The property is located on Highway 32, approximately 3,500 feet east of Yosemite Drive, east of Chico. APN 011-030-086 (CS) (UP 02-14) Mr. Sanders gave a brief summary of the project noting that Ubiquitel is leasing one acre of land out of the 230 -acre parcel. The hearing was opened to the public. No one was present to comment on this item. The hearing was closed. It was moved by Commissioner Nelson, seconded by Commissioner Marin, and unanimously carried to approve the Use permit for Ubiquitel Leasing subject to the findings and conditions listed below. I. The project is exempt from the provisions of the California Environmental Quality Act under Section 15301. Section 15301 (Existing Facilities) consists of the leasing and minor alteration of existing public utility structure(s) involving negligible or no expansion of use. Proposed wireless communication facilities colocated with the existing utility pole constitute a negligible expansion of the existing use. II. Approve Use Permit 02-14 for Ubiquitel Leasing Company, subject to the following findings and conditions found in Attachment A. A. The proposed location, size, design, and operating characteristics of the proposed use is in accordance with the purpose of this Ordinance, the purpose of the zone in which the site is located, the Butte County General Plan, and the development policies and standards of the County because: Project conditions of approval have been applied to this project pursuant to the applicable requirements of Section 24-262 (Wireless Communication Facilities), the Butte County Building Division, the Butte County Environmental Health Department, and the Butte County Air Quality Management District. The project is consistent with the Butte County General Plan in that the Agricultural Residential land use designation allows public uses as a Secondary Use and cellular telephone facilities are considered a public use. The project also complies with the Unclassified (U) zoning provisions and the Wireless Communication Facilities Ordinance in that proposed facilities mounted to an existing utility pole are permitted with approval of a Use Permit. B. The location, size, design, and operating characteristics of the proposed use will be compatible with, and will not adversely affect, or be detrimental to adjacent uses, 0 BUTTE COUNTY PLANNING COMMISSION 0 MINUTES 0 APRIL 25, 2002 0 PAGE 2 ■ residents, buildings, structures, or natural resources, with consideration given to: 1. Harmony in scale, bulk, coverage, and density: The proposed flush -mounted antennas would not increase the height of the existing tower and would not be visually conspicuous in this setting. 2. The availability of public facilities, services, and utilities: Electrical power service is already established to the property and no additional services or utilities are required. 3. The harmful effect, if any, upon desirable neighborhood character: The project site is already developed with a lattice communications tower. The proposed antennas mounted to the existing tower would not have a harmful effect on the neighborhood character. The radio-frequency emissions from the proposed antennas must meet FCC standards. 4. The generation of traffic and the capacity and physical character of surrounding streets: Very few vehicle trips would be generated during installation of the antennas and equipment shelter. The communications facility is unmanned and only one regular maintenance visit per month would be required after construction. 5. The suitability of the site for the type and intensity of use or development which is proposed: The site is well suited for the project because the proposed antennas would be mounted on the existing 161 foot tall lattice tower. The operation and maintenance of the facility would not impact the surrounding uses. 6. Any other relevant impact of the proposed use: The Planning Division has circulated the proposed communication facility application to County Agencies and has received no evidence that the use would cause any other relevant impact. C. Based on the above findings, the proposed location, size, design, and operating characteristics of the proposed use and the condition under which it would be operated or maintained would not be detrimental to the public health, safety, or welfare, or injurious to properties or improvements in the vicinity. 0 BUTTE COUNTY PLANNING COMMISSION 0 MINUTES ■ APRIL 25, 2002 0 PAGE 3'■ • D. The proposed use would comply with all applicable provisions of Chapter 24, Section 262 of the Butte County Code. E. The radio-frequency emissions generated by the antennas on the monopole are below the limits set by the Federal Communications Commission. F. The proposed antennas would not create any impacts to aircraft operations. Conditions of Approval: Planning Division: The new antennas shall be painted to match the color of the tower at the height they will be located. 2. The Facility must meet or fall within current standards and regulations of the FAA, the FCC, the County, and any other agency of the Federal or State government with the authority to regulate such Facilities. 