The change will be from a church to a day care center for up to 41 children. The day care center will use the existing 1,968 square foot church structure. The First United Pentecostal Church will manage the day care center. The property is zoned A -R (Agricultural - Residential) and is located on the northwest corner of Tenth Street and Thermalito Avenue, at 1619 Tenth Street, Thermalito. APN 031-253-044 (SB) (UP 01-20) (VIDEO) Mr. Breedon gave a brief summary of the project. A video was shown. He emphasized the need to for 50 feet of dispersal area as shown in Condition 11. The hearing was opened to the public. Ron Woodward said there was a Use Permit issued on the property next door to this parcel. The hearing was closed. It was moved by Mr. Mooney, seconded by Commissioner Marin, and unanimously carried for approval of a Use Permit for the First United Pentecostal Church subject to the findings and conditions listed below. I. Determine the project to be Categorically Exempt -from environmental review under Section 15303 of the California Environmental Quality Act. This section states that the conversion of an existing small structure from one use to another where only minor modifications are made in the exterior of the structure. The existing building does not exceed 2,500 square feet, will not require any exterior modifications, and the project does not involve the use of any hazardous materials. H. Approve Use Permit 01-20 for the First United Pentecostal Church, subject to the following findings and conditions found in Exhibit A: , A. The proposed use of the property will not impair the integrity and character of the zone in which the land lies, and that the use would not be unreasonably incompatible with, or injurious to, surrounding property, or detrimental to the health, safety and general welfare of the persons residing or working in the neighborhood, or to the general health, welfare and safety of the County because: The project will not cause any significant vehicle circulation impacts. The maximum number of children allowed in the play yard at any one time is limited to thirteen children in order to prevent significant noise impacts to adjacent residential uses. 3. The project will not create an aesthetic impact because no exterior modifications to the existing structure are proposed or required 4. There is sufficient parking area on the site for the proposed use. 5. The parking area and driveway are required to either be paved or treated with a dust palliative in order to prevent fugitive dust emissions. B. The change in nonconforming use from a church to a day care center will not conflict with, impair, or be detrimental to the uses both permitted and conditional of the zone in which it is located and/or adjoins as determined by the findings contained in paragraph A.1. through A.5. above. C. The project is consistent with the Agricultural -Residential zone, which allows a quasi -public use with a Use Permit. D. The project is consistent with the General Plan land use designation of Low Density . Residential, which lists a quasi -public use as a Secondary Use. E. The project site is located in Airport Compatibility Zone D, which does not have any limitation on density or intensity of uses. Conditions of Approval: Planning Division No more than thirteen (13) children shall be allowed in the play yard at any one time. 2. Enlargement or major exterior modifications to the existing structure shall not be allowed unless a new Use Permit is first obtained. 3. Prior to issuance of a building permit for the interior modifications, the parking area and driveway shall either be paved or shall be treated with a dust palliative to prevent fugitive dust emissions. If dust palliatives are used they shall be reapplied as necessary to maintain their effectiveness. 4. Provide a minimum of three (3)•on-site parking spaces. Landscaping shall be installed in the parking lot per the requirements of the Butte County Zoning Ordinance. Prior to issuance of the Use Permit, the applicant shall submit a landscaping plan showing the location and types of vegetation to be planted. The landscaping plan shall also show the method of irrigation. All landscaping shall be maintained in a healthy condition and replaced as necessary. 5. The project site shall be developed in accordance with the approved project site plan and the conditions contained herein. Said site plan is on file in the Planning Division, is date- stamped May 9, 2001, and is incorporated herein by this reference: 6. One (1) free-standing sign is allowed, not exceeding thirty-five (35) square feet in size and no higher than four (4) feet above ground level. 7. Meet the requirements of the Thermalito Irrigation District. Fire Department 8. Applicant must comply with California Code of Regulations Title 19; 1998 , California Building and Fire Codes. 