The property is located south of Durham and west 'of Nelson, on the west side of and at the south end of Pintail Lane, approximately 2.75 miles south of the intersection of Pintail Lane and Grainland Road, Durham area. APN 038-110-016 (CS) (UP 02-23) Mr. Sanders gave a brief summary of the hearing. Commissioner Lambert asked what the role was of the State Housing Board. Mr. Sanders said the State develops standards for the club park and will issue a license to operate. The hearing was opened to the public. Suzanne Combs, representative, said the applicant agrees with the conditions. . The hearing was closed. Commissioner Leland asked where is it stated that the use is seasonal. Mr. Sanders said "under Condition 3." It was moved by Commissioner Leland, seconded by Commissioner Marin, and unanimously carried to approve a Use Permit for Scott Larabee subject to the findings and conditions listed below: I. Adopt a Mitigated Negative Declaration with the following findings: A. An Initial Study was completed in compliance with the California Environmental Quality Act. Said study identified two potentially significant environmental effects and includes two mitigation measures that would mitigate such effect below significant levels; a Mitigated Negative Declaration is proposed. B. The Planning Commission has considered the proposed Mitigated Negative Declaration, together with comments received during the review process. C. On the basis of the whole record before the Planning Commission, including the Initial Study and any comments received, there is no substantial evidence that the Use Permit for L.C. Properties/Scott Larrabee, Planning Division File No. UP 02-23, will have a significant effect on the environment. D. The proposed Mitigated Negative Declaration reflects the independent judgment and analysis of the County, which is the Lead Agency. II. Adopt a "de minimus" exemption regarding impact to fish and wildlife or their habitat. The collection of fees pursuant to Fish and Game Code Section 711.4(d)(3) and 14 CCR 753.5. is not required. The project site is not known to contain any species identified as a candidate, sensitive, or special status species in local or regional plans; policies, or regulations, or by the California Department of Fish and Game or U. S. Fish and Wildlife Service. The project will not have a substantial adverse effect on any riparian habitat; have a substantial adverse effect on federally protected wetlands as defined by Section 404 of the Clean Water Act; interfere substantially with the movement of any native resident or migratory fish or wildlife species; conflict'with any local policies or ordinances protecting biological resources; or conflict with the provisions of an adopted Habitat Conservation Plan. III. Approve Use Permit 02-23, subject to the conditions found in Exhibit "A" and subject to the following findings: - A. The proposed uses of the property will not impair the integrity and character of the zone in which the land lies, and that the use would not be unreasonably incompatible with, or injurious to, surrounding properties or detrimental to the health and general welfare of the persons residing or working in the neighborhood, or to the general health, welfare and safety of the residents of the County as supported by the , following: 1. With the exception of one caretaker's residence, the facility improvements will only be occupied on a seasonal basis between the months of October through January. The facilities will be unoccupied for the balance of the year. 2. There are no residences or other habitable structures within '/z mile of the proposed hunting club facilities. 3. The proposed facility will be compatible with surrounding agricultural uses because the months the hunting club will be operating coincide with the months when agricultural activities in the area are minimal to non-existent. Conditions of Approval: Planning Division Exterior lighting for security purposes shall utilize low pressure sodium bulbs and the fixtures shall be shielded to prevent light from being directed off the property of upwards. Shielded shall mean that the light rays are directed onto the site and the light source, whether bulb or tube, is not visible from an adjacent property. Submit to the Department of Development Services the type of exterior lighting fixtures to be used prior to the issuance of the Use Permit. Plan Requirements: Submit to the Department of Development Services the type of exterior lighting fixtures to be used prior to the issuance of the Use Permit. Should any archaeological artifacts be discovered during construction or excavation, the Planning Division shall be notified immediately, and all work shall cease until a qualified archaeologist has examined the artifacts and the site and submitted his or her findings to the Planning Division, and recommended clearance to continue. Recommencement of construction shall be upon the approval of the Planning Division. Plan Requirements: The required condition shall be made part of the issued Use Permit. Timing: Ongoing throughout the earthwork phase of the development of the site Monitoring: Department of Development Services shall check plans prior to approval and shall spot check in the field. Additional monitoring shall be on an incident basis. State Law requires the reporting of any human remains or artifacts. 3. The 28 spaces shown on the development plan may accommodate a mobile home, travel trailer, or recreational vehicle. Occupancy of any of the above shall be restricted to the time period commencing one (1 ) week before the opening of waterfowl hunting season and ceasing one (1) week after the season closes. 4. The owner or operator of the hunting club shall meet the requirements of the State Department of Housing and Community Development for improvements and operation. Public Works/Land Development 5. Prior to establishing the use, obtain an encroachment permit for all new or existing driveway ' approaches and construct them to County standards, as specified in the County Improvement Standards. 6. Prior to establishing the use, a plan for a permanent solution to drainage shall be submitted to and approved by the Department of Public Works. The drainage plan shall specify how drainage waters shall be detained on-site and/or conveyed to the nearest natural or publicly maintained drainage channel or facility and shall provide that there shall be no increase in the peak flow runoff to said channel or facility. 7. Prior to establishing the use, establish the 100 year floodplain elevations and the lowest floor elevations for any structure. Show on the site plan map, the elevations (by contours) and the location of an accepted NVGD benchmark and a temporary benchmark on-site. Butte County Fire 8. Building identification and/or addresses shall be installed in conformance with Public Resources Code 4290 and shall be posted at the beginning of construction and maintained continuously thereafter. ■ BUTTE COUNTY PLANNING COMMISSION ■ MINUTES ■ SEPTEMBER 26.2000 ■ PAGE 18 ■ 9. Provide an all weather access road at least 10 feet wide and having a vertical clearance of 15 feet that will accommodate a 40,000 pound fire apparatus to all structures. Environmental Health 10. Prior to initiating any grading or site improvements, obtain conceptual approval from the Regional Water Quality Control Board in essence stating that Waste Discharge. Requirements are likely to be issued for the project. 11. Prior to issuance of any building or construction permits, provide a plan to construct a community sewage collection, treatment, and disposal facility in compliance with the Regional Water Quality Control Board and the Butte County Environmental Health Division's applicable codes and regulations governing the design, construction, and operation of the facilities. At a minimum, these plans must meet the following standards and criteria: a. Comply with all State and local laws regarding the design, placement, and construction of a waste water collection and disposal system. b. The design must be included as an integral part of the grading and site improvement plans subject to approval from both Butte County Environmental Health Division and Public Works Department. C. The plan must be complete and detailed, showing a continuous flow-through system. This plan shall specify construction detail with appropriate construction notes, materials to be used, and shall show elevations of various gravity fed components in relation to the site plan (commonly called a hydraulic profile cross-section). This plan must be finished and sufficiently detailed with construction' specifics that would allow a contractor to install the facilities in accordance with the above referenced criteria. , a. 12. Prior to installation of any mobile home, travel trailer, or recreational vehicle, provide Waste Discharge Requirements issued by the Regional Water Quality Control Board. 