The structure would be a single -story wood -frame building. The building would be used as a church and include a main sanctuary, three, 400 (+/-)-square foot classrooms, an office, and two bathrooms. A total of 32 parking spaces would be required by County Code. Sewage disposal would be handled by on-site septic system. Water supply would be provided by on-site domestic well. The property is zoned A-5 (Agricultural — 5 acre parcels) and is located on the North side of Foothill Boulevard, approximately 500 feet southwest of the intersection of Foothill Boulevard and Lower Wyandotte Road, south of Oroville. APN 036-330-043 (DB) (UP 02-16) Mr. Breedon gave a brief summary of the project. Vice Chairman Lambert asked what the zoning and General Plan designation are. Mr. Breedon said the zoning is AR -5 and the General Plan designation is Agricultural Residential. Commissioner Nelson commented that he would like to see the filming of videos started again and Commissioner Leland agreed. Vice Chairman Lambert asked staff to include the Assessor's -Parcel Map in their packets and staff agreed. The hearing was opened to the public. Russell Cowan, Representative of the Church, said that this will be a small church and asked for approval. The hearing was closed. It was moved by Commissioner Leland, seconded by Commissioner Nelson, and unanimously carried to approve the Use Permit for the Church of god Mennonite subject to the findings and conditions listed below: I. Adopt a Mitigated Negative Declaration with the following findings: A. An Initial Study was completed in compliance with the California Environmental Quality Act. Said study identified significant environmental effects and includes mitigation measures that would mitigate such effects below significant levels; a Mitigated Negative Declaration is proposed. B. On the basis of the whole record before the Planning Commission, including the Initial Study and any comments received, there is no substantial evidence that the Use Permit for the Church of God, Mennonite, Planning Division File No. UP 02=16, will have a significant effect on the environment. D. The proposed Mitigated Negative Declaration reflects the independent judgment and analysis of the County, which is the Lead Agency. II. Adopt a "de minimus" exemption regarding impact to fish and wildlife or their habitat. The design of the proposed project improvements will not cause environmental damage to fish and wildlife or their habitat. The collection of fees pursuant to Fish and Game Code Section 711.4(d)(3) and 14 CCR 753.5. is not required. The project site is not known to contain any species identified as a candidate, sensitive, or special status species in local or regional plans, policies, or regulations, or by the California Department of Fish and Game or U. S. Fish and Wildlife Service. The project will not have a substantial adverse effect on any riparian habitat; have a substantial adverse effect on federally protected wetlands as defined by Section 404 of the Clean Water Act; interfere substantially with the movement of any native resident or migratory fish or wildlife species; conflict with any local policies or ordinances protecting biological resources; or conflict with the provisions of an adopted Habitat Conservation Plan. III. Approve Use Permit 02-16 for the Church of God, Mennonite, subject to the following findings and conditions found in Exhibit "A". A. The proposed uses of the property will not impair the integrity and character of the zone in which the land lies, and the use would not be unreasonably incompatible with, or injurious to, surrounding properties, or detrimental to the health and general welfare of the persons residing or working in the neighborhood, or to the general health, welfare and safety of the residents of the County as supported by the following: Compliance with California Department of Forestry Condition #12 will ensure that the proposed use will not pose a fire hazard and will comply with the Fire Safe Regulations (Public Resources Code Section 4290); and, 2. Compliance with Butte County Air Quality Management District Condition #3 will ensure that no impacts related to air quality and fugitive dust will occur as a result of the proposed use; and, 3. Compliance with Department of Public Works Condition #9 ensures that the proposed use complies with Butte County Development standards pertaining to drainage. 4. Compliance with Planning Division Conditions #1, #2 and #6 regarding night ' lighting, shielding of trash receptacles, and hours of development activities, ensures the use shall not be incompatible with the surrounding neighborhood. ■ BUTTE COUNTY PLANNING SERVICES MEETING ■ MINUTES ■ SEPTEMBER 12, 2002 ■ PAGE 17 ■ 5. Compliance with Planning Division Condition #8 ensures the provision of . adequate parking facilities for the use proposed. 6. Compliance with Planning Division Condition #5 ensures that development activity shall not generate significant amounts of erosion. 7. Compliance with Planning Division Condition #4 ensures that development activity shall take place in a manner that presents the least amount of disturbance to native trees. B. The proposed project is conditionally consistent with the AR -5 (Agricultural Residential, 5 -acre Parcels) zone with a Use Permit, and is permitted as a secondary use under the Agricultural Residential General Plan designation. Conditions of Approval: Planning Division 1. All new outdoor lights shall be fully shielded. Lights shall be directed downward and contained on-site. Direct light shall not be allowed on adjoining properties and roads. Plan Requirements: The condition shall be placed on the Use Permit. All requirements shall be shown on building plans. Timing: Requirements of the condition shall be adhered to while installing outdoor lighting and during all use of outdoor lighting. Monitoring: The Planning Division shall ensure that the conditions are placed on the Use Permit. The Planning Division shall ensure compliance through routine inspection. (Mitigation Measure # 1) 2. All outdoor trash containers shall be enclosed within a solid masonry wall or view - obstructing fence at least one (1) foot higher than the trash container. Plan Requirements: The condition shall be placed on the Use Permit. All requirements shall be shown on building plans. Timing: Requirements of the condition shall be adhered to during the installation of any outdoor trash receptacles. ' Monitoring: The Planning Division shall ensure that the conditions are placed on the Use Permit. The Planning Division shall ensure compliance through routine inspection. (Mitigation Measure #2) 3. Standard Mitigation Measures to prevent or reduce fugitive dust emissions can be obtained from the Butte County Air Quality Management District. Plan Requirements: The conditions shall be placed on the Use Permit. All requirements shall be shown on building plans. Timing: Requirements of the condition shall be adhered to throughout all grading and construction periods. Monitoring: The Planning Division and the Public Works Department shall ensure that the conditions are placed on the Use Permit. Building inspectors shall spot check and shall ensure compliance on-site. Butte County Air Pollution Control District inspectors shall respond to nuisance complaints. (Mitigation Measure # 3) Prior to Use Permit issuance, a tree plan prepared by a certified arborist, botanist, or landscape architect shall be provided to the Planning Division. The Plan shall be prepared in accordance with the following • Site improvements