The business would involve the recycling of wood, producing wood surveyor's stakes, wood cut stock, and in the future, making honey bee boxes out of pine. The applicant anticipates three full-time employees. An equipment building is developed on the site, which is the only structural improvement. A portable toilet is used on- site currently and no water service is available, but the site will be improved with a septic system and well water service. A permit was issued on April 4, 2002, by the Butte County Environmental Health Department, to construct a well for water service on-site. The existing 2,800 square foot building would be used and no new structures are anticipated. A 100 kilowatt diesel generator would provide power. This is a project on which notice of intent to adopt a negative declaration with mitigation measures regarding environmental impacts has been given. He noted a letter that was submitted by Mr. and Mrs. Duncan. , The hearing was opened to the public. Jose Vega said that he agreed with the conditions. Anthony Koester, 2170 Lone Tree Road, said that his property is adjacent to Mr. Vega's property to the south and there are no trees between the two properties to shield him from the noise. He added that the area is zoned for residential dwelling and he moved to the area for peace and quiet. He explained that the agricultural noise in the area is not a sustained noise for 8 or more hours a day. He said that this request is not compatible with the area and the noise levels would be unacceptable. He was also concerned with fire danger and waste disposal. He said that the residents in the area do not want this use in the area and asked that the Negative Declaration and Use Permit be denied. Commissioner Leland inquired about the number of parcels surrounding the subject property that are developed with residences. Mr. Koester said that there is another property behind him that is adjacent to Mr. Vega's property with a dwelling on it and another dwelling on a property directly to the east. He said all of the property owners that are in the general vicinity of Mr. Vega's property were present at the hearing in opposition to this project. Fred Dahlke said that he was against the noise. He assured the Commission that with his house closed up, he could hear the noise made by Mr. Vega's operation. He said that the noise and sawdust would affect his 6 -year old almond orchard and the honey produced by the bees that are kept in his orchard. James Ray said that Mr. Vega has been operating for two years with no water and no permit. He said that there are also no facilities for restrooms and the operation is an eyesore. ■ BUTTE COUNTY PLANNING COMMISSION ■ MINUTES ■ JUNE 13, 2002 ■ PAGE 9 ■ Joyce Duncan who lives to the north stated that the trees do not mitigate the noise. He told the Commission that diesel fumes come into her house from Mr. Vega's generators and she does not want the fumes to get on her tomato plants. I Kathy Ray said this problem has been ongoing for two years as an illegal operation and if this permit were approved it would exacerbate an already existing problem. Jim Shaffer was opposed to the permit stating that the use was not needed in the subject neighborhood. Donna Wolfe was concerned with the noise as there is no sound buffer. She said that the subject area is slated for residential growth. She described the area as quiet with new expensive homes, and added that she did not object to the intermittent agricultural noises, but does object to this consent year-round noise. She encouraged the Commission to go out and look at the area. Bonnie Dahlke supported the other speakers who were in opposition to the project and stated that she was concerned with the wells in the area being polluted. Brian Price said that he could not sit outside or open his windows because of the noise and fumes. Joyce Gaza, 1184 Montgomery, Oroville, asked that the Negative Declaration not be adopted. She contended that the safe handling of hazardous material can not be done safely without the proper training. She said that the subject project would affect crops in the area and she opposed the Mitigated Negative Declaration. Bill Duncan said that he moved to the subject area to retire and enjoy the peace and quiet. He said that he could not stand the noise from Mr. Vega's saws and generator when he is outside. He was afraid of a pollution problem with Mr. Vega's diesel fumes. He concluded that he was opposed to this project. Claudie Holland agreed with all the speakers who opposed this project. The hearing was closed. Commissioner Leland discussed the hazardous material. Mr. Gerken said that the Commission could limit the type of wood being used by Mr. Vega. Commissioner Leland said that he had a problem with the compatibility issue. He added that this is more an industrial use than an agricultural use and should be placed in an industrial zone. He agreed that the noise and fumes are inconsistent with the neighborhood. At the initial permit hearing, I was not given time to respond to the concerns/alegations placed by neighbors and interested parties. The majority of their concerns were unfounded and based on inaccuarate assumptions. Without giving me the opportunity to respond it made it impossible to have a fair hearing. If i had been given the time to respond i would have addressed their