The property is located on the south side of Highway 32, approximately 3/4 mile west of Meridian Road, at 4133 Highway 32, west of Chico. ' APN 039-600-010 (CBS) (UP 02-05) Commissioner Leland excused himself from this hearing and stepped down. Mr. Breedon gave a brief summary of the project. Commissioner Lambert inquired if one staff member is adequate for the night and swing shifts? The hearing was opened to the public. Mark Adams, representative, said that this is a very important program and he agreed with the conditions. Commissioner Lambert asked if a time frame should be included in Condition 4. She suggested that in Condition 5, they might want to add "prior to occupancy of additional people." Geordie Mosbarger submitted some materials to the Commission. He said that this is an ideal location. He gave a brief overview of what the use does. He discussed the repairs to the pool. He said that there are 1-7 staff members on the swing shift and 1-2 staff members at night. Commissioner Nelson asked about the difference between the House of Mercy and the Skyway House. Mr. Mosbarger answered that the House of Mercy went out of business.and the lease was purchased by the Skyway House. David Williams stated that this is a very loving and caring program which has changed his life. There was a brief discussion on how the program works. Kathleen Williams asserted that the program is very intense and well structured; she added that there is a lot of one-on-one counseling and a family atmosphere. Jenie Chila, the owner of the property, said that the project is in the middle of an agricultural area with no residences around them and she has had no problems with the tenants. David Singh voiced his concerns about the adequacy of the septic system for the additional people. He said that he understood there would be an open pit and he was concerned about odors. He said that he did not want the water draining to his land. Mr. Breedon assured Mr. Singh that there will be an engineered sewage disposal system required. 0 BUTTE COUNTY PLANNING COMMISSION 0 MINUTES 0 JANUARY 24, 2002 0 PAGE 9 0 Mr. Adams addressed the waste water process. He said that the owner is proposing to add a treatment system for additional occupancy. He pointed out that wste water would be treated before the water goes into the leachfield and through a sand filter and there would be no odor problems. Mr. Mosbarger explained that the cost of the septic system has been funded. The hearing was closed. It was moved by Commissioner Lambert, seconded by Commissioner Nelson, and unanimously carried to approve the Use Permit for Geordie Mosbarger subject to the findings and conditions listed below: I. The project is Categorically Exempt from environmental review under a Class 3 Exemption. II. Approve the Use Permit 02-05 for Geordie Mosbarger (Skyway House) to allow a group home for up to 30 residents, including staff, on APN 039-600-010, subject to the following findings and conditions found in Exhibit "A": A. The proposed use of the property will not impair the integrity and character of the zone in which the land lies, and that the use would not be unreasonably incompatible with, or injurious to, surrounding property, or detrimental to the health, safety and general welfare of the persons residing or working in the neighborhood, or to the general health, welfare and safety of the County because: 1. The operational characteristics of the facility is essentially a residential use and residential uses are consistent with the A-40 zone. 2. The facility is located at a significant distance from other homes. 3. The size of the dwelling is capable of accommodating the requested number of residents and proposed upgrades to the sewage disposal system will meet state and local requirements. 4. The proposed use will not have an impact on surrounding agricultural operations. 5. The proposed use is quasi -public use as defined by the Butte County Zoning Code and is conditionally consistent with the A-40 zone and is a secondary use under the Orchard and Field Crop designation of the General Plan. Conditions of Approval: Development Services The existing building, including proposed remodeling shall comply with current Building 0 BUTTE COUNTY PLANNING COMMISSION 0 MINUTES 0 JANUARY 24, 2002 0 PAGE 10 0 regulations for the proposed use. Verify that the existing building has been converted to a group home with permits, inspections, and approvals or obtain the necessary permits, including building permits for the proposed remodeling and portable office structure. See California Building Code, 1998 Edition, Appendix 3A, Division 1 for R-6 occupancy requirements. The increased occupancy of the structure shall not occur until final building permits have been issued. Environmental Health Division 2. Prior to occupancy, obtain the necessary permit from the Butte County Environmental Health Division to operate a "public" water system. 3. Prior to occupancy, inquire and receive a determination from the Butte County Environmental Health Division regarding the status of the home as a food facility. If it is determined that the group home will need a county food permit, then apply and acquire a "Permit to Operate" a food facility. 4. The swimming pool must be upgraded to meet State and/or County requirements for a public pool. Obtain necessary permit from the Butte County Environmental Health Division within 60 day of issuance of this Use Permit. 5. Obtain all required licenses or permits from the State of California to operate a drug and alcohol group home treatment facility. 6. Prior to occupancy, obtain a permit from the Butte County Environmental Health Division to upgrade the existing septic system. 7. Prior to occupancy, obtain Waste Discharge requirements and a Permit from the Regional Water Quality Control Board. Fire Department 8. Building identification and/or address shall be installed in conformance with Public Resource Code 4290 and shall be posted and maintained throughout the life of this project. 9. Provide an all weather access to all structures, which is designed to carry a 40,000 pound fire apparatus at least 10 feet wide with a 15 -foot vertical clearance. 10. Obtain a re -inspection of the facility after remodeling has been completed and prior to occupancy to ensure that Title 19, State Fire Marshall Regulations have been met (Form 850 — Department of Alcohol and Drug Programs). Program description: The Skyway House (SH) is a non-profit corporation that specializes in long-term residential recovery for clients and their families suffering from substance abuse. SH is licensed by the State of California for 36 individuals. Tommy Higgins founded SH in 1993 in Paradise, CA. SH started with one client taken to Tommy's personal home. Our first client remains clean and sober today. SH has grown to 17 men's beds, 14 women's beds, and 21 clean and sober living beds. Recently, due to community demand, we have opened our first outpatient program with space for 12 clients. SH's philosophy is the 12 step approach to recovery and is non denominational. SH is the only long-term treatment center in Butte and the surrounding counties. SH has an excellent reputation in our area. It is the favored treatment center among Butte and surrounding county agencies as well as the defense attorney community. In fact, many defense attorneys have left their clients in jail a little longer to ensure a space at our facility. SH typically has a waiting list between 10 to 20 individuals with little marketing efforts. SH has contracts with Butte County Drug Court, Dept. of Behavioral Health, California State Prison System, the Superior Court of Butte County, Plumas County drug court, Plumas county ADS and Trinity County. II. Staffing: SH is staffed 24 hours per day, seven day per week. During treatment hours (8:00am — 5:00pm) we have a staff to client ratio of 1:10. Swing and night shifts are staffed to need with a minimum of one full time employee on location. III. Location: SH has 7 properties. Headquarters is located at 6373 Oak Way in Paradise, CA. This property houses the administration office as well as the women's residential recovery center. There are four single-family homes that are utilized as clean and sober living houses and a commercial building in Paradise houses the outpatient facility. The property in question is 4133 Hwy. 32 outside of Chico. This property houses the men's recovery facility. The property is 40 acres. 