13. Prior to occupancy of any mobile space or the operation of the community sewage disposal system, establish a suitable entity to insure the operation, maintenance, and repair of the community sewage disposal system. 14. Prior to occupancy of any dwelling unit design and construct a new public water supply system in compliance with the California State Safe Drinking Water Act (codified in the CA Health and Safety Code). 15. All dwelling units and buildings must connect to the community sewer and public water supply. 17. The applicant must also comply with all other applicable State and local statutes, regulations, and ordinances. County Counsel 18. If this Use Permit or any finding, action or condition of this Use Permit is appealed to the Board of Supervisors, the applicant or any other developer/operator other than the applicant agrees to indemnify the County of Butte from liability or loss related to the approval of this project and agrees to sign an indemnification agreement in a form approved by County Counsel before the Board's appeal hearing. If the application is not appealed, this condition is deemed satisfied. The following is a brief synopsis of the current status of the Hunting Club and Mr. Larrabee's proposed plans for the Director of Development Services (DDS) to consider as a "Minor Change" under #3 of Use Permit 02- 23. LC Properties Hunting Club (Hunt Club) is currently under construction as a permitted Mobile Home Park through the State Department of Housing and Community Development (FAC ID 04-11282MP). The project is approximately 95% complete with all grading, and utility systems constructed. In an effort to have quality and uniform dwelling units, the owners would like to construct one caretaker's unit and seven small, two bedroom cottages in lieu of placing eight double -wide manufactured homes or mobile trailers. (See Exhibit A, Proposed Cottages) These permanent, wood frame buildings would be placed within the mobile home park lots as originally configured and approved under UP 02-23 and through the State. (See Exhibit B, Site Plan) On March 30, 2004, we had a "preliminary plan review" with the HCD representative as required prior to submitting plans to the Sacramento HCD office for plan review. The result of that meeting was a referral back to Butte County Development Services for review, inspection and approval of the building plans. (See attached Activity Report) The HCD representative also notes that an amended Government Agency Approval Sheet and Permit to Operate (all State docs) will be required. The approved UP 02-23, Condition of Approval #3 states "The 28 spaces shown on the development plan may accommodate a mobile home, travel trailer or recreation vehicle." We respectfully request that permanent buildings be allowed in addition to the mobile home, travel trailer or recreation vehicle as a "Minor Change" allowed if administratively approved by the DDS. Please note, that #3 further describes the restricted time hunt club facilities can be utilized. Other than the allowed caretaker's unit, all proposed permanent buildings will be occupied only within those restricted times. No year-round operation is requested; The use will be seasonal. C. Properties Hunting Club to three ponds. Up to 28 mobile homes will be occupied one week before to one week after the waterfowl hunting season. The project will be developed in two phases, 16 mobile homes in Phase I and 12 in Phase II. An additional mobile home for year-round occupancy by a caretaker will be installed in Phase I. On 20 December 2002 and 30 June 2003, L. C. Properties provided additional information on the proposed discharge. With the additional information, we find the ROWD to be complete. We will begin the waste discharge requirements (WDRs) process soon: The Regional Board has 120 .days from the date of this letter to either issue individual WDRs or a Notice of Applicability (NOA) for general WDRs. The latest date we anticipate that you will receive WDRs for the facility is at the 16 and 17 October 2003 meeting of the Regional Board. There is also a Regional Board meeting in September. If individual WDRs are to be issued, we will inform you of the date, time, and location of the meeting. Shielded shall mean that the light rays are directed onto the site and the light source, whether bulb or tube, is not visible from an adjacent property. Additional monitoring shall be on an incident basis. State Law requires the reporting of any human remains or artifacts. The 28 spaces shown on the development plan may accommodate a mobile home, travel trailer, or recreational vehicle. Occupancy of any of the above shall be restricted to the time period commencing one (1 ) week before the opening of waterfowl hunting season and ceasing one (1) week after the season closes. 4. The owner or operator of the hunting club shall meet the requirements of the State Department of Housing and Community Development for improvements and operation. Public Works/Land Development 5. Prior to establishing the use, obtain an encroachment permit for all new or existing driveway approaches and construct them to County standards, as specified in the County Improvement Standards. 6. Prior to establishing the use, a plan fora permanent solution to drainage shall be submitted to and approved by the Department of Public Works. The drainage plan shall specify how drainage waters shall be detained on-site and/or conveyed to the nearest natural or publicly maintained drainage channel or facility and shall provide that there shall be no increase in the peak flow runoff to said channel or facility. Prior to establishing the use, establish the 100 year floodplain elevations and the lowest floor elevations for any structure. Show on the site plan map, the elevations (by contours) and the location of an accepted NVGD benchmark and a temporary benchmark on-site. Butte County Fire 8. Building identification and/or addresses shall be installed in conformance with Public Resources Code 4290 and shall be posted at the beginning of construction and maintained continuously thereafter. 9. Provide an all weather access road at least 10 feet wide and having a vertical clearance of 15 feet that will accommodate a 40,000 pound fire apparatus to all structures. Environmental Health 10. Prior to initiating any grading or site improvements, obtain conceptual approval from the Regional Water Quality Control Board in essence stating that Waste Discharge Requirements are likely to be issued for the project. 11. Prior to issuance of any building or construction permits, provide a plan to construct a community sewage collection, treatment, and disposal facility in compliance with the Regional Water Quality Control Board and the Butte County Environmental. Health Division's applicable codes and regulations governing the design, construction, and operation of the facilities. At a minimum, these plans must meet the following standards and criteria:. Comply with all State and local laws regarding the design, placement, and construction of a waste water collection and disposal system. b. The design must be included as an integral part of the grading and site improvement plans subject to approval from both Butte County Environmental Health Division and Public Works Department. The plan must be complete and detailed, showing a continuous flow-through system. This plan shall specify construction detail with appropriate construction notes, materials to be used, and shall show elevations of various gravity fed components in relation to the site plan (commonly called a hydraulic profile cross-section). This plan must be finished and sufficiently detailed with construction specifics that would allow a contractor to install the facilities in accordance with the above referenced criteria. 3 12. Prior to installation of any mobile home, travel trailer, or recreational vehicle, provide Waste Discharge Requirements issued by the Regional Water Quality Control Board. 13. Prior to occupancy of any mobile space or the operation of the community sewage disposal system, establish a suitable entity to insure the operation, maintenance, and repair of the community sewage disposal system. 14. Prior to occupancy of any dwelling unit design and construct a new public water supply system in compliance with the California State Safe Drinking Water Act (codified in the CA Health and Safety Code). 