9. A "local' fire alarm system "(utilize NFPA 72 and California Electrical Code) and fire extinguishers are required - the fire department will assist locating manual pull stations and extinguishers. 10. Apply to the State of California Community Care Licensing for a "Form 850 - Request for Fire Department Inspection." Building Division 11. Prior to the issuance of a building permit, prove to the satisfaction of the Building Division that the project meets the Safe Dispersal Requirements of the 1998 California Building Code, Section 1007.3.11. 12. Building Permits Required. Prepare .four (4) sets- of construction plans and make an application for permit. Construction shall comply with federal, state, and local regulations. Plans shall be prepared, sealed and signed by a California Licensed Architect or Registered Engineer for non-residential buildings,and certain residential buildings. 13. Proposed improvements constitute a "change in use" or "change in the character of use" as stated in the building code. Improvement plans shall incorporate all code -required elements for the new use. 14. All structures shall be made accessible to the disabled. Disabled accessible -parking and an accessible path of travel shall be provided. 15. Proposed improvements shall comply with Title 24 energy conservation regulations. Development fees for the proposed residential or non-residential improvements shall be paid prior to the issuance of building permits. The fees shall be those in effect at time of application, and shall include, but not be limited to, School Fees, Park and Recreation District fees, Water and Sewer Service Fees, Permit and Plan Check fees, and Fire Protection Fees. Unless otherwise provided for in a special condition to this use permit, all conditions must be completed prior to or concurrently with the establishment of the granted use. The use granted by this permit must be established within 24 months of the delivery of the countersigned permit to the Permittee. 3. Minor changes may be approved administratively by the Directors of Development Services, Environmental Health, or Public Works, or their respective designee, upon receipt of a substantiated written request by the applicant. Prior to such approval, verification shall be made by each Department or Division that the modification is consistent with the application, fees paid and environmental determination asconditionally approved. Changes deemed to be major or significant in nature shall require a formal application for amendment. 4. If any use for which a use permit has been granted is not established within two years of the date of receipt of the countersigned permit by the Permittee, the permit shall become null and void and reapplication and a new permit shall be required to establish the use. 5. The terms and conditions of this permit shall run with the land and shall be binding upon and be to the benefit of the heirs, legal representatives, successors, and assigns of the Permittee. Conditions of Approval: Planning Division No more than thirteen (13) children shall be allowed in the play yard at any one time. 2. Enlargement or major exterior modifications to the existing structure shall not be allowed unless a new Use Permit is first obtained. 3. Prior to issuance of a building permit for the interior modifications, the parking area and driveway shall either be paved or shall be treated with a dust palliative to prevent fugitive dust emissions. If dust palliatives are used they shall be reapplied as necessary to maintain their effectiveness. 4. Provide a minimum of three (3) on-site parking spaces. Landscaping shall be installed in the parking lot per the requirements of the Butte County Zoning Ordinance. Prior to issuance of the Use Permit, the applicant shall submit a landscaping plan showing the location and types of vegetation to be planted. The landscaping plan shall also show the method of irrigation. The landscaping shall be installed prior to issuance of a Certificate of Occupancy or Final Inspection by the Building Division. All landscaping shall be maintained in a healthy condition and replaced as necessary. 5. The project site shall be developed in accordance with the approved project site plan and the conditions contained herein. Said site plan is on file in the Planning Division, is date- stamped May 9, 2001, and is incorporated herein by this reference. 6. One (1) free-standing sign is allowed, not exceeding thirty-five (35) square feet in size and no higher than four (4) feet above ground level. 7. Improvement plans shall incorporate all code -required elements for the new use. 14. All structures shall be made accessible to the disabled. Disabled accessible parking and an accessible path of travel shall be provided. 15. Proposed improvements shall comply with Title 24 energy conservation regulations. Appropriate compliance forms (two sets) shall be submitted indicating compliance with those standards. 