The property is located at the west end of Dulcinea Drive, at 3699 Dulcinea Drive, west of Clark Road, Butte Valley area. APN 041-100-014 (SB) (UP 03-07) Mr. Betts gave a brief summary of the hearing and showed slides of the area. He added a finding under II, H. "The project meets the 5 conditionally consistent development criteria of the Agricultural Residential General Plan designation." Chairman Lambert questioned if the applicant would be able to comply with Condition 9 for the road to accommodate a 40,000 pound fire apparatus if a bridge is built? Mr. Betts said when the applicant comes in for a building permit, the building permit is reviewed by the Fire Department and the Fire Warden will put a note on the permit saying that the road must meet this condition. The hearing was opened to the public. Mr. Hubbell said he had no problems with the conditions. He said he is putting in two culverts across the creek. He said the second dwelling will have a separate well. Cindy Caswell said she is concerned for the future and that this would set a precedent. She said if the parcel is split with a home on each parcel, then those parcels will be allowed to have a second dwelling when the law changes July 1, 2003. Mr. Betts said the "U" zone will not allow this parcel to be divided further without an application for a rezone. There was a brief discussion regarding the potential of splitting surrounding properties and setting a precedent by approving this application. Mr. Wannenmacher explained the State Law effective July 1, 2003. He said it will no longer be a discretionary act for someone to get a second unit on their parcel. He said the law talks about residential zones. He said as of July 1, 2003, the act will be ministerial. He said the County still has the ability to have its own regulations and restrictions by passing an Ordinance which is in the Zoning Code. He said if there was no Ordinance, the County would have to follow the State rules. Commissioner Leland asked about the types of situations that are not covered by the zoning, for example, the County does not allow a ministerial approval of second units in agricultural areas. Mr. Wannenmacher said that the way he reads the law for July I", the law is talking about residential zones. He said the Zoning Code lists those zones that are residential. He explained if there was not an Ordinance that applied to zones listed as residential, then the owner could get a second dwelling ministerial permit under the State's standards in those zones. He noted that the County does have an ordinance that applies to the residential zones. ■ BUTTE COUNTY PLANNING COMMISSION ■ MINUTES ■ MARCH 27, 2003 ■ PAGE I ■ Chairman Lambert asked Mr. Wannenmacher if the Ordinance specifically disallowed second dwelling units in the agricultural zones? Mr. Wannenmacher said the Ordinance states that wherever second units are permitted in,a particular zone, these are the standards that apply. Section 24-280 sets out the standards that apply to second dwelling units. Commissioner Leland said that there will always be a chance that a Commission or Board will approve more density in the future. The hearing was closed. Commissioner Evans asked Counsel if the hearing before them was submitted after July 1, 2003, would the application be necessary. Mr. Wannenmacher said the application would not need to be before the Commission, that it could be done ministerially. Commissioner Nelson said there is a "U" zone with a 20 acre minimum and this parcel is 10 acres. Mr. Wannenmacher said that Section 24-280 stated for non -urban areas there needs to be a certain size minimum to allow for second dwellings. He said after July 1, 2003, there would no longer be any discretion in granting the permit and the permits would not need to come to the Commission. He said the "U" zone allows for second units in two ways, under the Use Permit and under the Minor Use Permit process. He said the Minor Use Permit specifically references the Ordinance Section 24-280, the Use Permit does not. He said the determination was that this process is not falling under Section 24-280 because this application is under the Use Permit process. It was moved by Commissioner Evans, seconded by Commissioner Leland, and unanimously carried to approve the Use Permit for Stan and Nancy Hubbell subject to the findings and conditions listed below adding a finding II, H. to state "The project meets the 5 conditionally consistent development criteria of the Agricultural Residential General Plan designation." I. Find that the application is Categorically Exempt from environmental review under Section 15303(a), as defined by CEQA. Il. Approve the Use Permit for Stan and Nancy Hubbell for a permanent second dwelling, UP 03-07, on APN 041-100-014, subject to the following findings and the conditions found in Exhibit "A": A. The proposed second dwelling unit will not create a need for new public facilities, services, and utilities