15. Obtain a permit to operate a public water system from the Butte County Division of Environmental Health. 16. All dwelling units and buildings must connect to the community sewer and public water supply. 17. The applicant must also comply with all other applicable State and local statutes, regulations, and ordinances. County Counsel 18. If this Use Permit or any finding, action or condition of this Use Permit is appealed to the Board of Supervisors, the applicant or any other developer/operator other than the applicant agrees to indemnify the County of Butte from liability or loss related to the approval of this project and agrees to sign an indemnification agreement in a form approved by County Counsel before the Board's appeal hearing. Filing fee - We have determined that your facility has a threat -to -water -quality and complexity rating of 3B (the lowest is a 3C). The filing fee associated with a 3B rating is $900. Please provide payment in that amount made out to the State Water Resources Control Board. 2. § 1. 1. 1 _ Volume - Our earlier letter, dated 31 October 2002, said that full design flows (i.e., 300 gallons per day—gpd—for caretaker residence, 4,500 gpd for Phase 1, and 7,200 gpd for Phase 2) should be used when sizing the evaporation pond(s). Since the housing units will not be permanent residences, you may be able to justify lower flow rates in pond sizing calculations. The basis for lowering design flows should be clearly stated, well supported, and expressed in terms of occupancy. Tentative waste discharge requirements would then be written to limit occupancy and/or flow based on provided information. 3. §3.3, Disposal Capacity, and Appendix A. Design Calculations - The pond sizing calculations in Appendix A display an unfamiliarity with how such calculations should be done. The following paragraphs attempt to explain how pond sizing calculations (i.e., water balances) work and -comment on,some of the problems with the current calculations. Inflows include wastewater, precipitation, and I&I (infiltration and inflow of storm water or groundwater into the wastewater collection system). Outflows are evaporation, percolation, and use (wastewater may be removed from the pond system -and t* allowed in waste discharge requirements, for example). C If an existing wastewater pond's geometry, inflows, and outflows are known, its wastewater I receiving,capacity can be determined. If the inflows and outflows of a proposed pond are known, ttitia t: J NAA0 1 its required capacity can be calculated. These kinds of calculations can be conveniently accomplished by_rneansi of a spreadsheet table like the one shown below. � - X81• �)• �1• �1• �1• �1• � The calculations (table) begin in October, just prior to the wet season, with an empty pond. If properly sized, the pond should be empty.again at the end of September in time for the coming wet season. We generally require that the calculations simulate a 100 -year wet season followed by two normal seasons. Under this simulation, the pond should be dry by the end of September in the third year. Such a calculation requires three tables, the first table having 100 -year wet season precipitation values, the other two tables having normal year precipitation values. Many of the cells in the tables contain formulas that depend on values in other table cells. When there is more than one table, the tables themselves are linked by formulas so that the results at the end of one table are carried on to the beginning of the next. In creating formulas and expressing results, it is important to maintain consistency between units, not meaning that only one kind of unit may be used, but that units are correctly converted. Some things to avoid in developing your spreadsheet are having values in either of the volume columns that exceed the capacity of the specified pond (when running a simulation, a pond size must first be assumed), incorrect cell formulas, and non -representative input data. A common mistake is subtracting outflows (e.g., evaporation) from pond volume when the pond is empty. Some of the mentioned inflows and outflows may not apply at the proposed site. If collection system piping is above highest groundwater levels and there are no manholes or other ways for storm water to enter the collection system, I&I should not be a significant issue and the I&I column can be removed from the table. Two other columns can be removed because percolation is assumed to be zero and irrigation is not proposed. The end result is a simpler table containing six columns instead of the original nine (supposing a table like the one above is used). Scott Larrabee - 3 - 10 January 2003 Comments on the Current Pond -sizing Calculations I will comment briefly on some of the deficiencies of the current pond sizing calculations. The calculations include a number of tables showing monthly data. Some tables contain the months June through February; one table'has September through February. As shown in the above example, all months of the year should be included in the calculations because at least one of the inflows or outflows can occur in any given month. The Rational Method (Q=CIA) is used when applying precipitation from the 100 -year, 10 -minute storm event. I have several comments about this: (a) the Rational Method does not apply in any way to a pond lacking a catchment area outside of itself (the Rational Method is typically used to size storm water conveyances at the lowest point of a catchment area); (b) a 100 -year, 10 -minute storm is a design parameter used to determine maximum instantaneous discharge from a catchment area havina.a time of concentration equal to 10 minutes (time of concentration is the longest travel time from the extreme extent of a catchment area to its discharge point); and (c) a wet season (e.g., 100 -year) is the appropriate design parameter when designing terminal storage facilities. In short, the Rational Method and associated. parameters are used to design the flow-through capacity of conveyance structures and result in units of discharge volume per unit time (e.g., cubic feet per second). Water balances, on the other hand, are used to design storage facilities with relatively long retention times and deal in units of volume. The end result of the current calculations,is a pond with a 1.5 -acre surface area (Phase 2) and a one -foot working depth. A one -foot working depth -is. wholly inadequate, as an estimated two feet or more is needed to handle the 100 -year precipitation alone. (i.e. without accounting for wastewater entering the pond). Station information (e.g., name, location) should be cited when providing climatological data. 4. § 5.2.2, Evaporation/Evapotranspiration - This section states, "It should be noted that the estimate of 52 inches/year is considerably less than the annual average pan evaporation of 63.7 inches from Chico." A common conversion factor for Pan A evaporation is 0.7. Applied to this situation, 63.7 inches times 0.7 is equal to 44.6 inches, less than the 52 inches mentioned. Design evaporation rates should reflect literature -based adjustment values for evaporation (e.g., 0.7 for Pan Type A) or, if known, site specific values. 5. Separate pond for caretaker - The report shows the caretaker having a separate pond in one corner of the main pond. This is not advisable because the internal berms would take away from overall pond capacity without providing a comparable benefit. With respect to the pond sizing calculations, peak wastewater flow need only be applied over the period of occupancy as specified in the final Conditional Use Permit. Design wastewater flow the rest of the year (with respect to pond sizing calculations) should be no less than that contributed by the caretaker's residence. 6. p. 8, §2.2, Treatment Capacity - The organic treatment capacity of the wastewater treatment system is not provided because "... the effluent is to be evaporated and not discharged into a water. body." Comment: If the proposed treatment system works as intended, organic loading should not present a problem. However, high organic strength in pond influent can lead to odors and other nuisance conditions. Therefore, organic treatment is important even when not discharging to a surface water. 7. P. 8, §2.3, Disinfection Method - Ultra -violet (UV) radiation will be used to disinfect the wastewater before it is discharged to the ponds. Design calculations are not provided because ".. . the effluent is (sic) evaporated and not discharged into a water body." Comment: Total suspended solids and turbidity can interfere with UV disinfection. If disinfection is required (e.g., to protect groundwater), frequent monitoring to evaluate its effectiveness will also be required (as well as design calculations). 