16. Development fees for the proposed residential or non-residential improvements shall be paid prior to the issuance of building permits. The California Community Care Licensing Board is the agency responsible for licensing the day care center. Sewage disposal for the existing structure is handled by the Thermalito Irrigation District. Domestic water supply for the site is also provided by the Thermalito Irrigation District. The 0.66 -acre project parcel is developed with 1,968 square foot building that was until recently used by the applicant for a church. Two 80 -square foot storage sheds are also located on the site. Most of the project site is undeveloped and consists of an open dirt/gravel area that is used for parking. No significant amounts of vegetation are found on the property. The project site is level. There are no curbs, gutters, or sidewalks in the area, but unlined drainage ditches are located along the Tenth Street and Thermalito Avenue frontages of the site. A fire hydrant is located on the southeast corner of the property. The project site is located approximately 2 miles northeast of the Oroville Airport, and is within Airport Compatibility Zone "D". The project site is zoned A -R (Agricultural -Residential) and has a General Plan Land Use designation of Low Density Residential. Surrounding parcels are zoned A -R and range in size from 0.27 acres to 1.5 acres. Land uses on the surrounding parcels are single family dwellings at suburban densities and a large lot planted with olive trees. An elementary school is located 800 feet to the south of the site. The applicant received a Use Permit in 2000 to establish a church on the adjoining parcel with the olive orchard (to the northwest of the project site), but that church use has not been established and the property is undeveloped. The existing building was constructed at a time when building permits were not required (prior to 1962) and there was either no zoning at that time or the zoning allowed a church use by right. The property was zoned to A -R in 1984. Previous zoning of the property was A-1 in 1953 and then to A-2 in 1955. ANALYSIS: A change of a legal nonconforming use requires approval of a Use Permit (Butte County Code Section 24-35.20). This section states that when considering a Use Permit for a nonconforming use, the Planning Commission shall grant the Use Permit when it finds that the change, expansion, enlargement, extension, reconstruction, or structural alteration of such use will not conflict with, impair or be detrimental to the uses both permitted and conditional of the zone in which it is located and/or adjoins. This finding is in addition to the findings required by Section 24-45.10 of the Butte County Zoning Ordinance. Pursuant to Section 24-45.15 the Planning Commission may impose conditions upon the issuance of the Use Permit which are reasonably related to the use of the property for which the Use Permit is requested. In addition the Planning Commission may at its own discretion establish a date for either the termination of the use or review of the Use Permit. The proposed day care center is a quasi -public use because it will be operated by the applicant (the First United Pentecostal Church), which is a non-profit organization, and will provide day care services to the community. The A -R zone requires a Use Permit for a quasi -public use. The project ■ BUTTE COUNTY PLANNING COMMISSION AGENDA REPORT ■ PAGE 2 ■ parcel is designated by the Land Use Element Map of the Butte County General Plan as Agricultural - Residential, which lists quasi -public uses as a Secondary Use. Noise Impacts Only interior modifications to the existing structure are needed, and the noise generated by that construction activity will not create any impacts to nearby residents. The only outside construction activity that will generate noise will be the installation of a chain-link fence around the playground area. The installation of the fence will not create a significant impact to the surrounding residential uses. The arrival and departure of vehicles from the project site will create some noise. The vehicle noise will be primarily during the morning and late aftemoon/early evening hours when parents drop off and pick up their children. The noise from vehicles arriving and departing the site is not expected to create any significant noise impacts because it will occur during normal rush hour time periods when noise from existing vehicles is at a maximum. Additional noise will be generated by children playing outside. The proposed play area is located on the north and west sides of the buildings. The residents of the houses on the adjacent parcels may be impacted by the noise generated by children playing in the play yard. According to the applicant, no more than thirteen children will be allowed in the play area at any one time. In order to prevent any significant noise impacts, a condition of approval limits the number of children in the play area to no more than thirteen at any one time. Traffic Circulation Impacts