concerns. Based on established zoned ordinances i have the right to use the building in the manner requested. Comments regarding the noise of diesel motors were cited emphatically by neighbors and residents as one of their reasons for disagreement with the proposed use. My generators are no different than those used for decades by farmers to power irrigation pumps. In any manner we are in the process of switching to PG&E electrical service, the switch will be completed as soon as possible. Another incorrect assumption was the length of typical work outings in the building and the intent of it's use. There is NO intention of working 24 hrs a day. Furthermore it's use is restricted to family with no plans for employees of any kind. Our intent is to be self-sufficient. I would also like to request a meeting prior to any hearing that may be scheduled. I feel that much of the information presented to the neighbors and group was not entirely accurate and misinterpreted. The applicant anticipates three full-time employees. The site is developed with an equipment building, which is the only structural improvement. A bathroom is proposed in a corner of the existing equipment building. A permit was issued on April 4t', 2002, by the Butte County Environmental Health Department to construct a well for water service on-site. No new structures are anticipated. The site is flat, and an intermittent stream flows from north to south on the western portion of the project site. The western portion of the site is located in the 100 -year flood zone. The site is not near any municipal airport. The project site is surrounded by an agricultural and low-density residential uses. Zoning on all surrounding parcels is A-5 (Agricultural, parcels of five or more acres in area). General Plan designations on all surrounding parcels are Orchard and Field Crops. ANALYSIS: General Plan and Zoning: The General Plan land use designation of the project site is Orchard and Field Crops. Primary uses in this General Plan land use designation include the following: • Cultivation, harvest, storage, processing, sale, and distribution of all plant crops, especially annual food crops Secondary uses in the land use designation include the following: • Animal husbandry and intense animal uses • Resource extraction and processing • Hunting and water -related recreation facilities • Dwellings • Airports • Utilities • Environmental preservation activities • Public and quasi -public uses • Home occupations Conditional zoning and development criteria include: • Predominant existing parcel sizes ranging from 5 to 10 acres • Adjacent to, or in the general vicinity of, urban boundaries • Present status of agricultural production will not be significantly impaired The proposed'project is located in an area zoned A-5 for agricultural use on parcels of five acres or more in size. The proposal would establish a wood processing business in an agricultural area, which is permitted by issuance of a Use Permit in the A-5 zone. No residence is developed on the project site. The nearest residential dwelling is located to the north of the project property, approximately 400 feet from the project site. The project site is buffered from the nearest residence not only by distance but also by trees. For the approval of the Use Permit, the applicant is required to present information, including plans or other information that is 0 Butte County Department of Development Services 0 Staff Report 0 Page 2 0 • • substantial enough to make an informed decision. The Planning Commission reviews the proposal and will grant a Use Permit if: ...the proposed uses of property will not impair the integrity and character of the zone in which the land lies, and that the use would not be unreasonably incompatible with, or injurious to, surrounding properties or detrimental to the health and general welfare of the persons residing or working in the neighborhood or the general health, welfare, and safety of the residents of the county (Butte County Code, Section 24-45.10) Mitigation measures, as a part of the Initial Study prepared for the project, include those that address safety, noise, and water quality. Additional conditions required as a part of this Use Permit include those that address potential air quality, fire, access, and potential expansion of the business. The conditions satisfactorily address potential deleterious impact to the use and enjoyment of neighboring properties considering the agricultural nature of the area and the zoning and land use designations. CEQA ISSUES: The project was reviewed for environmental impacts under the California Environmental Quality Act (CEQA) in accordance with State Law. The following discussion summarizes those issues and impacts identified in the Initial Study. Hazards The project would involve the use and transport of diesel fuel to power an on-site generator. The initial study indicates mitigation measure that requires the applicant to prepare a hazardous materials plan that guards against spillage, contamination, and fire -to be reviewed by the Environmental Health Department and the Development Services Department before permit approval. The California Department of Forestry has submitted conditions which are to be met before approval of the project that would reduce any potential impact relating to fire hazard. An additional condition requires compliance with the latest California Fire Safe Regulations that are described in Public Resources Code 4290. Hydrology/Water Quality A standard Environmental Health Department condition addresses water quality impacts associated with the proposed water service and septic system. Another mitigation measure included in the Initial Study and as a condition of approval requires that no earthwork occur, and no structures be built in the 100 -year flood zone that crosses the back of the property. Though no drainage impact is expected since no significant additional impervious surfaces are anticipated, the applicant is required to provide a drainage plan to the satisfaction of the Public Works Department, as required by Mitigation Measure #5 of the Initial Study. 