will generate approximately 16 vehicle trips on weekdays, 14 vehicle trips on Saturdays, and 10 vehicle' trips on Sundays. Peak hours of vehicle traffic generated by the proposed mini -storage business will be weekdays 12 noon to 5:00 p.m., Saturdays 12 noon to 1:00 p.m.; and Sundays 1:00 p.m. to 4:00 p.m. The outdoor vehicle storage component of the project is expected to generate a very low number of vehicle trips. Due to the low number of vehicle trips that will be generated by the proposed mini -storage business, no significant vehicle circulation impacts are anticipated. The Butte County Public Works Department requests that the applicant install a standard public road connection (County Standard S-18) for the approach to the site driveway. This will be added as a condition of project approval. The Public Works Department also requests that 40 feet of right-of- way from the centerline of Skyway be deeded to Butte County. The 40 feet of right-of-way may have already been deeded, but if not the condition assures the dedication is accomplished. ACTIONS FOR CONSIDERATION: Staff recommends that the Planning Commission take the following actions: I. Adopt a Mitigated Negative Declaration regarding environmental impacts, with mitigation measures 1 through 6, as detailed in this agenda report, and authorize the Chair to sign, with the following findings: A. Find that an Initial Study was completed in compliance with the California Environmental Quality Act, that said study identified potential significant environmental effects and includes mitigation measures that -would mitigate such effects below significant levels, and that a Mitigated Negative Declaration is proposed. ■ BUTTE COUNTY PLANNING COMMISSION AGENDA REPORT ■ PAGE 4 ■ B. Find that the Planning Commission has considered the proposed Mitigated Negative Declaration, together with comments received during the public review. process. C. Find, on the basis of the whole record before the Planning Commission, including the Initial Study and -any comments received, that there is no substantial evidence that the Use Permit project for Dan Kennedy, as mitigated, will have a significant effect on the environment. D. Find that the proposed Mitigated Negative Declaration reflects the independent judgement and analysis of the County, which is the lead agency. II. The design of the proposed project improvements will not cause environmental damage to fish ' and wildlife or their habitat because the property does not contain any significant amounts of wildlife habitat and the area where the mini -storage business will be located has been already been cleared of vegetation. Therefore, a "de minimus" impact of finding regarding fish and wildlife and their habitat is hereby made. The collection of fees pursuant to Fish and Game Code Section 71.1.4(d)(3) and 14 CCR 753.5. is not required. III: Approve Use Permit 01-16 for Dan Kennedy, subject to the conditions found in Exhibit A and subject to the following findings: A. The proposed use of the property will not impair the integrity and character of the zone in which the land lies, and that the use would not be unreasonably incompatible with, or injurious to, surrounding property, or detrimental to the health, safety and general welfare of the persons residing or working in the neighborhood, or to the general health, welfare and safety of the County because: - All outside lighting at the mini -storage unit will be fully shielded. 2. Measures are required to be taken during construction activities to prevent fugitive dust emissions. 3. The times of construction activities are limited to prevent significant noise impacts to adjacent residents and an adjacent church. After construction, the project will not create any significant noise impacts. 4. Skyway has the capacity,to handle the increase in vehicle traffic generated by the project. 5. Failure to comply with the conditions specified herein as the basis for approval of application and issuance of Permit, constitutes cause for the revocation of said permit in accordance with the procedures set forth in the Butte County Zoning Ordinance, including Butte County Code Sec. 24-45.65. 2. Unless otherwise provided for in a special condition to this use permit, all conditions must be completed prior to or concurrently with the establishment of the granted use. The use granted by, this permit must be established within 24 months of the delivery of the countersigned permit to the Permittee. 3. Minor changes may be approved administratively by the Directors of Development Services, Environmental Health, or Public Works, or their respective designee, upon receipt of a substantiated written request by the applicant. Prior to such approval, verification shall be made by each Department or Division that the modification is consistent_ with the application, fees paid and environmental determination as conditionally approved. Changes deemed to be major or significant in nature shall require a formal application for amendment'. 4. If any use for which a use permit has been granted is not established within two years of the date of receipt of the countersigned permit by the Permittee, the permit shall become null and void and reapplication and a new permit shall be required to establish the use. 5. The terms and conditions of this permit shall run with the land and shall be binding upon and be to the benefit of the heirs, legal representatives, successors, and assigns of the Permittee. ■ BUTTE COUNTY PLANNING COMMISSION AGENDA REPORT ■ PAGE 7 ■ Conditions of Approval: Planning Division Evergreen trees shall be planted in the ten -foot building setback area on the west property line to help shield the mini -storage structure from the adjacent parcels. A plan showing the location and type of each tree planted shall be submitted -to and approved by the Planning Division prior to the issuance of a Building Permit. The plan shall depict the irrigation method. The trees shall be installed prior to the Issuance of a Certificate of Occupancy for the first building installed or shall be