A. Meleka, Principal Planner—have determined it is not necessary for Mr. Atwal to have his request considered for approval through the Use Permit process. Mr. Atwal is seeking a beer & wine license from the State Alcoholic and Beverage Control Board in order to sell these beverages at his convenience store located at the above address. This request, upon further review, has been determined not to constitute an expansion of a pre-existing, nonconforming use. The sell of such beverages is a reasonable expectation under the County's Code Section 24, Definitions, where the selling of beverages is included in the retail sales of products in a convenience store. Mr. Atwal is not expanding the type of uses at the site, nor is he expanding the physical facilities at the site. Mr. Atwal is submitting a request: withdrawing his application and requesting a full refund of his deposit and fees payment. The zoning classification for this site is R -N (Residential - Nonconforming). The zoning does not make any provision for the sale of alcoholic beverages in the R -N zone. The land uses on APN 035-073-020 have included a gas station and convenience store for a number of years. The Department recognizes these uses, while nonconforming in the R -N zone, as "grand fathered" uses. However, the Director of Development Services has determined the new and additional use of selling alcoholic beverages at this location constitutes an expansion of a nonconforming use. As per County Zoning Code Section 24-35.20 Change Or Expansion Of Nonconforming Use, an expansion of a nonconforming use requires approval of a Use Permit from the Planning Commission.