33 of the acres have prune trees. The "Men's House" is located at the back of the property to Hwy. 32. The house is approximately 4900 square feet. We currently have a use permit for 17 individuals we adopted from the House of Mercy, the pervious tenant. IV. Project Description Phase 1: As indicated in the attached program description and grant proposal, SH desires to increase occupancy in order to meet community demands. The increase in occupancy to 50 will be accomplished in two phases. Phase I will utilize the current structure to its highest use. The three bedrooms upstairs will house 22 individuals. The largest room (New Comers Room) has room for 12 (6 bunks). The senior room houses 3 bunks and the coordinators room for 2 bunks. The upstairs has 3 full baths. Downstairs contains one bedroom and a large open area. The bedroom will house 2 bunks. With minor construction a section of the open area will house another 2 bunks. There is 1 full bath downstairs. (See attached house diagram). The office currently located in the downstairs bedroom will be moved to a temporary trailer office to be placed on the cement pad west of the structure. V. Orchard Description: The property contains 33 acres of 4 -year-old prune trees in excellent condition. There are 172 per acres (14 X 18 plantings). The property owner has entered into a contractual agreement with a local prominent farmer to manage the 33 acres of prune trees. Despite the down turn in the prune market, a buyer for next years crop has already been located. It is the intent of the property owner to maintain the majority (> 85%) of the orchard as is. There are plans to turn approximately 1 acre of land into a food garden for the recovery center (to be maintained by the recovery center). Another. small section of orchard may be required to complete phase 2. VI. Traffic Impact: Impact to traffic on Hwy 32 will be minimal. Residences of SH utilize one of our 4 vans to take them to meetings or work. The SH runs a morning and afternoon shuttle to a bus stop in Chico. We may be required to increase our vanpool by 1. On weekends some individuals have family members visit. There are no family visits on weekdays. VII. Project Description Phase 2: Phase 2 will require additional septic improvements to increase occupancy to 50 individuals (see attached project description). Our plan is to house the additional individuals in structures (most likely double -wide mobile units) on the pad currently utilized as the leach line - location. (SW corner of attached map) ' VIII. Project Funding: SH is currently applying for a capital improvement grant (attached). If we are not successful with the grant, SH will use a combination of fund raising as well as borrowing to complete the project. IX. The prune trees are 4 years old and are actively farmed. There is a 4846 square foot Spanish style house set at the south east end of the property and 1350 square foot traditional barn at the south west end of the property. The property contains a large pond (386' x 165') that is maintained as a catch and release fishing pond. There is also a residential swimming pool that is being converted to a commercial pool. 33. All adjacent properties are designated orchard and field crops. The property is surrounded on all sides, except the northern lot line, by prune trees. To my knowledge there are no occupied dwellings on any of the adjacent properties. The Skyway House was my tenant for approximately one and one half years. Prior to the Skyway House, I leased the property to the House of Mercy. In both cases I found my tenants to be excellent. I never had any issues with either group. They always paid rent on time and took good care of the property. The Skyway House residents were respectful of my ranch workers and myself. They were willing to help me if I needed assistance at the ranch. Since I do not reside in Butte County, it was actually a benefit to have the tenants on the property in case of any emergencies that came up. I have met several of the residents of the Skyway House. PROJECT DESCRIPTION/SITE CHARACTERISTICS: On January 27, 1998 the Butte County Planning Commission issued Use Permit 98-07 to House of Mercy allowing a group home for up to 17 residents, including staff, on the subject parcel. Approximately 2 years ago the Skyway House, a non-profit corporation specializing in long-term residential treatment and recovery for clients and their families suffering from substance abuse, took over the property. Skyway House is licensed by the State of California as a group care facility. Most of the clients at the facility are placed there through contracts with Butte County Drug Court, Butte County Department of Behavioral Health, California State Prison System, Butte County Superior Court, Plumas County Drug Court, and Trinity County. Skyway House has several facilities within Butte County. The 4,900 -square foot residence on this site serves as their men's recovery facility. The facility is staffed 24/7. During treatment hours (8:00 am to 5:00 pm), the staff/client ratio is 1:7. The swing and night shifts are staffed based on need with a minimum of one person always on the site. 0 BUTTE COUNTY PLANNING COMUSSION ■ AGENDA REPORT 0 PAGE 1 ■ The property is located approximately 5 miles west of Chico in an agricultural area. In addition to the house, the property is planted with roughly 33 acres of prunes. Access to the parcel is via a long private driveway off of Highway 32. The dwelling unit sits back approximately 1/3 mile from Highway 32. Domestic water is obtained by an on-site well, and sewage disposal is handled by an on-site septic system. The applicant's long term goal for this facility is to have up to 50 residents. However, that number will require additional structures. In the interim, the request is to allow up to 30 residents within the existing structure. A portable office unit will have to be placed on the rear patio slab in order to obtain the living capacity in the house. Some minor interior construction is proposed in order to accommodate the increased occupancy but no addition to the structure will be necessary. ANALYSIS: The project site is 40 acres in size, and is zoned A-40 (Agricultural, 40 -acre minimum parcel size). The Land Use Element of the Butte County