The property is located on the north side of Oak Way, approximately 1,000 feet east of Meridian Road, at 3408 Oak Way, west of Chico. APN 042-120-024 (SB) (UP 02-20) } Mr. Betts gave a brief summary of the project. He noted that there was an error on Page 2 of the Report and that Orchard Way should be changed to Oak Way. There was a brief discussion on the possibility of the addition becoming a third dwelling. The hearing was opened to the public. Mike Sterling stated that he has no intention of making the addition into a separate unit. He explained that the present home is only 750 square feet and he needs a larger house. The hearing was closed. It was moved by Commissioner Nelson, seconded by Commissioner Leland, and unanimously carried to approve the Use Permit for Michael J. Sterling subject to the findings and conditions listed below: I. The project is exempt from the provisions of the California Environmental Quality Act under Section 15303 Class 3(a). Section 15303 includes construction and location of limited numbers of new structures. II. Approve Use Permit 02-20 for Michael J. Sterling, subject to the following findings and the conditions in Exhibit "A": A. The proposed location, size, design, and operating characteristics of the proposed use are in accordance with the purpose of this Ordinance, the purpose of ,the zone in which the site is located, the Butte County General Plan, and the development policies and standards of the County because: The project is in accordance with the purpose of the zone in which the land lies and the Butte County General Plan because the project site is designated as Orchard and Field Crops. The Orchard and Field Crops land use designation allows residential uses as Secondary Uses. The Butte County Zoning Ordinance allows the expansion of a nonconforming use upon approval of a Use Permit. B. The location, size, design, and operating characteristics of the proposed use would be compatible with, and would not adversely affect, or be detrimental to adjacent uses, residents, buildings, structures, or natural resources, with consideration given to: Harmony in scale, bulk, coverage, and density: ■ BUTTE COUNTY PLANNING SERVICES MEETING ■ MINUTES ■ SEPTEMBER 12, 2002 ■ PAGE 23 ■ The project is in harmony with scale, bulk, coverage, and density because the addition to the existing nonconforming second dwelling does not represent a coverage issue due to the large size of the parcel. The modified second dwelling unit would not be out of character for the area. 2. The availability of public facilities, services and utilities The addition to the nonconforming second dwelling unit would not create a need for new public facilities, services, and utilities because telephone and electrical services already extend to the project parcel. The Butte County Fire Department requires compliance with standard California Fire Safe Regulations, Public Resources Code 4290. 3. The harmful effect, if any, upon desirable neighborhood character: The addition to the existing nonconforming second dwelling unit would not change the traditional architectural style that is of a character consistent with a rural residential neighborhood. 5. The suitability of the site for the type and intensity of use or proposed development: The site is suited for the project because the property is of a sufficient size to contain the modified nonconforming second dwelling unit and because the property does not contain any physical constraints that would impact the dwelling. 6. Any other relevant impact of the proposed use: The Planning Division has 'circulated the proposed addition to a nonconforming second dwelling unit application to County agencies and has received responses that indicated there is no evidence that the use, with appropriate conditions, would cause any other relevant planning -related impact. C. Based on the above findings, the proposed location, size, design, and operating characteristics of the proposed use and the conditions under which it would be operated or maintained would not be detrimental to the public health, safety, or welfare, or injurious to properties or improvements in the vicinity. D. The expansion of the nonconforming second dwelling unit will not'conflict with, impair or be detrimental to the uses both permitted and conditional of the zone in which it is located and/or adjoins because: 1. The adjoining agricultural operations have not significantly impacted the residents of the nonconforming second dwelling unit. 2. The Butte County Agricultural Commissioners Office determined that the expansion of the nonconforming second dwelling unit would not impact agricultural operations. Conditions of Approval: Planning Division: 1. The project site shall be developed in accordance with the approved project site plan and the conditions contained herein. Said site plan is on file in the Planning Division, which is identified as "Exhibit C," date-stamped June 20, 2002, and is incorporated herein by this reference. 2. The 1,346 square foot addition to the second dwelling shall not include a kitchen or have electrical connections installed necessary for a kitchen stove. 