Access to the site is from an existing gravel driveway off of Tenth Street. Additional access is from Thermalito Avenue over an unimproved dirt driveway. The posted speed limit on Tenth Street and Thermalito Avenue is 25 MPH. There is excellent site vision of Tenth Street and Thermalito Avenue in both directions from the driveways. A stop sign is located on Thermalito Avenue at Tenth Street. The proposed day care facility. is estimated to generate 159 to 185 vehicle trips per day. These estimates were obtained from the Institute of Transportation Engineers Trip Generation handbook (6th Edition). Two methods were used to determine the trip generated rate - the size of the structure and the number of children. Based upon the maximum number of children that will attend the day care center, the proposed day care center is estimated to generate approximately 185 vehicle trips each day (4.52 vehicle trips x 41 children). Alternatively, based upon the gross floor area of the day care center (2,000 square feet), the proposed day care center is estimated to generate approximately 159 vehicle trips each day (79.26 vehicle trips per 1,000 square feet of gross floor area). Peak hours of vehicle traffic generated by the proposed day care center will coincide with the peak hour of the adjacent street traffic (7:00 a.m. to 9:00 a.m. and 4:00 p.m. to 6:00 p.m.). The Sierra Avenue Elementary School is located one block to the south of the project site. The morning peak hour of vehicle traffic generated by the elementary school use will coincide with the ■ BUTTE COUNTY PLANNING'COMMISSION AGENDA REPORT ■ PAGE 3 ■ proposed day care center, which could lead to some vehicle circulation impacts in the area. Short term delays may occur at the intersection of Tenth Street and Thermalito Avenue due to the project. The school afternoon peak hour will occur before most children at the day care center are picked up by their parents so no significant vehicle circulation impacts during the evening peak hours are anticipated. Dust Emissions The parking area and driveway consists of a gravel/dirt surface. Vehicles driving on the parking area may create fugitive dust emissions that impact the residents on the surrounding and nearby properties. The City of Oroville commented that the parking area should be paved or treated so as to prevent fugitive dust emissions. In order to prevent fugitive dust emissions, the parking area and driveway are required to either be hard surfaced or treated with a dust palliative. Safe Dispersal Requirements According to the Building Division, the proposed fenced playground area does not appear to conform to the Safe Dispersal Requirements of the 1998 California Building Code, Section 1007.3.11. This section allows fences around school grounds (note: the Building Division considers the proposed day care center to be a school use), provided that safe dispersal areas based upon 3 square feet per occupant are located between the building and the fence, and that such safe dispersal areas are located not less than 50 feet from the building. The play yard as proposed does not appear to meet these safe dispersal requirements because there is only 30 to 38 feet between the building and the fence. However, it appears that the play yard could be extended further to the south of the building to allow for the required removal of area and distance. This would require removal of three parking spaces, but these spaces can be easily accommodated elsewhere on the property. The project is conditioned to require that the Safe Dispersal Requirements of the 1998 California Building Code be met. On -Site Parking Requirements The Parking Regulation of the Butte County Zoning Ordinance (Section 24-250(b)) does not specify the number of parking spaces required for a day care center use. Uses similar to this use, such as a nursery or pre-school uses, are listed and the minimum parking requirement is one space per classroom or office ( but in no case is less than three spaces). The floor plan for the proposed day care center shows one classroom and one office. The site plan shows that there will be eleven parking spaces, one of which is a handicapped parking space. This number of parking spaces exceeds what is required by the Zoning Ordinance and is sufficient to handle the parking needs of the day care center. ' Comments from Other Agencies The project site is located approximately two miles from the nearest runway at the Oroville Municipal Airport. Comments received from the Butte County Airport Land Use Commission ■ BUTTE COUNTY PLANNING CONIMMSSION AGENDA REPORT ■ PAGE 4 ■ (ALUC) staff stated that the project site is located in Airport Compatibility Zone D. Zone D does not have any limitation on density or intensity of uses; ALUC staff stated that the project is compatible with airport operations and safety concerns. The Butte County Environmental Health Department did not object to the project and did not recommend