Hon, proposed Mitigated Negative Declaration regarding environmental impacts and Use Permit to allow a dog kennel in an existing 4,000 square -foot warehouse building on orchard property. The Use Permit would allow the boarding of up to 20 dogs. The dogs would be kept in pens inside the building and let out into a fenced -in area attached to the building. An addition to the existing septic system on-site is proposed to handle waste from the dogs. Sanitary sewer service for the project is, and would continue to be, provided by a septic tank. Water is, and would continue to be, obtained from a well on the site. Because the existing building was built under an exemption, it was not subject to a building permit. As a condition of the approval of the Use Permit, the applicant may be required to make changes in the building and site that would ensure compliance with provisions of the Uniform Building Code, as adopted by the County. The environmental impacts of the changes to the building are not expected to be significant, but a certain level of change is assumed throughout the following environmental review. Mitigation measures are recommended where they could feasibly reduce the impacts of the change in use and the impacts of the changes to the building and property. The property is zoned A-20 (Agricultural — 20 acre parcels) and is located on the south side of Camas Court and the west side of Esplanade, at 4061 Camas Court, Chico. APN 006-680-004 (RC) (UP 02-06) Pam Nelson, Cotton Bridges Associates, gave a brief summary of the project. Chairman Mooney was concerned that this is considered an agricultural use and if it is an agricultural use the building should be an agricultural buildings which does not require plans signed by an engineer. Commissioner Lambert disagreed that a dog kennel is considered an agricultural use and, therefore, a Use Permit is required. Ms. Nelson said that the Building Division could not make such determination and, therefore, this condition was added as a safeguard in the event that the building does require some modifications. Chairman Mooney said that on Condition 7, he did not know if Title ,24 covered _dog kennels. Ms. Nelson was not sure which department requested the condition. Chairman Mooney said that he would like to add to the end of Condition 13, "or equipped with bark ° collars." r Commissioner Lambert asked if this request for a Use Permit was as a result of a violation. She noted that there is an existing small kennel there. Mr. Meleka explained that when the applicant found out that she was required to get a Use Permit, she applied. Commissioner Lambert said that there is at least one condition, maybe more, that states "prior to use of this project" while the kennel already exists. She said that this wording should be deleted. She also mentioned'that the kennel is located next to Mud Creek where a mobile home park is located and across the street from the Shasta Elementary School which would give the impression of being more of a residential area than it is. Commissioner Nelson asked about the distance between the R-1 zoning across the creek and the proposed building. Ms. Nelson stated that it is approximately 850 feet to 1000 feet from the nearest residence. She said that it is approximately 6-7 hundred feet to the R-1 property line. The hearing was opened to the public. Gertrude Hon informed the Commission that this kennel was opened as a day care facility and she did not need a Use Permit until the animals started staying overnight. The hearing was closed. Commissioner Lambert requested that the words "prior to use of this project' be deleted from Condition 19 and any other where it might appear. Mr. Meleka said that this was a commercial use and Ms. Hon would need to bring the building up to code wherever necessary. It was moved by Mr. Nelson, seconded by Ms. Lambert, and carried to approve the Use Permit for Gertrude Hon subject to the findings and conditions listed below adding to Condition 13 "or equipped with bark collars.", and deleting from Condition 19 "Prior to use of this project." Adopt a Mitigated Negative Declaration with the following findings: A. An Initial Study was completed in compliance with the California Environmental Quality Act. Said study identified significant environmental effects and includes mitigation measures that would mitigate such effects below significant levels; a Mitigated Negative Declaration is proposed. B. The Planning Commission has considered the proposed Mitigated Negative Declaration, together with comments received during the review process. C. On the basis of the whole record before the Planning Commission, including the Initial Study and any comments received, there is no substantial evidence that the Use Permit for Gertrude Hon, Planning Division File No. UP 02-06, will have a significant effect on the environment. D. The proposed Mitigated Negative Declaration reflects the independent judgment and analysis of the County, which is the Lead Agency. ------------ BUTTE COUNTY PLANNING COMMISSION MINUTES FEBRUARY 28, 2002 PAGE 12 E. Adopt the Mitigated Negative Declaration regarding environmental impacts, with Mitigation Measures, as detailed in the Agenda Report dated February 28, 2002. II. This project will not have an impact to fish and/or wildlife habitat pursuant to Fish and Game Code Section 711.4(d)(3) and 14 CCR 753.5. III. Recommend to the Planning Commission approval of Use Permit 02-06 for Gertrude Hon, subject to the following findings and the conditions in Exhibit "A": A. The proposed location, size, design, and operating characteristics of the proposed use are in accordance with the purpose of this Ordinance, the purpose of the zone in which the site is located, the Butte County General Plan, and the development policies and standards of the County because: Conditions of approval have been applied to this project after CEQA review. The project is in accordance with the purpose of the zone in which the land lies and the Butte County General Plan because the project site is designated Orchard and Field Crops. The Orchard and Field Crops land use designation allows "intense animal uses" as Secondary Uses. The A-20 zone allows kennels with approval of a Use Permit. B. The location, size, design, and operating characteristics of the proposed use would be compatible with, and would not adversely affect, or be detrimental to adjacent uses, residents, buildings, structures, or natural resources, with consideration given to: 1. Harmony in scale, bulk, coverage, and density: The proposed project will involve changes to an existing building to comply with Uniform Building Code requirements. Otherwise, no changes to buildings or density are proposed. 2. The availability of public facilities, services and utilities: No additional services are needed to accommodate this project. 3. The harmful effect, if any, upon desirable neighborhood character: The surrounding properties are used for orchards. One residence is located approximately 850 to 1000 feet from the proposed project site. The proposed use would not have deleterious impacts on the use of this residential property, as discussed in the Initial Study and summarized above in the section regarding CEQA Issues. 5. The suitability of the site for the type and intensity of use or development which is proposed: BUTTE COUNTY PLANNING COMMISSION MINUTES FEBRUARY 28, 2002 PAGE 13 • The site is suited for the project because the property is developed with a building currently serving as a small kennel. The proposed use will not impact the ongoing use of the remainder of the propertyfor growing walnuts. 