shall be made in coordination with the tree plan to ensure that development occurs idareas that would provide a minimum amount of disturbance with native oak trees and result in fewer trees being removed. • The applicant shall minimize the removal of trees deemed suitable for retention. The plan shall show the location of trees deemed suitable for retention, and trees to be removed. • Factors used to assess suitability of trees shall include health, location, and size of the tree. The plan shall encourage the retention of larger, healthier trees over smaller or diseased trees. • Each tree to be preserved in the vicinity of construction activities shall be surrounded by a tree zone identified by the drip line of the tree. An orange plastic fence or other suitable type of fence shall be used to identify the tree zone during construction activities to ensure that construction equipment does not compact the soil surrounding the tree. • No vegetation removal, soil disturbance, or other development activities shall occur within the tree zone in order to protect root systems and minimize compaction of the soil. Plan Requirements: No vegetation removal, grading, road construction, or other earthwork shall be permitted until the tree plan is submitted and approved. ■ BUTTE COUNTY PLANNING SERVICES MEETING ■ MINUTES ■ SEPTEMBER 12, 2002 ■ PAGE 19 ■ Timing: The tree plan shall be submitted to the Planning Division prior to site development and Use Permit issuance. r Monitoring: The Planning Division shall ensure compliance through routine inspection and review. (Mitigation Measure #4) Perform the following requirements to minimize soil erosion: (a) All graded slopes, over 5 feet in height shall be seeded, planted, mulched/hydroseeded, or otherwise protected to prevent soil erosion. (b) Structures, dumping, fill material, vegetation removal, and/or excavation shall not be allowed in areas having a slope of 30% or greater unless an Erosion Control Plan prepared by a registered civil engineer or other qualified professional is submitted to and approved by the Department of Public Works. Plan Requirements: The erosion protection measures shall be implemented during all times of construction where graded slopes are created over 5 feet in height or where development is proposed in areas of 30% slope or greater. Timing: This measure shall be implemented during site preparation and construction. Monitoring: The Planning Division shall coordinate with the developer and perform routine inspections to ensure compliance. (Mitigation Measure #5) 6. All development activity shall be limited to 7:00 a.m. to 6:00 p.m., Monday through Friday, and 10 a.m. to 6 p.m., Saturday, Sunday, and holidays. Plan Requirements: The mitigation shall be placed on the Use Permit as a condition and shown on all building plans. Timing: The mitigation shall be applicable during all construction activity. Monitoring: The Department of Development Services shall be responsible for ensuring compliance with this mitigation. (Mitigation Measure #8) The applicant or developer shall be required to submit a development impact fee for Sheriffs facilities to be paid pursuant to the provisions of Chapter 3, Article II of the Butte County Code, prior to issuance of building permits. The fee amount would be determined and calculated as of the date of application for the building permit. Plan Requirements: The mitigation shall be placed on the Use Permit and shown on all building plans. Timing: The mitigation shall be required prior to the issuance of building permits. Monitoring: The Butte County Planning Division and Building Division shall ensure compliance. Thirty -Two (32) parking stalls shall be provided, -two of which shall be disabled parking stalls. In accordance with Butte County Code Section 24-240.10 (e), an additional 5 percent of the gross lot area (approximately. 850 square feet) shall be devoted to landscaping. Each planter area shall be surrounded by a six-inch raised concrete curbing or equivalent. An irrigation system shall be installed in each separate planter area. Plan Requirements: The mitigation shall be placed on the Use Permit and shown on all building plans. Timing: The mitigation shall be required prior to the issuance of building permits. Monitoring: The Butte County Planning Division and Building Division shall ensure compliance. (Mitigation Measure #10) Public Works 9. Prior to site development and building permit issuance, a permanent solution for drainage shall be submitted to and approved by the Department of Public Works. The drainage plans shall specify how stormwater drainage shall be detained on-site and/or conveyed to the nearest natural or publicly maintained drainage channel or facility and shall provide that there shall be no net increase in the peak flow runoff to said channel or facility. Plan Requirements: The mitigation shall be placed on the Use Permit and shown on all building plans. Timing: The drainage plan shall be required prior to the issuance of building permits. Monitoring: The Department of Public Works shall be responsible for ensuring compliance with this mitigation. (Mitigation Measure #7) 10. Prior to issuance of Building Permits obtain encroachment permit for all new or existing driveway approaches and construct them to County, standards, as specified in the County Improvement Standards. 11. Prior to issuance of Building Permits deed to Butte County, in fee simple, 40 feet of right-of- way from the centerline of Foothill Boulevard. The right-of-way shall be sufficient for the installation of a standard No. S-5 sign at all street intersections. California Department of Foresgy/Butte County Fire 12. Perform the following to the satisfaction of the Butte County Fire/California Department of Forestry: (a) Construction, installation or development of structures or facilities within this development shall comply with the latest California Fire Safe Regulations, (Public' Resources Code 4290), and all other applicable State and County codes, ordinances and regulation in effect at the time of application for improvement permits. ■ BUTTE COUNTY PLANNING SERVICES MEETING ■ MINUTES ■ SEPTEMBER 12, 2002 ■ PAGE 21 ■ (b) Building identification and/or addresses shall be installed in conformance with Public Resources Code 4290 and shall be posted at the beginning of building construction and maintained continuously thereafter. (c) Water for fire protection is required. The preferable system is a hydrant system capable of meeting the fire flow requirements. If this is not feasible, a system involving independent pumps, static water storage and dry standpipes may be substituted. Such a system is subject to the approval of the fire department. The available water flow from such a system must meet the general flow requirement. The minimum volume of water in storage must equal the fire flow for the type of project times 20 minutes. Provisions must be made to ensure the system provided is maintained to its design capacity. Plan Requirements: The mitigation shall be placed on the Use.Permit and shown on all building plans. Timing: This Mitigation shall be implemented at the time of site construction and prior to issuance of final building permits. Monitoring: The Butte County Fire/California Department of Forestry shall ensure compliance with the requirements of this mitigation. (Mitigation Measure #6) County Counsel 13. If this Use Permit or any finding, action or condition of this Use Permit is appealed to the Board of Supervisors, the applicant or any other developer/operator other than the