3. Applicant must also comply with all other applicable State and local statutes, ordinances, and regulations. Environmental Health Division 4. Meet Butte County Environmental Health Division requirements for on-site sewage disposal: a. Prior to issuance of a building permit, apply and obtain a permit to install sewage disposal system for proposed remodel of the second dwelling unit. b. Under County review, remove old septic tank serving the second dwelling unit. Butte County Fire Department/CDF 5. Building identification and/or addresses shall be installed in conformance with Public Resources Code 4290 and shall be posted at the beginning of building construction and maintained continuously thereafter. 6. Provide an all weather access to all structures. The access shall have a minimum 10 -foot width and 15 -foot vertical clearance, and be able to accommodate a 40,000 pound fire apparatus. Building Division 7. Building permits are required. Construction shall comply with federal, state, and local regulations. Plans shall be prepared, sealed, and signed by a California Licensed Architect or Registered Engineer for non-residential buildings and certain residential buildings. , 8. Proposed improvements shall comply with Title 24 energy conservation regulations. Appropriate compliance forms (two sets) shall be submitted indicating compliance with those standards. 9. Development fees for the proposed residential or non-residential improvements shall be paid prior to the issuance of building permits. The fees shall be those in effect at time of application, and shall include, but not be limited to, School Fees, Park and Recreation District fees, Water and Sewer Service Fees, Permit and Plan Check fees, and Fire Protection Fees. 10. Prior to issuance of a building permit for the addition to the second dwelling unit, obtain final inspection for the swimming pool (Building Permit # 01-0761). County Counsel 11. If this entire matter or any finding, action or condition of this matter is appealed to the Board of Supervisors, the applicant or any other developer/operator other than the applicant agrees to indemnify the County of Butte from liability or loss related to the approval of this project and agrees to sign an indemnification agreement in a form approved by County Counsel before the Board's appeal hearing. If the application is not appealed, this condition is deemed satisfied. Changes deemed to be major or significant in nature shall require a formal application for amendment. 4. If any use for which a Use Permit has been granted is not established within two years of the receipt of the Permit by the Permittee, the Permit shall become null and void and reapplication pursuant to Section 24-45 (of the Zoning Code) shall be required to establish the use previously granted under the expired Permit unless, 30 days prior to the expiration date, a request for a one-year extension is submitted to the Planning Commission together with sufficient evidence that the time limits for processing development permits under federal or State regulations require time limits which exceed one year. Upon application, and for good cause by the Permittee, at a public hearing pursuant to Section 24-45.25 above, the Planning Commission may extend any time limitation previously made a part of any condition to a Use Permit. 1 5. The terms and conditions of this Permit shall run with the land and shall be binding upon and be to the benefit of the heirs, legal representatives, successors, and assigns of the Permittee. 6. Neither the applicant, nor any agent nor representative of the applicant shall intentionally omit or misrepresent any material fact in connection with the application. Any alleged material misrepresentation shall constitute grounds for the Director of Development Services to commence a revocation hearing, and, if proven to exist, shall constitute sufficient grounds to revoke a Permit. Conditions of Approval: Planning Division: The project site shall be developed in accordance with the approved project site plan and the conditions contained herein. Said site plan . is on file in the Planning. Division, which is identified as `Exhibit C," date-stamped June 20, 2002, and is incorporated herein by this reference. 2. The 1,346 square foot addition to the second dwelling shall not include a kitchen or have electrical connections installed necessary fora kitchen stove. 3. Applicant must also comply with all other applicable State and local statutes,_ ordinances, and regulations. Environmental Health Division 4. Meet Butte County Environmental Health Division requirements for on-site sewage disposal: a. Prior to issuance of a building permit, apply and obtain a permit to install sewage disposal system for proposed remodel of the second dwelling unit. b. Under County review, remove old septic tank serving the second dwelling unit. Butte County Fire Department/CDF 5. Building identification and/or addresses shall be installed in conformance with Public Resources Code 4290 and shall be posted at the beginning of building construction and maintained continuously thereafter. 