any conditions. The Environmental Health Department stated that day care facilities are inspected and licensed through the State Community Care Licensing Board. The Butte County Fire Department/CDF commented that the building must meet the requirements of the California Building Code and that a "local' fire alarm system and fire extinguishers are required. The Fire Department/CDF also stated that the applicant must apply to the State of California Community Care Licensing for a "Form 850 - Request for Fire Department Inspection." The Thermalito Irrigation District (TID), which provides public water and sewer services to the site, did not object to the project. TID states that some on-site water and sewer infrastructure improvements may be required due to the proposed day care center use. The City of Oroville commented that the entire designated parking area should be covered with a dust -free surface in accordance with development standards for the City of Oroville. The City also commented that curbs, gutters, sidewalks, and a paved parking lane should be constructed along 10th Street adjacent to the portion of the site that is proposed to be used in accordance with development standards for the City of Oroville. Staff does not recommend that street improvements be a condition of project approval because no other properties in the project area have curbs, gutters, and sidewalks. According to the Butte County Building Division, the proposed day care center constitutes a change in use as stated in the building code. The existing building is required to meet the requirements of the Uniform Building Code for a day care use. The project is conditioned to meet the requirements of the Uniform Building Code and the California Building Code. ACTIONS FOR CONSIDERATION: Staff recommends that the Planning Commission take the following actions: I. Determine the project to be Categorically Exempt from environmental review under Section 15303 of the California Environmental Quality Act. This section states that the conversion of an existing small structure from one use to another where only minor modifications are made in the exterior of the structure. The existing building does not exceed 2,500 square feet, will not require any exterior modifications, and the project does not involve the use of any hazardous materials. 11. Approve Use Permit 01-20 for the First United Pentecostal Church, subject to the following findings and conditions found in Exhibit A: ■ BUTTE COUNTY PLANNING CONMSSION AGENDA REPORT ■ PAGE 5 ■ A. Tenth Street and Thermalito Avenue have the capacity to handle the increase in vehicle traffic generated by the project. 2. The maximum number of children allowed in the play yard at any one time is limited to thirteen children in order to prevent significant noise impacts to adjacent residential uses. 3. The project will not create an aesthetic impact because no exterior modifications to the existing structure are proposed or required. 4. There is sufficient parking area on the site for the proposed use. 5. The parking area and driveway are required to either be paved or treated with a dust palliative in order to prevent fugitive dust emissions. B. The change in nonconforming use from a church to a day care center will not conflict with, impair, or be detrimental to the uses both permitted and conditional of the zone in which it is located and/or adjoins as determined by the findings contained in paragraph A.1. through A.5. above. C. The project is consistent with the Agricultural -Residential zone, which allows a quasi -public use with a Use Permit. D. Prior to such approval, verification shall be made by each Department or Division that the modification is consistent with the application, fees paid and environmental determination as conditionally approved. Changes deemed to be major or significant in nature shall require a formal application for amendment. 4. If any use for which a use permit has been granted is not established within two years of the date of receipt of the countersigned permit by the Permittee, the permit shall become null and void and reapplication and a new permit shall be required to establish the use. 5. Prior to issuance of a building permit for the interior modifications, the parking area and. driveway shall either be paved or shall be treated with a dust palliative to prevent fugitive dust emissions. Plans shall be prepared, sealed and signed by a California Licensed Architect or Registered Engineer for non-residential buildings and certain residential buildings. 13. Proposed improvements constitute a "change in use" or "change in the character of use" as stated in the building code. Improvement plans shall incorporate all code -required elements for the new use. 14. All structures shall be made accessible to the disabled. Disabled accessible parking and an accessible path of travel shall be provided. 