0 Butte County Department of Development Services 0 Staff Report 0 Page 3 0 r Noise r The project would create additional noise in the area by allowing the recycling of wood and production of wood products. It is expected that some amount of noise -producing equipment would be used for the business, including a diesel -powered generator. Mechanical equipment such as a generator or a saw can produce noise levels reaching approximately 78 decibels at 50 feet. Noise levels at the nearest residence would be approximately 60 to 66 decibels while the equipment is running, and less than that when averaged out over a period of 24 hours. Noise levels would be approximately 64 decibels at the northern property line. Noise level would be approximately 70 decibels at the property line of the property across Lone Tree Road to the east, which is the closest property to the proposed location of the generator and other equipment. According to the Noise Element of the Butte County General Plan, the normally acceptable noise level for agricultural areas ranges up to 75 decibels, La„ or CNEL. Conditionally acceptable levels of noise range from 70 to 80 decibels, Ld„ or CNEL. Given the agricultural zoning, land use designation, and agricultural character of the area, the sensitivity to noise impacts is relatively lower than other more populated parts of the county. The closest home to the project site is also buffered by trees, which would further reduce the noise impact. Nighttime operation is prohibited as a condition of this Use Permit. Since the anticipated noise levels are based on assumptions about typical noise level of similar equipment, and not based on an on-site noise analysis, a mitigation measure included in the Initial Study requires construction of noise barriers, installation of mufflers on equipment, or other measures recommended by the Department of Development Services if County departments receive noise -related complaints having to do with the proposed project. ACTIONS FOR CONSIDERATION Staff recommends that the Planning Commission take the following actions: I. Adopt a Mitigated Negative Declaration with the following findings: A. An Initial Study was completed in compliance with the California Environmental Quality Act. Said study identified significant environmental effects and included mitigation measures that would mitigate such effects below significant levels; a Mitigated Negative Declaration is proposed. B. The Planning Commission has considered the proposed Mitigated Negative Declaration, together with comments received during the review process. C. On the basis of the whole record before the Planning Commission, including the Initial Study and any comments received, there is no substantial evidence that the Use Permit for Jose and Maria Vega, Planning Division File No. UP 02-11, will have a significant effect on the environment. 0 Butte County Department of Development Services 0 Staff Report 0 Page 4 0 0 th D. The proposed Mitigated Negative Declaration reflects the independent judgment and analysis of the County, which is the Lead Agency. II. The design of the proposed project improvements will not cause environmental damage to fish and wildlife or their habitat, and a "de minimus" exemption regarding impact to fish and wildlife or their habitat is recommended. The collection of fees pursuant to Fish and Game Code Section 711.4(d)(3) and 14 CCR 753.5. is not recommended. III. Recommend to the Planning Commission approval of Use Permit 02-11 for Jose and Maria Vega, subject to the following findings and the conditions in Exhibit "A": A. The proposed location, size, design, and operating characteristics of the proposed use are in accordance with the purpose of this Ordinance, the purpose of the zone in which the site is located, the Butte County General Plan, and the development policies and standards of the County because: Conditions of approval have been applied to this project after CEQA review. The project is in accordance with the purpose of the zone in which the land lies and the Butte County General Plan because the project site is designated Orchard and Field Crops. The Orchard and Field Crops land use designation allows "resource extraction and processing" as Secondary Uses. The A -S zone allows wood processing with approval of a Use Permit. B. The location, size, design, and operating characteristics of the proposed use would be compatible with, and would not adversely affect, or be detrimental to adjacent uses, residents, buildings, structures, or natural resources, with consideration given to: Harmony in scale, bulk, coverage, and density: The proposed project will not involve significant changes to the existing building on-site, nor would it involve construction of additional structures on-site. The equipment expected on-site consists of trucks, a generator, and wood processing equipment that would not be significantly different, relative to aesthetic or compatibility, from agricultural equipment which is routinely used in this agricultural area of Butte County. 