The property is zoned R-1 (Residential) and is located on the east side of Madera Lane, approximately 270 feet north of Pillsbury Road, in the north Chico area. APN 007-120-009 (CS) (UP 02-21) Mr. Sanders gave a brief summary of the project. The hearing was opened to the public. Mary Dorn said there is a day care across the street for a small day care. She said she cares for children 1-12 years old and if this is approved she will have one employee which is required by law. The hearing was closed. It was moved by Commissioner Leland, seconded by Commissioner Marin, and unanimously carried to approve the Use Permit for Mary Dorn subject to the findings and conditions listed below: I. Find that the application is statutorily exempt from CEQA review under Section 15274 of the Public Resources Code. II. Approve a Use Permit 02-21 for Mary Dorn for a large family day care facility for 12 or fewer children on APN 007-120-009, based on the following findings and the conditions found in Exhibit "A": II. A. The proposed uses of the property will not impair the integrity and character of the zone in which the land lies, and that the use would not be unreasonably incompatible with, or injurious to, surrounding properties or detrimental to the health and general welfare of the persons residing or working in the neighborhood, or to the general health, welfare and safety of the residents of the County as supported by the following: 1. Large family day care facilities have been defined by the State as a use that is accessory to a residence. 2. Madera Lane and the surrounding roads have the capacity to handle the additional traffic generated by the proposed use in addition to the existing uses in the area including the large family day care facility located across the street at 2713 Madera Lane. 3. The location, size, design, and operating characteristics of the proposed -use will -be compatible with, and will not adversely affect, or be detrimental to adjacent uses, residents, buildings, structures, or natural resources, with consideration given to: 1. Harmony in scale, bulk, coverage, and density: The project is in harmony with scale, bulk, coverage, and density because the large family day care facility will not create a need for any new structures or an alteration to any existing structures. 2. The availability of public facilities, services, and utilities: The large day care facility will not create a need for new public facilities, services, and utilities because water, telephone, gas, and electrical services already extend to the project parcel. The project site is provided with municipal water and existing septic facilities. The Butte County Fire Department requires compliance with State Fire Marshall requirements for large day care facilities. 3. The harmful effect, if any, upon desirable neighborhood character: The proposed large day care facility will not change the traditional architectural style that is of a character consistent with an urban residential neighborhood. The large day care facility will not lead to any significant increase in noise levels due to children playing outside or significant increase in vehicle traffic. 4. The generation of traffic and the capacity and physical character of surrounding streets: The proposed large day care facility will not significantly increase vehicle traffic in the area, nor will it create any vehicle circulation impacts. 5. The suitability of the site for the type and intensity of use or development which is proposed: The site has adequate area for off-site parking spaces for the residents of the dwelling and for employees of the large family day care facility. There is also adequate parking for an off-street loading area. 6. Any other relevant impact of the proposed use: The Planning Division has circulated the proposed large family day care facility application to County agencies and has received no evidence that the use will cause any other relevant impact. ■ BUTTE COUNTY PLANNING COMMISSION ■ MINUTES ■ JANUARY 9, 2003 ■ PAGE 8 ■ Conditions of Approval: S The facility is a single family residence that shall be the principal residence of the provider and the large day care facility shall be clearly incidental and secondary to the use of the property for residential purposes. 2. Minimum off-street parking shall be provided pursuant to the following standards: (a) Two (2) off-street parking spaces for the residents of the dwelling. (b) One (1) off-street parking space for each employee. The two (2) required residential spaces may not be used for employees. (c) One (1) off-street parking space/loading area. 3. One sign, not to exceed 3 square feet, is allowed. This sign shall not be placed in the front yard building setback. 4. The large family day care home shall be licensed by the California Department of Social Services, Community Care Licensing. 5. The day care structure shall meet all California Building Code regulations pertaining to large family day care facilities, including, but not limited to, the installation of smoke detectors, a device for sounding alarm, fire extinguishers, and exit doors operable from the inside without the use of a key or any special knowledge or effort. 6. Prior to use of the large day care, the facility shall be inspected by the Butte County Fire Department/CDF and the State Fire Marshal and shall meet the requirements of CCR Title 19. 7. Prior to issuance of the Use Permit, applicant shall obtain any necessary building permits required by code. 8. The capacity of the Large Family Day Care facility may be increased to 14 children when the Butte County Code is amended to conform to the State statute. 