The property is located on the east side of Pacific Heights Road, approximately 3,100 feet north of the intersection with Palermo Road, at 5813 Pacific Heights Road ("Dingerville USA"), southwest of Oroville. APN 025- 240-104 (SB) (UP 03-11) Mr. Betts gave a brief summary of the project and showed some slides of the proposed mobile home site and the mobile home park, the golf course, clubhouse, etc. The hearing was opened to the public.;, Patricia Oswood Solari said approval of this one home site will allow her to finish the park. She said - there will be no,future requests.,_ The hearing was closed. It was moved by Commissioner Evans, seconded by Commissioner Leland, and unanimously carried to approve the Use Permit for Oswood Partnership subject to the findings and conditions listed below. Find that the application is Categorically Exempt from environmental review under Section 15303(a), as defined by CEQA. II. Approve the Use Permit for Oswood Partnership for an expansion of a nonconforming use (a 41 -space mobile home park) by allowing one (1) additional mobile home space for a total of forty-two (42) mobile home spaces, File # UP 03-11, on APN 025-240-104, subject to. the following findings and the conditions found in Exhibit "A": A. The proposed uses of property will not impair the integrity and character of the zone in which the land lies, and that the use would not be unreasonably incompatible with, or injurious to, surrounding properties or detrimental, to the health and general welfare of the persons residing or working in the neighborhood or the general health, welfare, and safety of the residents of the county because: The proposed additional mobile home would not create a significant increase in, light, noise, or vehicle traffic. The proposed additional mobile home will not create a need for new public facilities, services, and utilities because telephone, electrical, domestic water, and sewage disposal services already extend to the proposed mobile home space. ' 3. The site is ideally suited for the project because it is developed with a mobile home park and a recreational vehicle park. The project does not require any grading or the removal of any trees or riparian vegetation. The project will not impact any vernal pools. B. The expansion of the existing nonconforming mobile home park by one additional mobile home space, for a total of forty-two (42) mobile homes on the park, will not conflict with, impair or be detrimental to the uses both permitted and conditional of the zone in which it is located and/or adjoins. Conditions of Approval: Planning Division The project site shall be developed in accordance with the approved project site plan and the conditions contained herein. Said site plan is on file in the Planning Division, is identified as "Attachment C" and date-stamped January 16, 2003, and is incorporated herein by this reference. 2. Prior to installation of the mobile home, obtain all required permits from the California Department of Housing and Community Development. 3. Prior to installation of the mobile home, obtain approval from the California Regional Water Quality Control Board. 4. Prior to issuance of the Use Permit, pay any outstanding project -related processing fees and/or Department of Fish and Game fees. 5. Applicant must also comply with all other applicable State and local statutes, ordinances, and regulations. County Counsel 6. Unless otherwise provided for in a special condition to this Use Permit, all conditions must be completed prior to or concurrently with the establishment of the granted use. The use granted by this permit must be established within two years of the date of approval. 3. Minor changes may be approved administratively by the Directors of Development Services, Environmental Health, or Public Works upon receipt of a substantiated written request by the applicant, or their respective designee. Prior to such approval, verification shall be made by each Department or Division that the modification is consistent with the application, fees paid and environmental determination as conditionally approved. Changes deemed to be major or significant.in nature shall require a formal application for amendment. 4. If any use for which a Use Permit has been granted is not established within two years of the receipt of the Permit by the Permittee, the Permit shall become null arid void and reapplication pursuant to Section 24-45 (of the Zoning Code) shall be required to establish the use previously granted under the expired Permit unless, 30 days prior to the expiration date, a request for a one year extension is submitted to the Planning Commission together with sufficient evidence that the time limits for processing development permits under federal or state regulations require time limits which exceed one year. Upon application, and for good cause by the Permittee, at a public hearing pursuant to Section. 24-45.25 above, the Planning Commission may extend any time limitation previously made a part of any condition to a Use Permit. 5. The terms and conditions of this Permit shall run with the land and shall be binding upon and be to the benefit of the heirs, legal representatives, successors, and assigns of the Permittee. 6. Neither the applicant, nor any agent nor representative of the applicant shall intentionally omit or misrepresent any material fact in connection with the application. Any alleged material misrepresentation shall constitute grounds for the Director of Development Services to commence a revocation hearing, and, if proven to exist, shall constitute sufficient grounds to revoke a Permit. Conditions of Approval: Planning Division The project site shall be developed in accordance with the approved project site plan and the conditions contained herein. Said site plan is on file in the Planning Division, is identified as "Attachment C" and date-stamped January 16, 2003, and is incorporated herein by this reference. 2. Prior to installation of the mobile home, obtain all required permits from the California Department of Housing and Community Development. 