2. The availability of public facilities, services and utilities: Water service capacity and sewerage system adequacy is subject -to review by the Environmental Health Department, which does not anticipate problems based on a preliminary review. 3. The harmful effect, if any, upon desirable neighborhood character: 0 Butte County Department of Development Services ■ Staff Report ■ Page 5 0 The surrounding properties are used for agriculture and low-density residential uses. The nearest residence is located approximately 400 feet to the north of the proposed project site. With the various mitigation measures required of the project applicant and the various other conditions of this permit that address potential impact on neighbors, the proposed use would not have significant deleterious impacts on the use or enjoyment of adjacent residential property, as discussed in the Initial Study and as summarized above in the section regarding CEQA Issues. 5. The suitability of the site for the type and intensity of use or development which is proposed: The site is suited for the project because no significant additional buildings or other substantial improvements would be required for the project, and because the property is situated such that water, sewerage, and transportation service would be adequate, and because the surrounding character, zoning, and land use designation allows agricultural and resource extraction and processing uses. 6. Any other relevant impact of the proposed use: The Planning Division has circulated the application to County Agencies, and other interested parties. No significant issues were identified by County Agencies. One neighbor identified potential impacts having to do with fire safety, property value, airborne sawdust, and noise. Another neighbor identified concerns relating to noise, accumulation and disposal of scrap materials, impact on property values, groundwater contamination, sawdust emission, and eventual growth of the business. The mitigation measures and conditions of approval address all the potential compatibility and environmental issues. Accumulation of scrap materials on-site would be subject to County Code provisions that require clearance of refuse and junk from property. Property values are protected by zoning and general planning, which exist in part to give property owners an idea of the potential future use of adjacent parcels which could affect property values. The current surrounding property owners and potential future buyers of property in the area have notice, through the zoning and general planning policies, regarding potential agricultural and resource extraction/processing uses that could potentially locate in this area. C. Pursuant to the provisions of the Zoning Ordinance of the County of Butte and the special conditions set forth below: Jose and Maria Vega are hereby granted a Use Permit to establish a wood processing operation on APN 025-170-055 on Lone Tree Road. Failure to comply with the conditions specified herein as the basis for approval of application and issuance of Permit constitutes cause for the revocation of said permit in accordance with the procedures set forth in the Butte County Zoning Ordinance, including Butte County Code Sec. 24-45.65. 2. Unless otherwise provided for in a special condition to this Use Permit, all conditions must be completed prior to or concurrently with the establishment of the granted use. The use granted by this permit must be established within two years of the date of approval. 3. Minor changes may be approved administratively by the Directors of Development Services, Environmental Health, or Public Works upon receipt of a substantiated written request by the applicant, or their respective designee. Prior to such approval, verification shall be made by each Department or Division that the modification is consistent with the application, fees paid and environmental determination as conditionally approved. Changes deemed to be major or significant in nature shall require a formal application for amendment. 4. If any use for which a Use Permit has been granted is not established within two years of the receipt of the Permit by the Permittee, the Permit shall become null and void and reapplication pursuant to Section 24-45 (of the Zoning Code) shall be required to establish the use previously granted under the expired Permit unless, 30 days prior to the expiration date, a request 'for a one year extension is submitted to the Planning Commission together with sufficient evidence that the time limits for processing development permits under federal or state regulations require time limits which exceed one year. Neither the applicant, nor any agent nor representative of the applicant shall intentionally omit or misrepresent any material fact in connection with the application. Any alleged material misrepresentation shall constitute grounds for the Director of Development Services to commence a revocation hearing, and, if proven to exist, shall constitute sufficient grounds to revoke a Permit. Conditions of Approval: Planning Division: 1. The Use Permit is valid for the wood processing business described in this document, in the Project File UP 02-11, and in the Initial Study. The Use Permit is not valid for any expansion of the wood processing business beyond that described in said documents. Expansion, for the purposes of this Use Permit includes, but is not limited to, addition of employees, addition of product or raw material delivery trips, addition of equipment, or addition of operating hours. 