8. Outputs are evaporation, percolation, and the quantity of water that is beneficially used (reclaimed). (Since all of the wastewater at the site is said to evaporate, percolation and reclaimed water use are zero.) The pond sizing calculations in Appendix A do not make use of a water balance, as one would expect, but some sort of evaporation table. While design wastewater flow seems to play a part in the calculations (but it is not clear how), precipitation is not considered or even mentioned. Infiltration and inflow are also missing. As a result, the ponds do not appear to have sufficient capacity. A complete water balance must be submitted. The water balance must be certified by a California Registered Civil Engineer trained and experienced in pond capacity calculations. We recommend that water balances consider a 100 -year wet season followed by two average wet seasons. 10. Pond depth with respect to groundwater and original grade - On Sheet 3 of 5, pond bottoms are shown to be_ about.97.7;feet,elevation: : _: _.. Comment: Because the surrounding area is used for rice farming, pond bottoms inust remain at or above original grade (i.e., grade as it was before the building pad was constructed) to keep groundwater from entering the ponds. This consideration becomes more significant once a redesign of pond capacity shows that working depth will be on the order of five feet (not one -and - a -half feet) plus two feet (not one -foot) of freeboard. Effluent lift stations will almost certainly be necessary. 11. Overflow pipes - Overflow pipes will be provided on each pond. Overflow pipe invert elevations will match the required freeboard elevation. Comment: Overflow pipes are allowed. The following should be provided, however: (a.) A minimum 2 -foot separation -between overflow inverts and the wastewater surface when ponds are full. (b.) A locking valve on each overflow pipe. Waste discharge requirements will prohibit discharge from ponds. 12. Protection of groundwater - Groundwater at the site is very shallow, three to four feet from original grade when measured in August 2002. Based on groundwater information gathered at a nearby location,.the..aquifer appears to: be unconfined to considerable depth (at least 500+ feet)...;., ; Comment: First encountered groundwater is in communication with deeper groundwater where water supply wells are or may be screened. In order to protect beneficial uses (e.g., municipal and domestic supply), the Basin Plan (i.e., Water Quality Control Plan for the Sacramento River Basin and the San Joaquin River Basin) sets limits on the bacteriological quality of groundwater. With respect to leach field systems, the Basin Plan goes even further, prescribing minimum site • Mr. Scott Larrabee 4 31 October 2002 conditions for wastewater disposal. For example: "Depth to anticipated highest level of ground water below the bottom of a leaching trench shall not be less than five feet ... Greater depths are required if soils do not provide adequate filtration." [page 4, Guidelines for Waste Disposal from Land Developments; Basin Plan Appendix, Item 36.] The Basin Plan clearly intends for groundwater to be protected from possible deleterious effects associated with wastewater discharges to land. Arguably the most significant effect has to do with pathogens. A discussion of how the proposed pond system will be adequately protective of groundwater must be provided. The discussion should especially address pathogens and pathogen reduction. 13. Flood hazard - After the construction of a building pad, it appears that the site will be above the 100 -year flood. Comment: Waste discharge requirements will require that wastewater facilities be above the 100 -year flood. 14. Inflow and infiltration - Septic tanks, biofilter tanks, lift stations, piping, etc., may at times be below or partially below the water table. Comment: System components that could become submerged must be designed and constructed to be water tight. Leak tests must be proposed and conducted. 15. P. 16, §4.2, Groundwater, second paragraph - This section states that, based on, groundwater information from a nearby well, groundwater has been recorded to over 107 feet elevation (referenced to mean sea level). Comment: The subject well is on land owned by the Fenn Hunting Club and is designated 20NOIE18L001M by the Department of Water Resources (DWR). The well is screened from 767 to 894 feet below the ground surface. It is our opinion the well is affected, at least in part, by confined groundwater, since groundwater elevations in the well occasionally rise two feet or more above the land surface and are several feet higher than nearby wells. Geologic maps of the Sacramento Valley [DWR Bulletin 118-7] suggest the well is completed in the "Tuscan Unit B," another indicator that confining conditions exist. Data from Well No. 20NO1E18L001M should not be used to predict groundwater elevations at the site. The other wells mentioned in the ROWD appear to reflect unconfined groundwater conditions. 16. PROJECT DESCRIPTION/SITE CHARACTERISTICS: This is an application for a Use Permit to allow the development of a seasonal hunting club which will consist of 28 mobile homes that will remain on the site all year but will be occupied seasonally during waterfowl hunting season - normally late October to late January. The frequency of use by individual members will vary but the mobiles will not be occupied on a full time basis even during hunting season. The applicant is also proposing a caretaker's residence that will be occupied year- round and a shower/laundry room and indoor cleaning station. The site is located in a sparsely populated area which is predominantly used for rice production. The land is level with deep soils with a high clay content. Native vegetation is almost non-existent on the site which is currently used to grow rice. The proposed development would occupy approximately 6.5 acres of land including the area needed for an engineered sewage disposal system that will utilize a pond for treatment. 0 BUTTE COUNTY PLANNING COMMISSION ■ AGENDA REPORT 0 PAGE 1 ■ Club members will primarily hunt the balance of the applicant's property but may, on occasion, hunt other lands in the area. ANALYSIS: The General Plan Land Use designation for the project site is Orchard and Field Crops and the zoning is A-40. The zoning permits as an accessory use seasonal hunting and fishing camps that are designed for recreational vehicles and trailers provided they are removed during the off season. This request differs in that the proposed mobile homes will remain on the site year-round and there will be a permanent bath house and cleaning station. A Use Permit application was made pursuant to the provision in the A-40 zone that allows outdoor recreation facilities on sites of not less than 5 acres. The Orchard and Field Crop land use designation lists hunting related recreation facilities as a secondary use. In order to grant the Use Permit, the Commission must find that the proposed use of the property will not impair the integrity and character of the zone in which the land lies, and that the use would not impair the integrity and character of the zone in which the land lies, and that the use would not be unreasonably incompatible with, or injurious to, surrounding properties or detrimental to the health and general welfare of the persons residing or working in the neighborhood or to the general health, welfare and safety of the residents of the County. Evidence to support this finding is presented as follows. Hunting and hunting clubs are a historic and integral part of the agricultural areas of Butte County. There are dozens of hunting clubs throughout the A-40 and A-160 zones that co -exist without disrupting normal agricultural practices or operations. Hunting, however, is not the issue being reviewed by this permit. The issue at hand is whether it is appropriate to allow a hunting club with residential facilities that will be left in place year-round in a permanent or semi-permanent manner. The proposed mobiles would be used during the waterfowl hunting season which typically runs from mid to late October through January. During this time period, agricultural activities in the area are minimal or non-existent and the club would not represent an incompatible use with agricultural operations. Hunters will most likely come on the weekends, but mid -week hunting is