bonded for an amount determined by the Director of Development services or his or her designee. The trees shall be maintained in a healthy condition and replaced as necessary in order to maintain the visual shield. (Mitigation Measure) 2. All outdoor lights associated with the mini -storage use shall be fully shielded. Lights shall be directed downward and contained on-site. Direct light shall not be allowed on adjoining properties and roads. No lights shall be placed on the rear of the mini -storage structures. (Mitigation Measure) 3. Measures shall be taken to control fugitive dust emissions from all civil construction associated with development of the site. Standard Mitigation Measures to prevent or reduce fugitive dust emissions can be obtained from the Butte County Air Quality Management District. (Mitigation Measure) 4. Prior to the issuance of building permits a plan for a permanent solution for drainage shall be submitted to and approved by the Department of Public Works. The drainage plans shall specify how drainage waters shall be detained on site and or conveyed to the nearest natural or publicly maintained drainage channel or facility and shall provide that there shall be no increase in the peak flow runoff to said channel or facility. A copy of the approved plan shall be submitted to the Planning Division and the Building Division. (Mitigation Measure) 5. Maintenance of vehicles stored on the site shall not be allowed. The applicant shall place language into the rental agreement that states vehicle maintenance is not allowed. Prior to issuance of building permits, the applicant shall provide a copy of the rental agreement to the Planning Division for review and approval'. (Mitigation Measure) 6. Development activity shall be limited to 7:00 a.m. to 6:00 p.m. Monday through Friday, and 10 a.m. to 6 p.m. Saturday and holidays. No site development activity shall occur on Sundays. (Mitigation Measure) 7. The project site shall be developed in accordance with the approved project site plan and the conditions contained herein. No hazardous or explosive materials shall be stored in the storage unit facility. Hazardous materials are defined as any substance or material that, by reason of its toxic, caustic, corrosive, abrasive, or otherwise injurious properties, may be detrimental or deleterious to the health of any person handling or otherwise coming into contact with such material or substance. The property owner shall place language in the rental agreement for each storage unit stating that storage of hazardous or explosive material is .prohibited. Prior to establishment of the use, a copy of the proposed rental agreement shall be submitted to and approved by the Planning Division to verify compliance with this condition. 9. The hours of operation shall be restricted to the hours between 7:00 a.m. and 9:00 p.m. 10. Prior to use of this project, the applicant shall contact the Planning Division for a field inspection to verify all conditions of approval and ordinance requirements have been met. 11. Use of the two mobile homes as residential uses shall be allowed for only two years after approval of the Use Permit. The two mobile homes shall be removed from the site no later than two years from approval of the Use Permit. Public Works Department 12. Prior to the issuance of building permits obtain encroachment permit for standard 5-18 road approach and construct it to County standards, as specified in County Improvement Standards. 13. Prior to the issuance of building permits deed to Butte County, in fee simple, 40 feet of right- of-way from the centerline of Skyway. The right of way shall be sufficient for the installation of standard No. S-5 at all street intersections. 14. Prior to the issuance of building permits a plan for a permanent solution for drainage shall be submitted to and approved by the Department of Public Works. The drainage plans shall specify how drainage waters shall be detained on site and or, conveyed to the nearest natural or publicly maintained drainage channel or facility and shall provide that there shall be no increase in the peak flow runoff to said channel or facility. A copy of the approved plan shall be submitted to the Planning Division and the Building Division. (Mitigation Measure) Fire Department 15. Construction, installation or development of structures or facilities on the parcels/lots shall comply with the latest California Fire Safe Regulations, (Public Resources Code 4290), and all other applicable State and County codes, ordinances and regulations in effect at the time of application for improvement permits. 16. Sewage disposal for the existing dwelling and the offices on the site is handled by an on-site septic system. The mini -storage structures will not require a septic system. The Butte County Environmental Health Division requests that the septic system for the existing mobile home be upgraded or repaired. The Environmental Health Division also requests that the on-site well pass a potable water test or connect to a municipal water system (Del Oro Water Company). The proposed mini -storage structures will create approximately 12,000 square feet of new impervious surfaces on the site. Additionally, the compacted soils of the driving area and the outdoor storage area have a lower permeability than soils left in their natural state. A significant increase in surface water runoff can be expected due to the reduced absorption rate created from the new impervious surfaces, which may have a significant impact on downstream drainages. In order to prevent any significant impacts to drainages, a plan for a permanent solution for drainage is required to be submitted to and approved by the Department of Public Works. The drainage plans are required to specify how drainage waters will be detained on site and/or conveyed to the nearest natural or publicly maintained drainage channel or facility and will provide that there be no increase in the peak flow runoff to said channel or facility. The applicant intends to use the ten foot building setback area on the