3. Prior to installation of the mobile home, obtain approval from the California Regional Water Quality Control Board. 4. Prior to issuance of the Use Permit, pay any outstanding project -related processing fees and/or Department of Fish and Game fees. 5. PROJECT DESCRIPTION: This request is for a Use Permit to allow the expansion of a nonconforming use, which is a 41 -space mobile home park, by adding one additional mobile home space. Approval of this project would allow the mobile home park to have a total of 42 mobile home spaces. The proposed mobile home space has already been cleared and graded level and has electrical, phone, water, and sewer lines extending to it. SITE CHARACTERISTICS: The project site is 34.12 acres in size and is developed with a 34 -space recreational vehicle park, a 41 -space mobile home park, which is restricted to people 55 years of age or older, and a 9 -hole golf course. Sewage disposal for the mobile homes and recreational vehicles on the site is handled by an 0 Butte County Planning Commission Agenda Report 0 Page 1 0 on-site community disposal system operating under Waste Discharge Requirements from the California Regional Water Quality Control Board. Domestic water supply is obtained from an on- site community water system. The property is zoned AR -2'/2 (Agricultural Residential, 2-'/2 acre minimum parcel size). The site has split General Plan land use designations: Agricultural Residential on the western 2/3d of the site and Commercial on the eastern 1/3 rd of the site. Zoning on surrounding parcels is AR -21/2 to the north, south, and west, RC (Resource Conservation) to' the northwest, and M-2 (Heavy Industrial) to the east, across SR 99. Land uses on the surrounding parcels are dwellings at rural densities, livestock grazing, and open space. The site is not within an airport compatibility zone or within a 100 -year flood zone. The project site is not subject to a California Land Conservation Act Agreement ("Williamson Act"). Three Use Permits have been approved for various uses on the site. The three Use Permits are: • Use Permit 74-42 Allowed a 120 -space RV park (only 35 were constructed as of 1988). The property was zoned C-1 at that time. • Use Permit 79-46 Expanded the RV park to allow one additional mobile home space for use as a permanent residence. Two mobile homes were already on the site. A total of three mobile homes were now allowed. The property was zoned C-1 at that time. • Use Permit 89-4 Expanded the RV park to allow a 38 space mobile home park and a 9 -hole golf course. The Use Permit also limited the number of RV spaces to 35. The property was zoned ARMH-2'/z at that time. The Use Permit was for an expansion of a nonconforming use. In 2001, Planning Division staff allowed the applicants to relocate a vacant mobile home space to another location on the project site. The purpose of that substitution was to allow a large mobile home, which would not fit in the existing mobile home space, to be utilized as a home for the applicants. The applicants now wish to place a mobile home in the original space, but still retain their mobile home. ANALYSIS: The existing mobile home park is considered to be a legal, nonconforming use because the AR - 21/2 zone does not allow a mobile home park use (the AR, AR -'/z, and AR -1 zones do allow for a mobile home park use). Butte County Code section 24-35.20 (Change or expansion of nonconforming use) states that a Use Permit is required to expand a nonconforming use. The existing mobile home park exceeds the residential density of the Agricultural Residential General Plan land use designation. Using the total acreage of the project site, and not including the RV spaces, the existing residential density is 1.2 dwellings per acre. With the project, the 0 Butte County Planning Commission Agenda Report 0 Page 2 ■ • residential density would be 1.23 dwellings per acre. If computation of the density utilizes only the area on the project site that is designated as Agricultural Residential (approximately 19 acres), the existing mobile home park has a residential density of 2.1 dwellings per acre and with the project the density would be 2.2 dwellings per acre. The proposed mobile home space is already cleared and graded and is plumbed for domestic water and sewage disposal. Some minor soil excavation may be necessary for the support piers for the proposed mobile home, a driveway, and landscaping. The mobile home space is located adjacent to existing mobile homes and the placement of a mobile home in this space would not change the existing visual aesthetics of the project site or of the neighborhood. The proposed mobile home would add additional vehicle traffic to the roads in the project area. Pacific Heights Road, which is the only access for the project site, is classified as a minor collector roadway and does not have a high amount of vehicle traffic. According to the Trip Generation manual (Institute of Traffic Engineers, 6"' Edition), a dwelling in a mobile home park would generate approximately five vehicle trips per day. Pacific Heights Road has sufficient capacity to handle the minor increase in vehicle traffic generated by the project. The intersection of SR -70 and Welsh Road is not expected to be significantly impacted by this project due to the low number of vehicle trips that would be generated by the proposed mobile home. No Butte County department objected to the project or requested conditions of project approval. Mobile home parks are regulated by the State of California Department of Housing and Community Development, and permits for the proposed mobile home would be obtained from that agency. The California Regional Water Quality Control Board has issued Waste Discharge Requirements for the community sewage disposal system on the project site. Findings for Approval As a part of the Use Permit request, the applicant is required to present information, including plans or other information that is substantial enough to enable decision makers to make an informed decision regarding the compatibility of the