General Plan designates the project site as Orchard and Field Crops. The A-40 zoning district requires that a conditional use permit be obtained for quasi - public uses. Quasi -public uses are listed as a Secondary Use in the Orchard and Field Crops General Plan designation. Parcels surrounding the project site are zoned A-40 and have a General Plan Land Use Designation of Orchard and Field Crops. Land use on surrounding parcels is agricultural, either orchards or row crops. To approve a Use Permit, the Planning Commission must find that the proposed uses of the property will not impair the integrity and character of the zone in which the lands lies and the use would not be unreasonably incompatible with, or injurious to, surrounding properties, or detrimental to the health and general welfare of the persons residing or working in the neighborhood, or to the general health, welfare and safety of the County. The Commission made the above findings when the original Use Permit was granted. Over the past two years, Skyway House has operated without complaints or apparent impact to the surrounding properties. The increase in occupancy should not result in a substantial change in character of the operation. Vehicle traffic will still be minimal. While at the facility, residents do not have private vehicles. Skyway House utilizes vans to provide resident transport. Traffic should not be a significant issue with the subject expansion. The expansion will require an upgrade to the sewage disposal system serving the facility. The existing system was enlarged in 2000 to meet the needs of a 17 -person facility. This upgrade essentially exhausted the usable sewage disposal area on the property (though 40 acres in size, flooding and setbacks limit the sewage disposal area). The applicant has already retained a local engineering firm to design a sewage disposal system to accommodate the expansion request. The system would include the application of treated wastewater to the prune orchard. This type of system requires Waste Discharge Requirements and Permit from the Regional Water Quality Control Board. ■ BUTTE COUNTY PLANNING COMMSSION 0 AGENDA REPORT 0 PAGE 2 0 C� E Use Permit 98-07 had several conditions that were to be met, as contained in Exhibit `A." To date conditions 5 of that permit has not been met: 5. The existing swimming pool shall be upgraded to meet State requirements for a public pool, and then permitted by the Environmental Health Division. This condition would be made a condition of this Use Permit with specific timelines for completion. ACTIONS FOR CONSIDERATION: Staff recommends that the Planning Commission take the following actions: I. Find that the project is Categorically Exempt from environmental review under a Class 3 Exemption. H. Approve the Use Permit 02-05 for Geordie Mosbarger (Skyway House) to allow a group home for up to 30 residents, including staff, on APN 039-600-010, subject to the following findings and conditions found in Exhibit "A": A. Pursuant to the provisions of the Zoning Ordinance of the County of Butte and the special conditions set forth below: Patricia Hamilton (D.B.A. House of Mercy) is hereby granted a Use Permit in accordance with application filed: September 22, 1997, to allow a group home for up to seventeen people, including staff, in an A-40 (Agricultural, 40 -acre minimum parcel size) zone, identified as APN 039-600-010, at 4133 Highway 32, Chico. Failure to comply with the conditions specified herein as the basis for approval of application and issuance of Permit, constitutes cause for the revocation of said permit in accordance with the procedures set forth in the Butte County Zoning Ordinance, including Butte County Code Sec. 24-62. 2. If any condition for this use permit has not been completed within 90 days of the date of this approval, the permit shall become null and void and reapplication and a new permit shall be required to establish the use. 3. The terms and conditions of this permit shall run with the land and shall be binding upon and be to the benefit of the heirs, legal representatives, successors, and assigns of the Permittee. FINDINGS: Section 1: Environmental Findings. A. This project is categorically exempt from the California Environmentai Quaiity Act pursuant to Section 15303(c), conversion of existing small structures from one use to another; and Section 2: Zoning Ordinance Findings. A. The proposed use will not impair the integrity and character of the zone in which the land lies, and that the use would not be unreasonably incompatible with, or injurious to, surrounding property, or be detrimental to the health and general welfare of the persons residing or working in the neighborhood, or to the general health, safety, and welfare of the residents of the County because: The operational characteristics of the facility are essentially the same as a residential use; and 2. The parcel is located a considerable distance from other residential uses; and 3. The size of the dwelling unit is suited for the number of people proposed and the septic system can be easily upgraded to accommodate the proposed number of people; and 4. The proposed use will not have an impact on the agricultural uses on the property; and B. Program description: The Skyway House (SH) is a non-profit corporation that specializes in long-term residential recovery for clients and their families suffering from substance abuse. SH is licensed by the State of California for 36 individuals. Tommy Higgins founded SH in 1993 in Paradise, CA. SH started with one client taken to Tommy's personal home. Our first client remains clean and sober today. SH has grown to 17 men's beds, 14 women's beds, and 21 clean and sober living beds. Recently, due to community demand, we have opened our first outpatient program with space for 12 clients. SH's philosophy is the 12 step approach to recovery and is non denominational. SH is the only long-term treatment center in Butte and the surrounding counties. SH has an excellent reputation in our area. It is the favored treatment center among Butte and surrounding county agencies as well as the defense attorney community. In fact, many defense attorneys have left their clients in jail a little longer to ensure a space at our facility. SH typically has a waiting list between 10 to 20 individuals with little marketing efforts. SH has contracts with Butte County Drug Court, Dept. of Behavioral Health, California State Prison System, the Superior Court of Butte County, Plumas County drug court, Plumas county ADS and Trinity County. Il. Staffing: SH is staffed 24 hours per day, seven day per week. During treatment hours (8:OOam — 5:OOpm) we have a staff to client ratio of 1:7. Swing and night shifts are staffed to need with a minimum of one full time employee on location. III. Location: SH has 7 properties. Headquarters is located at 6373 Oak Way in Paradise, CA. This property houses the administration office as well as the women's residential recovery center. There are four single-family homes that are utilized as clean and sober living houses and a commercial building in Paradise houses the outpatient facility. The property in question is 4133 Hwy. 32 outside of Chico. This property houses the men's recovery facility. The property is 40 acres. 