3. The installation of the Facility shall comply with all applicable building and electrical codes. 4. No advertising or display shall be permitted on the Facility. 5. The placement of any antenna or structure shall not adversely affect any on-site sewage disposal system or its repair area without written approval from the Division of Environmental Health. 6. • The installation of the Facility shall not violate any existing deed restrictions. 7. The Facility shall have a twelve (12) foot wide all-weather access to a publicly maintained road capable of supporting a forty thousand (40,000) pound fire apparatus with fifteen (15) feet of vertical clearance. 8. The Facility shall fall within current standards and regulations of the FAA, the FCC, and any other State and/or Federal agency with the authority to regulate such Facility. If such standards and regulations are changed, the property owner or responsible party shall bring the Facility into compliance with such revised standards and regulations within ninety (90) days of the effective date of such standards and regulations, unless a more stringent compliance schedule is mandated by the controlling agency. 9. There shall be no outdoor vehicle or equipment storage except for emergency purposes. 10. The Facility or combination of the Facilities on the site shall not generate, at any time, electromagnetic frequency radiation (EMF) or radio frequency radiation (RF) in excess of ■BUTTE COUNTY PLANNING COMMISSION 0 MINUTES 0 APRIL 25, 2002 ■PAGE 4 0 the FCC adopted standards for human exposure, as amended over time. 11. If it is found that the Facility is or will be detrimental to the health, safety, or welfare of persons working or residing near such facility, then the service provider(s) and property owner shall be jointly and solely responsible for the removal, adjustment, or replacement of the Facility. In no case shall the Facility remain in operation if it is found to create a hazard to health, safety, and welfare. The Facility shall not be found to create a hazard to health, safety, or welfare as a result of EMF or RF emissions from the Facility so long as it meets all current standards established by the FCC, pursuant to FCC OET 65. Prior to issuance of the building permit for the installation of the Facility, the applicant shall post a performance security in an amount and form determined by the Director of Development Services that is sufficient to cover the cost of a one-time test by a radio frequency consultant selected by the County, sufficient to determine whether the Facility's RF/EMF emissions comply with FCC standards. If the Facility's emissions are determined to exceed FCC standards, the applicant is required to pay for such other tests and other corrective measures as are necessary to establish compliance with FCC OET 65 and its successors and such noncompliance shall constitute sufficient grounds to commence a permit revocation hearing which may lead to permit revocation. The applicant shall cooperate in all respects with the County's consultant to assist the consultant to reach his/her conclusion. 12. All Facilities that are not in continual use for a period of six (6) months shall be considered abandoned. Abandoned Facilities are hereby designated as unlawful and as public nuisances, requiring no amortization period. If the Director of Development Services determines that the Facility is abandoned, the applicant may be required to remove all equipment belonging to the applicant from the premises and return the site to its original condition within thirty (30) calendar days of receipt of notice to abate. If such Facility is not removed and the site returned to its original condition within thirty (30) days, the County may remove the Facility at the applicant's and/or land owner's joint and several expense. 13. All equipment cabinets shall be screened from view with a minimum six (6) foot tall wooden fence surrounding the equipment pad. All screening treatments, including landscaping, shall be maintained as approved for the life of the Facility. 14. The Facility may not encroach into, under, over, above, or upon any public street in the unincorporated area of the County in the absence of a valid encroachment permit from the County. 15. The owner/operator of the Facility shall annually submit a written verification, attested to under penalty of perjury, signed by both the owner/operator and an FCC licensee in the employ of or retained by the owner/operator, that the radio frequency radiation/electromagnetic frequency (RF/EMF) emitted by the facility conforms to safety standards set forth in FCC OET 65. The reports prepared for the Facility shall conform to reporting requirements set by the FCC and the County. The Facility shall be secured at all times to prevent access by the public. 