9. Pursuant to the provisions of the Zoning Ordinance of the County of Butte and the special conditions set forth below: Mary Dorn is hereby granted a Use Permit to establish a large family day care facility for up to 12 children within 500 feet of another large family day care facility, on APN 007- 120-009 at 2714 Madera Lane, Chico. Failure to comply with the conditions specified herein as the basis for approval of application and issuance of Permit constitutes cause for the revocation of said permit in accordance with the procedures set forth in the Butte County Zoning Ordinance, including Butte County Code Sec. 24-45.65. 2. ; .Unless otherwise provided for in a special condition to this Use Permit, all conditions must be completed prior to or concurrently with the establishment of the granted use. The use granted by this permit must be established within two years of the date of approval. 3. Minor changes may be approved administratively by the Directors of Development Services, Environmental Health, or Public Works upon receipt of a substantiated written request by the applicant, or their respective designee. Prior to such approval, verification shall be made by each Department or Division that, the modification is consistent with the application, fees paid and environmental determination as conditionally approved. Changes deemed to be major or significant in nature shall require a formal application for amendment. 4. If any use for which a Use Permit has been granted is not established within two years of the receipt of the Permit by the Permittee, the Permit shall become null and void and reapplication pursuant to Section 24-45 (of the Zoning Code) shall be required to establish the use previously granted under the expired Permit unless, 30 days prior to the expiration date, a request for a one year extension is submitted to the Planning Commission together with sufficient evidence that the time limits for processing development permits under federal or state regulations require time limits which exceed one year. Upon application, and for good cause by the Permittee, at a public hearing pursuant to Section 24-45.25 above, the Planning Commission may extend any time limitation previously made a part of any condition to a Use Permit. ;. The terms and conditions of this Permit shall run with the land and shall be binding upon and be to the benefit of the heirs, legal representatives, successors, and assigns of the Permittee. 6. Neither the applicant, nor any agent nor representative of the applicant shall intentionally omit or misrepresent any material fact in connection with the application. Any alleged material misrepresentation shall constitute grounds for the Director of Development Services to commence a revocation hearing, and, if proven to exist, shall constitute sufficient grounds to revoke a Permit. Conditions of Approval: The facility is a single family residence that shall be the principal residence of the provider and the large day care facility shall be clearly incidental and secondary to the use of the property for residential purposes. 2. Minimum off-street parking shall- be provided pursuant to the following standards: (a) Two (2) off-street parking spaces for the residents of the dwelling. (b) One (1) off-street parking space for each employee. The two (2) required residential spaces may not be used for employees. (c) One (1) off-street parking space/loading area. One sign, not to exceed 3 square feet, is allowed. This sign shall not be placed in the front yard building setback. 4. The large family day care home shall be licensed by the California Department of Social Services, Community Care Licensing. The day care structure shall meet all California Building Code regulations pertaining to large family day care facilities, including, but not limited to, the installation of smoke detectors, a device for sounding alarm, fire extinguishers, and exit doors operable from the inside without the use of a key or any special knowledge or effort. Prior to use of the large day care, the facility shall be inspected by the Butte County Fire Department/CDF and the State Fire Marshal and shall meet the requirements of CCR Title 19. 7. Prior to issuance of the Use Permit, applicant shall obtain any necessary building permits required by code. The capacity of the Large Family Day Care facility may be increased to 14 children when the Butte County Code is amended to conform to the State statute. 9. PROJECT DESCRIPTION/SITE CHARACTERISTICS: This is a proposal to expand a family day care facility from 6 children to 12 children with the provision that 14 children may be permitted when the Butte County Zoning Ordinance is changed to reflect current State Law. Per Butte County Zoning Code Section 24-265(b)(2), large -family day care homes may have up to twelve (12) children. The current state law has limits of eight (8) children for small day care and fourteen (14) for large family day care centers. The County Code has not been changed to reflect these new limits. This proposal is being processed under the existing County Code and at such time as the code is revised to the new state standards, the limits on the allowed number of children may be administratively adjusted for existing small and large child care centers. The project site is located at 2714 Madera Lane in the Chico area. The parcel is developed with a single family home, approximately 1,488 square feet in size, on an urban sized residential lot of approximately 0.26 acre. The property has a 6 -foot high fencing completely around the child care area. The project is in a neighborhood characterized by similar urban residential development. There are similar sized parcels ■ BUTTE COUNTY PLANNING MANAGER ■ AGENDA REPORT 0 PAGE 1 ■ bordering the property. Parcel sizes range from 0.25 -acre to 0.37 -acre. Access to the dwelling is from Madera Lane, a paved, County -maintained, road. Domestic water is supplied by Cal Water. The dwelling is served by a septic system. The applicant lives in the residence and is currently the primary care provider. With approval for a large day care facility, the