33 of the acres have prune trees. The "Men's House" is located at the back of the property to Hwy. 32. The house is approximately 4900 square feet. We currently ` have a use permit for 17 individuals we adopted from the House of Mercy, the pervious tenant. IV. Project Description Phase 1: As indicated in the attached program description and grant proposal, SH desires to increase occupancy in order to meet community demands. The increase in occupancy to 50 will be accomplished in two phases. Phase 1 will utilize the current structure to its highest use. The three bedrooms upstairs will house 22 individuals. The largest room (New Comers Room) has room for 12 (6 bunks). The senior room houses 3 bunks and the coordinators room for 2 bunks. The upstairs has 3 full baths. Downstairs contains one bedroom and a large open area. The bedroom will house 2 bunks. With minor construction a section of the open area will house another 2 bunks. There is 1 full bath downstairs. (See attached house diagram). The office currently located in the downstairs bedroom will be moved to a temporary trailer office to be placed on the cement pad west of the structure. V. Project Description Phase 2: Phase 2 will require additional septic improvements to increase occupancy to 50 individuals (see attached project description). Our plan is to house the additional individuals in structures (most likely double -wide mobile units) on the pad currently utilized. as the leach line location. VI. Project Funding: SH is currently applying for a capital improvement grant (attached). If we are not successful with the grant, SH will use a combination of fund raising as well as borrowing to complete the project. VII. The site has been operating under an existing Use Permit approval from the County of Butte since 1999. The proposed expansion will occur in two phases with Phase 1 increasing the occupant level to 30 and Phase 2 increasing the occupant level to 50. It is understood that the existing residence can accommodate the Phase 1 increase in occupancy without substantial physical improvements. Phase 2 will result in the need for additional housing. The site lies in the unincorporated area of Butte County approximately 4 miles west of the City of Chico, on the south side of State Highway 32. It is identified as Assessor's Parcel Number 42-27-10. The existing group home residence is located near the southeast corner of the 40 -acre parcel. Most of the parcel is planted in an almond orchard that is actively farmed. The property is surrounding by agricultural uses. Because the site is located in a flood zone the area immediately surrounding the residence is elevated several feet above the surrounding orchard. Community sewer is not available to this property and wastewater is disposed of on-site under permit approval from the County of Butte. The existing septic tank and leachfield system was increased in capacity in 1999 to accommodate the 17 -person group home activity. Wastewater flows by gravity from the plumbing fixtures in the residence to a septic tank. The septic tank provides primary clarification of the waste before it flows by gravity to approximately 500 -feet of leach line. The proposed increase in occupants will result in a corresponding need to increase the capacity of the wastewater system. Soil conditions and flooding issues limit the available options for wastewater disposal. A preliminary review of the project together with discussion with Regional Water Quality Control board staff indicates the ultimate solution for wastewater disposal is to treat the wastewater to an acceptable level (secondary), store it during the wet winter months and dispose of it during the dry summer months, all in accordance with Title 22 requirements, including flood plain issues. Disposal could be done with subsurface drip emitters applied in an agricultural use. This level of treatment and disposal would accommodate the ultimate Phase 2 expansion to 50 occupants. On an interim basis the existing septic tank/leachfield system could be augmented with secondary treatment to accommodate the Phase 1 increase to 30 occupants. The most cost effective method of providing secondary treatment is a recirculating gravel filter. This treatment device is widely accepted and has been approved previously by both the State and the County. Providing secondary treatment will allow us to maximize the capacity of the existing leach lines without the requirement for winter storage and summer disposal. The recirculating gravel filter can be constructed in three or four weeks without substantial disruption to the operation of the home. Once completed, the filter will allow the occupancy to increase to 30. Sunim�.. 7 The proposed project consists of two phases with Phase 1 increasing the current group home occupancy from 17 to 30 and Phase 2 further increasing the occupancy to the ultimate level of 50. The existing septic tank/leachfield system must be supplemented to accommodate the proposed expansion in occupancy. Phase 1 improvements consist of adding a recirculating gravel filter to the existing system. The filter will provide a higher level of wastewater treatment, increasing the capacity of the existing leach lines. Phase 2 improvements will include construction of winter storage and summer disposal facilities. The men's facility is currently licensed for 22 residents and has the capacity to house 30, however the current use permit for the facility will only allow an occupancy rate of 17 due to limited septic capacity. Completion of the proposed septic project will allow the facility to comply with their license for 22 beds by meeting the use permit requirements. Additionally, the septic system upgrade will allow for an increase in licensing to the full 30 -bed occupancy capacity of the building. This will increase the total availability of residential treatment beds in Butte County by 22% and will significantly increase access to one of the few (perhaps the only) licensed six-month residential treatment facility in the North State. Problem Statement. The significant lack of drug and alcohol treatment services in rural Butte County is an access to care issue for individuals who need these services. Drug and alcohol addiction is as much a problem in rural areas as urban areas. In January of 2000, the United States Conference of Mayors published a White Paper entitled No Place to Hide: Substance Abuse in Mid -Size Cities and Rural America. The Drug Enforcement Administration funded this report with support from the National Institute on Drug Abuse (NIDA). The disturbing findings of this reportare that the rate of drug, alcohol and nicotine use among young teens in rural America is now higher than in the nation's large urban centers and the rates of adult drug, alcohol and nicotine use are about the same in rural towns and mid-size cities as large urban areas. The report goes on to say that rural and mid-size cities also have a significant lack of treatment services and infrastructure to deal with this rising drug problem. The prevalence of alcohol and drug addiction in Butte County. The State of the State of Behavioral Health in California: Alcohol, Drug and Mental Health Services and Systems, cites the Surgeon General's Report (SGR) regarding the national prevalence of addictive disorders at 9% ( this rate is conservative; a 1990 California study by Meinhardt estimated that 11 % of the population had an alcohol or drug