applicant agrees to indemnify the County of Butte from liability or loss related to the approval of this project and agrees to sign an indemnification agreement in a form approved by County, Counsel before the Board's appeal hearing. If the application is not appealed, this condition is deemed satisfied. Pursuant to the provisions of the Zoning Ordinance of the County of Butte and the special conditions set forth below, the Church of God, Mennonite is hereby granted. a Use Permit, in accordance with the application filed, to develop a 3,495 -square foot church building. This building shall be used as a church and includes a main sanctuary, three, 400 square foot classrooms, an office, and two restrooms. Minor changes may be approved administratively by the Directors of Development Services, Environmental Health, or Public Works upon receipt of a substantiated written request by the applicant, or their respective designee, Prior to such approval, verification shall be made by each Department or Division that the modification is consistent with the application, fees paid and environmental determination as conditionally approved. Changes deemed to be major or significant in nature shall require a formal application for amendment. 4. If any use for which a use permit has been granted is not established within two years of the date of receipt of the countersigned permit by the Permittee, the permit shall become null and void and reapplication and a new permit shall be required to establish the use. The terms and conditions of this permit shall run with the land and shall be binding upon and be to the benefit of the heirs, legal representatives, successors, and assigns of the Permittee. 6. Prior to use of the site for the proposed use the applicant shall contact the Planning Division for a field inspection to verify that all conditions and ordinance requirements have been met. Conditions of Approval: Planning Division • All new outdoor lights shall be fully shielded. Lights shall be directed downward and contained on-site. Direct light shall not be allowed on adjoining properties and roads. Plan Requirements: The condition shall be placed on the Use Permit. All requirements shall be shown on building plans. Timing: Requirements of the condition shall be adhered to while installing outdoor lighting and during all use of outdoor lighting. Monitoring: The Planning Division shall ensure that the conditions are placed on the Use Permit. The Planning Division shall ensure compliance through routine inspection. (Mitigation Measure # 1) 2. Building inspectors shall spot check and shall ensure compliance on-site. Butte County Air Pollution Control District inspectors shall respond to nuisance complaints. (Mitigation Measure # 3) 4. Prior to Use Permit issuance, a tree plan prepared by a certified arborist, botanist, or landscape architect shall be, provided to the Planning Division. The Plan shall be prepared in accordance with the following . 11 2 • Site improvements shall be made in coordination with the tree plan to ensure that development occurs in areas that would provide a minimum amount of disturbance with native oak trees and result in fewer trees being removed. • The applicant shall minimize the removal of trees deemed suitable for retention. The plan shall show the location of trees deemed suitable for retention, and trees to be removed. • Factors used to assess suitability of trees shall include health, location, and size of the tree. The plan shall encourage the retention of larger, healthier trees over smaller or diseased trees. • Each tree to be preserved in the vicinity of construction activities shall be surrounded by a tree zone identified by the drip line of the tree. An orange plastic fence or other suitable type of fence shall be used to identify the tree zone during construction activities to ensure that construction equipment does not compact the soil surrounding the tree. No vegetation removal, soil disturbance, or other development activities shall occur within the tree zone in order to protect root systems and minimize compaction of the soil. Plan Requirements: No vegetation removal, grading, road construction, or other earthwork shall be permitted until the tree plan is submitted and approved. Timing: The tree plan shall be submitted to the Planning Division prior to site development and Use Permit issuance. Monitoring: The Planning Division shall ensure compliance through routine inspection and review. (Mitigation Measure #4) Perform the following requirements to minimize soil erosion: (a) All graded slopes, over 5 feet in height shall be seeded, planted, mulched/hydroseeded, or otherwise protected to prevent soil erosion. (b) Structures, dumping, fill material, vegetation removal, and/or excavation shall not be allowed in areas having a slope of 30% or greater unless an Erosion Control Plan prepared by a registered civil engineer or other qualified professional is submitted to and approved by the Department of Public Works. Plan Requirements: The erosion protection measures shall be implemented during all times of construction where graded slopes are created over 5 feet in height or where development is proposed in areas of 30% slope or greater. Timing: This measure shall be implemented during site preparation and construction. Monitoring: The Planning Division shall coordinate with the developer and perform routine inspections to ensure compliance. (Mitigation Measure #5) 6. All development activity shall be limited to 7:00 a.m. to 6:00 p.m., Monday through Friday, and 10 a.m. to 6 p.m., Saturday, Sunday, and holidays. Plan Requirements: The mitigation shall be placed on the Use Permit as a condition and shown on all building plans. Timing: The mitigation shall be applicable during all construction activity. Monitoring: The Department of Development. Services shall be responsible for ensuring compliance with this mitigation.. (Mitigation Measure #8) 7. The applicant or developer shall be required to submit a development impact fee for Sheriffs facilities to be paid pursuant to the provisions of Chapter 3, Article Il of the Butte County Code, prior to issuance of building permits. The fee amount would be determined and calculated as of the date of application for the building permit. Plan Requirements: The mitigation shall be placed on the Use Permit and shown on all building plans. Timing: The mitigation shall be required prior to the issuance of building permits. Monitoring: The Butte County Planning Division and Building Division shall ensure compliance. (Mitigation Measure #9) 8. Thirty -Two (32) parking stalls shall be provided, two of which shall be disabled parking stalls. In accordance with Butte County Code Section 24-240.10 (e), an additional 5 percent of the gross lot area (approximately 850 square feet) shall be devoted to landscaping. Each planter area shall be surrounded by a six-inch raised concrete curbing or equivalent. An irrigation system shall be installed in each separate planter area. Plan Requirements: The mitigation shall be placed on the Use Permit and shown on all building plans. Timing: The mitigation shall be required prior*to the issuance of building permits. Monitoring: The Butte County Planning Division and Building Division shall ensure compliance. (Mitigation Measure #10) Public Works 9. Prior to site development and building permit issuance, a permanent solution for drainage shall be submitted to and approved by the Department of Public Works. The drainage plans shall specify how stormwater drainage shall be detained on-site and/or conveyed to the nearest natural or publicly maintained drainage channel or facility and shall provide that .there shall be no net increase in the peak flow runoff to said channel or facility. Plan Requirements: The mitigation shall be placed on the Use Permit and shown on all building plans. 