also expected because waterfowl hunting is weather -dependant and hunters are likely to come when weather conditions are favorable. The rest of the year, the mobiles would remain unoccupied with the exception of the caretaker's unit. In this particular instance, the proposed use is not located near any residences or other land uses that would be impacted by the activities proposed. A hunting club that is almost identical to this proposal has operated in an identical manner to this proposal is located approximately 2 miles to the north of the project site. This club has operated and co -existed with adjacent agricultural uses for over 20 years. In reviewing the Goals and Policies of the Agricultural Element, no specific reference is made to hunting activities or hunting clubs in the agricultural areas of the County. Goal 3 states: "Support the management of agricultural lands in an efficient, economical manner with minimal conflict from non-agricultural uses." This goal is followed up with Policy 3.2 stating: "In order to preserve the maximum amount of land for commercial agricultural production and to avoid conflicts, restrict non- agricultural uses in the Zoning Ordinance, including, but not limited to: water ski lakes, riding stables, golf courses, residential subdivisions, and industrial and commercial uses not directly related 0 BUTTE COUNTY PLANNING COMMISSION 0 AGENDA REPORT 0 PAGE 2 0 9 to agriculture on agricultural lands......" Hunting and hunting clubs are not mentioned and because game species are located in the agricultural areas, alternate locations for hunting clubs locations are not feasible. Hunting clubs have a long history of locating in agricultural areas without conflicting with agricultural operations and in many instances help supplement farmer's incomes helping to provide some economic stability to a sometimes unpredictable occupation. The development of the proposed facility would come under the inspection of the State Department of Housing and Community Development and it would be licensed through them. All wastewater generated by the proposed hunting club will be handled by an on-site treatment facility. Due to the high groundwater and relatively poor soils on the area for wastewater disposal, an engineered disposal system would have to be utilized. The proposed treatment system would utilize an on-site pond. This system would have to be designed and installed under permit from the California Regional Water Quality Control Board. The applicant has submitted engineered plans to the State and is awaiting approval of their design. No significant impacts to surface water or ground water would occur. The project will need a small community water system to provide domestic water. The water system will have to be installed under permit from the Butte County Division of Environmental Health in accordance with the California Safe Drinking Water Act. Adequate quantities of groundwater are available in the area to serve the project. CEQA ISSUES: The following issues resulted from the initial study and are discussed below in more detail: potential impacts to aesthetics, conversion of agricultural lands, and cultural resources. Aesthetics Thought not specifically proposed, it is anticipated that the project may have outdoor security lighting which would contribute incrementally to nighttime light pollution. No other significant sources of lighting exist in the immediate vicinity so the introduction of a new light source could be seen as potentially significant. To reduce the impacts from light and glare, it is recommended that low-pressure sodium vapor lighting be installed for all outdoor security lighting. In addition, the fixtures used should be of a type that are shielded to contain direct lighting to the site. Agricultural land conversion The project site is located in an intensive agricultural area and the project site is planted in rice. This development of this hunting club would result in 6.5 acres being taken out of production. This is not seen as a significant impact. The amount of land planted to rice in Butte County varies greatly from year to year. Approximately 86,000 acres of rice was planted in Butte County in 2001 and 98,000 acres in 2000. Given the amount of land planted to rice and the fluctuation of land planted each year, the loss of 6.5 acres is not a significant impact. Cultural resources Archaeological sensitivity for the area is considered to be low as the property is not in proximity to any 0 BUTTE COUNTY PLANNING COMMISSION 0 AGENDA REPORT 0 PAGE 3 ■ natural watercourse. The surface of this property has been extensively disturbed by agricultural operations and no significant prehistoric sites have been found. The potential for site disturbance associated with this project is limited to the development of a level site for the proposed mobile homes and the construction of sanitation facilities for sewage disposal which could include a pond. Based on this information, no additional archaeological reconnaissance is recommended at this time. However, future excavations (as would occur with developing a pond) could reveal prehistoric artifacts. If any cultural resources are revealed, State and Federal law requires that construction activities cease until the find can be evaluated by a qualified professional. ACTIONS FOR CONSIDERATION: Adopt a Mitigated Negative Declaration with the following findings: A. An Initial Study was completed in compliance with the California Environmental Quality Act. Said study identified two potentially significant environmental effects and includes two mitigation measures that would mitigate such effect below significant levels; a Mitigated Negative Declaration is proposed. If any use for which a use permit has been granted is not established within two years of the date of receipt of the countersigned permit by the Permittee, the permit shall become null and void and reapplication and a new permit shall be required to establish the use. 5. Conditions of Approval: Planning Division Exterior lighting for security purposes shall utilize low pressure sodium bulbs and the fixtures shall be shielded to prevent light from being directed off the property of upwards. Shielded shall mean that the light rays are directed onto the site and the light source, whether bulb or tube, is not visible from an adjacent property. Submit to the Department of Development Services the type of exterior lighting fixtures to be used prior to the issuance of the Use Permit. The drainage plan shall specify how drainage waters shall be detained on-site and/or conveyed to the nearest natural or publicly maintained drainage channel or facility and shall provide that there shall be no increase in the peak flow runoff to said channel or facility. 7. Prior to establishing the use, establish the 100 year floodplain elevations and the lowest floor elevations for any structure. Show on the site plan map, the elevations (by contours) and the location of an accepted NVGD benchmark and a temporary benchmark on-site. Butte County Fire 8. Building identification and/or addresses shall be installed in conformance with Public Resources Code 4290 and shall be posted at the beginning of construction and maintained continuously thereafter. 9. Provide an all weather access road at least 10 feet wide and having a vertical clearance of 15 feet that will accommodate a 40,000 pound fire apparatus to all structures. Environmental Health 10. Prior to initiating any grading or site improvements, obtain conceptual approval from the Regional Water Quality Control Board in essence stating that Waste Discharge Requirements are likely to be issued for the project. 11. Prior to issuance of any building or construction permits, provide a plan to construct a community sewage collection, treatment, and disposal facility in compliance with the Regional Water Quality Control Board and the Butte County Environmental Health Division's applicable codes and regulations governing the design, construction, and operation of the facilities. At a minimum, these plans must meet the following standards and criteria: a. Comply with all State and local laws regarding the design, placement, and construction of a waste water collection and disposal system. b. The design must be included as an integral part of the grading and site improvement plans subject to approval from both Butte County Environmental Health Division and Public Works Department. . C. The plan must be complete and detailed, showing a continuous flow-through system. This plan shall specify construction detail with appropriate construction notes, materials to be used, and shall show elevations of various gravity fed components in relation to the site plan (commonly called a hydraulic profile cross-section). Prior to installation of any mobile home, travel trailer, or recreational vehicle, provide Waste Discharge Requirements issued by the Regional Water Quality Control Board. 