2. The applicant is required to obtain a Butte County Air Quality Management District (BCAQMD) Authority to Construct Permit for the proposed use of the diesel generator and wood processing equipment. The applicant shall prepare a description of plans to gather and dispose of sawdust that will be generated on-site. The BCAQMD shall review and approve these plans. The applicant shall implement all measures required by BCAQMD to reduce impact to air quality as a condition of the Authority to Construct Permit. BCAQMD shall respond to complaints regarding air quality. 3. If demolition, reconstruction, or construction of a new building is required, such activities will require additional review by the Butte County Air Quality Management District (BCAQMD), and any feasible measures recommended by the BCAQMD shall be implemented. 4. Any reconstruction, or construction of new buildings is required to comply with Butte County Code requirements (including the Uniform Building Code), and such activities will require review for potential environmental impacts by the Director of the Department of Development Services, or his or her designee. 5. Proposed improvements constitute a "change in use" or "change in character of use" as stated in the Building Code.. Improvement plans shall incorporate all code -required elements for the new use. The applicant must comply with Uniform Building Code requirements for property line clearances considering use, area, and fire -resistiveness of existing buildings. 8. Existing building/s shall be made to comply with current Building and Zoning regulations for the intended new use of the building/s or the existing building/s shall be demolished. 9. All Facilities that are not in continual use for a period of six months shall be considered abandoned. Abandoned Facilities are hereby designated as unlawful and as public nuisances, requiring no amortization period. If the Director of Development Services determines that the Facility is abandoned, the applicant may be required to remove all equipment belonging to the applicant from the premises and return the site to its original condition within 30 calendar days of receipt of notice to abate. If such Facility is not removed and the site returned to its original condition within 30 days, the County may remove the Facility at the applicant's and/or land owner's joint expense. 10. The project applicant shall prepare a plan for storage and use of the diesel fuel used to power the generator on-site. The plan shall describe all aspects of use, storage, and transport of the diesel fuel that is to be used in association with the proposed business. Safeguards against spillage, contamination, and fire shall be described. The plan shall be reviewed by the Environmental Health Department and the Development Services Department before_ permit approval. Any recommendations, such as method of storage and limits on the amount stored and used on the property, made by the Environmental Health or Development Services Department to reduce potential hazard impact shall be implemented by the applicant. Timing: The plan shall be prepared prior to project approval and the compliance with the plan is required during all construction and operational phases of the project. Monitoring: Building inspectors shall spot check on-site to ensure compliance. The Department of Environmental Health shall respond to complaints. 11. No structures shall be built nor shall any type of earthwork occur within the 100 -year flood zone. No storage or use of diesel fuel shall occur within 200 feet of the 100 -year flood zone. Plan requirements: The above condition shall be noted on building plans, and the 100 - year flood zone shall be shown on building plans. Timing: This requirement shall be adhered to during site preparation, construction, and operation of the business. If the Department of Development Services or other County departments receive noise - related complaints regarding the project and the level of noise is in excess of established standards, the applicant shall implement recommendations of the Department of Development Services to reduce the noise impacts, including, but not limited to, construction of noise barriers, further restrictions on operating hours, and/or installation of mufflers on equipment. Timing: The applicant shall implement measures to reduce noise impacts if they are recommended by the Department of Development Services as a result of complaints during the operational phase of the project. Monitoring: Building inspectors shall spot check and shall ensure compliance on-site, if necessary. 