17. Unless otherwise provided for in a special condition to this use permit, all conditions must be completed prior to or concurrently with the establishment of the granted use. The use granted by this permit must be established within 24 months of the date of approval. 3. Minor changes may be approved administratively by the Directors of Development Services, Environmental Health, or Public Works upon receipt of a substantiated written request by the applicant, or their respective designee. Prior to such approval, verification shall be made by each Department or Division that the modification is consistent with the application, fees paid and environmental determination as conditionally approved. Changes deemed to be major or significant in nature shall require.a formal application for amendment. 4. If any use for which a Use Permit has been granted is not established within two years of the date of approval, the permit shall become null and void and reapplication and a new permit shall be required to establish the use. A Use Permit subject to lapse may be renewed for an additional period of up to one year, provided that sixty (60) calendar days prior to the expiration date, an application for renewal, of the Use Permit is filed with the Planning Division on the prescribed form and accompanied by the necessary data and fees. 5. The terms and conditions of this permit shall run with the land and shall be binding upon and be to the benefit of the heirs, legal representatives, successors, and assigns of the Permittee. 1 6. Neither the applicant, nor any agent nor representative of the applicant shall intentionally omit or misrepresent any material fact in connection with the application. Any alleged material misrepresentation shall constitute grounds for the Director of Development Services to commence a revocation hearing, and, if proven to exist, shall constitute sufficient grounds to revoke a permit. Conditions of Approval: Planning Division: 1. The new antennas shall be painted to match the color of the tower at the height they will be located. 2. The Facility must meet or fall within current standards and regulations of the FAA, the FCC, the County, and any other agency of the Federal or State government with the authority to regulate such Facilities. 3. The installation of the Facility shall comply with all applicable building and electrical codes. 4. No advertising or display shall be permitted on the Facility. 5. The placement of any antenna or structure shall not adversely affect any on-site sewage disposal system or its repair area without written approval from the Division of Environmental Health. 6. The installation of the Facility shall not violate any existing deed restrictions. 7. The Facility shall have a twelve (12) foot wide. all-weather access to a publicly maintained road capable of supporting a forty thousand (40,000) pound fire apparatus with fifteen (15) feet of vertical clearance. 8. The Facility shall fall within current standards and regulations of the FAA, the FCC, and any other State and/or Federal agency with the authority to regulate such Facility. If such standards and regulations are changed, the property owner or responsible party shall bring the Facility into compliance with such revised standards and regulations within ninety (90) days of the effective date of such standards and regulations, unless a more stringent compliance schedule is mandated by the controlling agency. 9. - There shall be no outdoor vehicle or equipment storage except for emergency purposes. 10. The Facility or combination of the Facilities on the site shall not generate, at any time, electromagnetic frequency radiation (EMF) or radio frequency radiation (RF) in excess of the FCC adopted standards for human exposure, as amended over time. 2 M • 11. If it is found that the Facility is or will be detrimental to the health, safety, or welfare of persons working or residing near such facility, then the service provider(s) and property owner shall be jointly and solely responsible for the removal, adjustment, or replacement of the Facility. In no case shall the Facility remain in operation if it is found to create a hazard to health, safety, and welfare. The Facility shall not be found to create a hazard to health, safety, or welfare as a result of EMF or RF emissions from the Facility so long as it meets all current standards established by the FCC, pursuant to FCC OET 65. Prior to issuance of the building permit for the installation of the Facility, the applicant shall post a performance security in an amount and form determined by the Director of Development Services that is sufficient to cover the cost of a one-time test by a radio frequency consultant selected by the County, sufficient to determine whether the Facility's RF/EMF emissions comply with FCC standards. If the Facility's emissions are determined to exceed FCC standards, the applicant is required to pay for such other tests and other corrective measures as are necessary to establish compliance with FCC OET 65 and its successors and such noncompliance shall constitute sufficient grounds to commence a permit revocation hearing which may lead to permit revocation. The applicant shall cooperate in all respects with the County's consultant to assist the consultant to reach his/her conclusion. 