6. Provide an all weather access to all structures. The access shall have a minimum 10 -foot width and 15 -foot vertical clearance, and be able to accommodate a 40,000 pound fire apparatus. Construction shall comply with federal, state, and local regulations. PROJECT DESCRIPTION: The applicant is requesting a Use Permit to enlarge a nonconforming second dwelling unit. The dwelling to be enlarged is 720 square feet in size. The applicant proposes to add 626 square feet to the second dwelling unit; the resulting structure would be 1,346 square feet in size. The new addition would be two stories; the first story would contain a master bedroom and a full bath, while upstairs would be a general use room. A laundry/breezeway would separate the existing nonconforming second unit dwelling from the proposed two-story addition. The area where the proposed addition would be located currently consists of a lawn. A propane tank would have to be relocated to make room for the addition. The existing septic tank for the second dwelling unit may have to be relocated due to the proposed expansion. The proposed expansion would not encroach into any required building setback. The applicant first planned to add a second story onto the second dwelling unit. However, the applicant's architect determined that the foundation would not support a second story. Both dwellings on the site were constructed prior to building permits being required. The first dwelling is believed to have been constructed in the early 1900s, but was added on to in 1983. According to the records of the County Assessor's Office, the second dwelling unit was 0 BUTTE COUNTY PLANNING COMMISSION 0 AGENDA REPORT 0 PAGE 1 0 constructed in 1967. The zoning at that time could not be determined by Planning staff, but the project site is believed to have been zoned A-2, which allowed multiple dwelling units by right. The second dwelling unit is considered to be a legal, nonconforming use because the dwelling was legally established. Butte County Code section 24-35.20 states that no nonconforming use may be expanded or enlarged unless a Use Permit is approved by the Planning Commission. SITE CHARACTERISTICS: The project site is developed with two dwellings, a large barn, several outbuildings, a swimming pool, two septic systems, and a well. Access to both dwellings is from a private driveway off of Oak Way. The second dwelling unit is not located within any required building setback. Vegetation on the site consists of walnut trees, vegetables, lawns, and non-native trees. The project site is surrounded by walnut orchards. Surrounding and nearby parcels are zoned A-10, and range in size from 1.4 to 27 acres. Orchard Way is a very narrow road, but does not have much vehicular traffic. The project site is not located with an airport compatibility zone or within a 100 -year flood zone. ANALYSIS: The addition to the nonconforming second dwelling unit is not expected to create any significant impacts to the neighborhood. The nonconforming second dwelling unit has been in use for over 30 years and has not created any problems to the neighborhood. The proposed addition could result in additional people living in the dwelling, which would result in an increase in vehicle traffic, noise, sewage generation, and water consumption. These potential impacts are not expected to be significant and would not have an adverse impact to the neighborhood. The project site is surrounded by walnut orchards and the occupants of the site are subject to impacts associated with agricultural operations, such as noise, dust, smoke, and chemical spraying. These impacts already exist and the proposed addition to the nonconforming second dwelling unit would not create additional impacts. The Butte County Agricultural Commissioner commented on this project and stated that the project would not have an impact on agricultural activities. General Plan and Zoning: The General Plan land use designation of the project site is Orchard and Field Crops which lists dwellings as Secondary Uses. The proposed project is located in an area zoned A-10 for agricultural uses on parcels of ten acres or more in size. The proposal would allow the expansion of an existing nonconforming second dwelling unit, which is permitted by issuance of a Use Permit. Additional permanent second dwelling units are not allowed in the A-10 zone, except for dwellings for agricultural workers. However, the second dwelling unit is a legal, nonconforming use. 0 BUTTE COUNTY PLANNING COMMISSION ■ AGENDA REPORT ■ PAGE 2 0 For the approval of the Use Permit, the applicant is required to present information, including plans or other information that is sufficient to allow the Planning Commission to make an informed decision. The Planning Commission may grant a Use Permit if: "The proposed uses of property will not impair the integrity and character of the zone in which the land lies, and that the use would not impair the integrity and character of the zone in which the land lies, and that the use would not be unreasonably incompatible with, or injurious to, surrounding properties or detrimental to the health and general welfare of the persons residing or working in the neighborhood or the general health, welfare, and safety of the residents of the county" (Butte County Code, Section 24- 45.10). Section 24-35.20 of the Butte County Code states that when considering a use permit for a nonconforming use, the Planning Commission shall grant the use permit when it finds that the change, expansion, enlargement, extension, reconstruction, or structural alteration of such use will not conflict with, impair or be detrimental to the uses both permitted and conditional of the zone in which it is located and/or adjoins. This finding shall be in addition to the findings required by Section 24-45.10 of the