because telephone and electrical services already extend to the project parcel. B. The proposed use would not have deleterious -impacts on the surrounding neighborhood character because the proposed second dwelling unit would be similar to the other dwellings in the project area. The project would not have an impact on agricultural uses in the project area. C. The proposed second dwelling will not significantly increase vehicle traffic in the area. Due to the rural location of the project site, the project is expected to only generate two to four vehicle trips per day. D. The site is suited for the project with the respect to the Butte County General Plan designation (Agricultural Residential), which allows for a minimum parcel size of I acre. E. The Planning Division has circulated the proposed permanent second dwelling application to County and State Agencies and has received no evidence that the use, with appropriate conditions, would cause any other relevant impact. F. The project does not require the removal of any trees or riparian vegetation. The project will not impact any vernal pools. G. The proposed location, size, design, and operating characteristics of the proposed use and the conditions under which it would be operated or maintained will not be detrimental to the public health, safety, or welfare, or injurious to properties or improvements in the vicinity. H. The project meets the five conditionally consistent development criteria of the Agricultural Residential General Plan designation. Conditions of Approval: Planning Division: I. Prior to issuance of a building permit and/or prior to any construction activity including, but limited to, such activities as grading, road construction, and soil excavation, obtain a Streambed Alteration Permit from the California Department of Fish and Game. Provide a copy of the approved Streambed Alteration Permit to the Planning Division and the Building Division. If the California Department of Fish and Game determines that a Streambed Alteration Permit is not required, the applicant shall provide documentation from that agency stating such to the Planning Division prior to issuance of the building permit. 2. Should soil disturbance activities reveal the presence of cultural resources (i.e., artifact concentrations, including arrowheads and other stone tools or chipping debris, cans, glass, etc.; structural remains; human skeletal remains), work within 50 feet of 'the find shall cease immediately until a qualified professional archaeologist can be consulted to evaluate the remains and implement appropriate mitigation procedures. Recommencement of development activities shall not occur until clearance is provided by the Butte County Department of Development Services. Should human skeletal remains be encountered, State law requires immediate notification of the County Coroner. Should the County Coroner determine that such remains are in an archaeological context, the Native American Heritage Commission in Sacramento shall be notified immediately, pursuant to State law, to arrange for Native American participation in ■ BUTTE COUNTY PLANNING COMMISSION ■ MINUTES ■ MARCH 27, 2003 ■ PAGE 3 ■ determining the disposition of such remains. 3. The Facility may not encroach into, under, over, above, or upon any public street in the unincorporated area of the County in the absence of a valid encroachment permit from the County. 4. Prior to issuance of the Use Permit, pay any outstanding project -related processing fees and/or Department of Fish and Game fees. 5. Applicant must also comply with all other applicable State and local statutes, ordinances, and regulations. California Department of Forestry 6. Construction, installation or development of structures or facilities on the parcels/lots shall comply with the latest California Fire Safe Regulations, (Public Resources Code 4290), and all other applicable State and County codes, ordinances and regulations in effect at the time of application for improvement permits. 7. All driveways 16% or greater in slope shall be paved. 8. Building identification and/or addresses shall be installed in conformance with Public Resources Code 4290 and shall be posted at the beginning of building construction and maintained continuously thereafter. 9. Provide an all weather access of at least 10 feet wide and with a vertical clearance of 15 feet that will accommodate a 40,000 pound fire apparatus to all structures. 