12. All Facilities that are not in continual use for a period of six (6) months shall be considered abandoned. Abandoned Facilities are hereby designated as unlawful and as public nuisances, requiring no amortization period. If the Director of Development Services determines that the Facility is abandoned, the applicant may be required to remove all equipment belonging to the applicant from the premises and return the site to its original condition within thirty (30) calendar days of receipt of notice to abate. If such Facility is not removed and the site returned to its original condition within thirty (30) days, the County may remove the Facility at the applicant's and/or land owner's joint and several expense. 13. All equipment cabinets shall be screened from view with a minimum six (6) foot tall wooden fence surrounding the equipment pad. All screening treatments, including landscaping, shall be maintained as approved for the life of the Facility. 14. The Facility may not encroach into, under, over, above, or upon any public street in the unincorporated area of the County in the absence of a valid encroachment permit from the County. 15. The owner/operator of the Facility shall annually submit a written verification, attested to under penalty of perjury, signed by both the owner/operator and an FCC licensee in the employ of or retained by the owner/operator, that the radio frequency radiation/electromagnetic frequency (RF/EMF) emitted by the facility conforms to safety standards set forth in FCC OET 65. The reports prepared for the Facility shall conform to reporting requirements set by the FCC and the County. The reports shall be submitted to the Planning Division no later than January 31 of each year. 16. The Facility shall be secured at all times to prevent access by the public. • 17. The project site shall be developed in accordance with the approved project site plan and the conditions contained herein. Said site plan is on file in the Planning Division, is identified as "Exhibit D" and date-stamped November 21, 2001, and is incorporated herein by this reference. 18. Prior to use of this project, the applicant shall contact the Planning Division for a field inspection to verify all conditions of approval and ordinance requirements have been met. 19. Applicant must comply with all other applicable State and local statutes, ordinances, and regulations. Building Division 20. Building permits are required for the antennas and equipment cabinets. Engineer design calculations are required to verify adequacy of existing tower structure and footings when additional antennas are installed. The project site is located on the north side of Highway 32, east of Chico. The zoning is U (Unclassified). The proposed Personal Communication Services (PCS) base station facility is designed to extend and provide PCS service to areas around the east side of the Chico urban area. Proposed improvements include three panel antennas, each approximately four square feet in size (56" H x 8" W x 3" D), flush -mounted at the top of an existing 161 -foot tall lattice tower, at a height of approximately 100 feet. Additionally, there will be three equipment cabinets (66" H x 30" W x 31" D) containing the electronic equipment necessary to transmit the signal. The cabinets placed on a 96 -square foot concrete slab, along with a small power supply cabinet for utility connections. ■ BUTTE COUNTY PLANNING COMMISSION AGENDA REPORT ■ PAGE 1 ■ • Existing use of the subject parcel is as a communications facility. Proposed antennas would be required to be painted to match the color of the pole. The proposed lease space for equipment cabinets is located within an existing fenced area (6 -foot chain link with three strands of barbed wire). Access to the facilities will be via an existing driveway off of Highway 32. The proposed communication facility would be unmanned. However, a maintenance technician would visit the site once a month for inspection and preventive maintenance. These maintenance visits, along with emergency repairs, would be the only vehicle trips generated by the facility. Lighting of the facilities is not proposed. ANALYSIS: General Plan and Zoning Compliance: The General Plan land use designation of the project site is Agricultural Residential, which allows public and quasi -public uses as a Secondary Use. Zoning of the project site is U (Unclassified -20 acre parcel), which allows public and quasi -public uses with approval of a Use Permit. Additionally, in 1999, Butte County adopted a Wireless Communication Facility Ordinance establishing special permit provisions for wireless communication facilities based on potential impacts. Under this Ordinance, wireless communication facilities that are colocated in the Unclassified Zone require approval of a Use Permit. In order to ensure that the proposed project