13. Prior to occupancy of any mobile space or the operation of the community sewage disposal system, establish a suitable entity to insure the operation, maintenance, and repair of the community sewage disposal system. 14. Prior to occupancy of any dwelling unit design and construct a new public water supply system in compliance with the California State Safe Drinking Water Act (codified in the CA Health and Safety Code). 15. Obtain a permit to operate a public water system from the Butte County Division of Environmental Health. 16. All dwelling units and buildings must connect to the community sewer and public water supply. 17. The applicant must also comply with all other applicable State and local statutes, regulations, and ordinances. County Counsel 18. In this case, a brief discussion should identify the following: a) Earlier Analysis Used: Identify and state where they are available for review. b) Impacts Adequately Addressed: Identify which effects from the above checklist were within the scope of and adequately analyzed in an earlier document pursuant to applicable legal standards, and state whether such effects were addressed by mitigation measures based on the earlier analysis. The visual character of the area is dominated by extreme open vistas in all directions due to the level nature of the land and lack of tree cover. Open vistas of the Sierra Nevada Mountains and the Coast Range are available throughout the valley area. This site does not provide a unique vista in this respect. The site is located at least 500 feet away form the nearest public road and will not infringe upon any scenic vista. The mobile homes installed will be approximately 12' to 14' high and will not be represent a significant visual feature. With the existing agricultural and recreational hunting uses in the area, no significant conflicts with the established character or functioning of the surrounding community are anticipated. The project is expected to have outdoor security lighting which would contribute incrementally to nighttime light pollution. No other significant sources of lighting exist in the immediate vicinity so the introduction of a new light source could be seen as potentially significant. To reduce the impacts from light and glare, it is recommended that low-pressure sodium vapor lighting be installed for all outdoor security lighting. In addition, the fixtures used should be of a type that utilizes shielding to contain direct lighting to the site. This project would not affect a scenic vista nor would it have a demonstrable negative aesthetic effect. Mitigation Measure #1: Exterior lighting for security purposes shall utilize low pressure sodium bulbs and the fixtures shall be shielded to prevent light from being directed off the property or upwards. Shielded shall mean that the light rays are directed onto the site and the light source, whether bulb or tube, is not visible from an adjacent property. Submit to the Department of Development Services the type of exterior lighting fixtures to be used prior to the issuance of the Use Permit. Plan Requirements: Submit to the Department of Development Services the type of exterior lighting fixtures to be used prior to the issuance of the Use Permit. Timing: At the time of issuance of the Use Permit. The project site is planted in rice. This project would result in 6.5 acres being converted from agricultural production for use as seasonal hunting club. This is not seen as a significant impact. The amount of land plated to rice varies greatly from year to year in Butte County. Approximately 86,000 acres of rice was planted in Butte County in 2001 and 98,000 acres in 2000. Given the amount of land planted to rice and the fluctuation of land planted each year, the loss of 6.5 acres is not a significant impact The soil on the site has a Soil Conservation Service Classification of III (Butte County GIS soils coverage), which is suited for limited variety of agricultural uses. (Butte County Master Environmental Assessment, Table LU -4). The project site is not subject to a California Land Conservation Agreement ("Williamson Act"). The Butte County General Plan Land Use Diagram designates this site as Orchard and Field Crops (OFC). The provisions of the Agricultural Element of the Butte County General Plan are applicable to this site. The development of the hunting club would not affect the continued agricultural operation on-site as the fields will not be under cultivation during the hunting season and the two uses will not overlap. The Butte County Agricultural Commissioner's office has reviewed the project and does not have any concerns regarding compatibility with adjoining agricultural uses. Mitigation Measure: None required 4.3 AIR QUALITY: Would the proposal: Potentially Less Than Significant Less Than Reviewed Under Significant with Significant Previous Impact Mitigation Impact No Document Incorporated Impact a. Impact Discussion: The project is located within the Sacramento Valley Air District. According to the Butte County Air Quality Management District (BCAQMD), Butte County and all northern Sacramento Valley Air Districts have been designated as "moderate" non -attainment areas for the state standards for ozone (03) and fine particulate matter (PMIo). Currently, Butte County is in attainment for all the federal (less stringent) air quality standards. The site already generates a significant amount of dust from agricultural operations. Vehicle traffic generated by the hunting club would be intermittent and seasonal during the winter months when air quality is generally better due to winds and rain. A dirt road serves as the access to the parcel at 11 Butte County Department of Development Services o Planning Division 13Page 5 o J Pr ' oject Name: Scott Larrabee UP0 -23 11 this time. It is anticipated that this road will not be paved but will be graveled. Since the majority of the vehicle trips over this graveled road will be during the late fall and winter months, when the area is generally wet from rains, the dust generated from these trips will not be significant. In addition the number of trips is not expected to be significant (see discussion for section 4.15). The impact is less than significant. Impact Discussion: The project site is a predominately agricultural area subject to intensive cultivation. The subject property, as well as surrounding lands, are almost exclusively planted to rice. The California Department of Fish and Game operate two game refuges in the vicinity and a variety of wildlife live in or visit the area. The most significant species that use these lands are the Bald Eagle, Swainson's Hawk, Least Tern, Tri -color Blackbird, Greater Sandhill Crane, and Yellow Breasted Chat. The subject property and the area to be developed with the hunting club provides foraging habitat for these and other wildlife species. There are at least 100,000 acres of similar or superior foraging habitat in western Butte County and the conversion of 6+ acres is not seen as significant nor does it represent a significant cumulative loss. No impacts to nesting sites or other site specific impacts would occur as a result of the project as there are no trees for nesting on the property. The associated hunting activities are already occurring throughout the area including the State Game refuges. Federally listed animals in the area include the Bald Eagle, which is proposed for de -listing. The Swainson's Hawk is a State Threatened species as is the Sandhill Crane. (Dept. of Fish and Game ASBI maps). The activities associated with the use of the land for the housing component of a hunting club will not significantly affect any of these species due to the small acreage being converted and the large amount of foraging acreage available. A drainage canal forms the westerly boundary of the property. No significant riparian vegetation is associated with this watercourse. The project would not conflict with any local policies or ordinances protecting biological resources. The proposal would not conflict with the provisions of an adopted Habitat Conservation Plan, Natural Community Conservation Plan, or other approved local, regional, or state habitat conservation plan. Impact Discussion: Cultural resources include prehistoric and historic period archaeological sites; historical features, such