west property line for water detention purposes. Mitigation Measure # 1, found in item 1 above, requires that evergreen trees be planted in the 10 -foot setback area, but doing so may conflict with the use of the setback area for water detention purposes. The applicant stated that the setback area could be increased in size to accommodate the evergreen trees by shifting.the mini - storage structures to the east. f. The project will allow up to 39 outdoor vehicle storage spaces. The outdoor storage of vehicles may result in various materials, such as engine oils, antifreeze, and transmission fluid, dripping onto the ground. This is not expected to cause a significant impact to water quality because the vehicles will be parked on a gravel surface, which will help prevent rapid stormwater runoff that may be contaminated. Maintenance of vehicles on the site could result in a significant amount of contaminants being deposited on the ground. In order to prevent this, a mitigation measure is recommended that prohibits maintenance of vehicles stored on the, site. g. - i. The project site is not located within a 100 -year flood zone as shown on Federal Emergency Management Agency Flood Insurance Rate Map 06007C -0400C, dated June 8, 1998. j. The property is not located in an area prone to seiche, tsunami, or mudflow. No impact will be incurred with respect to these natural hazards. Grading equipment and installation of the mini -storage structures will generate the most noise. Vehicles containing construction workers, equipment, and material will also generate noise as they arrive and depart the site. Due to the project site's location adjacent to a residential zone significant noise impacts may occur. Additionally, construction activity occurring on Sunday may generate noise levels that could cause a significant impact to worshipers at the church on the adjacent parcel. In order to limit construction noise impacts to the nearby residents and to the church, a mitigation measure is recommended that limits construction activity from 7:00 a.m. to 6:00 p.m. Monday through Friday, and 10 a.m. to 6 p.m. Saturday and holidays. No construction activity will be allowed on Sundays. After the mini -storage business is constructed, the primary noise that will be generated will be from vehicles arriving and departing the site. The opening and closing of the doors on the storage units will also generate some noise. These noises are not expected to create a significant impact due to the low number of vehicle trips that the mini -storage business will generate and due to the low number of units available for rent. e. - f. The project is not located in the vicinity of an airstrip or within an airport land use plan. No impact will be incurred. According to the Institute of Traffic Engineers Trip Generation Handbook (6th Edition), a mini -storage use will generate approximately .28 vehicle trips per storage unit per weekday, .25 vehicle trips per unit on a Saturday, and .18 vehicle trips per unit on a Sunday. Based upon the number of enclosed storage units proposed (56), the proposed mini -storage business will generate approximately 16 vehicle trips on weekdays, 14 vehicle trips on Saturdays, and 10 vehicle trips on Sundays. Peak hours of vehicle traffic generated by the proposed mini -storage business will be weekdays 12 noon to 5:00 p.m., Saturdays 12 noon to 1:00 p.m., and Sundays 1:00 p.m. to 4:00 p.m. The outdoor vehicle storage component of the project is expected to generate a very low number of vehicle trips. Due to the low number of vehicle trips that will be generated by the proposed mini -storage business, no significant vehicle circulation impacts are anticipated... The Butte County Public Works Department requests that the applicant install a standard public road connection (County Standard S-18) for the approach to the site driveway. This will be added as a condition of project approval. f. At least two on-site parking spaces are required to be located at the mini -storage business office and two on-site spaces for each of the two dwelling units on the site. The plan shall depict the irrigation method. The trees shall be installed prior to the Issuance of a Certificate of Occupancy for the first building installed or shall be bonded for an amount determined by the Director of Development services or his or her designee. The trees shall be maintained in a healthy condition and replaced as necessary in order to maintain the visual shield. 2. All outdoor lights associated with the mini -storage use shall be fully shielded. Lights shall be directed downward and contained on-site. Direct light shall not be allowed on adjoining properties and roads. No lights shall be placed on the rear of the mini -storage structures. 3. "Prior to any soil disturbance or construction the applicant shall submit an improvement plan with respect to fugitive dust and air pollution to the Butte County Air Quality Management District for review and determination of approval. Said plan shall include measures to control fugitive dust emissions from all civil construction associated with development of the site. Measures may include site and road watering and/or use of other acceptable soil palliatives. Measures determined to be acceptable by the Air Quality Management District . shall be implemented during all development activities on the site. 4. Prior to the issuance of building permits a plan for a permanent solution for drainage shall be submitted to and approved by the Department of Public Works. The drainage plans shall specify how drainage waters shall be detained on site and or conveyed to the nearest natural or publicly maintained drainage channel or facility and shall provide that there shall be no increase in the peak flow runoff to said channel or facility. A copy of the approved plan shall be submitted to the Planning Division and the Building Division. Maintenance of vehicles stored on the site shall not be allowed. The applicant shall place language into the rental agreement that states vehicle maintenance is not allowed.