6. Any other relevant impact of the proposed use: The Planning Division has circulated the proposed kennel application to County Agencies, the City of Chico, and other interested parties and has received no evidence that the use, with appropriate conditions, would cause any other relevant impact. C. Based on the above findings, the proposed location, size, design, and operating characteristics of the proposed use and the conditions under which it would be operated or maintained would not be detrimental to the public health, safety, or welfare, or injurious to properties or improvements in the vicinity. Conditions of Approval: Planning Division: 1. Follow the dust control measures listed below: a During clearing, grading, earth moving, excavation, or transportation of cut or fill materials, water trucks or sprinkler systems are to be used to prevent dust from leaving the site and to create a crust after each day's activities cease. b During construction, water trucks or sprinkler systems shall be used to keep all areas of vehicle movement damp enough to prevent dust from leaving the site. At a minimum, this would include wetting down such areas in the later morning and after work is completed for the day and whenever wind exceeds 15 miles per hour. c Soil stockpiled for more than two days shall be covered, kept moist, or treated with soil binders to prevent dust generation." 11vv) 2. If significant demolition, reconstruction, or construction of a new building is required, such activities will require additional review by the Butte County Air Quality Management District (BCAQMD), and any feasible measures recommended by the BCAQMD shall be implemented. M 3. If significant demolition, reconstruction, or construction of new buildings is required to comply with Butte County Code requirements (including the Uniform Building Code), such activities will require review for potential impacts on biological resources by the Director of the Department of Development Services, or his or her designee. ' Any measures recommended by the Department of Development Services to reduce impacts on biological resources must be implemented. As a condition of the approval of the Use Permit, the applicant is required to prepare and submit four sets of construction plans and make an application for a Building Permit. Construction shall comply with federal, State, and local regulations. Plans shall be prepared, sealed and signed by a California Licensed Architect or Registered Engineer for non- residential buildings and certain residential buildings. Proposed improvements constitute a "change in use" or "change in character of use" asstated in the Building Code. Improvement plans shall incorporate all code -required elements for the new use. 6. All structures shall be made accessible to the disabled. Disabled accessible parking and an accessible path of travel shall be provided. 7. Proposed improvements shall comply with Title 24 energy conservation regulations. Appropriate compliance forms (two sets) shall be submitted indicating compliance with those standards. Development fees for the proposed residential or non-residential improvements shall be paid. prior to the issuance of Building Permits. The fees shall be those in effect at time of application and shall include, but not be limited to, School Fees, Park and Recreation District fees, Water and Sewer Service Fees, Permit and Plan Check Fees, and Fire Protection Fees. 9. The applicant must comply with Uniform Building Code requirements for property line clearances considering use, area, and fire -resistiveness of existing buildings. 10. If a pattern of noise complaints attributable to the kennel is established, the Planning Division shall measure the level of noise at the project property lines. If the noise level of the barking dogs exceeds the "normally acceptable" range established in the Noise Element of the General Plan, revocation of the Use Permit shall be considered by the Planning Commission. 15. The installation of the kennel shall comply with all applicable building and electrical codes. 16. The Facility shall have a 12 -foot wide all-weather access to a publicly maintained road capable of supporting a 40,000 -pound fire apparatus with 15 feet of vertical clearance. 17. All Facilities that are not in continual use for a period of six months shall be considered abandoned. Abandoned Facilities are hereby designated as unlawful and as public nuisances, requiring no amortization period. If the Director of Development Services determines that the Facility is abandoned, the applicant may be required to remove all equipment belonging to the applicant from the premises and return the site to its original condition within 30 calendar days of receipt of notice to abate. If such Facility is not removed and the site returned to its original condition within 30 days, the County may remove the Facility at the applicant's and/or land owner's joint expense. 18. The Facility may not encroach into, under, over, above, or upon any public street in the unincorporated area of the County in the absence of a valid encroachment permit from the County. 19. The installation of the kennel shall comply with all applicable building and electrical codes. 16. The Facility shall have a 12 -foot wide all-weather access to a publicly maintained road capable of supporting a 40,000 -pound fire apparatus with 15 feet of vertical clearance. 17. All Facilities that are not in continual use for a period of six months shall be considered abandoned. Abandoned Facilities are hereby designated as unlawful and as public nuisances, requiring no amortization period. PROJECT DESCRIPTION/SITE CHARACTERISTICS: Gertrude Hon is requesting a Use Permit to allow a dog kennel in an existing 4,000 -square foot warehouse building on orchard property. The Use Permit would allow the boarding of up to 20 dogs. The dogs would be kept in pens inside the building and let out into a fenced -in area attached to the building. Sanitary sewer service for the project is, and would continue to be, provided by a septic tank. An addition to the existing septic system on-site is proposed for disposal of waste from the dogs. Water is, and would continue to be, obtained from a well on the site. Because the existing building was built under an exemption for agricultural structures, it was not subject to a building permit. As a condition of the approval of the Use Permit, the applicant may be required to make changes to the building and site that would ensure compliance with provisions of the Uniform Building Code, as adopted by the County. 0 BUTTE COUNTY PLANNING COMMISSION 0 AGENDA REPORT 0 PAGE 1 0 The project site is located just northwest of the Chico Greenline, near the intersection of Nord Highway and Esplanade. The site is flat, and Mud Creek flows from east to west, just south of the project site. The site is not located in the 100 -year flood zone. The site is located approximately 1.7 miles southwest of the Chico Municipal Airport, and is not within the 65 or 70 CNEL noise contour or aircraft overflight zone. The project site is surrounded by orchards, low-density residential uses, and light industrial and commercial uses along Esplanade. The surrounding parcels range from two to 45 acres in size. Zoning on the surrounding parcels is A-20 (Agricultural, 20 -acre parcels), R-1 (Low -Density Residential), and M-1 (Light Industrial). ANALYSIS: General Plan and Zoning: The General Plan land use designation of the project site is Orchard and Field Crops. The proposed project is located in an area zoned A-20 for agricultural use on parcels of 20 acres or more in size. The proposal would establish a kennel in an agricultural area, which is permitted by issuance of a Use Permit in the A-20 zone. The nearest residential dwelling is located at the western end of Camas Court, approximately 850-1000 feet from the proposed project building and fenced yard area. The proposed project building is buffered not only by distance but by the walnut orchards that surround it. As a part of the Use Permit request, the applicant is required to present information, including plans or other information, that is substantial enough to enable decision makers to make an informed decision regarding the compatibility of the proposed project with existing zoning, General Plan designation, and surrounding properties. The following finding is necessary for the Planning Commission to grant a Use Permit: "the proposed uses of property will not impair the integrity and character of the zone in which the land lies, and that the use would not impair the integrity and character of the zone in which the land lies, and that the use would not be unreasonably incompatible with, or injurious to, surrounding properties or detrimental to the health and general welfare of the persons residing or working in the neighborhood or the general health, welfare, and safety of the residents of the county" (Butte County Code, Section 24-45.10). Implementation of mitigation measures included in the Initial Study and Project Conditions imposed by the Planning Commission will ensure compliance with all land use plans and policies and that the proposed project would not impair the health, welfare; or safety of Butte County residents. 