disorder.) Additional research reported by SGR notes that about 2% of the population meets the criteria for the most severe degree of abuse and require treatment. It is also noted that over 40% of people with serious mental illness have a co-occurring substance abuse disorder. In another 1990 study conducted by Meinhardt, the Butte County incidence rate of "All Alcohol Disorders" was stated as 371% above the state average and "All Drug Disorders" as 51 % above the state average. Using the conservative 9% SGR prevalence rate would mean that in Butte County there are approximately 17,649 individuals with addictive disorders and 3,922 individuals with a severe degree of abuse requiring treatment. Access to drug and alcohol treatment services is an essential component to successful drug and alcohol treatment. A 1999 NIDA publication entitled Principles of Drug Addiction Treatment: A Research -Based Guide identifies having different treatment environments readily available as anessential component to successful drug and alcohol addiction treatment. There are many treatment approaches for drug and alcohol addiction. In Butte County, these -approaches range from twice a week outpatient group counseling for 16 weeks to the six- month residential treatment program with aftercare and transitional sober living environments provided by Skyway House. The M range of drug and alcohol treatment services in Butte County are provided through a network of agencies and organizations. The current drug and alcohol service system in Butte County is not able to meet the need. The Butte County Behavioral Health Master Plan for FY 01105 was released in March of 2001. MCPP Healthcare Consulting prepared this plan in coordination with a planning team comprised of the administration and management from a number of county agencies and representatives of community partner organizations. This plan identifies that "current resources are inadequate to serve all those who need services from the alcohol/drug service delivery system". According to this plan there are 705 alcohol and drug clients in the current system. It is estimated that the actual number of those needing services in Butte County is closer to 5,000. This would include all of the most severe population, 9% of the MediCal population and an estimated 360 Proposition 36 cases. There is a need in Butte County for additional residential alcohol and drug treatment beds. Of the estimated 5,000 individuals needing drug and alcohol treatment services it is further estimated that 432 adults require residential treatment and aftercare. These individuals are considered to have the highest needs for drug and alcohol treatment services. The current system does not meet this need. (The report stated that these benchmarks were drawn from the experience of a substance abuse program in a large, staff model HMO as well as programs in Arizona.) How the proposed project will address the problem. The previously mentioned studies, reports and statistical findings mirror the experience of the Skyway House residential treatment program, which has provided drug and alcohol treatment services in Butte County since 1994. During this time their number of licensed treatment beds has 9 • grown from six beds for men to it's current 22 beds for men and 14 beds for women. Skyway House also operates four clean and sober transitional housing units that accommodate 21 individuals that have successfully completed the six-month program. Skyway House manages 36 of the 63 licensed residential treatment beds in Butte County. The current septic system problem at the men's house, keeps five licensed beds from being utilized (almost 10% of the total county availability). Improving the current septic system will allow use of these five licensed beds and allow for the licensing of an additional eight beds in the same structure. The proposed project will increase the available residential treatment beds in Butte County by 22%. Skyway House provides unique, quality, rural -based, drug and alcohol treatment. Location- For the last three years the Skyway House men's treatment program has been provided in a 5,000 sq/foot home on 40 acres located in an a primarily agricultural area in Butte County. The area is also zoned for quazi-public agency use. This is an ideal location for these services as the "not in my back yard" factor, which has been a difficult issue for other treatment facilities, has not been an issue for the Skyway House. In addition, this house is located a quarter mile down a private rural road, which allows the residents an increased sense of anonymity while living there. A new owner who is committed to the Skyway House mission has recently purchased this property and has given the organization a 10 -year lease to the property.(see attachments) Demand for service- The Skyway House is often the facility of first choice for organizations, agencies and families seeking long-term residential treatment services for their clients and family members. The men's house has had a waiting list of 10-12 clients with an identified source of payment for the past 9 months. In addition to serving Butte County residents, Skyway House also has contracts with Trinity and Plumas counties (both rural) for treatment services. Most of the individuals currently in treatment and on the waiting list come from rural communities in the North State region. It is anticipated that the implementation of Prop 36 will add to the demand for Skyway House treatment services. The staff - Most of the Skyway House treatment team has been with the organization for over four years, they are in recovery themselves and come from the surrounding rural communities. As a result, the staff understands and is able to address the unique dynamics of living in a rural community. The treatment approach -Skyway House is a six -month residential treatment program. Most residential treatment programs in the region only offer a one to three month program and few offer clean and sober transitional housing units as part of their aftercare. Research supports that there is a higher rate of success the longer someone is in treatment. The NIDA Principles of Drug Addiction Treatment: A Research -Based Guide publication, states that for most patients, the threshold of significant improvement is reached at about 3 months in treatment and that additional treatment can produce further progress toward recovery. It further states that to be effective, treatment must address the individual's drug use and any associated medical, psychological, social, vocational, and legal problems. As part of the six-month treatment program Skyway House residents access physical and mental health care services, participate in work training and community service activities and address their legal issues. In order to accommodate the existing occupancy, a repair was made to the original septic system last summer (2000). That repair essentially exhausted all of the practical usable area available on the property (due to flooding and setbacks). Most'of the property is subject to flood irrigation and is considered in the 100 -yr. flood plain. From discussions with the applicant's engineer, Mark Adams, it is apparent that they understand the limitations of the site for expanding the existing.septic system using conventional onsite sewage disposal methods. He states that they