as rock walls, water ditches and flumes, and cemeteries; and architectural features. Cultural resources consist of any human -made site, object (i.e., artifact), or feature that defines and illuminates our past. No such structures are present on this site. Archaeological sensitivity for the area is considered to be low as the property is not in proximity to any natural watercourse. The surface of this property has been extensively disturbed by agricultural operations and no significant prehistoric sites have been found. The potential for site disturbance associated with this project is limited to the development of a level site for the proposed mobile homes and the construction of sanitation facilities for sewage disposal which could include a pond. Based on this information, no additional archaeological reconnaissance is recommended at this time. However, future excavations (as would occur with developing a pond) could reveal prehistoric artifacts. If any cultural resources are revealed, State and Federal law requires that construction activities cease until the find can be evaluated by a qualified professional. Existing regulations: California Health and Safety Code § 7050.5, California Penal Code §622 %. Mitigation Measure #2: Include a condition in the Use Permit stating: "Should any archaeological artifacts be discovered during construction or excavation, the Planning Division shall be notified immediately, and all work shall cease until a qualified archaeologist has examined the artifacts and the site and submitted his or her findings to the Planning Division, and recommended clearance to continue. Recommencement of construction shall be upon the approval of the Planning Division." Plan Requirements: The required condition will be included in the Use Permit. Timing: Ongoing throughout the earthwork phase of the development of the site. Monitoring: Monitoring shall be on an incident basis. Impact Discussion: The Seismic Safety Element of the Butte County General Plan indicates that all of Butte County is in Moderate Earthquake Intensity Zone VIII. The site is not within an Alquist-Priolo Earthquake fault zone. The nearest active fault, the Cleveland Hill fault, is located approximately 24 miles to the east of the site. The Butte County GIS Fault Lines theme shows that an inferred fault is located approximately 3 miles to the east of the site. No impacts would be anticipated due to seismic activity in the project area because all new structures placed on the site are required to meet seismic standards of the Uniform Building Code. The intensity of ground shaking at any specific site depends on the characteristics of the earthquake, the distance from the earthquake, and on the local geologic soils and conditions. At present, there is insufficient data to predict accurately the expected ground motions at various locations in Butte County. However, strong seismic ground shaking is closely related to the proximity of active fault lines. Although there is insufficient data to predict these forces, the closest mapped Fault -Rupture Zone is the Cleveland Hills fault zone, which is located approximately 20 miles southeast of the project site. The Cleveland Hills fault line is the only fault line in Butte County that is recognized Butte County Department of Development Services c Planning Division aPage 9 a r I1 • Project Name: Scott Larrabee UP 02-23 under the Alquist-Priolo Special Study Zones Act to pose a threat from fault rupture. Seismic risk - is not limited to faults which have been currently identified. Some earthquakes originate from unknown sources sometimes characterized as "background seismicity" or "floating earthquakes". The Butte County Master Environmental Assessment indicates that it is reasonable to assume that background seismicity could produce earthquakes as large as Richter magnitude (modified Mercalli intensity scale) 6.5 virtually anywhere in Butte County. There is no current evidence that an earthquake larger than magnitude 6.5 would occur at this location. Earthquakes at this magnitude are generally felt by all persons, but damage is generally slight to minor, with fallen chimneys and cracked plaster the most prominent damage. Richter magnitude 6.5 is not subjectively characterized on the intensity scale, but a magnitude 7 is generally characterized by negligible damage, especially in buildings of good design and construction. Considerable damage can occur in poorly built or badly designed structures. The Butte County Seismic Safety Element's Liquefaction Potential Map indicates that the site has a moderate potential for liquefaction. Given the low development potential of the project this is not significant issue. The Subsidence and Landslide Potential Map of the Safety Element of the Butte County General Plan indicates that there is a low potential for landslides in this area. No impact would be anticipated. The Erosion Potential Map of the Safety Element of the Butte County General Plan indicates that the soil erosion potential for the project site is low. The site is almost completely level. Disruption of soils on the site during construction activity is not expected to create significant soil erosion due to the level nature of the site, low rainfall potential and low potential for soil erosion. However, a permit from the California Regional Water Quality Control Board is required for all projects that will result in the disruption of 5 or more acres. This project would meet this threshold and a Construction Activities Storm Water Permit would be required. Obtaining this permit would address water erosion concerns. No impact would be anticipated from instability, landslide, lateral spreading, subsidence, liquefaction or collapse. The Conservation Element's Expansive Soils Map indicates that the project site has a high expansive soil potential. During the building permit process, the Butte County Building Division would assess the expansive soil potential and determine if an engineer's statement and a designed foundation system would be required to accommodate expansive soil properties. No significant impact would be anticipated. Sewage disposal for the proposed use will not utilize the traditional septic tank/leachfield systems due to high groundwater. Sewage disposal will be handled by an engineered system utilizing a pond. The system will be installed under permit from the California Regional Water Quality Control Board. Existing regulation: California Regional Water Quality Control Board Storm Water Pollution Prevention Plan and Waste Discharge Requirements, California building code for seismic regions. Mitigation Measure: None required. The amounts stored will be consistent with typical residential uses and will not pose a significant hazard. No significant use of dangerous or hazardous materials would be associated with this type of development. No impact would be anticipated. The property is not located within the vicinity of an airport, airport land -use plan, private airstrip, or interfere with an adopted emergency response plan or emergency evacuation plan. No impact would be anticipated. The project is located in an area with an unclassified fire hazard designation, indicating it is either in an urbanized area or irrigated area. In this instance the area is irrigated farmland. The project would not expose people or structures to wildland fires because the area is irrigated agriculture. The proposed treatment system would utilize an on-site pond. This system would have to be designed and installed under permit from the California Regional Water Quality Control Board. The applicant has submitted engineered plans to the State and is awaiting approval of their design. No significant impacts to surface water or ground water would occur. Butte County Department of Development Services 13 Planning Division oPage 12 13 Project Name: Scott Larrabee UP 0.3 Domestic water supply for the future dwelling on the site would be obtained from a private well. Groundwater is plentiful in the area and can be found at relatively shallow levels. The incremental impact on groundwater withdrawal is below a threshold of significance and would be offset by a reduction in groundwater use for irrigation purposes for the land being taken out of production. No impacts to ground water supplies in the project area would occur. This project would ultimately result in the creation of new impervious surfaces such as houses, accessory structures, and parking area. This impact would not be significant as the amount of impervious surfaces would be less than 1% of the site. A significant increase in surface water runoff is not expected. The project site is located within a 100 -year flood zone as per Federal Emergency Management Agency's Flood Insurance Rate Map 06007C -0730C, dated June 8, 1998. All improvements will have to meet the requirements for building in a flood plain contained in Chapter 26 of the Butte County Code. The property is not located in an area prone to seiche, tsunami, or mudflow. No impact shall be incurred with respect to these natural hazards. Existing regulation: Butte County Code Chapter 26 Article IV - Flood Hazard Prevention, Mitigation Measure: None required. 