0 BUTTE COUNTY PLANNING COMMISSION 0 AGENDA REPORT 11 PAGE 2 0 • CEQA ISSUES: C� The project was reviewed for environmental impacts under the California Environmental Quality Act (CEQA) in accordance with State Law. The following discussion summarizes issues and impacts identified in the Initial Study. These issues resulted from the preparation of an initial study. Air Quality Establishing a dog kennel at the project site would result in a cumulative impact on air quality created by the slight increase in vehicle traffic and associated exhaust emissions, and dust from vehicular traffic on unpaved driveways on the site. The additional vehicle traffic is not anticipated to be significant since only 20 dogs are allowed to be kept at any one time at the kennel, and since traffic on that road is expected to increase by less than 15 trips per day. ,For the purposes of this environmental review and based on assumptions from the applicant, it is anticipated that there would be three employees including the project applicant, a night shift employee, and a weekend shift employee. The air quality impact of this increase is minimal. The project may create fugitive dust emissions if changes to the site and/or building are required to comply with Uniform Building Code requirements as specified by the County Building Manager, and as adopted by reference in the Butte County Code. The Butte County Air Quality Management District (BCAQMD) recommends incorporating measures to control fugitive dust emission for all road and other construction activities during project development, using such methods as site and driveway watering and/or use of other acceptable soil palliatives. Since the changes to a 4,000 -square foot building are expected to require few pieces of equipment, the impacts from exhaust emission are expected to be less than significant An increase in odor on-site is expected as a result of the keeping of up to 20 dogs. The residential areas and surrounding buildings are a significant enough distance from the project site for the odors to dissipate. The nearest residential dwelling is approximately 850 to 1000 feet from the proposed project building and fenced yard area. The project applicant has indicated that in the outdoor pens, solid waste from the dogs would be picked up and deposited into the septic system as needed, or approximately three to four times per day. This would also help reduce the impact of odors on nearby receptors. Because of these conditions, the odors would be negligible or imperceptible at the nearest residences. Hydrology/Water Quality The proposed project proposes an addition to an existing septic system to accommodate the keeping of up to 20 dogs on-site. The project applicant indicates that water service to the site is from a well, and that this service will continue. The County Environmental Health Department will review the proposed project and determine whether or not the project site has adequate soils for the proposed septic system. The applicant has indicated that the dogs would be let into the outside pen adjoining the building in the morning and evening to defecate and urinate. The applicant has also indicated that solid 0 BUTTE COUNTY PLANNING COMMISSION 0 AGENDA REPORT 0 PAGE 3 0 waste in this outdoor area would be picked up and put into the septic system on an as -need basis, at least three to four times per day. The Department of Environmental Health, in addition to assessing the adequacy of the proposed septic system, will examine the adequacy of this plan for dealing with outdoor dog waste. Noise The project would create additional noise in the area by allowing the keeping of up to 20 dogs. The dogs would generate some amount of noise, especially when people or cars approach the project site. Because of the distance to neighboring residential uses and buildings, the impact is expected to be less than significant. The nearest residential dwelling to the proposed project building is located approximately 850 to 1000 feet to the west. The project applicant has indicated that any especially noisy dog will be kept inside. If kept inside the building, the sound of the dogs' barking would not be perceptible to people in neighboring buildings. The Noise Element of the Butte County General Plan incorporates the Land Use Compatibility for Community Noise Environments chart by reference and requires that the chart be used during environmental review. For agricultural areas, noise levels of up to 70 to 75 dB CNEL or Ld„ are considered "normally acceptable." Given the agricultural zoning and character of the area, the impacts related to noise are less than significant. Some temporary increase, in noise is expected as the site is prepared for the implementation of the proposed project. Construction on the site is expected to be minimal and the noise impacts of this construction will be temporary. Because of the character of the area, the distance to neighboring residential uses and buildings, the temporary nature of such activities, and the trees that buffer the project site from surrounding areas, the impact is less than significant. ACTIONS FOR CONSIDERATION Staff recommends that the Planning Commission take the following actions: I. Adopt a Mitigated Negative Declaration with the following findings: A. An Initial Study was completed in compliance with the California Environmental Quality Act. Said study identified significant environmental effects and includes mitigation measures that would mitigate such effects below significant levels; a Mitigated Negative Declaration is proposed. B. The Planning Commission has considered the proposed Mitigated Negative Declaration, together with comments received during the review process. C. On the basis of the whole record before the Planning Commission, including the Initial Study and any comments received, there is no substantial evidence that the 0 BUTTE COUNTY PLANNING COMMISSION 0 AGENDA REPORT 0 PAGE 4 0 Use Permit for Gertrude Hon, Planning Division File No. UP 02-06, will have a significant effect on the environment. D. The proposed Mitigated Negative Declaration reflects the independent judgment and analysis of the County, which is the Lead Agency. E. Adopt the Mitigated Negative Declaration regarding environmental impacts, with Mitigation Measures, as detailed in the Agenda Report dated February 28, 2002. II. This project will not have an impact to fish and/or wildlife habitat pursuant to Fish and Game Code Section 711.4(d)(3) and 14 CCR 753.5. III. Recommend to the Planning Commission approval of Use Permit 02-06 for Gertrude Hon, subject to the following findings and the conditions in Exhibit "A": A. The proposed location, size, design, and operating characteristics of the proposed use are in accordance with the purpose of this Ordinance, the purpose of the zone in which the site is located, the Butte County General Plan, and the development policies and standards of the County because: Conditions of approval have been applied to this project after CEQA review. The project is in accordance with the purpose of the zone in which the land lies and the Butte County General Plan because the project site is designated Orchard and Field Crops. The Orchard and Field Crops land use designation allows "intense animal uses " as Secondary Uses. The A-20 zone allows kennels with approval of a Use Permit. B. The location, size, design, and operating characteristics of the proposed use would be compatible with, and would not adversely affect, or be detrimental to adjacent uses, residents, buildings, structures, or natural resources, with consideration v given to: Harmony in scale, bulk, coverage, and density: The proposed project will involve changes to an existing building to comply with Uniform Building Code requirements. Otherwise, no changes to buildings or density are proposed. 