proposed project with existing zoning, General Plan designation, and surrounding properties. The following finding is necessary for the Planning Commission to grant a Use Permit: "the proposed uses of property will not impair the integrity and character of the zone in which the land lies, and that the use would not be unreasonably incompatible with, or injurious to, surrounding properties or detrimental to the health and general welfare of the persons residing or working in the neighborhood or the general health, welfare, and safety of the residents of the county" (Butte County Code, Section 24-45.10). Implementation of project conditions imposed by the Planning Commission will ensure compliance with all land use plans and policies and that the proposed project would not impair the health, welfare, or safety of Butte County residents. This project entails the expansion of a nonconforming use, and the Planning Commission must make additional findings to support approval. When considering a Use Permit for an expansion of a nonconforming use, the Planning Commission shall grant the Use Permit when it finds that 0 Butte County Planning Commission Agenda Report ■ Page 3 0 0 • the expansion of such use will not conflict with, impair or be detrimental to the uses both permitted and conditional of the zone in which it is located and/or adjoins. This finding shall be in addition to the findings required by section 24-45.10 of the Butte County zoning ordinance (Butte County Code, Section 24-35.20). - Pursuant to Butte County Code section 24-45.15 the Planning Commission may impose conditions upon the issuance of the Use Permit which are reasonably related to the use of the property for which the Use Permit is requested. In addition the Planning Commission may at its own discretion establish a date for either the termination of the use or review of the Use Permit. Environmental Review: This application for a Use Permit to allow an additional mobile home is determined to be Categorically Exempt from environmental review under Section 15303 — New Construction or Conversion of Small Structures. Class 3 consists of construction and location of limited numbers of new, small facilities or structures; installation of small new equipment and facilities in small structures; and the conversion of existing small structures from one use to another where only minor modifications are made in the exterior of the structure. The numbers of structures described in this section are the maximum allowable on any legal parcel. Examples of this exemption include, but are not limited to: One single-family residence, or a second dwelling unit in a residential zone. In urbanized areas, up to three single-family residences may be constructed . or converted under this exemption. ACTIONS FOR CONSIDERATION Staff recommends that the Planning Commission take the following actions: I. Find that the application is Categorically Exempt from environmental review under Section 15303(a), as defined by CEQA. II. Approve the Use Permit for Oswood Partnership for an expansion of a nonconforming use (a 41 -space mobile home park) by allowing one (1) additional mobile home space for a total of forty-two (42) mobile home spaces, File # UP 03-11, on APN 025-240-104, subject to the following findings and the conditions found in Exhibit "A": A. The proposed uses of property will not impair the integrity and character of the zone in which the land lies, and that the use would not be unreasonably incompatible with, or injurious to, surrounding properties or detrimental to the health and general welfare of the persons residing or working in the neighborhood or the general health, welfare, and safety of the residents of the county because: 1. The proposed additional mobile home will not create a need for new public facilities, services, and utilities because telephone, electrical, domestic water, and sewage disposal services already extend to the proposed mobile home space. 3. The site is ideally suited for the project because it is developed with a mobile home park and a recreational vehicle park. The proposed additional mobile home will not create any aesthetic impacts because it will be located within an existing mobile home park. 4. The Butte County General Plan for the area is Agricultural -Residential, which permits a maximum density of one dwelling unit per acre. The original Use Permit for this project showed a site development plan resulting in approximately 120 recreational vehicle spaces. Discussion at the Planning Commission hearings indicated that only 70 spaces were contemplated at that time. Revised maps received at the later Use Permit hearing (to permit an additional residential mobile home) showed approximately the 35 spaces now on site, with an additional 35 spaces yet to be built. This current project will eliminate the approximately 35 spaces not yet built and convert them to a full-time residential mobile home park. While the Agricultural -Residential designation of the General Plan lists .-utdoor recreational facilities as a secondary use, residential densities are specifically required to less than one dwelling unit per acre. This conversion from an outdoor recreational facility to full- time residential uses does not appear to confo_m to the policies of the Butte Ccllnty General Plan Land Use Element. The existing ARMH-2.5 zone would not allow either the recreational vehicle park or a mobile home park at the proposed densities. 11,12: If this project is approved, it may trigger similar applications in the area. The surrounding area is essentially undeveloped at this time (see also Item 8). 