complies with all applicable provisions of the County's Wireless Communication Facilities Ordinance (Butte County Code Section 24-262), the following conditions have been incorporated. ➢ Submittal of bonds to cover the costs of a one-time radio-frequency analysis. ➢ Radio-frequency emissions in excess of FCC standards are not allowed. ➢ Facilities that are not in continual use for a period of six months shall be considered abandoned. ➢ Verification submitted annually attesting that the radio frequency radiation/electromagnetic frequency (RF/EMF) emitted by the facility conforms to safety standards set forth in FCC OET 65. ➢ Access to the site must be at least 12 feet wide and capable of supporting a 40,000 - pound fire apparatus. Aesthetic Impacts The proposed facilities (colocated panel antennas and equipment cabinets) will not have any significant negative aesthetic impact to the area. The addition of three panel -antennas in relationship to the 161 -foot tower will not be noticeable to this high-speed traffic. Radio -Frequency Emissions The radio emissions from the proposed antennas are regulated by the Federal Communication Commission (FCC). A radio-frequency analysis was performed by consulting engineer Hammett & Edison, Inc. to determine compliance with the appropriate federal guidelines for human exposure to radio frequency electromagnetic fields. Under a "worse -case" scenario, the maximum ambient RF level anywhere at ground level would be 0.0019% of the applicable public exposure limit. ACTIONS FOR CONSIDERATION: Staff recommends that the Planning Commission take the following actions: I. The project is exempt from the provisions of the California Environmental Quality Act under Section 15301. Section 15301 (Existing Facilities) consists of the leasing and minor alteration of existing public utility structure(s) involving negligible or no expansion of use. Proposed wireless communication facilities colocated with the existing utility pole constitute a negligible expansion of the existing use. II. Approve Use Permit 02-14 for Ubiquitel Leasing Company, subject to the following findings and conditions found in Attachment A. A. The proposed location, size, design, and operating characteristics of the proposed use is in accordance with the purpose of this Ordinance, the purpose of the zone in which the site is located, the Butte County General Plan, and the development policies and standards of the County because: Project conditions of approval have been applied to this project pursuant to the applicable requirements of Section 24-262 (Wireless Communication Facilities), the Butte County Building Division, the Butte County Environmental Health Department, and the Butte County Air Quality Management District. The project is consistent with the Butte County General Plan in that the Agricultural Residential land use designation allows public uses as a Secondary Use and cellular telephone facilities are considered a public use. The project also complies with the Unclassified (U) zoning provisions and the Wireless Communication Facilities Ordinance in that proposed facilities mounted to an existing utility pole are permitted with approval of a Use Permit. B. The harmful effect, if any, upon desirable neighborhood character: The project site is already 'developed with a lattice communications tower. The proposed antennas mounted to the existing tower would not have a harmful effect . on the neighborhood character. The radio-frequency emissions from the proposed antennas must meet FCC standards. 4. The generation of traffic and the capacity and physical character of surrounding streets: Very few vehicle trips would be generated during installation of the antennas and equipment shelter. The communications facility is unmanned and only one regular maintenance visit per month would be required after construction. 5. The suitability of the site for the type and intensity of use or development which is proposed: The site is well suited for the project because the proposed antennas would be mounted on the existing 161 foot tall lattice tower. The operation and maintenance of the facility would not impact the surrounding uses. 6. Any other relevant impact of the proposed use: The Planning Division has circulated the proposed communication facility application to County Agencies and has received no evidence that the use would cause any other relevant impact. C. Based on the above findings, the proposed location, size, design, and operating characteristics of the proposed use and the condition under which it would be operated or maintained would not be detrimental to the public health, safety, or welfare, or injurious to properties or improvements in the vicinity. If any use for which a Use Permit has been granted is not established within two years of the date of approval, the permit shall become null and void and reapplication and a new permit shall be required to establish the use. Any alleged material misrepresentation shall constitute grounds for the Director of Development Services to commence a revocation hearing, and, if proven to exist, shall constitute sufficient grounds to revoke a permit. Conditions of Approval: Planning Division: 1. The new antennas shall be painted to match the color of the tower at the height they will be located. 