2. The availability of public facilities, services and utilities: No additional services are needed to accommodate this project. . 3. The harmful effect, if any, upon desirable neighborhood character: The surrounding properties are used for orchards. The proposed use will not impact the ongoing use of the remainder of the property for growing walnuts. 6. Any other relevant impact of the proposed use: The Planning Division has circulated the proposed kennel application to County Agencies, the City of Chico, and other interested parties and has received no evidence that the use, with appropriate conditions, would cause any other relevant impact. C. Pursuant to the provisions of the Zoning Ordinance of the County of Butte and the special conditions set forth below: Gertrude Hon is hereby granted a Use Permit to establish a commercial dog kennel for boarding of up to 20 dogs on APN 006-680-004 on Camas Court. 1. Failure to comply with the conditions specified herein as the basis for approval of application and issuance of Permit constitutes cause for the revocation of said permit in accordance with the procedures set forth in the Butte County Zoning Ordinance, including Butte County Code Sec. 24-45.65. 2. Unless otherwise provided for in a special condition to this Use Permit, all conditions must be completed prior to or concurrently with the establishment of the granted use. The use granted by this permit must be established within two years of the date of approval. 3. Minor changes may be approved administratively by the Directors of Development Services, Environmental Health, or Public Works upon receipt of a substantiated written request by the applicant, or their respective designee. Prior to such approval, verification shall be made by each Department or Division that the modification is consistent with the application, fees paid and environmental determination as conditionally approved. Changes deemed to be major or significant in nature shall require a formal application for amendment. 4. If any use for which a Use Permit has been granted is not established within two years of the receipt of the Permit by the Permittee, the Permit shall become null and void and reapplication pursuant to Section 24-45 (of the Zoning Code) shall be required to establish the use previously granted under the expired Permit unless, 30 days prior to the expiration date, a request for a one year extension is submitted to the Planning Commission together with sufficient evidence that the time limits for processing development permits under federal or state regulations require time limits which exceed one year. Upon application, and for good cause by the Permittee, ata public hearing pursuant to Section 24-45.25 above, the Planning Commission may extend any time limitation previously made a part of any condition to a Use Permit. 0 BUTTE COUNTY PLANNING COMMISSION 0 AGENDA REPORT 0 PAGE 7 0 5. The terms and conditions of this Permit shall run with the land and shall be binding upon and be to the benefit of the heirs, legal representatives, successors, and assigns of the Permittee. 6. Neither the applicant, nor any agent nor representative of the applicant shall intentionally omit or misrepresent any material fact in connection with the application. Any alleged material misrepresentation shall constitute grounds for the Director of Development Services to commence a revocation hearing, and, if proven to exist, shall constitute sufficient grounds to revoke a Permit. Conditions of Approval: Planning Division: 1. Follow the dust control measures listed below: a During clearing, grading, earth moving, excavation, or transportation of cut or fill materials, water trucks or sprinkler systems are to be used to prevent dust from leaving the site and to create a crust after each day's activities cease. b During construction, water trucks or sprinkler systems shall be used to keep all areas of vehicle movement damp enough to prevent dust from leaving the site. At a minimum, this would include wetting down such areas in the later morning and after work is completed for the day and whenever wind exceeds 15 miles per hour. c Soil stockpiled for more than two days shall be covered, kept moist, or treated with soil binders to prevent dust generation." 2. If significant demolition, reconstruction, or construction of a new building is required, such activities will require additional review by the Butte County Air Quality Management District (BCAQMD), and any feasible measures recommended by the BCAQMD shall be implemented. 3. If significant demolition, reconstruction, or construction of new buildings is required to comply with Butte County Code requirements (including the Uniform Building Code), such activities will require review for potential impacts on biological resources by the Director of the Department of Development Services, or his or, her designee. Any measures recommended by the Department of Development Services to reduce impacts on biological resources must be implemented. 4. As a condition of the approval of the Use Permit, the applicant is required to prepare and submit four sets of construction plans and make an application for a Building Permit. Construction shall comply with federal, State, and local regulations. Proposed improvements constitute a "change in use" or "change in character of use" asstated in the Building Code. Improvement plans shall incorporate all code -required elements for the new use. 6. All structures shall be made accessible to the disabled. Disabled accessible parking and an accessible path of travel shall be provided. 7. Proposed improvements shall comply with Title 24 energy conservation regulations. Appropriate compliance forms (two sets) shall be submitted indicating compliance with those standards. 8. Development fees for the proposed residential or non-residential improvements shall be paid prior to the issuance of Building Permits. The fees shall be those in effect at time of application and shall include, but not be limited to, School Fees, Park and Recreation District fees, Water and Sewer Service . Fees, Permit and Plan Check Fees, and Fire Protection Fees. 9. The applicant must comply with Uniform Building Code requirements for property line clearances considering use, area, and fire -resistiveness of existing buildings. 10. Existing building/s shall be made to comply with current Building and Zoning regulations for the intended new use of the building/s or the existing building/s shall be demolished. 11. The applicant shall provide for percolation and other tests deemed necessary -by, and to the satisfaction of, the Department of Environmental Health for the septic system proposed on-site. All feasible measures recommended by the Department of Environmental Health to reduce potential impacts associated with the septic system shall be implemented. 12. Place the following conditions on the building plans: a Identify the usable sewage disposal, area proved to meet the requirements of the County Improvement Standards Appendix VII. b Place a note on the map that states that no water well may be placed within 100 feet of the Usable Sewage Disposal Area. c Show the 50 -foot setback from the high water mark of Mud Creek. 