11 Timing: The drainage plan shall be required prior to the issuance of building permits. Monitoring: The Department of Public Works shall be responsible for ensuring compliance with this mitigation. (Mitigation Measure #7) 10. Prior to issuance of Building Permits obtain encroachment permit for all new or existing driveway approaches and construct them to County standards, as specified in the County Improvement Standards. 11. Prior to issuance of Building Permits deed to Butte County, in fee simple, 40 feet of right-of- way from the centerline of Foothill Boulevard. The right-of-way shall be sufficient for the installation of a standard No. S-5 sign at all street intersections. California Department of Forestrv/Butte County Fire 12. Perform the following to the satisfaction of the Butte County Fire/California Department of Forestry: (a) Construction, installation or development of structures or facilities within this development shall comply with the latest California Fire Safe Regulations, (Public Resources Code 4290), and all other applicable State and County codes, ordinances and regulation in effect at the time of application for improvement permits. (b) Building identification and/or addresses shall be installed in conformance with Public Resources Code 4290 and shall be posted at the beginning of building construction and maintained continuously thereafter. ' (c) Water for fire protection is required. The preferable system is a hydrant system capable of meeting the fire flow requirements. If this is not feasible, a system involving independent pumps, static water storage and dry standpipes may be substituted. Such a system is subject to the approval of the fire department. The available water flow from such a system must meet the general flow requirement. The minimum volume of water in storage must equal the fire flow for the type of project times 20 minutes. Provisions must be made to ensure the system provided is maintained to its design capacity. Plan Requirements: The mitigation shall be placed on the Use Permit and shown on all building plans. Timing: This Mitigation shall be implemented at the time of site construction and prior to issuance of final building permits. The Tentative Parcel Map shows the church structure to be in the southwest portion of the property, adjacent to the Wyandotte Cemetery. However, the site plan for the Use Permit shows the church to be located in the middle of the property. It was pointed out that the size of the church structure as shown on the Tentative Parcel Map is much larger than that approved by the Planning Commission under the Use Permit. The change in the location and the size of the church/school structure must be approved by the Planning Commission at a public hearing. Butte County Code Sections 24-45.45 and 24-45.50 state that modifications to a Use Permit must be approved by the Planning Commission. A new Use Permit application, along with the applicable processing fees, must be submitted. Due to the new location of the church there may be additional conditions of project approval. Please note that the Butte County Building Division cannot issue a building permit for the church structure in the location as shown on the Tentative Parcel Map. At the Inter -Departmental Review Committee meeting it was also pointed out that vegetation clearing is occurring on the property. Condition # 4 of the Use Permit requires that a tree plan be submitted to and approved by the Planning Division prior to any vegetation removal, grading, road construction, or other earthwork. The vegetation removal and other site preparation activities are in violation of the Use Permit. PROJECT DESCRIPTION/SITE CHARACTERISTICS: This is an application for a Use Permit to allow a 3,495 -square foot church. The structure would be a single -story wood -frame building. The building would be used as a church and would include a main sanctuary; three, 400 (+/-) square foot classrooms; an office; and two restrooms. A total of 32 parking spaces would be required by County Code. Sewage disposal would be handled by on-site septic system. Water supply would be provided by on-site domestic well. A 4 -foot high chain link fence is proposed to be developed around the facility. The property is largely undeveloped, with the exception of a mobile home. The applicant has disclosed plans to divide a 5 -acre portion from the 23 -acre parcel, in which case the mobile home would not be located on the 5 -acre portion proposed to be developed with the church. Vegetation consists primarily of native oaks, as well as associated understory shrubs and grasses. ANALYSIS: The area of the property proposed for construction of the multi-purpose building is zoned AR -5 (Agricultural Residential, 5 acre parcels) and is designated by the Butte County General Plan as Agricultural Residential. Quasi -public uses and uses of a religious nature are allowed in the AR -5 zone with a Use Permit. The surrounding parcels are zoned AR -5. Land uses on surrounding parcels include scattered single family dwellings. The Wyandotte Cemetery is adjacent to the east. No land use impact is anticipated with surrounding land uses. Parking and Landscaping In accordance with Butte County Code, the church use requires one parking space for each six seats or one parking space per 50 square feet of usable seating area, whichever is greater. The plans submitted with the church show that the sanctuary would be approximately 1,500 -square feet in size. Based on this size, 30 parking spaces are required for the church. In addition, two disabled parking spaces are required. The site plan shows 25 parking spaces. Therefore, Mitigation Measure #10 requires the installation of 32 parking spaces, with two of the spaces being disabled spaces. The site has an adequate amount of additional room to provide for the additional parking spaces required. In accordance with the landscaping requirements as set forth within Butte County Code, 5 percent (approximately 850 square feet) of the parking lot area shall be devoted to landscaping. This requirement is also contained within Mitigation Measure #10. Aesthetic Issues Additional outdoor lights may be required to be placed on or around the proposed church facility for safety and security purposes. Mitigation Measure #1 has been set forth to ensure that all new outdoor lights are fully shielded and directed downward to prevent lighting from becoming a nuisance to neighboring residents. Outdoor trash receptacles may also present a visual impact to surrounding residents. Mitigation Measure #2 requires that any outdoor trash receptacle be screened from view with a solid masonry wall or fence. Local Agency Comment The City of Oroville commented on the preservation of native trees. The City is concerned about the retention of native trees at the project site. The trees in this area are not protected by local ordinance and they are not considered rare or endangered. However, since development pressure in foothill areas of the County influence native blue oaks and their habitat, the California Department of Fish and Game encourages developers to preserve as many trees as possible, with an emphasis on larger, more mature trees. Staff recognizes that development projects should include measures that