15. Proposed improvements shall comply with Title 24 energy conservation regulations. Appropriate compliance forms (two sets) shall be submitted indicating compliance with those standards. 16. Development fees for the proposed residential or non-residential improvements shall be paid prior to the issuance of building permits. The fees shall be those in effect at time of application, and shall include, but not be limited to, School Fees, Park and Recreation District fees, Water and Sewer Service Fees, Permit and Plan Check fees, and Fire Protection Fees. Other Condition 17. Applicant must also comply with all other applicable State and local statutes, ordinances and regulations. PROJECT DESCRIPTION/SITE CHARACTERISTICS: This is an application for a Use Permit to allow a change in a legal, nonconforming use. The change will be from a church to a day care center for up to 41 children. The daycare center will be operated out of the existing 1,968 square foot church structure. The day care center will be for preschool children ages 2 to 5 years old. Hours of operation will be from 7:00 a.m. to 6:00 p.m., Monday through Friday. There will be up to three employees, depending on the number of children in attendance. Interior modifications to the existing structure will be required to meet Uniform Building Code requirements for the proposed use, but no exterior structural modifications are proposed. A new six foot tall chain-link fence will be placed around the outside play area on the north and west sides of the building. The California Community Care Licensing Board is the agency responsible for licensing the day care center. Sewage disposal for the existing structure is handled by the Thermalito Irrigation District. Domestic water supply for the site is also provided by the Thermalito Irrigation District. The 0.66 -acre project parcel is developed with 1,968 square foot building that was until recently used by the applicant for a church. Two •• 08�are foot storage sheds are also located on the site. Most of the project site is undeveloped and consists of an open dirt/gravel area that is used for parking. No significant amounts of vegetation are found on the property. The project site is level and does not contain any drai age . here are no curbs, gutters, or sidewalks in the area. A fire hydrant is-� located on the southeast corner of the property. The project site is located approximately 2 miles northeast of the Oroville Airport, and is within Airport Compatibility Zone "D". The project site is zoned A -R (Agricultural -Residential) and has a General Plan Land Use es*gnation of Low Density Residential. Surrounding parcels are zoned A -R and range in size from f o27,cres to 1.5 acres. Land uses on the surrounding parcels are single family dwellings at suburban densities. An elementary school is located 800 feet to the south of the site. The applicant received a Use Permit in 2000 to establish a church on the adjoining parcel to the northwest of the project site, butt church use has not been established and the property is undeveloped. The existing building was constructed at a time when building permits were not required (prior to 1962) and there was either no zoning at that time or the zoning allowed a church use by right. The property was zoned to A -R in 1984. Previous zoning of the property was A-1 in 1953 and then to A-2 in 1955. ANALYSIS: A change of a legal nonconforming use requires approval of a Use Permit (Butte County Code Section 24-35.20). This section states that when considering a Use Permit for a nonconforming use, the Planning Commission shall grant the Use Permit when it finds that the change, expansion, enlargement, extension, reconstruction, or structural alteration of such use will not conflict with, impair or be detrimental to the uses both permitted and conditional of the zone in which it is located and/or adjoins. This finding is in addition to the findings required by Section 24-45.10 of the Butte County Zoning Ordinance. Pursuant to Section 24-45.15 the Planning Commission may impose conditions upon the issuance of the Use Permit which are reasonably related to the use of the property for which the Use Permit is requested. In addition the Planning Commission may at its own discretion establish a date for either the termination of the use or review of the Use Permit. The proposed day care center is a quasi -public use because it will be operated by the applicant (the First United Pentecostal Church), which is a non-profit organization, and will provide day care services to the community. The A -R zone requires a Use Permit for a quasi -public use. The project parcel is designated by the Land Use Element Map of the Butte County General Plan as Agricultural - Residential, which lists quasi -public uses as a Secondary Use. 0 BUTTE COUNTY PLANNING COMMISSION AGENDA REPORT 0 PAGE 2 0 Noise Impacts Only interior modifications to the existing structure are needed, and the noise generated by that construction activity will not create any impacts to nearby residents. The only outside construction activity that will generate noise will be the installation of a chain-link fence around the playground area. The installation of the fence will not create a significant impact to the surrounding residential uses. The arrival and departure of vehicles from the project site will create some noise. The vehicle noise will be primarily during the morning and late afternoon/early evening hours when parents drop off and pick up their children. The noise from vehicles arriving and departing the site is not expected to create any significant noise impacts because it will occur during normal rush hour time periods when noise from existing vehicles is at a maximum. .