wish to install an engineered mitigation that proposes among other techniques, the application of treated wastewater to agriculture (prunes). This proposal will require Waste Discharge Requirements and Permit from the Regional Water Quality Control Board (RWQCB). A component of the application process for the Discharge Permit is a Report of Waste Discharge. From conversations with RWQCB engineers, because of the topography and the plan to use effluent for irrigation, that report must contain Title 22 engineering requirements and a plan to protect the;system from flood plain and flood irrigation drainage. The project will require extensive study and detailed review from the Board before they will even consider the report complete. In addition the Board may request review from other state agencies (i.e., State Dept. of Health Services) because of the plan to discharge effluent above ground under the aforementioned circumstances. The increase in occupancy will require the applicant to apply to this Department for a permit to operate a "public" water system. The proposed facility may qualify as a food facility and be required to obtain a county food facility permit. The swimming pool must be brought up to code as a "public" pool (a requirement of the existing Use Permit). The applicant must inquire and obtain any permits and licensed from the State Community Care Licensing Department. The site has been operating under an existing Use Permit approval from the County of Butte since 1999. The proposed expansion will occur in two phases with Phase 1 increasing the occupant level to 30 and Phase 2 increasing the occupant level to 50. It is understood that the existing residence can accommodate the Phase 1 increase in occupancy without substantial physical improvements. Phase 2 will result in the need for additional housing. The site lies in the unincorporated area of Butte County approximately 4 miles west of the City of Chico, on the south side of State Highway 32. It is identified as Assessor's Parcel Number 039-600-010. The existing group home residence is located near the southeast corner of the 40 -acre parcel. Most of the parcel is planted in a prune orchard that is actively farmed. The property is surrounding by agricultural uses. Because the site is located in a flood zone the area immediately surrounding the residence is elevated several feet above the surrounding orchard. Community sewer is not available to this property and wastewater is disposed of on-site under permit approval from the County of Butte. The existing septic tank and leachfield system was increased in capacity in 1999 to accommodate the 17 -person group home activity. Wastewater flows by gravity from the plumbing fixtures in the residence to a septic tank. The septic tank provides primary clarification of the waste before it flows by gravity to approximately 500 -feet of leach line. The proposed increase in occupants will result in a corresponding need to increase the capacity of the wastewater system. Soil conditions and flooding issues limit the available options for wastewater disposal. A preliminary review of the project together with discussion with Regional Water Quality Control board staff indicates the ultimate solution for wastewater disposal is to treat the wastewater to an acceptable level (secondary), store it during the wet winter months and dispose of it during the dry summer months, all in accordance with Title 22 requirements, including flood plain issues. Disposal could be done with subsurface drip emitters applied in an agricultural use. This level of treatment and disposal would accommodate the ultimate Phase 2 expansion to 50 occupants. On an interim basis the existing septic tank/leachfield system could be augmented with secondary treatment to accommodate the Phase 1 increase to 30 occupants. The most cost effective method of providing secondary treatment is a recirculating gravel filter. This treatment device is widely accepted and has been approved previously by both the State and the County. Providing secondary treatment will allow us to maximize the capacity of the existing leach lines without the requirement for winter storage and summer disposal. The recirculating gravel filter can be constructed in three or four weeks without substantial disruption to the operation of the home. Once completed, the filter will allow the occupancy to increase to 30. Summary The proposed project consists of two phases with Phase 1 increasing the current group home occupancy from 17 to 30 and Phase 2 further increasing the occupancy to the ultimate level of 50. The existing septic tank/leachfield system must be supplemented to accommodate the proposed expansion in occupancy. Phase 1 improvements consist of adding a recirculating gravel filter to the existing system. The filter will provide a higher level of wastewater treatment, increasing the capacity of the existing leach lines. Phase 2 improvements will include construction of winter storage and summer disposal facilities. Buttwdounty Planning Commission Chairman CC: Land Development Division Building Division Health Department Department of Forestry Problem Statement/ Proiect Description Project summary- The Skyway House, a residential drug and alcohol treatment program, is requesting $50,000 in funding to upgrade the septic system at their men's ' facility located in Butte County. The men's facility is currently licensed for 22 residents and has the capacity to house 30, however the current use permit for the facility will only allow an occupancy rate of 17 due to limited septic capacity. Completion of the proposed septic project will allow the facility to comply with their license for 22 beds by meeting the use permit requirements. Additionally, the septic system upgrade will allow for an increase in licensing to the fu1130-bed occupancy capacity of the building. This will increase the total availability of residential treatment beds in Butte County by 22% and will significantly increase access to one of the few (perhaps the only) licensed six-month ,residential treatment facility in the North State. Problem Statement. The significant lack of drug and alcohol treatment services in rural Butte County is an access to care issue for individuals who need these services. Drug and alcohol addiction is as much a problem in rural areas as urban areas. In January of 2000, the United States Conference of Mayors published a White Paper entitled No Place to Hide: Substance Abuse in Mid -Size Cities and Rural America. The Drug Enforcement Administration funded this report with support from the National Institute on Drug Abuse (NIDA). The disturbing findings of this report are that the rate of drug, alcohol and nicotine use among young teens in rural America is now higher than in the nation's large urban centers and the rates of adult drug, alcohol and nicotine use are about the same in rural towns and mid-size cities as large urban areas. The report goes on e,4 13 py 2 �� s • i to say that rural and mid-size cities also have a significant lack of treatment services and infrastructure to deal with this rising drug problem. The prevalence of alcohol and drug addiction in Butte County. The State of the State of Behavioral Health in California: Alcohol, Drug and Mental Health Services and Systems, cites the Surgeon General's Report (SGR) regarding the national