10. In lieu of a pressurized water system or water storage tank, payment of $200.00 into the Battalion 3 water tender fund is required prior to the issuance of a building permit. Building Division 11. Development fees for the proposed second dwelling unit shall be paid prior to the issuance of building permits. The fees shall be those in effect at time of application and shall include, but not be limited to, School Fees, Park and Recreation District fees, Water and Sewer Service Fees, Permit and Plan Check Fees, and Fire Protection Fees. 12. Building Permits Required. Prepare 4 sets of construction plans and make an application for permit. Construction shall comply with federal, state, and local regulations. Plans shall be prepared, sealed and signed by a California Licensed Architect or Registered Engineer for non- residential buildings and certain residential buildings. Public Works 13. Prior to the issuance of building permits obtain encroachment permit for all new or existing driveway approaches and construct them to County standards, as specified in County ■ BUTTE COUNTY PLANNING COMMISSION ■ MINUTES ■ MARCH 27, 2003 ■ PAGE 4 ■ Improvement Standards. ` County Counsel 14. Upon application, and for good cause by the Permittee, at a public hearing pursuant to Section 24-4,5.25 above; the .Planning Commission tray extend„any time limitation previously made apart of any condition to a Use Permit. 5. Any alleged material misrepresentation shall constitute grounds for the Director of Development Services to commence a revocation hearing, and, if proven to exist, shall constitute sufficient grounds to revoke a Permit. Conditions of Approval: Planning Division: 1. Prior to issuance of a building permit and/or prior to any construction activity including, but limited to, such activities as grading, road construction, and soil excavation, obtain a Streambed Alteration Permit from the. California Department of Fish and Game. Provide a copy of the approved Streambed Alteration Permit to the Planning Division and the Building Division. If the California Department of Fish and Game determines that a Streambed Alteration Permit is not required, the applicant shall provide documentation from that agency stating such to the Planning Division prior to issuance of the building permit. 2. Should soil disturbance activities reveal the presence of cultural resources (i.e., artifact concentrations, including arrowheads and other stone tools or chipping debris, cans, glass, etc.; structural remains; human skeletal remains), work within 50 feet of the find shall cease immediately until a qualified professional archaeologist can be consulted to evaluate the remains and implement appropriate mitigation procedures. Recommencement of development activities shall not occur until clearance is provided by the Butte County Department of Development Services. Should human skeletal remains be encountered, State law requires immediate notification of the County Coroner. Should the County Coroner determine that such remains are in an archaeological context, the Native American Heritage Commission in Sacramento shall be notified immediately, pursuant to State law, to arrange for Native American participation in determining the disposition of such remains. 3. The Facility may not encroach into, under, over, above, or upon any public street in the unincorporated area of the County iii the absence of a valid encroachment permit from the County. 4. Prior to issuance of the Use Permit, pay any outstanding project -related processing fees and/or Department of Fish and Game fees. 5. Applicant must also comply with all other applicable State and local statutes, ordinances, and regulations. California Department of Forestry 6. Construction, installation or development of structures or facilities on the parcels/lots shall comply with the latest California Fire Safe Regulations, (Public Resources Code 4290), and all other applicable State and County codes,, ordinances and regulations in effect at the time of application for improvement permits. OJ 7. All driveways 16% or greater in slope shall be paved. 8. Building identification and/or addresses shall be installed in conformance with Public Resources Code 4290 and shall be posted at the beginning of building construction and maintained continuously thereafter. 9.. Provide an all weather access of at least 10 feet wide and with a vertical clearance of 15 feet that will accommodate a 40,000 pound fire apparatus to all structures. 10. In lieu of a pressurized water system or water storage tank, payment of $200.00 into the Battalion 3 water tender fund is required prior to the issuance of a building permit. Building Division 11. Development fees for the proposed second dwelling unit shall be paid prior to the issuance of building permits. The fees shall be those in effect at time of application and shall include, but not be limited to, School Fees, Park and Recreation District fees, Water and Sewer Service Fees, Permit and Plan Check Fees, and Fire Protection Fees. 12. Building Pen -nits Required. Prepare 4 sets of construction plans and make an application for permit. Construction shall comply with federal, state, and local regulations. Plans shall be prepared, sealed and signed by a California Licensed Architect or Registered Engineer for non-residential buildings and certain residential buildings. Public Works 13. Prior to the issuance of building permits obtain encroachment permit for all