+ Additional noise will be generated by children playing outside. The proposed play area is located on the north and west sides of the buildings. A house on the adjacent parcel to the north of the site is located approximately five feet from the property line and the noise generated by the children may have a significant impact to the residents of this dwelling. According to the applicant, approximately 13 children will be allowed in the play area at any one time. In order to prevent any significant noise impacts, a condition of approval limits the number of children in the lay area to no more than fifteen (15) at any onetime. L' . 0v Gal _ ,& Traffic Circulation Impacts Access to the site is from an existing gravel driveway off of 10th Street. Additional access is from Thermalito Avenue over an unimproved dirt driveway. The posted speed limit on 10th Street and Thermalito is 25 MPH. There is excellent site vision of 10th Street and Thermalito Avenue in both directions from the driveways. A stop sign is located on Thermalito Avenue at 10th Street. The proposed day care facility is estimated to generate 159 to 185 vehicle trips per day. These estimates were obtained from the Institute of Transportation Engineers Trip Generation handbook (6th.Edition). Two methods were used to determine the trip generated rate - the size of the structure and the number of children. Based upon the maximum number of children that will attend the day care facility, the proposed day care facility is estimated to generate approximately 185 vehicle trips each day (4.52 vehicle trips x 41 children). Alternatively, based upon the gross floor area of the day care facility (2,000 square feet), the proposed daycare facility is estimated to generate approximately 159 vehicle trips each day (79.26 vehicle trips per 1,000 square feet of gross floor area). Peak hours of vehicle traffic generated by the proposed day care facility will coincide with the peak hour of the adjacent street traffic (7.00 a.m. to 9:00 a.m. and 4:00 p.m. to 6:00 p.m.). The Sierra Avenue Elementary School is located one block to the south of the project site. The morning peak hour of vehicle traffic generated by the elementary school use will coincide with the proposed day care facility, which could lead to some vehicle circulation impacts in the area. Short term delays may occur at the intersection of 10th Street and Thermalito Avenue due to the project. The school afternoon peak.hour will occur before most children at the day care center are picked up 0 BUTTE COUNTY PLANNING COMMISSION AGENDA REPORT ■ PAGE 3 ■ by their parents so no significant vehicle circulation impacts during the evening peak hours are anticipated. Dust Emissions The parking area and driveway consists of a gravel/dirt surface. Vehicles driving on the parking area may create fugitive dust emissions that impact the residents on the surrounding and nearby properties. The City of Oroville commented that the parking area should be paved or treated so as to prevent fugitive dust emissions. In order to prevent fugitive dust emissions, the parking area and driveway are required to either be hard surfaced or treated with a dust palliative. Comments from Other Agencies Comments received from the Butte County Airport Land Use Commission (ALUC) staff stated that the project site is located in Compatibility Zone D. Zone D does not have any limitation on density or intensity of uses'aALUC staff stated that the project is compatible with airport operations and C safety concerns. The Butte County Environmental Health Department s not object to the project and 2LAiot recommend any conditions. The Environmental Health Department stated that day care facilities are inspected and licensed through the State Community Care Licensing Board. The Butte County Fire Department/CDF commentAthat the building must meet the requirements of �- the California Building Code and that a "local' fire alarm system and fire extinguishers are required. The Fire Department/CDF also stated that the applicant . must apply to the State of California Community Care Licensing for a "Form 850 - Request for Fire Department Inspection." A request for comments concerning this project was. sent to the Butte County Public