prevalence of addictive disorders at 9% ( this rate is conservative; a 1990 California study by Meinhardt estimated that 11 % of the population had an alcohol or drug disorder.) Additional research reported by SGR notes that about 2% of the population meets the criteria for the most severe degree of abuse and require treatment. It is also noted that over 40% of people with serious mental illness have a co-occurring substance abuse disorder. In another 1990 study conducted by Meinhardt, the Butte County incidence rate of "All Alcohol Disorders" was stated as 371% above the state average and "All Drug Disorders" as 51 % above the state average. Using the conservative 9% SGR prevalence ratewould mean that in Butte County there are approximately 17,649 individuals with addictive disorders and 3,922 individuals with a severe degree of abuse requiring treatment. Access to drug and alcohol treatment services is an essential component to successful drug and alcohol treatment. A 1999 NIDA publication entitled Principles of Drug Addiction Treatment: A Research -Based Guide identifies having different treatment environments readily available as an essential component to successful drug and alcohol addiction treatment. There are many treatment approaches for drug and alcohol addiction. In Butte County, these approaches range from twice a week outpatient group counseling for 16 weeks to the six- month residential treatment program with aftercare and transitional sober living environments provided by Skyway House. The of range of drug and alcohol treatment services in Butte County are provided through a network of agencies and organizations. The current drug and alcohol service system in Butte County is not able to meet the need. The Butte County Behavioral Health Master Plan for FY 01/05 was released in March of 2001. MCPP Healthcare Consulting prepared this plan in coordination with a planning team comprised of the administration and management from a number of county agencies and representatives of community partner organizations. This plan identifies that "current resources are inadequate to serve all those who need services from the alcohol/drug service delivery system". According to this plan there are 705 alcohol and drug clients in the current system. It is estimated that the actual number of those needing services in Butte County is closer to 5,000. This would include all of the most severe population, 9% of the MediCal population and an estimated 360 Proposition 36 cases. There is a need in Butte County for additional residential alcohol and drug treatment beds. Of the estimated 5,000 individuals needing drug and alcohol treatment services it is further estimated that 432 adults require residential treatment and aftercare. These individuals are considered to have the highest needs for drug and alcohol treatment services. The current system does not meet this need. (The report stated that these benchmarks were drawn from the experience of a substance abuse program in a large, staff model HMO as well as programs in Arizona.) How the proposed project will address the problem. The previously mentioned studies, reports and statistical fmdings mirror the experience of the Skyway House residential treatment program, which has provided drug and alcohol treatment services in Butte County since 1994. During this time their number of licensed treatment beds has grown from six beds for men to it's current 22 beds for men and 14 beds for women. Skyway House also operates four clean and sober transitional housing units that accommodate 21 individuals that have successfully completed the six-month program. Skyway House manages 36 of the 63 licensed; residential treatment beds in Butte County. The current septic system problem at the men's house, keeps five licensed beds from being utilized (almost 10% of the total county availability). Improving the current septic system will allow use of these five licensed beds and allow for the licensing of an additional eight beds in the same structure. The proposed project will increase the available residential treatment beds in Butte County by 22%. Skyway House provides unique, quality, rural -based, drug and alcohol treatment. Location- For the last three years the Skyway House men's treatment program has been provided in a 5,000 sq/foot home on 40 acres located in an a primarily agricultural area in Butte County. The area is also zoned for quazi-public agency use. This is an ideal location for these services as the "not in my back yard" factor, which has been a difficult issue for other treatment facilities, has not been an issue for the Skyway House. In addition, this house is located a quarter mile down a private rural road, which allows the residents an increased sense of anonymity while living there. Anew owner who is committed to the Skyway House mission has recently purchased this property and has given the organization a 10 -year lease to the property.(see attachments) Demand for service- The Skyway House is often the facility of first choice for organizations, agencies and families seeking long-term residential treatment services for their clients and family members. This positive reputation is the result of having quality staff, a sound treatment approach, reasonable rates and history in the recovery community of providing quality services. Every time the Skyway House has added beds, within six months, they are full. The men's house has had a waiting list of 10-12 clients with an identified source of payment for the past 9 months. In addition to serving Butte County residents, Skyway House also has contracts with Trinity and Plumas counties (both rural) for treatment services. Most of the individuals currently in treatment and on the waiting list come from rural communities in the North State region. It is anticipated that the implementation of Prop 36 will add to the demand for Skyway House treatment services. The staff - Most of the Skyway House treatment team has been with the organization for over four years, they are in recovery themselves and come from the surrounding rural communities. As a result, the staff understands and is able to address the unique dynamics of living in a rural. community. The treatment approach -Skyway House is a six -month residential treatment program. Most residential treatment programs in the region only offer a one to three month program and few offer clean and sober transitional housing units as part of their aftercare. Research supports that there is a higher rate of success the longer someone is in treatment. The NIDA Principles.of Drug Addiction Treatment: A Research -Based Guide publication, states that for most patients, the threshold of significant improvement is reached at about 3 months in treatment and that additional treatment can produce further progress toward recovery. It further states that to be effective, treatment must address the individual's drug use and any associated medical, psychological, social, vocational, and legal problems. As part of the six-month treatment program Skyway House residents access physical and mental health care services, participate in work training and community service activities and address their legal issues. Project Description The proposed project consists of expanding an existing group home use from the current level of 17 occupants to 50 occupants. The