13. Construction, installation, or development of structures or facilities on the parcels/lots shall comply with the latest California Fire Safe Regulations, (Public Resources Code 4290), and all other applicable State and County codes, ordinances, and regulations in effect at the time of application for improvement permits. 14. For all structures, provide an all-weather access at least 10 -feet wide and with a vertical clearance of at least 15 feet that will accommodate a 40,000 -pound fire apparatus. 15. Install the following fire extinguishers: two (2) 2 and %2 gallon pressurized water extinguishers — and place one at each end of the existing building on-site; one (1) 2A1OBC multipurpose extinguisher to be installed near the diesel generator. 16. Prior to use of this project, the applicant shall contact the Planning Division for a field inspection to verify all conditions of approval and ordinance requirements have been met. 17. Applicant must also comply with all other applicable State and local statutes, ordinances, and regulations. 18. Operation of the proposed wood processing business shall be limited to the hours between 8:00 A.M. and 7:00 P.M. during the week (from Monday through Friday). Noise We have experienced Mr. Vega's unauthorized milling operation for a number of years, and our use and enjoyment of our property has been adversely impacted by the noise of saws and other power equipment. Our residence is approximately four hundred (400) feet from'Mr. Vegas shop. Over the course of years, Mr. Vega has operated a milling business during the day and during evenings and weekends, and has interrupted our use of our yard by the constant whine of both his power saws and his generator. It further appears by the language of Mr. Vegas intended use, he will be operating a wood chipping operation to recycle wood into fuel or other commercial purposes. The noise created by this operation will be intolerable. The granting of a use permit for the manufacturing of wood products and the recycling of wood will result in continual noise pollution to not only ourselves, but several other residents living near this property. 2. Reduction In Property Value It is clear the granting of a use permit for a saw mill operation in an area not currently zoned for manufacturing will negatively effect the property value of our property. While there is a considerable amount of current farming going on in the general area, there are single family structures near the Vega property which will be adversely impacted. In simple terms, an upscale residence, as many in the area which are located next to a saw mill will experience a reduced property values. • 3. Sawdust • One can only expect Mr. Vega will dispose of sawdust under a Use Permit similar to his current practice. This involves a metal duct running out a hole high in the building wall which allows the wind to carry the dust away rather than dispose of it in a steel bin currently in place. 4. Fire Currently Mr. Vega operates without any fire suppression system. There is currently no water available on his property and the construction of a water well does little to calm the fears of a saw mill created grass fire threatening local residents. Mr. Vega indicates he intends to operate under generator power, as he has been doing for ,years. Mr. Vega has placed his generator within feet of his building. A fire in this building would likely result in the shutting down of his generator power, therein rendering his water well inoperable. Without water to combat a small fire, it would quickly spread to neighboring property and immediately threaten residential housing. As long as Mr. Vega uses generator power exclusively, there exists a significantly increased threat of fire to neighbor residences. Currently, Mr. Vega has placed a large propane tank within two (2) feet of the building in violation of code which has caused a substantially increased risk of explosion and fire by his disregard for the safety of area residents. Attached hereto are several photos taken on May 11, 2002. The manner in which Mr. Vega currently operates his business is evident. These photos were taken from Lone Tree Road. Of special note is the tree Mr. Vega planted at the north east corner of his building to hide the placement of his propane tank next to the building. Also, please note the proximity of this building to our home. You can see why we would be horribly effected by a saw mill operation at this site. SUMMARY Mr. Vega purchased this property knowing the current zoning of the property and that of the area for miles around. Mr Vega represented he intended to develop the property into a commercial farming operation growing flower plants for wholesale distribution. A use fully compatible with the zoning. We welcomed Mr. Vegas stated use. In fact, however, Mr. Vega began to immediately build the wooden pole and corrugated steel"agricultural" building and upon completion, began moving wood supplies and saw mill equipment into the property.This building is the building Mr. Vega references in his application. Aside from leveling a portion of the property. Mr. Vega has made no effort to develop the property as announced leading his residential neighbors to conclude his representations were false. In short, Mr. Vega has disregarded the existing limitations on the use of his property and has instead created a hazard and nuisance to all of his immediate neighbors. The granting of a Use Permit to allow the