2. The Facility must meet or fall within current standards and regulations of the FAA, the FCC, the County, and any other agency of ' the Federal or State government with the authority to regulate such Facilities. 3. The installation of the Facility shall comply with all applicable building and electrical codes. 4. No advertising or display shall be permitted on the Facility. 5. The placement of any antenna or structure shall not adversely affect any on-site sewage disposal system or its repair area without written approval from the Division of Environmental Health. 6. The installation of the Facility shall not violate any existing deed restrictions. 7. The Facility shall have a twelve (12) foot wide all-weather access to a publicly maintained road capable of supporting a forty thousand (40,000) pound fire apparatus with fifteen (15) feet of vertical clearance. 8. The Facility shall fall within current standards and regulations of the FAA, the FCC, and any other State and/or Federal agency with the authority to regulate such Facility. If such standards and regulations are changed, the property owner or responsible party shall bring the Facility into compliance with such revised standards and regulations within ninety (90) days of the effective date of such standards and regulations, unless a more stringent compliance schedule is mandated by the controlling agency. ■ BUTTE COUNTY PLANNING COMMISSION AGENDA REPORT ■ PAGE 7 m CJ 9. There shall be no outdoor vehicle or equipment storage except for emergency purposes. 10. The Facility or combination of the Facilities on the site shall not generate, at any time, electromagnetic frequency radiation (EMF) or radio frequency radiation (RF) in excess of the FCC adopted standards for human exposure,' as amended over time. 11. If it is found that the Facility is or will be detrimental to the health, safety, or welfare of persons working or residing near such facility, then the service provider(s) and property owner shall be jointly and solely responsible for the removal, adjustment, or replacement of the Facility. In no case shall the Facility remain in operation if it is found to create a hazard to health, safety, and welfare. The Facility shall not be found to create a hazard to health, safety, or welfare as a result of EMF or RF emissions from the Facility so long as it meets all current standards established by the FCC, pursuant to FCC OET 65. Prior to issuance of the building permit for the installation of the Facility, the applicant shall post a performance security in an amount and form determined by the Director of Development Services that is sufficient to cover the cost of a one-time test by a radio frequency consultant selected by the County, sufficient to determine whether the Facility's RF/EMF emissions comply with FCC standards. If the Facility's emissions are determined to exceed FCC standards, the applicant is required to pay for such other tests and other corrective measures as are necessary to establish compliance with FCC OET 65 and its successors and such noncompliance shall constitute sufficient grounds to commence a permit revocation hearing which may lead to permit revocation. The applicant shall cooperate in all respects with the County's consultant to assist the consultant to reach his/her conclusion. 12. All Facilities that are not in continual use for a period of six (6) months shall be considered abandoned. Abandoned Facilities are hereby designated as unlawful and as public nuisances, requiring no amortization period. If the Director of Development Services determines that the Facility is abandoned, the applicant may be required to remove all equipment belonging to the applicant from the premises and return the site to its original condition within thirty (30) calendar days of receipt of notice to abate. If such Facility is not removed and the site returned to its original condition within thirty (30) days, the County may remove the Facility at the applicant's and/or land owner's joint and several expense. 13. All equipment cabinets shall be screened from view with a minimum six (6) foot tall wooden fence surrounding the equipment pad. All screening treatments, including landscaping, shall be maintained as approved for the life of the Facility. 