protect native oak trees, since development is decreasing their numbers to the point that they may become endangered in the future. For this reason, Mitigation Measure #4 has been set forth to ensure that 0 BUTTE COUNTY PLANNING COMMISSION AGENDA REPORT 0 PAGE 2 0 native blue oaks present on the property are protected from development activity to the extent possible. The site is located in an area identified as having a Very High Wildfire Hazard pursuant to the Natural Fire Hazard Fire Classes Map of the Safety Element of the Butte County General Plan. The Butte County Fire Department/California Department of Forestry (CDF) is recommending compliance with the latest California Fire Safe Regulations (Public Resources Code Section 4290). Water for fire protection is also required by CDF. These requirements and other recommendations taken from the Fire Safe Regulations are set forth in Mitigation Measure #6. The Agricultural Commissioner reviewed the project for impacts on agricultural resources. The Agricultural Commissioner noted that olive orchards lie to the northwest, but indicated that no setback was required and there were no other agricultural issues. ACTIONS FOR CONSIDERATION: Staff recommends that the Planning Commission take the following actions: Adopt a Mitigated Negative Declaration with the following findings: A. An Initial Study was completed in compliance with the California Environmental Quality Act. Said study identified significant environmental effects and includes mitigation measures that would mitigate such effects below significant levels; a Mitigated Negative Declaration is proposed. B. The Planning Commission has considered the proposed Mitigated Negative Declaration together with comments received during the review process. C. On the basis of the whole record before the Planning Commission, including the Initial Study and any comments received, there is no substantial evidence that the Use Permit for the Church of God, Mennonite, Planning Division File No. UP 02-16, will have a significant effect on the environment. D. The proposed Mitigated Negative Declaration reflects the independent judgment and analysis of the County, which is the Lead Agency. Il. Adopt a "de minimus" exemption regarding impact to fish and wildlife or their habitat. The design of the proposed project improvements will not cause environmental damage to fish and wildlife or their habitat. The collection of fees pursuant to Fish and Game Code Section 711.4(d)(3) and 14 CCR 753.5. is not required. The project site is not known to contain any species identified as a candidate, sensitive, or special status species in local or regional plans, policies, or regulations, or by the California Department of Fish and Game or U. S. Fish and Wildlife Service. The project will not have a substantial adverse effect on any riparian habitat; have a substantial adverse effect on federally protected wetlands as defined by Section 404 of the Clean Water Act; interfere substantially with the movement of any native resident or migratory fish or wildlife species; conflict with any local policies or ordinances ■ BUTTE COUNTY PLANNING COMMISSION AGENDA REPORT 0 PAGE 3 0 protecting biological resources; or conflict with the provisions of an adopted Habitat Conservation Plan. III. Approve Use Permit 02-16 for the Church of God, Mennonite, subject to the following findings and conditions found in Exhibit "A". A. The proposed uses of the property will not impair the integrity and character of the zone in which the land lies, and the use would not be unreasonably incompatible with, or injurious to, surrounding properties, or detrimental to the health and general welfare of the persons residing or working in the neighborhood, or to the general health, welfare and safety of the residents of the County as supported by the following: 1. Compliance with California Department of Forestry Condition #12 will ensure that the proposed use will not pose a fire hazard and will comply with the Fire Safe Regulations (Public Resources Code Section 4290); and, 2. Compliance with Butte County Air Quality Management District Condition #3 will ensure that no impacts related to air quality and fugitive dust will occur as a result of the proposed use; and, 3. Compliance with Department of Public Works Condition #9 ensures that the proposed use complies with Butte County Development standards pertaining to drainage. 4. Compliance with Planning Division Conditions #1, #2 and #6 regarding night lighting, shielding of trash receptacles, and hours of development activities, ensures the use shall not be incompatible with the surrounding neighborhood. Compliance with Planning Division Condition #8 ensures the provision of adequate parking facilities for the use proposed. 6. Compliance with Planning Division Condition #5 ensures that development activity shall not generate significant amounts of erosion. 7. Compliance with Planning Division Condition #4 ensures that development activity shall take place in a manner that presents the least amount of disturbance to native trees. B. Unless otherwise provided for in a special condition to this use permit, all conditions must be completed prior to or concurrently with the establishment of the granted use. The use granted by this permit must be established within 24 months of the delivery of the countersigned permit to the Permittee. Minor changes may be approved administratively by the Directors of Development Services, Environmental Health, or Public Works upon receipt of a substantiated written request by the applicant, or their respective designee, Prior to such approval, verification shall be made by each Department or Division that the modification is consistent with the application, fees paid and environmental determination as conditionally approved. Changes deemed to be major or significant in nature shall require a formal application for amendment. 4. If any use for which a use permit has been granted is not established within two years of the date of receipt of the countersigned permit by the Permittee, the permit shall become null and void and reapplication and a new permit shall be required to establish the use. 5. The terms and conditions of this permit shall run with the land and shall be binding upon and be to the benefit of the heirs, legal representatives, successors, and assigns of the Permittee. 6. All new outdoor lights shall be fully shielded. Lights shall be directed downward and contained on-site. Direct light shall not be allowed on adjoining properties and roads. Timing: Requirements of the condition shall be adhered to while installing outdoor lighting and during all use of outdoor lighting. Monitoring: The Planning Division shall ensure that the conditions are placed on the Use Permit. The Planning Division shall ensure compliance through routine inspection. (Mitigation Measure # 1) 2. All outdoor trash containers shall be enclosed within a solid masonry wall or view - obstructing fence at least one (1) foot higher than the trash container. Timing: Requirements of the condition shall be adhered to during the installation of any outdoor trash receptacles. Measures shall be taken to control fugitive dust emissions from all civil construction associated with development of the site. Standard Mitigation Measures to prevent or reduce fugitive dust emissions can be obtained from the Butte County Air Quality Management District. Plan Requirements: The conditions shall be placed on the Use Permit. All requirements shall be shown on building plans. Timing: Requirements of the