Works Department. However, that department did not respond, even after repeated requests. P���/� o writing#this report, staff is attempting to get the Public Works Department to provide comments and if any are forthcoming staff will present them at the public hearing. The Thermalito Irrigation District (TID), which provides public water and sewer services to the site, did not object to the project. TID states that some on-site water and sewer infrastructure improvements may be required due to the proposed day care center use. The City of Oroville commented that the entire designated parking area should be covered with a dust -free surface in accordance with development standards for the City of Oroville. The City also commented that curbs, gutters, sidewalks, and a paved parking lane should be constructed along 10th Street adjacent to the portion of the site that is proposed to be used in accordance with development standards for the City of Oroville. Staff does not recommend that street improvements be a condition of project approval because no other properties in the project area have curbs, gutters, and sidewalks. 0 BUTTE COUNTY PLANNING COMMISSION AGENDA REPORT 0 PAGE 4 ■ According to the Butte County Building Division, the proposed day care center constitutes a change in use as stated in the building code. The existing building is required to meet the requirements of the Uniform Building Code for a day care use. Additionally, the proposed fenced playground area does not appear to conform to the Safe Dispersal Requirements of the 1998 California Building Code, Section 1007.3.11. The project is conditioned to meet the requirements of the Uniform Building Code and the California Building Code. ACTIONS FOR CONSIDERATION: Staff recommends that the Planning Commission take the following actions: I. Determine the project to be Categorically Exempt from environmental review under Section 15303 of the California Environmental Quality Act. This section states that the conversion of an existing small structure from one use to another where only minor modifications are made in the exterior of the structure. The existing building does not exceed 2,500 square feet, will not require any exterior modifications, and the project does not involve the use of any hazardous materials. III. Approve Use Permit 01-20 for the First United Pentecostal Church, subject to the following findings and conditions found in Exhibit A: A. The proposed use of the property will not impair the integrity and character of the zone in which the land lies, and that the use would not be unreasonably incompatible with, or injurious to, surrounding property, or detrimental to the health, safety and general welfare of the persons residing or working in the neighborhood, or to the general health, welfare and safety of the County because: 1. The project will not cause any significant vehicle circulation impacts. 10th Street and Thermalito Avenue have the capacity to handle the increase in vehicle traffic generated by the project. 2. The number of children allowed in the play area is limited to fifteen children at any one time in order to prevent significant noise impacts to the adjacent residential use. 3. The project will not create an aesthetic impact because no exterior modifications to the existing structure are required. 4. There is sufficient parking area on the site for the proposed use. 5. Enlargement or major exterior modifications to the existing structure shall not be allowed unless a new Use Permit is first obtained. 2. If dust palliatives are used they shall be reapplied as necessary to maintain their effectiveness. 3. Landscaping shall be installed in the parking lot per the requirements of the Butte County Zoning Ordinance. Prior to issuance of the Use Permit, the applicant shall submit a landscaping plan showing the location and types of vegetation to be planted. The. landscaping plan shall also show the method of irrigation. The landscaping shall be installed prior to issuance of a Certificate of Occupancy or Final Inspection by the Building Division. All landscaping shall be maintained in a healthy condition and replaced as necessary. 4. The project site shall be developed in accordance with the approved project site plan and the conditions contained herein. Said site plan is on file in the Planning Division, is date- stamped May 9, 2001, and is incorporated herein by this reference. 5. One (1) free-standing sign is allowed, not exceeding thirty-five (35) square feet in size and no higher than four (4) feet above ground level. 6. Meet the requirements of the Thermalito Irrigation District. Fire Department 7. Applicant must comply with California Code of Regulations Title 19; 1998 California Building and Fire Codes. 8. A "local' fire alarm system (utilize NFPA 72 and California Electrical Code) and fire extinguishers are required - the fire department will assist locating manual pull stations and extinguishers. 9.