13. All especially noisy dogs shall be kept indoors. 14. If a pattern of noise complaints attributable to the kennel is established, the Planning Division shall measure the level of noise at the project property lines. A "No Impact' answer should be explained where it is based on project -specific factors as well as general standards, (e.g., the project will not expose sensitive receptors to pollutants based on a project -specific screening analysis.) 2) All answers must take account of the whole action involved including off-site as well as on-site, cumulative as well as project -level, indirect as well as direct, and construction as well as operational impacts. 3) Once the lead agency has determined that a particular physical impact may occur, then the checklist answers must indicate whether the impact is potentially significant, less than significant with mitigation, or less than significant. "Potentially Significant Impact' is appropriate if there is substantial evidence that an effect may be significant. If there are one or more "Potentially Significant Impact' entries when the determination is made, an EIR is required. 4) "Negative Declaration: Less Than Significant With Mitigation Incorporated" applies where the incorporation of mitigation measures has reduced an effect from "Potentially Significant Impact' to a "Less Than Significant Impact." The lead agency must describe the mitigation measures, and briefly explain how they reduce the effect to a less than significant level (mitigation measures from Section XVII, "Earlier Analyses," may be cross-referenced). 5) "Reviewed Under Previous Document." Earlier analyses may be used where, pursuant to the tiering, program EIR, or other CEQA process, an effect has been adequately analyzed in an earlier EIR or negative declaration. Section 15063 (c)(3)(D). In this case, a brief discussion should identify the following: a) Earlier Analysis Used: Identify and state where they are available for review. b) Impacts Adequately Addressed: Identify which effects from the above checklist were within the scope of and adequately analyzed in an earlier document pursuant to applicable legal standards, and state whether such effects were addressed by mitigation measures based on the earlier analysis. C) Mitigation Measures: For effects that are "Less Than Significant with Mitigation Measures Incorporated," describe the mitigation measures which were incorporated or refined from the earlier document and the extent to which they address site-specific conditions for the project. 6) Lead agencies are encouraged to incorporate into the checklist references to information sources for potential impacts (e.g., general plans, zoning ordinances). The buffer between the project site and adjacent residences also ensures that any lighting proposed as a part of the project would not significantly impact nearby residents. The property is zoned A-20, for agricultural uses on parcels of at least 20 acres in size. The project does not propose to change the existing agricultural operations that surround the project site. The project does not propose to convert any farmland to non- agricultural use. As a part of the processing of this development application, comments were sought from the Agricultural Commission, which recommended approval and cited no conditions. Mitigation Measure: None required 4.3 AIR QUALITY: Would the Potentially Less Than Less Than No Reviewed proposal: Significant Significant Significant Impact Under Impact with Impact Previous Mitigation Document Incorporated a. X Impact Discussion: Both the California Air Resources Board and the Environmental Protection Agency have established air pollution standards in an effort to protect human health and welfare. Geographic areas are designated "attainment' if these standards are met and "nonattainment" if they are not met. In addition, each agency has several levels of classifications based on severity of the problem. Butte County and all northern Sacramento Valley Air Districts have been designated as "moderate" nonattainment areas for the state standards for ozone and fine particulate matter (PMto). Currently, Butte County is in attainment for all the federal (less stringent) air quality standards. Establishing a dog kennel at the project site would result in a cumulative impact on air quality created by the slight increase in vehicle traffic and associated exhaust emissions, and dust from vehicular traffic on unpaved driveways on the site. The additional vehicle traffic is not anticipated to be significant since only 20 dogs are allowed to be kept at any one time at the kennel. No additional air-quality analysis is required (1997 Air Quality Attainment Plan). Camas Road, which provides access to the project site from Esplanade is a private road, and traffic on that road is expected to increase by less than 15 trips per day, which includes trips to the site by employees of the kennel. For the purposes of this environmental review, based on assumptions from the applicant, it is anticipated that there will be three employees including the project applicant, a night shift employee, and a weekend shift employee. The air quality impact of this increase is minimal. ■ Butte County Department of Development Services ■ Planning Division ■ Page 5 ■ Project Name: Canine Retreat, Use Permit, File # UP 02-06 The project may create fugitive dust emissions if changes to the site and/or building are required'to comply with Uniform Building Code requirements as specified by the County Building Manager, and as adopted by reference in the Butte County Code. Fugitive dust emission occurs during site development activities such as grading, excavation for foundations and utilities, road construction, and other soil work. Exhaust emissions are also possible if equipment is used on-site to bring the building and property in compliance with the Building Code. The Butte County Air Quality Management District (BCAQMD) recommends incorporating measures to control fugitive dust emission for all road and other construction activities during project development, using such methods as site and driveway watering and/or use of other acceptable soil palliatives. Mitigation Measure #1 is recommended if site development activities are required. Since the changes to a 4,000 square -foot building are expected to require few pieces of equipment, the impacts from exhaust emission are expected to be less than significant. If demolition or construction of a new building is required, Mitigation Measure #2 shall apply. An increase in odor on-site is expected as a result of the keeping of up to 20 dogs. The residential areas and surrounding buildings are a significant enough distance from the project site for the odors to dissipate. The nearest residential dwelling is approximately 850 to 1000 feet from the proposed project building. The project applicant has indicated that in the outdoor pens, solid waste from the dogs would be picked up and deposited into the septic system as needed, or approximately three to four times per day. This will also help reduce the impact of odors on nearby receptors. Because of these conditions, the odors would be imperceptible at adjacent buildings. The project site is located in an agricultural area where the sensitivity to such odors is relatively less than would be the case in a residential neighborhood, park, commercial district, or other sensitive use. Mitigation Measure # 1: Follow the dust control measures listed below: a. During clearing, grading, earth moving, excavation, or transportation of cut or fill materials, water trucks or sprinkler systems are to be used to prevent dust from leaving the site and to create a crust after each day's activities cease. b. During construction, water trucks or sprinkler systems shall be used to keep all areas of vehicle movement damp enough to prevent