14. Along with the low power of such facilities, this means that it is generally not possible for exposure conditions to approach the maximum permissible exposure limits without being physically very" near the antennas. Computer Modeling Method The FCC provides direction for determining compliance in its Office of Engineering and Technology Bulletin No. 65, "Evaluating Compliance with FCC -Specified Guidelines for Human Exposure to Radio Frequency Radiation," dated August 1997. Figure 2 attached describes the calculation methodologies, reflecting the facts that a directional antenna's radiation pattern is not fully formed at locations very close by (the "near -field" effect) and that the power level from an energy source decreases with the square of the distance from it (the "inverse square law"). The conservative nature of this method for evaluating exposure conditions has been verified by numerous field tests. Site and Facility Description Based upon information provided by Ubiquitel, including zoning drawings by LCC, dated December 7, 2001, it is proposed to mount six EMS Model RV65l&02DP directional panel antennas on an existing 161 -foot guyed lattice tower, located at 4439 Highway 32 in Chico. The antennas would be mounted at an effective height of about. 100 feet above ground and would be oriented towards 70°T, 170°T, and 290°T, to provide service to surrounding areas. The maximum effective radiated power in any direction would be 100 watts: Already mounted on the tower are several microwave "dish" antennas, for use by MCI, a telecommunications carrier. There are no other wireless telecommunications base stations installed nearby. Study Results The maximum ambient RF level anywhere at ground level due to the proposed operation is calculated to be 0.000019 mW/cm2, which is 0.O�o of the applicable public limit. It should be noted that this result includes several "worst-case" assumptions and therefore is expected to overstate actual power density levels. The microwave dish antennas are in point-to-point service and are so directional that they make no significant contribution to RF exposure conditions at ground level. EDI SOV, INC. To prevent occupational exposures in excess of the FCC guidelines, no access within 2 feet in front of the antennas themselves, such as might occur during tower maintenance activities, should be allowed while the site is in operation, unless other measures can be demonstrated to ensure that occupational protection requirements are met. Posting explanatory warning signs* at the base of the tower and at the antennas, such that the signs would be readily visible from any angle of approach to persons who might need to work within that distance, would be sufficient to meet FCC -adopted guidelines. Conclusion Based on the information and analysis above, it is the undersigned's professional 'opinion that the base station facilities proposed by Ubiquitel at 4439 Highway 32 in Chico, California, can comply with the prevailing standards for limiting human exposure to radio frequency energy and, therefore, need not for this reason cause a significant impact on the environment. The highest calculated level in publicly accessible areas is much less than the prevailing standards allow for exposures of unlimited duration. This finding is consistent with measurements of actual exposure conditions taken at other operating base stations. Warning signs should comply with ANSI C952 color, symbol, and content conventions. In addition, contact information should be provided (e.g., a telephone number) to arrange for access to restricted areas. The selection of language(s) is not an engineering matter, and guidance from the landlord, local zoning or health authority, or appropriate professionals may be required. In .Docket 93-62, effective October 1.5, 1.997, the FCC adopted the human exposure limits for field strength and power density recommended in Report No. 86, "Biological Effects and Exposure Criteria for Radiofrequency Electromagnetic Fields," published in 1986 by the Congressionally chartered National Council on Radiation Protection and Measurements ("NCRP"). Separate limits apply for occupational and public exposure conditions, with the latter limits generally five times more restrictive. Hereby petitions the Butte Planning Commission to grant a use permit pursuant to its zoning regulations. Enclosed are copies of documentation as evidence to make this application. Simmons; James Edward Simmons; and John Drake; leased buy MCl/Unisite at 4439 Hwy 32 Chico CA, 95928. • Thel facility will consist of the collocation of, (3) panel antennas (mounted at 100') gthe existing MCI lattice tower and three Lucent model 200 PCS cabinets at the 5 base of tower station cabinets all enclosed in a 6' chain link fence with -in MCI's existing compound. • UbiquiTel provides an integrated communications service that includes a cellular phone, paging, e-mail, conference calling, caller ID and call forwarding. • The proposed site in Butte County is part of a network of sites that are designed to provide a continuous web of service coverage throughout central and northern California. • The proposed changes to the existing site will not result in any negative impact to the local residence by way of noise, smell, vibration, or traffic and will not make any demands on municipal services. • Once constructed, the facility will be unmanned except for periodic maintenance and inspection and will fully comply with federal regulations concerning radio