13: This project will generate additional traffic, both from the residential uses proposed (38 -space mobile home park) and from the golf course. While it is difficult to estimate traffic from a use such as a golf course, past expevience has shown that the residential portiun of the project will generate from 7 to 10 trips per day in the area. This translates to a figure of from 266 trips per day to 380 trips per day onto Pacific Heights Road, thence to State Highway 70 either to the north or south. Current traffic counts indic.nte that 80-100 trips per day access Highway 70 via Welsh Road at the Palermo Ruad intersection, and that remaining traffic goes north to either the Ophir Road intersection or the Georgia Pacific Way intersection with Highway 70. Current traffic counts indicate that approximately 600 trips per day access Highway 70 at Ophir Road and approximately 1,250 at Georgia Pacific Way. If most of the traffic generated by this project goes south, it would represent an increase of approximately 300%. If most of the traffic goes to the north, there would be approximately a 50% increase in traffic. Traffic surveys performed for other projects in the area indicate that an interchange will be necessary at the Ophir Road intersection by the year 2005. If a problem develops, it would be the property owner's responsibility to provide fencing or screening along the right of way fence. we recommend the County define a mechanism to require screening when and it becomes a problem." The Butte County Sheriff's Department and the Butte County Fire Department had no comments. ANALYSIS: This project is a request to expand an existing non -conforming recreational vehicle park to allow an additional 38 spaces to be used as permaner.i residence mobilehome park and also to allow a 9 -hole golf course. The property is located south of Oroville, on the west side of Highway 70 and is visible from the Highway. Access is taken from Pacific Heights Road via any of its three intersections with State Highway 70 (at Palermo Road, Ophir Road or Georgia Pacific way). The original Use Permit for the recreational vehicle park showed a site development plan of approximately 120 recreational vehicle spaces. Thirty-five of those spaces were constructed. Another Use Permit several years ago permitted the third residential mobilehome that is currently on-site. Approval of this project will freeze the recreational vehicle park development at 35 spaces. An analysis of densities of the project is awkward because of the proposed mixed uses. The existing recreational vehicle park would not normally be considered a residential use and densities would not be a factor. By eliminating the currently developed area and just using the golf course area and proposed mobilehome park area, a density of 1.93 dwelling units per acre is achieved. The Butte County General Plan for the area is Agricultural -Residential, which permits a maximum density of one dwelling unit per acre. While the Agricultural -Residential designation of the General Plan lists outdoor recreation facilities as a secondary use, residential densities are specifically required to be one dwelling unit per acre or less. The proposed cmnversion from an outdoor recreational facility such as an RV Park to a full time residential use does not appear to conform to the policies of the Butte County General Plan Land Use Element. The existing AR -MH 2.5 zone would not allow either the recreational vehicle park or a mobilehome park at the proposed densities. Approval of this project could mark the beginning of requests for similar projects or densities in the area. The surrounding area is essentially undeveloped at this time. Pacific: Heights Road is a substandard publically maintained road that currently has very light traffic loads. Approval of this project would not create significant traffic hazards on Pacific Heights Road or its intersections of Highway 70, but additional development of the same character throughout the area would have significant effects. The Land Use Element of the Butte County General Plan indicates a commercial frontage along Highway 70. Development of this commercial strip would be appropriate only after frontage roads are constructed in accordance with State Highway Standards. The area designated as commercial on the subject property is proposed to be developed as a golf course. outdoor recreation facilities are not listed as either primaiy,ar secondary uses within the commercial general plan designation unless it were set up as a public or quasi -public use, as in this proposal. While the Palermo Union School District has not commented in writing, telephone conversations with the superintendent indicates that children resulting from full time residential use could Impact the Palermo Union School District, but if the project is conditioned to be ar adult only park then no impacts would occur. The applicant is 1,.oposing an adult park. It is recommended that the Planning Commission adopt a condition restricting the park to adult only occupancy. The environmental documents for this project have been completed and a Negative Declaration with Mitigation Measures attached is recommended should the project be approved. In the general plan, AR lists under intensity of use one single-family dwelling per parcel and other uses regulated to maintain rural character. The ARMH-3 zone is deemed conditionally consistent, and it allowed mobile homes, but this section has been deleted. This property is zoned AR -2 1/2. Do we have to make the development criteria findings to allow the use or an expansion of the use? Under the AR zoning, 24-95, mobile home parks are allowed by use permit "subject to the density of the general plan in the AR, AR -1/2, and AR -1 zones only." Since this property is AR -2 1/2, there would appear to be a problem. If the use here is deemed to be a nonconforming use, the application should be for an expansion of an existing nonconforming use. I am also unclear why the prior use permit, I assume one was issued from the application, did not contemplate one more mobile home site that appears to already have been shown on the map. Was there a reason why the additional mobile home site was not included or approved in the prior UP? Was 40 a limit set in the UP for a particular reason? I assume there will not be additional, separate, applications for more sites in the future (it would certainly be more cost effective to apply for all now). These issues need to be explored to determine what to do with this application.