applicant proposes to have as many as twelve (12) children, with one additional full-time employee. ANALYSIS: The property is zoned R-1(Residential) and has a General Plan land use designation of LDR (Low Density Residential). The R-1 zoning classification allows large family day care facilities with approval of a Minor Use Permit and subject to the requirements of Section 24-265 of the Zoning Code as follows: (1) The facility is a single family residence that is the principal residence of the provider and the use is clearly incidental and secondary to the use of the property for residential purposes. (2) Properties proposed for Large Family day care shall be located at least five hundred (500) feet driving distance from any other Large Family day care property and the granting of the permit shall not result in any residence being bounded on more than one (1) side by a Large Family day care. (3) Large Family day care homes shall meet the following traffic control measures: In addition to providing the required number of parking spaces for the residential use, one (1) off-street parking space for each employee of the facility and one (1) off-street parking space/loading area shall be provided. The drive- way area may be used to meet this requirement. b. Large Family day care homes located on principal or minor arterial roads as designated by the General Plan Circulation Element shall provide drop-off and pick-up areas which prevent vehicles from backing onto such roads. Properties proposed for Large Family day care homes shall have frontage on and access off a paved road. Roads that are constructed for the purpose of meeting this requirement shall meet the RS -4C standard as contained in the Butte County Improvement Standards contained in Chapter 20 of the Butte County Code. (4) One (1) sign, not to exceed three (3) square feet, shall be allowed. (5) The Large Family day care home shall be licensed by the California Department of Social Services, Community Care Licensing. (6) Meet all State Fire Marshall regulations pertaining to Large Family day care facilities. The application met all of the above requirements except provision (2). Staff conducted an analysis of the location of other large family day care centers in the area of the project and determined that there is another large -family day care facility located directly across the street at 2714 Madera Lane, issued in 1996 (MUP 96-19). This facility is less than 500 feet away and, a Use Permit is required rather than a Minor Use Permit and thus this application has been made. The requirement for having at least 500 feet driving distance was to avoid over concentration so these uses and to limit traffic impacts within neighborhoods. This neighborhood currently experiences very little traffic on Madera Lane, which along with Elverta Circle, serves 21 residences. Madera is not a through street and traffic is generally limited to those persons residing in the neighborhood. Madera Lane is constructed to urban standards and is paved with adjoining curb, gutter, and sidewalk. The current roadway certainly carries much less traffic than it would be capable of given its road width and residents on Madera Lane experience much less traffic than many residential roads in the Chico urban area. As the two day care facilities are across the street from each other, the traffic would have to pass in front of 5 of the 21 dwellings on Madera Lane excluding the two day care facilities. Based solely on a Level of Service standard, the additional traffic represented by this permit would not cause a significant impact to the operation of the road. However, this is a neighborhood issue and the Planning Commission will want to take into account public testimony regarding neighborhood concerns and desires. Family day care facilities are regulated to large degree by the State of California. Defined as a residential use and deemed compatible in all single family dwellings, the State finds that family day care home operated under the provisions of the State law do not fundamentally alter the nature of residentially zoned and occupied properties. Further more, family day care homes draw clients and vehicles to their sites during a limited time of day and do not require the attendance of a large number of employees or equipment. The State allows local jurisdictions to address Large Family day care facilities in one of three ways: (1) Classify these homes as a permitted use of residential property for zoning purposes. (2) Grant a nondiscretionary permit to that complies with a local ordinance prescribing reasonable standards, restrictions, and requirements concerning spacing and concentration, traffic control, parking, and noise control relating to such homes. (3) Require a Use Permit. However, the Use Permit must be granted if the family day care home complies with local ordinance prescribing reasonable standards, restrictions, and requirements concerning spacing and concentration, traffic control, parking, and noise control relating to such homes. Notice must be given to neighboring properties within 100 feet of the subject property and a hearing is not required unless a neighbor or the applicant requests it. Because the project doesn't meet all of the local standards, spacing in this instance, the Commission has the ability to deny the request. However, based on the physical aspects of the request, staff cannot find any reason to deny the project. 