new or existing driveway approaches and construct them to County standards, as specified in County Improvement Standards. County Counsel 14. If this entire matter or any finding, action or condition of this matter is appealed to the Board of Supervisors, the applicant or any other developer/operator other than the applicant agrees to indemnify the County of Butte from liability or .loss related to the approval of this project and agrees to sign an indemnification agreement in a form approved by County Counsel before the Board's appeal hearing. A small, seasonal creek is located to the west of the existing home site. Vegetation consists of numerous oaks, mostly located to the east of the small creek, and a large open area of grass to the west of the creek. The site is located within a deer herd Designated Development Zone. The project parcel is located at the end of Dulcinea Drive, approximately 0.69 miles from Clark Road. Dulcinea Drive is a private road and is wide enough in most places to allow for two-way vehicle traffic. There are occasional vehicle turnouts along this road. Dulcinea Drive provides access for six parcels, four of which are developed with dwellings. The property is currently zoned U (Unclassified) and the Butte County General Plan designation is Agricultural Residential. Zoning on the parcels to the north, south, and west is Unclassified. Zoning on the parcels to the east is AR -2.5 (Agricultural Residential, 2.5 -acre minimum parcel size). Surrounding parcels range in size from 1.3 to 328.5 acres, with the predominant size being in the 4 to 10 -acre range. Land uses on the surrounding parcels are dwellings at rural densities, horse stables, and some livestock grazing. The site is located approximately 2.1 miles southwest of the Paradise Municipal Airport, but is not within an airport compatibility zone. The project site is not within a 100 -year flood zone and is not subject to a California Land Conservation Act Agreement ("Williamson Act"). ANALYSIS: The proposed second dwelling unit is being requested under section (c)(1) of the Unclassified zoning district (Butte County Code section 24-230), which states that multiple -family dwellings are allowed with a Use Permit, but that second dwelling units do not have to meet the general plan density requirements. Under this section of the zoning code, the project parcel is not required to have double the acreage of the zone in which it lies. The second dwelling unit can be any size and does not need to be attached to the primary unit. Additionally, the owner of the parcel is not required to live in one of the dwellings on the property. Vehicle traffic generated by the residents of the proposed second dwelling unit would be limited given the small size of the dwelling and due to the rural location of the project site. The project is not expected to have a significant impact to vehicle traffic on Dulcinea Drive. A culvert or small bridge would be needed to cross the small, seasonal creek that traverses the project site. An at -grade dirt road already crosses the creek. The project is conditioned to require the applicant obtain a Streambed Alteration Permit from the California Department of Fish and Game if this agency determines one is necessary. There is no riparian vegetation along this creek. The project site is designated by the Butte County General Plan Land Use Element Map as Agricultural Residential. As already noted, second dwelling units located in the Unclassified zoning district are not required to meet the density requirements of the General Plan (Butte County Code section 24-230(c)(1)). However, the project would meet the density requirement of 0 Butte County Planning Commission Agenda Report ■ Page 2 0 • the Agricultural Residential land use designation, which allows a parcel size of as little as 1 acre. Consistent zones in the Agricultural Residential designation are 20 acres or greater in size, while conditionally consistent zones are 1 acre or greater in size. The Unclassified zone is not listed as either a consistent or conditionally consistent zone by the Agricultural Residential designation. The Unclassified zone was created after the Agricultural Residential designation was adopted. None of the land use designations in the General Plan have been revised to reflect the Unclassified zone. The Agricultural Residential designation lists five development criteria for parcels less than 20 acres in size. The five conditional development criteria are listed below, along with a response: 1. Compatible with neighboring agricultural activities. Agricultural uses in the project area consist of scattered livestock grazing. The project is not expected to create any impacts to agricultural activities. The Butte County Agricultural Commissioner's Office stated that the project would not have an impact to agricultural uses. 2. Evidence of adequate water and sewage disposal capacity. Sewage disposal for the proposed second