condition shall be adhered to throughout all grading and construction periods. Monitoring: The Planning Division and the Public Works Department shall ensure that the conditions are placed on the Use Permit. Building inspectors shall spot check and shall ensure compliance on-site. Butte County Air Pollution Control District inspectors shall respond to nuisance complaints. Prior to Use Permit issuance, a tree plan prepared by a certified arborist, botanist, or landscape architect shall be provided to the Planning Division. The Plan shall be prepared in accordance with the following • Site improvements shall be made in coordination with the tree plan to ensure that development occurs in areas that would provide a minimum amount of disturbance with native oak trees and result in fewer trees being removed. • The applicant shall minimize the removal of trees deemed suitable for retention. The plan shall show the location of trees deemed suitable for retention, and trees to be removed. • Factors used to assess suitability of trees shall include health, location, and size of the tree. The plan shall encourage the retention of larger, healthier trees over smaller or diseased trees. • Each tree to be preserved in the vicinity of construction activities shall be surrounded by a tree zone identified by the drip line of the tree. An orange plastic fence or other suitable type of fence shall be used to identify the tree zone during construction activities to ensure that construction equipment does not compact the soil surrounding the tree. No vegetation removal, soil disturbance, or other development activities shall occur within the tree zone in order to protect root systems and minimize compaction of the soil. Plan Requirements: No vegetation removal, grading, road construction, or other earthwork shall be permitted until the tree plan is submitted and approved. Timing: The tree plan shall be submitted to the Planning Division prior to site development and Use Permit issuance. Monitoring: The Planning Division shall ensure compliance through routine inspection and review. (Mitigation Measure #4) 5. Perform the following requirements to minimize soil erosion: (a) All graded slopes, over 5 feet in height shall be seeded, planted, mulched/hydroseeded, or otherwise protected to prevent soil erosion. (b) Structures, dumping, fill material, vegetation removal, and/or excavation shall not be allowed in areas having a slope of 30% or greater unless an Erosion Control Plan prepared by a registered civil engineer or other qualified professional is submitted to and approved by the Department of Public Works. Plan Requirements: The erosion protection measures shall be implemented during all times of construction where graded slopes are created over 5 feet in height or where development is ■ BUTTE COUNTY PLANNING COMMISSION AGENDA REPORT ■ PAGE 7 0 proposed in areas of 30% slope or greater. Timing: This measure shall be implemented during site preparation and construction. Monitoring: The Planning Division shall coordinate with the developer and perform routine inspections to ensure compliance. (Mitigation Measure #5) 6. All development activity shall be limited to 7:00 a.m. to 6:00 p.m., Monday through Friday, and 10 a.m. to 6 p.m., Saturday, Sunday, and holidays. Plan Requirements: The mitigation shall be placed on the Use Permit as a condition and shown on all building plans. Timing: The mitigation shall be applicable during all construction activity. Monitoring: The Department of Development Services shall be responsible for ensuring compliance with this mitigation. (Mitigation Measure #8) 7. The applicant or developer shall be required to submit a development impact fee for Sheriff s facilities to be paid pursuant to the provisions of Chapter 3, Article II of the Butte County Code, prior to issuance of building permits. The fee amount would be determined and calculated as of the date of application for the building permit. Plan Requirements: The mitigation shall be placed on the Use Permit and shown on all building plans. Timing: The mitigation shall be required prior to the issuance of building permits. Monitoring: The Butte County Planning Division and Building Division shall ensure compliance. (Mitigation Measure #9) 8. Thirty -Two (32) parking stalls shall be provided, two of which shall be disabled parking stalls. In accordance with Butte County Code Section 24-240.10 (e), an additional 5 percent of the gross lot area (approximately 850 square feet) shall be devoted to landscaping. Each planter area shall be surrounded by a six-inch raised concrete curbing or equivalent. An irrigation system shall be installed in each separate planter area. Plan Requirements: The mitigation shall be placed on the Use Permit and shown on all building plans. Timing: The mitigation shall be required prior to the issuance of building permits. Monitoring: The Butte County Planning Division and Building Division shall ensure compliance. (Mitigation Measure #10) Public Works 9. Prior to site development and building permit issuance, a permanent solution for drainage shall be submitted to and approved by the Department of Public Works. Plan Requirements: The mitigation shall be placed on the Use Permit and shown on all building plans. Timing: The drainage plan shall be required prior to the issuance of building permits. Monitoring: The Department of Public Works shall be responsible for ensuring compliance with this mitigation. (Mitigation Measure #7) 10. Prior to issuance of Building Permits obtain encroachment permit for all new or existing driveway approaches and construct them to County standards, as specified in the County Improvement Standards. 11. Prior to issuance of Building Permits deed to Butte County, in fee simple, 40 feet of right-of- way from the centerline of Foothill Boulevard. The right-of-way shall be sufficient for the installation of a standard No. S-5 sign at all street intersections. California Department of Forestry/Butte County Fire 12. Perform the following to the satisfaction of the Butte County Fire/California Department of Forestry: (a) Construction, installation or development of structures or facilities within this development shall comply with the latest California Fire Safe Regulations, (Public Resources Code 4290), and all other applicable State and County codes, ordinances and regulation in effect at the time of application for improvement permits. (b) Building identification and/or addresses shall be installed in conformance with Public Resources Code 4290 and shall be posted at the beginning of building construction and maintained continuously thereafter. (c) Water for fire protection is required. The preferable system is a hydrant system capable of meeting the fire flow requirements. If this is not feasible, a system involving independent pumps, static water storage and dry standpipes may be substituted. Such a system is subject to the approval of the fire department. Both the California Air Resources Board and the Environmental Protection Agency have established air pollution standards in an effort to protect human health and welfare. Geographic areas are designated "attainment" if these standards are met and "nonattainment" if they are not met. In addition, each agency has several levels of classifications based on severity of the problem. According to the Butte County Air Quality Management District (BCAQMD), Butte County and all northern Sacramento Valley Air Districts have been designated as "moderate" nonattainment areas for the state standards for ozone (03) and fine