0 BUTTE COUNTY PLANNING MANAGER ■ AGENDA REPORT 0 PAGE 3 ■ There is sufficient area for off-street parking for the residents of the dwelling, one employee, and drop- off and pick-up of children. Parking on the site is provided by a two -car garage and two parking spaces in the driveway. An additional off-street paved area large enough to accommodate a car is located along the southerly property boundary. It is currently occupied by a boat, but could be made available by relocating the boat on the street. Located on a quiet residential street, the location provides a measure of traffic safety during drop-off and pick-up times. The Butte County Environmental Health Department recommends approval with a condition that the applicant shall maintain the septic system in compliance with Butte County ordinance. The Butte County Fire Department requires standard conditions to comply with Public Resources Code 4290. Currently, there is an existing small family day care facility at this location. The expansion will result in a minor change in traffic to. the location. However, as previously noted, Madera Lane and the surrounding streets do not carry large traffic volumes and the increase is not expected to create a significant problem. CEQA ISSUES: Family day care facilities are by statutorily exempt from CEQA under Section 15274. ACTIONS FOR CONSIDERATION Staff recommends that the Planning Commission take the following actions: I. Find that the application is statutorily exempt from CEQA review under Section 15274 of the Public Resources Code. II. Approve a Use Permit 02-21 for Mary Dorn for a large family day care facility for 12 or fewer children on APN 007-120-009, based on the following findings and the conditions found in Exhibit "A": A. The proposed uses of the property will not impair the integrity and character of the zone in which the land lies, and that the use would not be unreasonably incompatible with, or injurious to, surrounding properties or detrimental to the health and general welfare of the persons residing or working in the neighborhood, or to the general health, welfare and safety of the residents of the County as supported by the following: Large family day care facilities have been defined by the State as a use that is accessory to a residence. 2. Madera Lane and the surrounding roads have the capacity to handle the additional traffic generated by the proposed use in addition to the existing uses in the area including the large family day care facility located across the street at 2713 Madera Lane. 3. The location, size, design, and operating characteristics of the proposed use will be compatible with, and will not adversely affect, or be detrimental to adjacent uses, residents, buildings, structures, or natural resources, with consideration given to: Harmony in scale, bulk, coverage, and density: The project is in harmony with scale, bulk, coverage, and density because the large family day care facility will not create a need for any new structures or an alteration to any existing structures. The project site is provided with municipal water and existing septic facilities. The Butte County Fire Department requires compliance with State Fire Marshall requirements for large day care facilities. 3. The harmful effect, if any, upon desirable neighborhood character: The proposed large day care facility will not change the traditional architectural style that is of a character consistent with an urban residential neighborhood. The large day care facility will not lead to any significant increase in noise levels due to children playing outside or significant increase in vehicle traffic. 4. The generation of traffic and the capacity and physical character of surrounding streets: The proposed large day care facility will not significantly increase vehicle traffic in the area, nor will it create any vehicle circulation impacts. If any use for which a Use Permit has been granted is not established within two years of the receipt of the Permit by the Permittee, the Permit shall become null and void and reapplication pursuant to Section 24-45 (of the Zoning Code) shall be required to establish the use previously granted under the expired Permit unless, 30 days prior to the expiration date, a request for a one year extension is submitted to the Planning Commission together with sufficient evidence that the time limits for processing development permits under federal or state regulations require time limits which exceed one year. Neither the applicant, nor any agent nor representative of the applicant shall intentionally omit or misrepresent any material fact in connection with the application. Any alleged material misrepresentation shall constitute grounds for the Director of Development Services to commence a revocation hearing, and, if proven to exist, shall constitute sufficient grounds to revoke a Permit. Conditions of Approval: The facility is a single family residence that shall be the principal residence of the provider and the large day care facility shall be clearly incidental and secondary to the use of the property for residential purposes. Minimum off-street parking shall be provided pursuant to the following standards: (a) Two (2) off-street parking spaces for the residents of the dwelling. (b) One (1) off-street parking space for each employee. The two (2) required residential spaces may not be used for employees. (c) One (1) off-street parking space/loading area. One sign, not to exceed 3 square feet, is allowed. This sign shall not be placed in the front yard building setback. 4. The large family day care home shall be licensed by the California Department of Social Services, Community Care Licensing. 5. The day care structure shall meet all California Building Code regulations pertaining to large family day care facilities, including, but not limited to, the installation of smoke detectors, a device for sounding alarm, fire extinguishers, and exit doors operable from the inside without the use of a key or any special knowledge or effort. Prior to use of the large day care, the facility shall be inspected by the Butte County Fire Department/CDF and the State Fire Marshal and shall meet the requirements of CCR Title 19. Prior to issuance of the Use Permit, applicant shall obtain any necessary building permits required by code. 8.