dwelling unit would be handled by a new, on- site septic system. The Butte County Environmental Health Division requires that a sewage disposal permit for a new septic system to serve the proposed second dwelling unit be obtained prior to issuance of a building permit. The Environmental Health Division states that the soil on the site in the area of the proposed second dwelling unit is adequate for a new septic system, although the leachfield area might have to include the fill from the cut that created the level building pad for the proposed second dwelling unit. Domestic water for the proposed second dwelling unit would be obtained from a new on- site well. According to the Environmental Health Division, wells in the project area generally are low producers (2 toy gallons per minute). There may be a minor reduction in ground water supplies in the project area due to the new well on the site. The reduction is not expected to be significant. 3. Availability of adequate fire protection facilities. The nearest fire station is Station 25, which is located approximately 3.5 miles south of the site at Butte College. Station 25 is a volunteer station, but is staffed part-time during the fire season. The nearest full-time fire station is located in Durham, approximately 12 miles from the site. The Butte County Fire Department/CDF did not object to the project, but recommended that water tender fees ($200) must be paid at the time of issuance of a building permit. The water tender fees would help offset the cost of providing fire protection services to the project area. 4. Adequately maintained approved road access with sufficient capacity to service area. ■ Butte County Planning Commission Agenda Report 0 Page 3 ■ The project parcel is located at the end of Dulcinea Drive, approximately 0. 69 miles from Clark Road. Dulcinea Drive is a private road sui faced with gravel, is in good condition, and is generally of a sufficient width to allow for two-way traffic along much of this roadway. There are occasional vehicle turnouts in the narrower sections to allow for safe vehicular circulation. Dulcinea Drive provides access for six parcels, four of which are developed with dwellings. Dwelling units in urban areas generate approximately ten vehicle trips per day. Due to the project site's rural location, the proposed second dwelling unit is expected to generate much less vehicular traffic then would occur in an urban area. Additionally, the small size of the proposed second dwelling unit would limit the number of people residing in this dwelling. No significant vehicle circulation impacts are expected due to the low number of vehicle trips that the proposed second dwelling unit would generate. 5. Reasonable accessibility to commercial. services and schools. The nearest commercial services are located in the Town of Paradise, approximately 6 miles to the north of the site. Driving time from the project site to the Town of Paradise is approximately 15 minutes. Commercial services are located in Chico (20 minute drive) and Oroville (also a 20 minute drive). The project site is located within the Durham Unified School District, and K-12 schools are located in Durham, approximately 12 miles from the project site. Based upon the above responses, the project appears to meet the conditional development criteria found in the Agricultural Residential General Plan land use designation. It should be noted that the conditional development criteria are very subjective and are open to interpretation. As a part of the Use Permit request, the applicant is required to present information, including plans or other information that is substantial enough to enable decision makers to make an informed decision regarding the compatibility of the proposed project with existing zoning, General Plan designation, and surrounding properties. The following finding is necessary for the Planning Commission to grant a Use Permit: "the proposed uses of property will not impair the integrity and character of the zone in which the land lies, and that the use would not be unreasonably incompatible with, or injurious to, surrounding properties or detrimental to the health and general welfare of the persons residing or working in the neighborhood or the general health, welfare, and safety of the residents of the county" (Butte County Code, Section 24-45.10). Implementation of Project Conditions imposed by the Planning Commission will ensure compliance with all land use plans and policies and that the proposed project would not impair the health, welfare, or safety of Butte County residents. The Butte County Fire Department/CDF does not object to the proposed second dwelling unit, but recommended several conditions of project approval. One condition requires that the project meet the requirement of Public Resources Code 4290, which has standards for addressing, driveways, and vegetation clearance. The Fire Department/CDF requires a payment of $200.00 ■ Butte County Planning Commission Agenda Report ■ Page 4 ■ into the Battalion 3 water tender fund to help offset the cost of providing fire protection services in the project area. Environmental Review: This application for a Use Permit to allow a permanent second dwelling is determined to be Categorically Exempt from environmental review under Section 15303 — New Construction or Conversion of Small Structures. Class 3 consists of construction and location of limited numbers of new, small facilities or structures; installation of small new equipment and facilities in small structures; and the conversion of existing small structures from one use to another where only minor modifications are made in the exterior of the structure. The numbers of structures described in this section are the maximum allowable on any legal parcel. Examples of this exemption include, but are not limited to: One single-family residence, or a second dwelling unit in a residential zone. In urbanized areas, up to three single-family residences may be constructed or converted under this exemption. ACTIONS FOR CONSIDERATION Staff recommends that the Planning Commission take the following actions: I. Find that the application is Categorically Exempt from environmental review under Section 15303(a), as defined by CEQA. II. Approve the Use Permit for Stan and Nancy Hubbell for a permanent second dwelling, UP 03-07, on APN 041-100-014, subject to the following findings and the conditions found in Exhibit "A": A. The proposed second dwelling unit will not create a need for new public facilities, services, and utilities because telephone and electrical services already extend to the project parcel. B. The proposed use would not have deleterious impacts on the surrounding neighborhood character because the proposed second dwelling unit would be similar to the other dwellings in the project area. The proposed second dwelling unit would not be able to be easily seen from any existing off-site dwelling. The project would not have an impact on agricultural uses in the project area. C. • The proposed second dwelling will not significantly increase vehicle traffic in the area. Due to the rural location of the project site, the project is expected to only generate two to four vehicle trips per day. D. The site is suited for the project with the respect to the Butte County General Plan designation (Agricultural Residential), which allows for a minimum parcel size of 1 acre. ■ Butte County Planning Commission Agenda Report 0 Page 5 0 E. The Planning Division has circulated the proposed permanent second dwelling application to County and State Agencies and has received no evidence that the use, with appropriate conditions, would cause any other relevant impact. F. The project does not require the removal of any trees or riparian vegetation. The project will not impact any vernal pools. B. Pursuant to the provisions of the Zoning Ordinance of the County of Butte and the special conditions set forth below: Stan and Nancy Hubbell are hereby granted a Use Permit for a 1,100 square foot permanent second dwelling on APN 041-100-014. Failure to comply with the conditions specified herein as the basis for approval of application and issuance of Permit constitutes cause for the revocation of said permit in accordance with the procedures set forth in the Butte County Zoning Ordinance, including Butte County Code Sec. 24-45.65. 2. Unless otherwise provided for in a special condition to this Use Permit, all conditions must be completed prior to or concurrently with the establishment of the granted use. The use granted by this permit must be established within two years of the date of approval. 3. Minor changes may be approved administratively by the Directors of Development Services, Environmental Health, or Public Works upon receipt of a substantiated written request by the applicant, or their respective designee. Prior to such approval, verification shall be made by each Department or Division that the modification is consistent with the application, fees paid and environmental determination as conditionally approved. Changes deemed to be major or significant in nature shall require a formal application for amendment. 4. If any use for which a Use Permit has been granted is not established within two years of the receipt of the Permit by the Permittee, the Permit shall become null and void and reapplication pursuant to Section 24-45 (of the Zoning Code) shall be required to establish the use previously granted under the expired Permit unless, 30 days prior to the expiration date, a request for a one year extension is submitted to the Planning Commission together with sufficient evidence that the time limits for processing development permits under federal or state regulations require time limits which exceed one year. Upon application, and for good cause by the Permittee, at a public hearing pursuant to Section 24-45.25 above, the Planning Commission may extend any time limitation previously made a part of any condition to a Use Permit. 