dust from leaving the site. At a minimum, this would include wetting down such areas in the later morning and after work is completed for the day and whenever wind exceeds 15 miles per hour. c. Soil stockpiled for more than two days shall be covered, kept moist, or treated with soil binders to prevent dust generation." Timing: Requirements of the condition shall be adhered to throughout all grading and construction periods. Monitoring: Building inspectors shall spot check and shall ensure compliance on-site. Butte County Air Pollution Control District inspectors shall respond to nuisance complaints. Mitigation Measure # 2: If significant demolition, reconstruction, or construction of a new building is required, such activities will require additional review by the Butte County Air Quality Management District (BCAQMD), and any feasible measures recommended by the BCAQMD shall be implemented. Timing: Requirements of the condition shall be adhered to throughout all grading and construction periods. Monitoring: Building inspectors shall spot check and shall ensure compliance on-site. Orchards do not provide habitat for a rich variety of species. No impact on significant biological resources is expected because the project consists of a change in use to an existing building and because the project is completely surrounded by orchard crops. Mud Creek is located south of the project property. The project, as proposed, is not expected to have any impact on this water feature or the wildlife it supports. The proposed septic system addition will be reviewed by the Department of Environmental Health to ensure its sustainability. Any potential impacts on Mud Creek will be mitigated by measures included in the Hydrology and Water Quality section pertaining to the, proposed septic system addition. The project would not conflict with any local policies or ordinances protecting biological resources with adherence to tree protection mitigation measures included below. The proposal would not conflict with the provisions of an adopted Habitat Conservation Plan, Natural Community Conservation Plan, or other approved local, regional, or state habitat conservation plan. Mitigation Measure # 3: If significant demolition, reconstruction, or construction of new buildings is required to comply with Butte County Code requirements (including the Uniform Building Code), such activities will require review for potential impacts on biological resources by the Director of the Department of Development Services, or his or her designee. Any measures recommended by the Department of Development Services to reduce impacts on biological resources must be implemented. Timing: Requirements of the condition shall be adhered to throughout all grading and construction periods and operational periods, if applicable. Because of the location and the nature of the project, the potential for uncovering or otherwise disturbing cultural resources as a result of project -related activities is unlikely. Mitigation Measures: None required. 4.6 GEOLOGIC PROCESSES: Would the Potentially Less Than Less Than No Reviewed proposal: Significant Significant Significant Impact Under Impact with Impact Previous Mitigation Document Incorporated a. Expose people or structures to potential substantial adverse effects, including the risk of loss, injury, or death involving: 1. Rupture of a known earthquake fault, as delineated on the most recent Alquist-Priolo Earthquake Fault Zoning Map issued by the X State Geologist for the area or based on other substantial evidence of a known fault? Impact Discussion: The Seismic Safety Element of the Butte County General Plan indicates that all of Butte County is in Moderate Earthquake Intensity Zone VIII. The site is not within an Alquist-Priolo Earthquake fault zone or an aftershock zone. The only known active fault in Butte County is the Cleveland Hill fault, located approximately 25 miles from the project site, where activity on August 1, 1975 resulted in the Oroville earthquake. This earthquake had a Richter magnitude of 5.7 and resulted in approximately 2.2 miles of ground rupture along the western flank of Cleveland Hill. In the northwest corner of Butte County near Chico there are a series of short, north-northwest trending faults similar to the Cleveland Hill fault. These faults appear to be an extension of the Bear Mountain Fault or Foothills Shear Zone. Minor seismic activity has occurred in the area of these short faults; however, other geologic evidence indicates these faults are not active (Butte County General Plan 1977). No impacts are anticipated since no rupture of a known active earthquake fault exists in the project area. 0 Butte County Department of Development Services ■ Planning Division ■ Page 9 ■ Project Name: Canine Retreat, Usetrmit, File # UP 02-06 • The 80 -mile -long Midland-Sweitzer fault is located approximately 50 miles southwest of the project site. This fault is considered active and has caused historic earthquakes of Richter magnitudes between 6 to 6.9 in the area in 1892. There is some speculation as to the exact location of the historic earthquake epicenters and some question if they actually occurred on the Midland-Sweitzer fault (Butte County; 1977). Approximately 5 miles west of Butte County there is a north trending fault system known as the Willows fault. This fault is approximately 40 miles long and displaces Cretaceous sediment in the Sacramento Valley. It does not appear to displace surface sediment and has been mapped principally by geophysical methods. However, there have been enough historical seismic events in the vicinity of this fault to conclude that it should be considered potentially active (Butte County General Plan 1977). A moderate earthquake occurred on the afternoon of Friday, August 10, 2001, centered about 9 miles west of Portola, California and about 50 miles east of the project site. Minor damage occurred as a result of this earthquake, which had a magnitude of 5.5, but brief groundshaking was felt in Chico during the earthquake and the aftershocks. This earthquake occurred in the Mohawk Valley Fault Zone, which is an area that experiences a magnitude 5 or higher earthquake approximately every 20 years (according to the University of California, Berkeley Seismological Laboratory). As most of central California, the site can be expected to be subjected to seismic ground shaking at some future time. Accordingly, all buildings, pipes, light poles, roadways, and other improvements will be designed and installed in accordance with Uniform Building Code requirements. Because the project appears to be located such that the probability of significant groundshaking is low, because the project does not propose the addition of significant structures that would be at risk to seismic activity, and because any structures that are built during the course of the project will be designed and installed in accordance with Uniform Building Code standards for the appropriate Seismic Hazard Zone, potential geologic. impacts would be less than significant. The Butte County Seismic Safety Element's Liquefaction Potential Map indicates that the site has a low potential for liquefaction. The impact would be less than significant. The Subsidence and Landslide Potential Map of the Safety Element of the Butte County General Plan indicates that there is not a potential for landslides in this area. The same map indicates that the project area is in a Potential Subsidence Area, similar to much of the city of Chico and northwest Butte County. There is no soil erosion potential for the project site, according to Butte County General Plan GIS data. The Conservation Element's Expansive Soils Map indicates that the project site has moderate expansive soil potential. Because the existing building was built under an exemption, it was not reviewed by the Building Manager. Review of the existing building for the proposed uses is required as a condition of the Use Permit. Mitigation Measure #4 addresses potential impacts. 