4.9 LAND USE: Would the proposal: Potentially Less Than Significant Less Than Reviewed Under Significant with Significant Previous Impact Mitigation Impact No Document Incorporated Impact a. This project requires a Use Permit because the proposed mobile homes would remain on site all year. The site is zoned A-40 and is designated by the Land Use Element Map of the Butte County General Plan as Orchard and Field Crops. As there will be an on-site caretaker for security purposes and the site is removed from concentrations of people, the need for sheriff services should be minimal. The project will not result in any increased demand for school facilities or services due the transient and recreational character of the use. During peak -hour, a campground generates approximately 0.39 trips per camp space. This would equate to approximately 11 peak -hour vehicle trips for a 28 space campground/RV park. This insignificant amount of vehicle trips combined with the fact that the area roads convey very little traffic and are at a Level of Service "C" result in a conclusion that the project will not have a significant traffic impact. Based on the limited operating characteristics that only one person will occupy each spot for the season and the limited hunting season, the proposed hunting club will generate less vehicle trips than a commercial campground/RV park. The hunting club will have access to a publicly maintained road via a 60 foot wide easement for roadway purposes. An encroachment permit for the new roadway approach must be obtained from the Butte County Public Works Department prior to construction of the driveway. Adequate parking is shown and will be available within the improved area of the hunting club to accommodate at least two vehicles per mobile home. Therefore, the project would present no impact relative to insufficient parking capacity. Sewage disposal will be provided by a local engineered system that will serve only the hunting club. ill dwellings on the project site would be handled by individual on-site septic systems. The Butte County Division of Environmental Health has reviewed the project and does not have any concern over sewage disposal capacity or the ability of the project to meet County sewage disposal standards. The project would not have an impact on any wastewater treatment facilities. Domestic water supply for the new dwellings on the site would be obtained from individual on-site wells. The project would not have an impact on any water treatment facilities. No additional storm water facilities would be necessary as a result of this project due to the extremely low density of the project and minimal amount of new impervious surfaces. The project would increase the stream of waste being deposited in the Neal Road Landfill by a minor amount. According to the Butte County Public Works Department, the Neal Road Landfill is expected to reach maximum holding capacity by the year 2018. The project would not have a significant impact on solid waste disposal. No impact would occur with respect to federal, state, and local statutes and regulations related to solid waste. Shielded shall mean that the light rays are directed onto the site and the light source, whether bulb or tube, is not visible from an adjacent property. Submit to the Department of Development Services the type of exterior lighting fixtures to be used prior to the issuance of the Use Permit. SEWAGE DISPOSAL AREAS The applicant has proposed a development that will require an on-site community sewage disposal system and a public water system. The environmental conditions at the site (high groundwater due to agricultural flood irrigation) preclude installing a commuiuty sewage disposal system under county standards (Sewage Code). The applicant's engineer, Feeney Engineering, has stated that they are aware of the site limitations, and are prepared to propose an engineered sewage disposal system to mitigate the problems at the site. Such a mitigation will require the involvement of the Regional Water Quality Control Board (RWQCB) and most likely a Report of Waste Discharge, or even a National Pollutant Discharge Elimination system (NPDES) permit. Therefore, give the aforementioned situation, this office recommends the following conditions for the Use Permit: 1. Prior to initiating any grading or site improvements, obtain conceptual approval from the RWQCB in essence stating that Waste Discharge Requirements (WDR's) are likely to be issued for the project. 2. Prior to issuance of any building or construction permits, provide a plan to construct a community sewage collection treatment and disposal facility in compliance with RWQCB and Butte County Environmental Health Division applicable codes and regulations governing the design, construction and operation of the facilities. At a minimum, these plans must meet the following standards and criteria: a. Comply with all State and local laws regarding the design, placement and construction of a waste water collection and disposal system; b. Design must be included as an integral part of the grading and site improvement plans subject to approval by both Butte County Environmental Health Division and Public Works Department; C. Plan must be complete and detailed, showing a continuous flow -throw system. This plan shall specify construction detail with appropriate construction notes, materials to be used, and show elevations of various gravity -fed components in relation to site plan (commonly called a hydraulic profile cross-section. This plan must be finished and detailed sufficiently with construction specifics that would allow a contractor to 4 install the facilities in accordance with the above referenced criteria. 3. Prior to the issuance of any building permit, provide Waste Discharge Requirements issued by the RWQCB. 4. Prior to occupancy of any dwelling unit or operation of the community sewage disposal system, provide a Homeowner's Association or other local entity acceptable to the RWQCB adequate to insure the operation, maintenance or repair of the community sewage disposal system. 5. All dwelling units and buildings must connect to community sewer and public water system. The mobile home park is considered "seasonal" because the park is to be occupied only during hunting season, from September to February. The land's current and previous uses include agriculture (rice) and a hunting ground for water fowl, pheasant, etc. The surrounding land has also historically been used for agriculture (rice) and as hunting grounds. There is an existing hunting park located nearby that is similar to the one proposed and a wildlife preserves located a few miles to the north and the south west of the site. The rice fields, canals and sloughs generally provide habitat for a wide range of wildlife. In the sluggish sloughs and canals water is slightly warmer, richer in nutrients, and more conducive to plant growth. Waterlihies and other vegetation may shelter a number of amphibians (salamanders and very small frogs), reptiles (mud turtles and snappers). Other plant life may include Baldcypress, Sycamore, Willow Oak, Black and other willows, Black and other tupelos, Yellow pondlily, and pondweed (to name a few). Muskrat, raccoon, Heron, Wood Duck, hawks, pheasant, quail, geese and vultures may also be seen in this type of environment at various time of the year. The property is located east of 7 Mile Lane and north of the Western Canal. It is zoned A-40. The APN is 038-110-016. Part of the property is located in the flood plain as shown on FMM panel map number 06007CO710 C. The proposed location of the seasonal mobile home park is a small section of the 171.57 acre parcel, north of the Western Canal and east of an unnamed slough. The actual park facilities, including buildings, roads, parking, recreation areas and all utilities require approximately 6.5 acres, or, 3.8 percent, of the whole parcel. The majority of the mobiles will be owned by the Hunting Park's clients. There is an additional space for a caretaker's mobile home (24' x 60' pads).
