The nonconforming use is a church which proposes to add a 2,052 sq. ft. kitchen and dining room. A 225 sq. ft. gazebo is also proposed. The property is zoned AR -1 (Agricultural Residential - 1 acre parcels) and is located on the north side of Kenilworth Avenue, approximately 400 feet east of Melvina Avenue, at 2290 Kenilworth Avenue, Palermo. APN 026-154-013 (SB) (UP 01-18) (VIDEO) Vice Chairman Mooney excused himself from this hearing and stepped down from the dais. Commissioner Lambert took over as Second Vice Chairman. A video of the site was shown. Mr. Betts gave a brief summary of the project. Second Vice -Chairman Lambert asked if the gazebo, which will be used for weddings, receptions, etc, would increase the attendance and she asked how many days would the new facilities be in use? Mr. Betts said that the Pastor told him nothing would change. The hearing was opened to the public. Pastor Patton said they have a small facility and they do conduct weddings and receptions now. He. said the only change is that when the new facility is complete there might be more weddings. Commissioner Marin asked if there was sufficient parking for the addition? Pastor Patton said there will be. He said they are bringing in gravel to expand the existing parking.area. The hearing was closed. Mr. Betts said he received a new comment sheet from the Department of Forestry regarding Condition 7. He suggested that Condition 7 be changed to say "Fire extinguishers are required every 75 feet." He said the Commission could add a condition for the applicant to provide adequate parking to meet County Code. It was moved by Commissioner Leland, seconded by Commissioner Marin, and carried to approve the Use Permit for the Palermo Baptist Church subject to the findings and conditions listed below. AYES: Commissioners Marin, Leland, and Second Vice Chairman Lambert NOES: No one ABSENT: Chairman Nelson ABSTAINED: Vice Chairman Mooney (he was not a part of the hearing) Determine the project to -be Categorically Exempt from environmental review under Section 15301(6) of the California Environmental Quality Act. This section states that construction of a structure not involving the use of significant amounts of hazardous substances, and not exceeding 2,500 square feet in floor area, is exempt from environmental review. Approve Use Permit 01-18 for the Palermo Baptist Church, subject to the conditions found in Exhibit A and subject to the following findings: A. The proposed use of the property will not impair the integrity and character of the zone in which the land lies, and that the use would not be unreasonably incompatible with, or injurious to, surrounding property, or detrimental to the health, safety and general welfare of the persons residing or working in the neighborhood, or to the general health, welfare and safety of the County because: 1. The expansion of the church will not cause an increase in vehicle traffic because the seating capacity of the church sanctuary will not be increased. 2. The project will not cause a significant increase in noise, dust, or odors. 3. The project will not cause a significant increase in light because conditions of project approval require that all new outside lights be fully shielded. 4. The project will not create an aesthetic impact because the proposed expansion will be similar to the existing church structure. 5. A drainage plan must be submitted to and approved by the Public Works Department that provides for no increase in stormwater runoff caused by the project. B. The project is consistent with the Agricultural -Residential General Plan land use designation, which allows quasi -public uses as Secondary Uses. C. The project is consistent with the AR -1 zone, which allows quasi -public uses with a Use Permit. D. The expansion of the church will not conflict with, impair, or be detrimental to the uses both permitted and conditional of the AR -1 zone. Conditions of Approval: Planning Division 1. All new outdoor lights on the project site shall be fully shielded to prevent glare and excess light on adjacent parcels. 2. Applicant shall implement measures to prevent fugitive dust emissions during all construction activities. 3. The project site shall be developed in accordance with the approved project site plan and the conditions contained herein. Proposed improvements shall comply with Title 24 energy conservation regulations. Appropriate compliance forms (two sets) shall be submitted indicating compliance with those standards. 11. Proposed improvements shall comply with Public Resource Code 4290 Fire Safe Construction standards. 12. Development fees for the proposed residential or non-residential improvements shall be paid prior to the issuance of building permits. The fees shall be those in effect at time of application, and shall include, but not be limited to, School Fees, Park and Recreation District Fees, Drainage Fees, Water and Sewer Service Fees, Permit and Plan Check Fees, and Fire Protection Fees. Prior to such approval, verification shall be made by each Department or Division that the modification is consistent with the application, fees paid and environmental determination as conditionally approved. Changes deemed to be major or significant in nature shall require a formal application for amendment. 4. If any use for which a use permit has been granted is not established within two years of the date of receipt of the countersigned permit by the Permittee, the permit shall become null and void and reapplication and a new permit shall be required to establish the use. 5. The terms and conditions of this permit shall run with the land and shall be binding upon and be to the benefit of the heirs, legal representatives, successors, and assigns of the Permittee. Conditions of Approval: Planning Division All new outdoor lights on the project site shall be fully shielded to prevent glare and excess light on adjacent parcels. l 2. Applicant shall implement measures to prevent fugitive dust emissions during. all construction activities. 3. The project site shall be developed in accordance with the approved project site plan and the conditions contained herein. Said site plan is on file in the Planning Division, is identified as "Exhibit D", and is date stamped February 15, 2001, and is incorporated herein by this reference. Public Works Department 4. Prior to the issuance of building permits obtain an encroachment permit for all new or existing driveway approaches and construct them to County standards, as specified in County Improvement Standards. I 5. Prior to the issuance of building permits a plan for a permanent solution for drainage shall be submitted to and approved by the Department of Public Works. The drainage plans shall specify how drainage waters shall be detained on-site and/or conveyed to the nearest natural or publicly maintained drainage channel or facility and shall provide that there shall be no increase in the peak flow runoff to said channel or facility. Fire Department/CDF 6. Building identification and/or addresses shall be installed in conformance with Public Resources Code 4290 and shall be posted at the beginning of building construction and maintained continuously thereafter. 7.