0 Butte County Planning Commission Agenda Report 0 Page 7 ■ 5. The terms and conditions of this Permit shall run with the land and shall be binding upon and be to the benefit of, the heirs, legal representatives, successors, and assigns of the Permittee. 6. Neither the applicant, nor any agent nor representative of the applicant shall intentionally omit or misrepresent any material fact in connection with the application. Any alleged material misrepresentation shall constitute grounds for the Director of Development Services to commence a revocation hearing, and, if proven to exist, shall constitute sufficient grounds to revoke a Permit. Conditions of Approval: Planning Division: Prior to issuance of a building permit and/or prior to any construction activity including, but limited to, such activities as grading, road construction, and soil excavation, obtain a Streambed Alteration Permit from the California Department of Fish and Game. Provide a copy of the approved Streambed Alteration Permit to the Planning Division and the Building Division. If the California Department of Fish and Game determines that a Streambed Alteration Permit is not required, the applicant shall provide documentation from that agency stating such to the Planning Division prior to issuance of the building permit. 2. Should soil disturbance activities reveal the presence of cultural resources (i.e., artifact concentrations, including arrowheads and other stone tools or chipping debris, cans, glass, etc.; structural remains; human skeletal remains), work within 50 feet of the find shall cease immediately until a qualified professional archaeologist can be consulted to evaluate the remains and implement appropriate mitigation procedures. Recommencement of development activities shall not occur until clearance is provided by the Butte County Department of Development Services. Should human skeletal remains be encountered, State law requires immediate notification of the County Coroner. Should the County Coroner determine that such remains are in an archaeological context, the Native American Heritage Commission in Sacramento shall be notified immediately, pursuant to State law, to arrange for Native American participation in determining the disposition of such remains. 3. The Facility may not encroach into, under, over, above, or upon any public street in the unincorporated area of the County in the absence of a valid encroachment permit from the County. 4. Prior to issuance of the Use Permit, pay any outstanding project -related processing fees and/or Department of Fish and Game fees. 5. Construction, installation or development of structures or facilities on the parcels/lots shall comply with the latest California Fire Safe Regulations, (Public Resources Code 4290), and all other applicable State and County codes, ordinances and regulations in effect at the time of application for improvement permits. 7. All driveways 16% or greater in slope shall be paved. 8. Building identification and/or addresses shall be installed in conformance with Public Resources Code 4290 and shall be posted at the beginning of building construction and maintained continuously thereafter. 9. Provide an all weather access of at least 10 feet wide and with a vertical clearance of 15 feet that will accommodate a 40,000 pound fire apparatus to all structures. 10. In lieu of a pressurized water system or water storage tank, payment of $200.00 into the Battalion 3 water tender fund is required prior to the issuance of a building permit. Building Division 11. Development fees for the proposed second dwelling unit shall be paid prior to the issuance of building permits. The fees shall be those in effect at time of application and shall include, but not be limited to, School Fees, Park and Recreation District fees, Water and Sewer Service Fees, Permit and Plan Check Fees, and Fire Protection Fees. 12. Building Permits Required. Prepare 4 sets of construction plans and make an application for permit. Construction shall comply with federal, state, and local regulations. Plans shall be prepared, sealed and signed by a California Licensed Architect or Registered Engineer for non-residential buildings and certain residential buildings. Public Works 13. Prior to the issuance of building permits obtain encroachment permit for all new or existing driveway approaches and construct them to County standards, as specified in County Improvement Standards. County Counsel 14. If this entire matter or any finding, action or condition of this matter is appealed to the Board of Supervisors, the applicant or any other developer/operator other than the applicant agrees to indemnify the County of Butte from liability or loss related to the approval of this project and agrees to sign an indemnification agreement in a form approved by County Counsel before the Board's appeal hearing.