incompatible use of this property for a commercial saw mill operation is contrary to the zoning plan and will cause irreparable harm to the adjacent homeowner. Importantly, it will reward Mr. Vega for operating without sanction for several years. It appears amply demonstrated Mr. Vega will not adhere to any mitigating factors which may be placed by this honorable body, such as time of use, fire suppression plans and equipment, etc. since he has operated unlawfully for several years, one can only conclude the rule of law will have little effect upon him. Like most of you and most in society, we have worked hard to create a home where we can enjoy ourselves. We chose the current zoning of ARl because we wanted a quieter style of life away from the noise of urban living. We fully relied on the general plan and the existing zoning established by this county in our choice of location. The granting of the Use Permit for the operation of a saw mill in this area is completely incompatible with the overall planning design, and at a time when the subject of land use is on the forefront for our Board of Supervisors. Please be assured we will seek a remedy through the courts if this Use Permit is granted. Just ask yourselves one question..... Would I want a saw mill placed next to my home?. Proiect Description: Jose and Maria Vega are requesting a Use Permit to allow the establishment and operation of a wood processing business. The business would involve the recycling of wood, producing wood surveyor's stakes, wood cut stock, and in the future, making honey bee boxes out of pine. The applicant anticipates three full-time employees. An equipment building is developed on the site, which is the only structural improvement. A portable toilet is used on-site currently and no water service is available, but the site will be improved with a septic system and well water service. A permit was issued on April 0, 2002, by the Butte County Environmental Health Department to construct a well for water service on-site. The existing 2800 -square foot equipment building would be used and no new structures are anticipated. A 100 -kilowatt diesel generator would provide power. M. No impact on significant biological resources is expected because of following two reasons: the project consists of the operation of a wood processing business, with no addition of buildings; and the existing grassland on-site is not the type of habitat that supports a rich diversity of species nor any listed species. There are no locally designated wildlife areas in the vicinity of the project, and animal and plant species and sensitive natural communities identified in the area are more than one mile from the project site. The project would not conflict with any local policies or ordinances protecting biological resources. The proposal would not conflict with the provisions .of an adopted Habitat Conservation Plan, Natural Community Conservation Plan, or other approved local, regional, or State habitat conservation plan. 4.5 CULTURAL RESOURCES: Impact Discussion: Cultural resources include prehistoric and historic period archaeological sites; historical features, such as rock walls, water ditches and flumes, and cemeteries; and architectural features. The site is not within an Alquist-Priolo Earthquake fault zone or an aftershock zone. The only known active fault in Butte County is the Cleveland Hill fault, located approximately 25 miles from the project site, where activity on August 1, 1975 resulted in the Oroville earthquake. This earthquake had a Richter magnitude of 5.7 and resulted in approximately 2.2 miles of ground rupture along the western flank of Cleveland Hill. In the northwest corner of Butte County near Chico there are a series of short, north-northwest trending faults similar to the Cleveland Hill fault. These faults appear to be an extension of the Bear Mountain Fault or Foothills Shear Zone. Minor seismic activity has occurred in the area of these short faults; however, other geologic evidence indicates these faults are not active (Butte County General Plan 1977). The Butte County GIS Fault Lines theme shows that an inferred fault is located approximately three miles to the east of the proposed project site. No impacts are anticipated since no rupture of a known active earthquake fault exists in the project area. The 80 -mile -long Midland-Sweitzer fault is located approximately 50 miles southwest of the project site. This fault is considered active and has caused historic earthquakes of Richter magnitudes between 6 to 6.9 in the area in 1892. This fault is approximately 40 miles long and displaces Cretaceous sediment in the Sacramento Valley. It does not appear to displace surface sediment and has been mapped principally by geophysical methods. However, there have been enough historical seismic events in the vicinity of this fault to conclude that it should be considered potentially active (Butte County General Plan 1977). A moderate earthquake occurred on the afternoon of Friday, August 10, 2001, centered about nine miles west of Portola, California, and about 50 miles east of the project site. Very little damage occurred as a restilt of this earthquake, which was had a magnitude of 5.5, but brief groundshaking was felt in Chico during the earthquake and the aftershocks. This earthquake occurred in the Mohawk Valley Fault Zone, and