APN 030-200-094 (MM) (UP 03-03) Mr. Michelena gave a brief summary of the project. The hearing was opened to the public No one was present to speak on this item. The hearing was closed to the public. It was moved by Commissioner Evans, seconded by Commissioner Leland, and unanimously carried to approve the Use Permit, UP 03-03, for Mary Ellen Miller subject to the findings and conditions listed below: Find that the application is Categorically Exempt from environmental review under Section 15303(a), as defined by CEQA. II. Approve the Use Permit for Mary Ellen Miller for conversion of a temporary mobile home to a permanent second dwelling, UP 03-03, on APN 030-200-094, based on the following findings and the conditions found in Exhibit "A": A. The location, size, design, and operating characteristics of the proposed use will be compatible with, and will, not adversely affect, or be materially detrimental to adjacent uses, residents, buildings, structures, or natural resources, with consideration given to: Harmony in scale, bulk, coverage, and density: The project is in harmony with scale, bulk, coverage, and density because the permanent second dwelling will not create a need for any new structures or any major alterations to the existing structure. 2. The availability of public facilities, services, and utilities: The conversion of the temporary use to a permanent will not create a need for new public facilities, services, and utilities because water, telephone, gas, and electrical services already extend to the project parcel. The project site is provided with municipal water and existing sewer facilities. 3. The harmful effect, if any, upon desirable neighborhood character: The proposed use would not have deleterious impacts on the surrounding neighborhood character due to the wide range of parcel sizes and condition of existing residences. The generation of traffic and the capacity and . physical character of surrounding streets: The proposed conversion of the temporary mobile home to a permanent second dwelling will not significantly increase vehicle traffic in the area. Based on the Trip Generation Manual of the Institute of Traffic Engineers for a single family residential use in urban areas, an increase of 10 vehicle trips/day per for the permanent second dwelling is possible. 5. The suitability of the site for the type and intensity of use or development which is proposed: The site is suited for the project with the respect to the zoning (Agricultural Residential) and Butte County General Plan designation (Low Density Residential) which allow for up to six dwelling units per acre. The Use Permit for the permanent second dwelling would create a density of 1.4 dwelling units per acre. 6. Any other relevant impact of the proposed use: The Planning Division has circulated the proposed permanent second dwelling application to County Agencies and other interested parties and has received no evidence that the use, with appropriate conditions, would cause, any other relevant impact. B. The proposed location, size, design, and operating characteristics of the proposed use and the conditions under which it would be operated or maintained will not be detrimental to the public health, safety, or welfare, or injurious to properties or improvements in the vicinity. Conditions of Approval: Planning Division: 1. Development fees for the proposed residential conversion shall be paid prior to the issuance of the Use Permit: The fees shall be those in effect at time of application and shall include, but not be limited to, School Fees, Park and Recreation District fees, Water and Sewer Service Fees, Permit and Plan Check Fees, and Fire Protection Fees. 2. The Facility may not encroach into, under, over, above, or upon any public street in the unincorporated area of the County in the absence of a valid encroachment permit from the County. 3. Applicant must also comply, with all other applicable State and local statutes, ordinances, and regulations. California Department of Forestry 5. The site is generally level. Ruddy Creek flows from north to south, east of the project site. The site has approximately 0.7 acres located in the southeast portion of the parcel within the 100 -year flood zone. The proposed permanent second dwelling would not be in the 100 -year flood zone. The site is located approximately 0.68 of a mile northeast of the Oroville Municipal Airport and is within the aircraft Compatibility Zone C. Compatibility Zone C is defined as the area commonly overflown by aircraft at an altitude of 1,000 feet or less above ground level. Included are locations beneath the traffic pattern and pattern entry points. Zone C also has restrictions regarding use and maximum densities/intensities. The proposed use is permitted in Zone C. Density requirements are less than 0.2 or more than 4 dwelling units per acre. ANALYSIS: This Use Permit would allow a temporary mobile home to be converted into permanent second dwelling on the project site. The project is consistent witli the A -R zone which allows for multiple residences with a Use Permit and is consistent with the Butte County General Plan Low Density Residential designation which allows for up to six (6) units per acre with sewer service. The conversion into a permanent second dwelling will not present a compatibility concern with the surrounding area in that parcel sizes and dwelling characteristics are a mix of older smaller homes, newer style homes, and mobile homes located on lots ranging in size between 7,000 sq. ft. and 21 acres and in various degrees of upkeep. The project site is located in an area zoned A -R for agricultural residential use on parcels of 6,500 square feet or more in size. The proposal would establish a permanent second dwelling of 960 sq. ft. and be detached from the main dwelling unit, in an Agricultural Residential zone. This use is permitted by a Use Permit under Section 24- 95(c)(1) which allows for duplex dwellings, multiple residences and multi -family dwellings subject to the density allowed by the General Plan. The Airport Land Use Commission has determined the existing dwelling is considered an "existing land use" and is not subject to ALUC review or provisions. The Butte County Agriculture Commission, Department of Public Works, and Department of Environmental Health, as well as the Theramalito Irrigation District have no comments. As a part of the Use Permit request, the applicant is required to present information, including plans or other information that is substantial enough to enable decision makers to make an informed decision regarding the compatibility of the proposed project with existing zoning, General Plan designation, and surrounding properties.