0 Butte County Department of Development Services ■ Planning Division ■ Page 10 ■ Project Name: Canine Retreat, Use�rmit, File # UP 02-06 9 Mitigation Measure #4: As a condition of the approval of the Use Permit, the applicant is required to hire an architect or engineer to provide building specifications to the Building Manager and to make changes in the building and site that would ensure compliance with applicable provisions of the Butte County Code, including the Uniform Building Code. The Building Division will require that the buildings and foundations of buildings on the site be designed and constructed to handle the shrink/swell characteristics of expansive soils, the potential for subsidence, and any other potential conditions. Timing: Requirements of the condition shall be adhered to throughout the process of development application and approval, and grading, construction, and operational periods, if applicable. Monitoring: Building inspectors shall spot check and shall ensure compliance on-site. 4.7 HAZARDS AND HAZARDOUS MATERIALS: Would the proposal: Potentially Significant Less Than Significant Less Than Significant No Impact Reviewed Under Impact with Impact Previous Mitigation Document Incorporated a. No impact is anticipated. The project site is not known to be listed on any hazardous materials sites lists, nor will its proximity to listed properties on Esplanade create any hazard to the public. The property is located approximately 1.6 miles southwest of the Chico Municipal Airport. The project site is not located within the 65 or 70 CNEL noise contour, nor is it located in an aircraft overflight area, according to the Butte County General Plan. The California Department of Forestry has submitted conditions which are to be met before approval of the project that would reduce any potential impact regarding fire. Compliance with these measures, which are included in the development application materials, is to be accomplished in coordination with the Butte County Fire Department. X ■ Butte County Department of Development Services ■ Planning Division ■ Page 12 ■ Project Name: Canine Retreat, Useennit, File # UP 02-06 • Impact Discussion: The proposed project proposes an addition to an existing septic system to accommodate the keeping of up to 20 dogs on-site. The project applicant indicates that water service to the site is from a well and that this service will continue. The County Environmental Health Department will review the proposed project and determine whether or not the project site has adequate soils for the proposed septic system. The applicant has indicated that the dogs will be let into the outside pen adjoining the building in the morning and evening to defecate and urinate. The applicant has also indicated that solid waste in this outdoor area will be picked up and put into the septic system on an as -need basis, at least three to four times per day. The Department of Environmental Health, in addition to assessing the adequacy of the proposed septic system, will examine the adequacy of this plan for dealing with outdoor dog waste. The project site is not located within a 100 -year flood zone or 500 -year flood zone as shown on Butte County GIS maps, which are based on a Federal Emergency Management Agency Flood Insurance Rate Map, dated June, 2000. The property is not located in an area prone to seiche, tsunami, or mudflow. No impact would occur with respect to these natural hazards. An addition to the existing septic system is proposed on-site and will be required to comply with the County Improvement Standards. Mitigation Measure # 5: The applicant shall provide for percolation and other tests deemed necessary by, and to the satisfaction of, the Department of Environmental Health for the septic system proposed on-site. All feasible measures recommended by the Department of Environmental Health to reduce potential impacts associated with the septic system shall be implemented. The Department of Environmental Health will also assess the applicant's plans regarding outdoor dog waste to ensure that the project will not significantly degrade water quality. The project site is not located within a 100 -year flood zone or 500 -year flood zone as shown on Butte County GIS maps, which are based on a Federal Emergency Management Agency Flood Insurance Rate Map, dated June, 2000. The property is not located in an area prone to seiche, tsunami, or mudflow. No impact would occur with respect to these natural hazards. The proposed project building is buffered not only by.distance, but also by the walnut orchards that surround it. Kennels are a permitted use in this zone with the approval of a Use Permit. For the approval of the Use Permit, the applicant is required to present information, including plans or other information, that is substantial enough to make an informed decision. The Planning Commission reviews the proposal and would grant a Use Permit if: "the proposed uses of property will not impair the integrity and character of the zone in which the land lies, and that the use would not impair the integrity and character of the zone in which the land lies, and that use would not be unreasonably incompatible with, or injurious to , surrounding properties or detrimental to the health and general welfare of the persons residing or working in the neighborhood or the general health, welfare, and safety of the residents of the county" (Butte County Code, Section 24-45.10). The dogs will generate some amount of noise, especially when people or cars approach the project site. Because of the distance to neighboring residential uses and buildings, the impact is expected to be less than significant. The nearest residential dwelling to the proposed project building is located approximately 850-1000 feet to the west. The project applicant has indicated that any especially noisy dog will be kept inside. If kept inside the building, the sound of the dogs' barking would not be perceptible to people in neighboring buildings. Given the agricultural zoning and character of the area, the impacts related to noise would be less than significant. The mitigation measure included below ensures that any potential impact would be reduced to a less -than -significant level. Some temporary increase in noise is expected as the site is prepared for the implementation of the proposed project. Because of the character of the area, the distance to neighboring residential uses and buildings, the temporary nature of such activities, and the trees that buffer the project site from surrounding areas, the impact would be less than significant. Because of the relatively small increment of traffic added to the local roadways, the project would not significantly affect future traffic noise levels. The project is not located in the 65 or 70 CNEL noise contour, according to the Butte County General Plan. Mitigation Measure # 7: If the Department of Development Services or other County departments receive noise -related complaints regarding the project, and the level of noise is in excess of established standards, the operator of the kennel shall implement recommendations of the Department of Development Services to reduce the noise impacts. The area is hard pan dirt with a small amount of gravel embedded in it. During the construction of the building there was a problem with heavy trucks sinking in the mud so rock was brought in to firm it up. I have also laid a 3 -inch layer of gravel over the area to prevent dust and mud. The exercise pens are covered with gravel also which eliminates dust and mud. The road to the building is Butte County owned and maintained. It is in very good shape and able to handle the traffic. I anticipate no more than an average of 15 vehicles per day coming to the facility, which includes a night person and myself. Many of my potential clients are retired and the normal workweek does not affect when