particulate matter (PMio). Currently, Butte County is in attainment for all the federal (less stringent) air quality standards. Fugitive dust emissions may occur during development activities on the site, such as excavation for foundations, which may create a temporary nuisance to persons residing or working near the project site. The Butte County Air Quality Management District requests that measures, such as site and driveway watering and/or use of other acceptable soil palliatives, be incorporated during development activities on the site. A mitigation measure is recommended that requires measures be taken to prevent fugitive dust emissions during development activities. d. No sensitive receptors are in the vicinity of the project site. No impact would be incurred. e. The project would not create any odors. Mitigation Measure # 3: Measures shall be taken to control fugitive dust emissions from all civil construction associated with development of the site. Standard Mitigation Measures to prevent or reduce fugitive dust emissions can be obtained from the Butte County Air Quality Management District. Plan Requirements: The conditions shall be placed on the Use Permit. All requirements shall be shown on building plans. The City of Oroville commented on the preservation of native trees; the city recommends that an arborist prepare a detailed plan for the preservation of native trees. The trees in this area are not protected by local ordinance and they are not considered rare or endangered. However, since development pressure in foothill areas of the county influence blue oaks and their habitat, the California Department of Fish and Game encourages developers to preserve as many trees as possible, with an emphasis on larger, more mature trees. Although oaks are not an endangered species and are not protected by local ordinance, efforts should be made to ensure that projects protect native oak trees, since development is decreasing their numbers to the point that they may become endangered in the future. Mitigation Measure #4: Prior to Use Permit issuance, a tree plan prepared by a certified arborist, botanist, or landscape archit6ct shall be provided to the Planning Division. The Plan shall be prepared in accordance with the following • Site improvements shall be made in coordination with the tree plan to ensure that development occurs in areas that would provide a minimum amount of disturbance with native oak trees and result in fewer trees being removed. • The applicant shall minimize the removal of trees deemed suitable for retention. The plan shall show the location of trees deemed suitable for retention, and trees to be removed. • Factors used to assess suitability of trees shall include health, location, and size of the tree. The plan shall encourage the retention of larger, healthier trees over smaller or diseased trees. • Each tree to be preserved in the vicinity of construction activities shall be surrounded by a tree zone identified by the drip line of the tree. An orange plastic fence or other suitable type of fence shall be used to identify the tree zone during construction activities to ensure that construction equipment does not compact the soil surrounding the tree. • No vegetation removal, soil disturbance, or other development activities shall occur within the tree zone in order to protect root systems and minimize compaction of the soil. Impact Discussion: a.1. The Seismic Safety Element indicates that all of Butte County is in Moderate Earthquake Intensity Zone VIII. The closest mapped Fault -Rupture Zone is the Cleveland Hills Fault line which is located approximately'/4 of a mile to the east. The project is not located in an area that would be subject to fault rupture because of the distance to the Cleveland Hills Fault. No impacts are anticipated as a result of fault rupture and no seismic related requirements are necessary with regard to fault rupture. a.2. The intensity of ground shaking at any specific site depends on the characteristics of the earthquake, the distance from the earthquake, and on the local geologic soils and conditions. At present, there is insufficient data to predict accurately the expected ground motions at various locations in Butte County. However, strong seismic ground shaking is closely related to the proximity of active fault lines. Although there is insufficient data to predict these forces, the closest mapped Fault -Rupture Zone is the Cleveland Hills fault line, which is located approximately 25 miles to the southeast. The Cleveland Hills fault line is the only fault line in Butte County that is recognized under the Alquist-Priolo Special Study Zones Act to pose a threat from fault rupture. Seismic risk is not limited to faults which have been currently identified. 0 Butte County Department of Development Services 0 Planning Division 0 Page 9 0 Project Name: Church of God, 1Crennonite, UP 02-16 • Some earthquakes originate from unknown sources sometimes characterized as "background seismicity" or "floating earthquakes". The Butte County Master Environmental Assessment indicates that it is reasonable to assume that background seismicity could produce earthquakes as large as Richter magnitude (modified Mercalli intensity scale) 6.5 virtually anywhere in Butte County. There is no current evidence that an earthquake larger than magnitude 6.5 would occur at this location. Earthquakes at this magnitude are generally felt by all persons, but damage is generally slight to minor, with fallen chimneys and cracked plaster the most prominent damage. Richter magnitude 6.5 is not subjectively characterized on the intensity scale, but a magnitude 7 is generally characterized by negligible damage, especially in buildings of good design and construction. Considerable damage can occur in poorly built or badly designed structures. a.3. The Butte County Seismic Safety Element's Liquefaction Potential Map indicates that the site has a low potential for liquefaction. No impact is anticipated. a.4. The Subsidence and Landslide Potential Map of the Safety Element of the Butte County General Plan indicates that there is low potential for landslides in this area. No impact is anticipated because the site does not contain any slopes. b. The Erosion Potential Map of the Safety Element of the Butte County General Plan indicates that there is a high potential for soil erosion at the site. Large amounts of grading is not anticipated in conjunction with this project. Because of the potential for high erosion of soil at this site, the Planning Division is recommending that all graded slopes, over 5 feet in height, be seeded, planted, mulched or hydroseeded or otherwise protected to prevent erosion. This recommendation is set forth below as a mitigation measure. C. No impact is anticipated from instability, landslide, lateral spreading, subsidence, liquefaction or collapse. d. The Conservation Element's Expansive Soils Map indicates that the project site has a high expansive soil designation. The Building Division may require that the foundations for structures on the site be designed and constructed to handle the shrink/swell characteristics of expansive soils. Standard grading and foundation design would reduce any potential impacts. No impact is anticipated e. Sewage disposal for the existing church is handled by an on-site septic system. The Butte County Environmental Health Division has reviewed the suitability of the site for use of on-site sewage disposal and does not object to the use of a septic system for the proposed structure. Mitieation Measure #5: Perform the following requirements to minimize soil erosion: (a) All graded slopes, over 5 feet in height shall be seeded, planted, mulched/hydroseeded, or otherwise protected to prevent soil erosion. (b) Structures, dumping, fill material, vegetation removal, and/or excavation shall not be allowed in areas having a slope of 30% or greater unless an Erosion Control Plan prepared by a registered civil engineer or other qualified professional is submitted to and approved by the Department of Public Works. Plan Requirements: The erosion protection measures shall be implemented during all times of construction where graded slopes are created over 5 feet in height or where development is proposed in areas of 30% slope or greater. Timing: This measure shall be implemented during site preparation and construction. (b) Building identification and/or addresses shall be installed in conformance with Public Resources Code 4290 and shall be posted at the beginning of building construction and maintained continuously thereafter. (c) Water for fire protection is required. The preferable system is a hydrant system capable of meeting the fire flow requirements. If this is not feasible, a system involving independent pumps, static water storage and dry standpipes may be substituted. Such a system is subject to the approval of the fire department. The available water flow from such a system must meet the general flow requirement. The minimum volume of water in storage must equal the fire flow for the type of project times 20 minutes. Provisions must be made to ensure the system provided is maintained to its design capacity. Plan Requirements: The mitigation shall be placed on the Use Permit and shown on all building plans. Timing: This Mitigation shall be implemented at the time of site construction and prior to issuance of final building permits. A significant increase in surface stormwater runoff can be expected due to the reduced absorption rate created from the new impervious surfaces of the project, which may have a significant impact on off- site drainage facilities. In order to prevent any significant impacts to drainages, a plan for a permanent solution for drainage is required to be submitted to and approved by the Department of Public Works prior to issuance of a building permit for the proposed multi-purpose structure. The drainage plans are required to specify how stormwater drainage would be detained on site and/or conveyed to the nearest natural or publicly maintained drainage channel or facility and would provide that there be no net increase in the peak flow runoff to said channel or facility. g. - i. The project site is not located within a 100 -year flood zone as shown on Federal Emergency Management Agency Flood Insurance Rate Map 06007C -1025D, dated June 8, 1998. The project site is located in an area of rural residential uses away from customary sources of significant noise. Ambient noise at and in the vicinity of the project area is affected primarily by vehicle traffic on the adjacent Foothill Boulevard, which has an average daily traffic volume of 2,037 vehicles. This road is not a significant source of noise impact. Noises that would be generated by the church use consist mainly of vehicles arriving and departing the site. Other noise is generated by outdoor activities held by church members. Because of the low density of the area, it is not expected that the church use would present any significant noise impact to surrounding land uses. Construction activities on the site would temporarily generate high noise levels on and adjacent to the project site intermittently during project development activities. During construction, the highest noise levels would result from operation of heavy earthmoving equipment, which can be expected to generate noise levels of between 85 to 90 decibels (dBA) at a distance of 50 feet from the source. Noise levels would be reduced, however, by a factor of six dBA with each doubling of distance from the noise source and by intervening topography. The General Plan Noise Element addresses a maximum acceptable community noise level of 65dBA for low density and multi -family residential land uses to provide a suitable noise environment. Any such noise disturbance would be intermittent and short-term in nature, but would be significant without the implementation of construction noise attenuation measures, specified below. Mitigation Measure #8: All development activity shall be limited to 7:00 a.m. to 6:00 p.m., Monday through Friday, and 10 a.m. to 6 p.m., Saturday, Sunday, and holidays. Levels of Service for Foothill Boulevard have not been determined but are observed to be generally very good, with an unrestricted flow of traffic. Based upon occupancy, the church is expected to generate a maximum of 60 trips per day during operations. The addition of 60 trips per day to Foothill Boulevard is not expected to significantly impact levels of service on Foothill Boulevard. The Department of Public Works requires that the applicant obtain an encroachment permit for entry onto the County right-of-way along Foothill Boulevard. This requirement shall be a condition of the Use Permit. The parking section of the Butte County Zoning Ordinance specifies the number of required parking spaces according to the type of use. The church use requires one parking space per each six seats or one parking space per 50 square feet of usable seating area, whichever is greater. The plans submitted with the church show that the sanctuary would be approximately 1,500 -square feet in size. Based on this size, 30 parking spaces are required for the church. In addition, two handicapped parking stalls are required. The site plan shows 25 parking spaces. Therefore, a condition of the Use Permit shall require the installation of 32 parking spaces, with two of the spaces being disabled spaces. The site has an adequate amount of additional room to provide for the additional parking spaces required. The parking and landscaping requirement have been set -forth below as a Mitigation Measure for this project. g. No vegetation removal, soil disturbance, or other development activities shall occur within the tree zone in order to protect root systems and minimize compaction of the soil. Timing: This measure shall be implemented during site preparation and construction. Mitigation Measure #6 Butte County Fire/California Department of Forestry Requirements: (a) Construction, installation or development of structures or facilities within this development shall comply with the latest California Fire Safe Regulations, (Public Resources Code 4290), and all other applicable State and County codes, ordinances and regulation in effect at the time of application for improvement permits. (b) Building identification and/or addresses shall be installed in conformance with Public Resources Code 4290 and shall be posted at the beginning of building construction and maintained continuously thereafter. (c) Water for fire protection is required. The preferable system is a hydrant system capable of meeting the fire flow requirements. If this is not feasible, a system involving independent pumps, static water storage and dry standpipes may be substituted. Such a system is subject to the approval of the fire department. The available water flow from such a system must meet the general flow requirement. The minimum volume of water in storage must equal the fire flow for the type of project times 20 minutes. Provisions must be made to ensure the system provided is maintained to its design capacity.