site has been operating under an existing Use Permit approval from the County of Butte since 1999. The proposed expansion will occur in two phases with Phase 1 increasing the occupant level to 30 and Phase 2 increasing the occupant level to 50. It is understood that the existing residence can accommodate the Phase 1 increase in occupancy without substantial physical improvements. Phase 2 will result in the need for additional housing. , The site lies in the unincorporated area of Butte County approximately 4 miles west of the City of Chico, on the south side of State Highway 32. It is identified as Assessor's Parcel Number 039-600-010. The existing group home residence is located near the southeast corner of the 40 -acre parcel. Most of the parcel is planted in a prune orchard that is actively farmed. The property is surrounding by agricultural uses. Because the site is located in a flood zone the area immediately surrounding the residence is elevated several feet above the surrounding orchard. Community sewer is not available to this property and wastewater is disposed of on-site under permit approval from the County of Butte. The existing septic tank and leachfield system was increased in capacity in 1999 to accommodate the 17 -person group home activity. Wastewater flows by gravity from the plumbing fixtures in the residence to a septic tank. The septic tank provides primary clarification of the waste before it flows by gravity to approximately 500 -feet of leach line. The proposed increase in occupants will result in a corresponding need to increase the capacity of the wastewater system. Soil conditions and flooding issues limit the available options for wastewater disposal. A preliminary review of the project together with discussion with Regional Water Quality Control board staff indicates the ultimate solution for wastewater disposal is to treat the wastewater to an acceptable level (secondary), store it during the wet winter months and dispose of it during the dry summer months, all in accordance with Title 22 requirements, including flood plain issues. Disposal could be done with subsurface drip emitters applied in an agricultural use. This level of treatment and disposal would accommodate the ultimate Phase 2 expansion to 50 occupants. On an interim basis the existing septic tank/leachfield system could be augmented with secondary treatment to accommodate the Phase 1 increase to 30 occupants. The most cost effective method of providing secondary treatment is a recirculating gravel filter. This treatment device is widely accepted and has been approved previously by both the State and the County. Providing secondary • treatment will allow us to maximize the capacity of the existing leach lines without the requirement for winter storage and summer disposal. The recirculating gravel filter can be constructed in three or four weeks without substantial disruption to the operation of the home. Once completed, the filter will allow the occupancy to increase to 30. Our first client remains clean and sober today. SH has grown to 17 men's beds, 14 women's beds, and 21 clean = �I and sober living beds. Recently,—due to community demand, we have opened our first outpatient program with space for 12 clients. SH's philosophy is the 12 step approach to recovery and is non denominational. SH is the only long-term treatment center in Butte and the surrounding counties. SH has an excellent reputation in our area. It is the favored treatment center among Butte and surrounding county agencies as well as the defense attorney community. In fact, many defense attorneys have left their clients in jail a little longer to ensure a space at our facility. SH typically has a waiting list between 10 to 20 individuals with little marketing efforts. SH has contracts with Butte County Drug Court, Dept. of Behavioral Health, California State Prison System, the Superior Court of Butte County, Plumas County drug court, Plumas county ADS and Trinity County. II. Staffing: SH is staffed 24 hours per day, seven day per week. During treatment hours (8:00am — 5:00pm) we have a staff to client ratio of 1:10. Swing and night shifts are staffed to need with a minimum of one full time employee on location. III. Location: SH has 7 properties. Headquarters is located at 6373 Oak Way in Paradise, CA. This property houses the administration office as well as the women's residential recovery center. There are four single-family homes that are utilized as clean and sober living houses and a commercial building in Paradise houses the outpatient facility. The property in question is 4133 Hwy. 32 outside of Chico. This property houses the men's recovery facility. The property is 40 acres. 33 of the acres have prune trees. The "Men's House" is located at the back of the property to Hwy. 32. The house is approximately 4900 square feet. We currently have a use permit for 17 individuals we adopted from the House of Mercy, the pervious tenant. IV. Project Description Phase 1: As indicated in the attached program description and grant proposal, SH desires to increase occupancy in order to meet community demands. The increase in occupancy to 50 will be accomplished in two phases. Phase 1 will utilize the current structure to its highest use. The three bedrooms upstairs will house 22 individuals. The largest room (New Comers Room) has room for 12 (6 bunks). The senior room houses 3 bunks and the coordinators room for 2 bunks. The upstairs has 3 full baths. Downstairs contains one bedroom and a large open area. The bedroom will house 2 bunks. With minor construction a section of the open area will house another 2 bunks. There is 1 full bath downstairs. (See attached house diagram). The office currently located in the downstairs bedroom will be moved to a temporary. trailer office to be placed on the cement pad west of the structure. V. Orchard Description: The property contains 33 acres of 4 -year-old prune trees in excellent condition. There are 172 per acres (14 X 18 plantings). The property owner has entered into a contractual agreement with a local prominent farmer to manage the 33 acres of prune trees. Despite the down turn in the prune market, a buyer for next years crop has already been located. It is the intent of the property owner to maintain the majority (> 85%) of the orchard as is. There are plans to turn approximately 1 acre of land into a food garden for the recovery center (to be maintained by the recovery center). Another small. section of orchard may be required to complete phase 2. VI. Traffic Impact: Impact to traffic on Hwy 32 will be minimal. Residences of SH utilize one of our 4 vans to take them to meetings or work. The SH runs a morning and afternoon shuttle to a bus stop in Chico. We may be required to increase our vanpool by 1. On weekends some individuals have family members visit. There are no family visits on weekdays. VII. Project Description Phase 2: Phase 2 will require additional septic improvements to increase occupancy to 50 individuals (see attached project description). Our plan is to house the additional individuals in structures (most likely double -wide mobile units) on the pad currently utilized as the leach line location. (SW corner of attached map) VIII. If we are not successful with the grant, SH will use a combination of fund raising as well as borrowing to complete the project. IX.