Butte County Zoning Ordinance. Pursuant to Section 24- 45.15, the Planning Commission may impose conditions upon the issuance of the use permit which are reasonably related to the use of the property for which the use permit is requested. In addition, the Planning Commission may at its own discretion establish a date for either the termination of the use or review of the use permit. Other Issues The Butte County Environmental Heath Division requests that permits be obtained by the applicant to replace the old septic tank with a new system. The Butte County Building Division requires that building permits be obtained for the proposed addition. Additionally, the Building Division requests that a final inspection be conducted for the swimming pool that was installed on the property in 2001. The proposed addition would be attached to the nonconforming second dwelling unit by a shared laundry room/breezeway. This configuration appears to result in two separate dwellings, and in fact, if a kitchen was added to the addition, it could be utilized as a separate dwelling unit. For this reason, staff has included a condition that prohibits the installation of a kitchen in the proposed addition. CEQA ISSUES: This application for a Use Permit to expand a nonconforming use is Categorically Exempt from environmental review under Section 15303 Class 3(a) of the California Environmental Quality Act. Class 3 includes construction and location of limited numbers of new, small facilities, or structures. Subsection (a) includes one single-family residence, or a second dwelling unit in a residential zone. ■ BUTTE COUNTY PLANNING COMMISSION ■ AGENDA REPORT 0 PAGE 3 ■ ACTIONS FOR CONSIDERATION Staff recommends that the Planning Commission take the following actions: I. The project is exempt from the provisions of the California Environmental Quality Act under Section 15303 Class 3(a). Section 15303 includes construction and location of limited numbers of new structures. H. Approve Use Permit 02-20 for Michael J. Sterling, subject to the following findings and the conditions in Exhibit "A": A. The proposed location, size, design, and operating characteristics of the proposed use are in accordance with the purpose of this Ordinance, the purpose of the zone in which the site is located, the Butte County General Plan, and the development policies and standards of the County because: The project is in accordance with the purpose of the zone in which the land lies and the Butte County General Plan because the project site is designated as Orchard and Field Crops. The Orchard and Field Crops land use designation allows residential uses as Secondary Uses. The Butte County Zoning Ordinance allows the expansion of a nonconforming use upon approval of a Use Permit. B. The location, size, design, and operating characteristics of the proposed use would be compatible with, and would not adversely affect, or be detrimental to adjacent uses, residents, buildings, structures, or natural resources, with consideration given to: 1. Harmony in scale, bulk, coverage, and density: The project is in harmony with scale, bulk, coverage, and density because the addition to the existing nonconforming second dwelling does not represent a coverage issue due to the large size of the parcel. The modified second dwelling unit would not be out of character for the area. 2. The availability of public facilities, services and utilities The addition to the nonconforming second dwelling unit would not create a need for new public facilities, services, and utilities because telephone and electrical services already extend to the project parcel. The harmful effect, if any, upon desirable neighborhood character: The addition to the existing nonconforming second dwelling unit would not change the traditional architectural style that is of a character consistent with a rural residential neighborhood. 5. The suitability of the site for the type and intensity of use or proposed development: The site is suited for the project because the property is of a sufficient size to contain the modified nonconforming second dwelling unit and because the property does not contain any physical constraints that would impact the dwelling. 6. Any other relevant impact of the proposed use: The Planning Division has circulated the proposed addition to a nonconforming second dwelling unit application to County agencies and has received responses that indicated there is no evidence that the use, with appropriate conditions, would cause any other relevant planning - related impact. C. Based on the above findings, the proposed location, size, design, and operating characteristics of the proposed use and the conditions under which it would be operated or maintained would not be detrimental to the public health, safety, or welfare, or injurious to properties or improvements in the vicinity. D. The expansion of the nonconforming second dwelling unit will not conflict with, impair or be detrimental to the uses both permitted and conditional of the zone in which it is located and/or adjoins because: 1. The nonconforming second dwelling unit has been on the property for over 30 years and has not caused any significant impacts to adjoining agricultural operations. The adjoining agricultural operations have not significantly impacted the residents of the nonconforming second dwelling unit. 2.