they leave on trips, so they leave on days of the week other than Friday the normal drop off day for boarding. This will help to even out the average number of vehicles coming and going. The building is located towards the front of the parcel so the tenants at the end of the road will not notice the added flow (see enclosed diagram page 9). The road doubles back along the Esplanade and then makes a 90 -degree turn to the right into the orchard. This prohibits people from any excessive speeding when approaching the building. ORCHARD SPRAYING The farmer who works the orchard lives on the other side of the adjacent orchard. He is living in a home he built two years ago surrounded by yet another orchard that he owns. . I plan on maintaining a good relationship with him since we will have to work together for the good of my business and also his. He has informed me that he plans on staying in this home and retiring there. I talked to him about the effects to the dogs of the spraying that he does, and he informed me that his dog, who is almost 10 years old, walks behind him as he sprays and has never suffered any ill results. He has told me though, that he would inform me when he was going to spray so that I would have the option of putting the dogs inside of the building. He also informed me that because the orchard is located so close to Shasta Elementary School the sprays that he uses are less invasive then those he uses in the other orchards. He has also told me that he will be spraying in the evening when the dogs will be inside of the building. He does not spray directly around the building because it discolors the building and the owner of the property has asked him not to do it. I intend on informing all of my potential clients of the spraying and what I have been told about any repercussions. DOG CARE/WASTE Dogs that are to be boarded will be housed in 6'x6' chain link kennels. The walnut trees that surround the building shade the outside pens. I have also installed freestanding awnings to protect the dogs if it rains and they are outdoors. Someone will be on the premises 24 hours a day for the dog's safety and to allow the dogs to spend as little time in kennels as possible during the night hours. I will be here every day except Sunday when I will be hiring someone to work. I will hire two people to work the night shifts. • All dogs will be taken out before sleeping to defecate and urinate. Early the next morning they will be taken out again for the same reason. Should an animal have an (S) a) • accident the solid waste will be picked up and dumped in the proposed addition to the septic system, and a clean replacement carpet put in kennel. House pets are usually housebroken and do not like to mess in their environment given the choice. That is why they will be taken out in the late evening to avoid accidents, just as they would be at home. After a client has ended their stay carpet will be cleaned with a machine that I have on the premises. Carpets are cut to fit in each 6'x6' kennel and are backed with rubber. The machine pulls all of the moisture and soil from the carpet into a holding tank on the machine and when it is full it will be dumped into the utility sink in the main kennel room That sink is connected to the septic system. Carpets will be cleaned with an all in one kennel disinfectant, fungicide, cleaner and deodorizer. It is effective against parvovirus, Canine Distemper, Pseudorabies and Newcastle's. The carpet will be rolled up and removed and the floor underneath will be treated the same way. DOG WASTE/OUTSIDE Waste will be picked up throughout the day on an as needed basis. It would cause more clean up if waste was allowed to stay on the ground too long since playing animals might step in it, so it will be picked up at least three or four times during the day. The septic system will be emptied per environmental health requirements. If a dog soils a concrete area the waste is picked up immediately and deposited in a holding can to be deposited onto the proposed septic pad. All dog waste picked up outside the building will be dumped into the pad described on page 10 and washed into the septic tank 0 NOISE FROM BARKING DOGS There will be occasions when there will be barking dogs. The time they will be the noisiest is when someone drives into the driveway to pick up or deliver a dog. This is not usually the case when someone is driving by. Since some dog's natural instinct is to protect the place they are they bark to notify me that someone is coming. This is not the case with all dogs only certain breeds. I will always go outside and greet the newcomer, which will probably reassure them that I am aware of the new arrival and in most cases this will stop them If a dog is consistently barking for not good reason I will be using training techniques to correct the behavior. I am successful in most cases. If all else fails a barking dog will be put inside of the building, in a kennel, until it calms down. Barking dogs that come here on a regular basis will be subject to behavior modification training until the problem can be corrected. If they are barking here they will also do it at home where it might become an .issue with neighbors. As a last resort I have collars that correct this problem and with the owners permission will use them I don't want to listen to a barking dog anymore than my neighbors do. ALL DOGS will spend the night inside of the building. The outside walls are 12 inches thick, fully insulated and have drywall on them. The inside walls are all 7 inches thick, fully insulated and have drywall on them Any barking that occurs in the evening hours will be confined to the inside of the building. Dogs usually sleep at night just like people and don't bark unless there are noises outside. Since the building is located away from the street and surrounding buildings are mostly commercial there is no activity at night. The fact that there will be someone on the site in the evening hours will help to alleviate • any distress a dog might experience. When dogs are outside playing during the day they will be occasionally bark during play. The surrounding orchards will muffle this barking and it is a different barking than that of a dog that is anxious or alerting you to something. Since someone is outside with the dogs the biggest majority of the time, throwing balls or supervising their play, the barking will be limited. IN CONCLUSION I have tried to anticipate any problems that can arise from housing dog's overnight. I have been researching this endeavor for two years looking for the right site and also contacting other businesses of this kind. I have risked everything I own, and am already giving all of my time and attention to making sure that his business is a success and that it run according to any laws or restrictions that might be imposed. I have polled potential clients and found that there is a need for this type of operation. No other kennel in this area offers the benefits I plan on giving such as: 1. A kennel with less driving distance. 2. A safe and clean place for dogs to be where a kennel stay won't overly stress them. 3. Located away from dense residential areas. 4. Peace of mind for those dog owners who wouldn't normally kennel their pets. 5. The daycare may prevent some pet owners from surrendering animals they can't supervise during the day when at work. I have compiled a list of future clients who are anticipating my getting a use permit with the idea that they will be using my facility. They are extremely interested in the way I plan to run my business, the location, and the kennel setup. I have worked with the local animal shelter, Butte Humane since moving to this area as a volunteer and also in breed rescue. They have also expressed to me the need for a facility of this kind. I also am very willing to help pet owners when they are experiencing behavioral problems that if uncorrected might mean giving up their animal.