this area of California experiences a magnitude five or higher earthquake approximately every 20 years, according to the University of California, Berkeley Seismological Laboratory. Like most of central California, the site can be expected to be subjected to seismic ground shaking at some future time. Accordingly, all buildings and other improvements will be designed and installed in accordance with Uniform Building Code requirements. Because the project appears to be located such that the probability of significant groundshaking is low, because the project does not propose the addition of significant structures that would be at risk to seismic activity, and because any structures that are built during the course of the project will be designed and installed in accordance with Uniform Building Code standards for the appropriate Seismic Hazard Zone, potential geologic impacts would be less than significant. The Butte County Seismic Safety Element's Liquefaction Potential Map indicates that the site has a generally moderate potential for liquefaction. The impact would be less than significant since the project does not propose new structures. The Subsidence and Landslide Potential Map of the Safety Element of the Butte County General Plan indicates that there is no to low potential for landslides in this area. The project involves only the use of property for a wood processing business within an existing structure. Any new structures built on the property would comply with applicable portions of the Uniform Building Code as adopted by Butte County, which would mitigate any potential impacts resulting from any sort of ground failure. The project site is, however, within a potential subsidence area, as indicated on the Subsidence and Landslide Potential Map of the Safety Element. No additional buildings are anticipated on-site, and therefore the impact is less than significant. There is a moderate soil erosion potential for the project site, according to Butte County General Plan GIS data. The project does not involve any activity that would result in significant soil erosion impacts. The Conservation Element's Expansive Soils Map indicates that the project site has a high expansive soil potential. The project involves only the use of property for wood processing. The Planning Commission reviews the proposal and will grant a Use Permit if: "the proposed uses of property will not impair the integrity and character of the zone in which -the land lies, and that the use would not impair the integrity and character of the zone in which the land lies, and that the use would not be unreasonably incompatible with, or injurious to, surrounding properties or detrimental to the health and general welfare of the persons residing or working in the neighborhood or the general health, welfare, and safety of the residents of the county" (Butte County Code, Section 24- 45.10). Any recommendations, such as method of storage and limits on the amount stored and used on the property, made by the Environmental Health or Development Services Department to reduce potential hazard impact shall be implemented by the applicant. Timing: The plan shall be prepared prior to project approval and the compliance with the plan is required during all construction and operational phases of the project. Monitoring: Building inspectors shall spot check on-site to ensure compliance. The Department of Environmental Health shall respond to complaints. Mitigation Measure # 3: Place the following conditions on the building plans: • Identify the usable sewage disposal area proved to meet the requirements of the County Improvement Standards Appendix VII. • Place a note on the building plans that states that no water well may be placed within 100 feet of the Usable Sewage Disposal Area. Plan Requirements: All requirements shall be shown or noted on building plans. Timing: The building plans shall. include required information and requirements of the condition shall be adhered to during project construction. Monitoring: The Planning Division and the Public Works Department shall ensure that the note is placed on the building plans. Building inspectors shall spot check and shall ensure compliance on-site. Mitigation Measure #4: No structures shall be built nor shall any type of earthwork occur within the 100 -year flood zone. No storage or use of diesel fuel shall occur within 200 feet of the 100 -year flood zone. Plan requirements: The above condition shall be noted on building plans, and the 100 -year flood zone shall be shown on building plans. Timing: This requirement shall be adhered to during site preparation, construction, and operation of the business. Monitoring: Building inspectors shall spot-check for compliance. Mitigation Measure #5: Prior to the recordation and issuance of building permits, a plan for a permanent solution for drainage shall be submitted to, and approved by, the Department of Public Works. The drainage plans shall specify how drainage waters shall be detained on-site and/or conveyed to the nearest natural or publicly maintained drainage channel or facility, and shall provide that there shall be no increase in the peak flow runoff to said channel or facility. The existing 2800 -square foot equipment building would be used and no new structures are anticipated. A 100 -kilowatt diesel generator would provide power.