frequency emissions. • UbiquiTel will fully comply with all applicable local, state, and federal laws and/or regulations. The public at large will benefit from the enhanced features that are part of the UbiquiTel system. n(] (Z BUTTE COUNTY PLANNING DIVISION 0 WHO IS UBMITEL LEASING.COMPANY • Ubiquitel is a Delaware State registered company that has a signed agreement with Sprint PCS, headquartered in Kansas City Missouri. The company, headed by Donald A. Harris, is'the exclusive provide of Sprint PCS digital Personal Communications Services, generally U wn as Sprint PCS, to midsize and smaller markets in Western and Midwestern United States with a total population of approximately 7.7 million residents. UbiquiTel expects to cover approximately 55% of the residential population in those markets by the year's end 2001 and expects to cover approximately 63% upon completion of the build -out. A copy of the FCC license is attached as Exhibit A, UbiquiTel will utilize all the "back office" capabilities of Sprint PCS through its affiliate relationship, such as network monitoring, billing and collections, and customer service. PCS base stations are low-power facilities. The power of a typical PCS system is less than 20 watts per sector. In fact this is extremely low when compared with other familiar radio systems, such as AM/FM radio and broadcast television, which typically, operates from 5,000 — 50,000 watts. PCS is a state of the art portable telephone and, paging system. PCS is competitively priced and more dependable than analog systems. PCS is more private than cellular because it utilizes digital technology that makes possible many new capabilities including the ability to transmit and receive data, e-mail, conference calling, caller ID, call forwarding, and information services such as news headlines, weather forecasts, stock quotes, and also eliminates the services for a separate pager. ' UbiquiTel helping to bring modern technology to your community. UbiquiTel is offering broadband PCS one of the newest entrants into wireless communication services. In 1994, the Federal Communications Commission (FCC) decided to allocate additional spectrum space on the radio frequency to broadband PCS. In the "Matter of Amendment of the Commission's rules to Establish New Personal Communication services, "GEN Docket No.90-314, Memorandum and Order FCC94-1l4 (June 1994), the FCC explained that it was taking action "to foster rapid creation of a competitive market" to deliver broadband PCS services. Issuance of the new PCS licenses is intended to enhance competition "not only in price, but also on the quality and the types of new products and services" that can be offered. The FCC specifically found that "rapid deployment" and "wide -area coverage" of new PCS services are very important and necessary for this new competition in the field of wireless communications. HOW THE PCS NETWORK OPERATES While this proposed site is only one of the sites within our entire service area, it is an essential link within the network. Wireless technology, PCS in particular,:operates on a "line of site" technology. The height and number of base station. facilities needed to provide coverage depends greatly on topography. of the are&to-be covered: -The antennae -also must,be at a:heightthat,enables the signal to transmit with no significant obstruction, such as a dense strand of trees or tall structures. The antennae also must be able to see the boundary of the next facility, in order to provide uninterrupted signal coverage between base station facilities. However, the operation of other surrounding sites. A PCS base station facility must transmit and receive from a point higher than the surrounding landscape. If a nearby hill is higher than the source, the signal cannot be transmitted or received, therefore, the structure must either be built higher than the hill, or an additional structure must be built on the other side of the hill. BUTTE COUNTY PLANNING DIVISION i • FACILITY SIGHTING Some people may wonder why we need this particular base station at this particular location. "Why Here?" In general, the design objective is seamless coverage along Hwy 32 into the eastside of the town of Chico. Each base station facility in a PCS network, whether co -location or a new build, covers a limited area. The Signal is handed off from facility to facility, just like a baton in a relay race. And much the same as light from a lighthouse, to be effective and maintain coverage, a PCS signal cannot be obstructed by tall structures or topography. PROJECT DESCRIPTION UbiquiTel is leasing a 10' X 20' plot of land (including access and egress easements) from MCI at 4439 Hwy 32 CA, 95928 Humboldt County. For the purpose of the construction of a telecommunications facility. This facility will consist of three PCS panel antennae mounted at 100' on the existing MCI lattice tower structure. In addition, UbiquiTel will place three equipment cabinets at the base of the tower, all enclosed by a 6' high chain link fence.
