This amendment involves modifying Condition #17 by reducing the required road standard from RS -3A (36 foot wide road) to RS -3C (24 foot wide road) Improvement Standard. The property is zoned "U" (Unclassified) and is located approximately 1.5 miles northeast of the intersection of Canyon Shadows Road and SR -32. The Condition Amendment pertains to the section of Humboldt Road between Canyon Shadows Road and SR -32, Chico area APN 11-040-023 (DB) (UP 04-09) Mr. Breedon gave a brief summary of the project. He said the modification request is to change Condition 17. The hearing was opened to the public. Scott Stevens said he was here to answer questions. He said this modification would reduce the road standard on Humboldt Road from a 36 -foot wide road to a 24 -foot wide road. Stu Edell, Land Development, said normal travel lanes for trucks are 12 feet wide and a 24 -foot wide road standard is satisfactory. The hearing was closed. It was moved by Commissioner Evans, seconded by Commissioner Marin, and unanimously carried to approve UP 04-09 for Scott D. Stephens subject to the findings and change in Condition 17 as follows: I: Find that this project is exempt from the provisions of the California Environmental Quality Act under CEQA Guideline Section 15301 (c), as a minor alteration of an existing public facility. The payment of fees pursuant to Fish and Game Code Section 711.4 and 14 CCR 753.5 is not required., - II. Approve a modification of Condition #17 of the Mining Permit for the Deer Creek Rock Mine_ (Min 99-02) reducing the required road standard from an RS -3A standard to an RS -3C standard. S �� 1 J �I TO: File FROM: Deborah DeBrunner SUBJECT: Blasting Complaint UP 04-09/MIN 99-02 DATE: 04/22/05 Rodman Burris, 4788 Zinfandel Drive, Chico — called to complain that blasting at Scott Stephens asphalt had caused damage to his home. Rodman was in his garage when he heard, then felt impacts of blasting. He indicated he was in an open garage when the blast occurred and a glass pitcher fell and broke. Rodman went inside his home and discovered cracks in his walls. Rodman indicated he didn't mind them blasting, but was concerned about damage to his home. He wondered if he was perhaps on a fault line ... Mr. Rodman said he attempted to call the asphalt company (he had seen the "smoke" from the blast) but there was no response. I called the Sheriff's Office to determine if they had been notified of blasting. I will check with our staff to see if we received the required notification. Mr. Burris felt he may be outside the 1 mile perimeter. I contacted Scott Stephens and asked if he had been blasting. He confirmed that they had been blasting. I told him of a "citizen" complaint about damage from the blasting and asked if I could give the citizen his number to talk to him. He was agreeable — he claimed the Sheriff and residents had been notified. Mr. Burris was told that he could complain to the Planning Commission and it might have an impact on the Use Permit/Mining Permit, but it would likely be a civil issue. He was also advised that lie may want to contact his homeowners insurance. When I called Mr. Burris back with Scott Stephens phone number (624-8079), he had already spoken with an attorney. Pursuant to the provisions of the Zoning Ordinance and the Surface Mining Ordinance of the County of Butte and the special conditions set forth below, Scott D. Stephens is hereby granted approval of a Mining Permit for the Deer Creek Rock Mine, to operate a surface rock quarry, rock crusher and screen, on 5 -acres, in accordance with the approved Mining Permit (File No. Min 99-02/UP 04-09) and to reclaim this rock quarry in accordance with the approved Reclamation Plan. Failure to comply with the conditions specified herein as the basis for approval of application and issuance of Permit, constitutes cause for the revocation of said permit in accordance with the procedures set forth in the Butte County Zoning Ordinance, including Butte County Code Sec. 24-45.65. 2. Unless otherwise provided for in a special condition to this use permit, all conditions must be completed prior to or concurrently with the establishment of the granted use. The mine operator shall commence operations within 5 (five) years from the date of issuance of the permit. Should operations not commence within said 5 (five) years the permit shall expire and become void, unless extended by the Planning Commission prior to expiration. 3. Amendments to an approved Mining Permit maybe submitted to the Planning Commission, detailing proposed changes to the original plan. Substantial deviations from the original plan shall not be undertaken until such amendment has been filed with and approved by the Planning Commission. The Planning Commission shall set a public hearing regarding such amendments in the same manner as provided for in Butte County Code Section 13-107. 5. The terms and conditions of this permit shall run with the land and shall be binding upon and be to the benefit of the heirs, legal representatives, successors, and assigns of the Permittee. 6. Prior to use of the site for the proposed use the applicant shall contact the Planning Division for a field inspection to verify that all conditions and ordinance requirements have been met. Conditions of Approval: Planning Division: All Reclamation work shall be in substantial compliance with the approved Reclamation Plan. 2. Annual inspection of the mine shall be conducted in accordance with the Surface Mining and Reclamation Act. All applicable inspection fees shall be paid in accordance with adopted rates. 3. The applicant shall ensure that all ground surfaces left exposed are covered or treated sufficiently to minimize fugitive dust emissions during any reclamation and mine operation activities where dust particles may become airborne. (Mitigation Measure # 1) 4. The applicant shall apply for and receive an authority to construct permit from the Air Quality Management District prior to operations. (Mitigation Measure #2) The approximately 75 native ' blue oaks (Quercus Douglasii) and live oaks (Quercus wizlizenii) removed as a result of mine development within the 5 -acre mine site shall be replaced during reclamation on a two-for=one basis, within the 5 acre area. Oaks shall be planted on 15 foot centers. The plantings shall be monitored for a period of three years. (Mitigation Measure #3) 6. During development activities, should any archaeological artifacts be discovered, the Planning Division shall be notified immediately, and all work shall cease until a qualified archaeologist has examined the artifacts and the site and submitted his or her findings to the Planning Division, and recommended clearance to continue. Re -commencement of construction shall be upon the approval of the Planning Division. (Mitigation Measure #5) 7. Prior to disturbance in the area to be mined, a storm water run-off retention pond shall be developed in accordance with the exhibit maps for this Deer Creek Mine. The retention pond shall be designed to accept storm water run-off to the satisfaction of the Regional Water Quality Control Board. (Mitigation Measure #4) 8. In order to minimize off-site sediment transport and erosion during mine operation and reclamation the following measures shall be followed: The mine floor shall be graded to a slope of 1 percent as per the exhibit map submitted for this Mining Permit. This is intended to create a positive drain at a very slow rate, towards the detention pond. b. All topsoil at the mine site shall be conserved for later use in reclamation. A V -type ditch shall be located above the stockpile to divert drainage away from the stockpile and mining area. The stockpile shall be seeded, in accordance with the re -vegetation plan, and a silt fence shall be installed down grade to prevent erosion. The slope of the stockpile shall not exceed 2:1. (Mitigation Measure #6) 9. The following measures shall be followed during all times of mine operation: a. Upon commencement of normal mining and processing activities at the project site, a follow-up noise level survey shall be conducted to check the accuracy of the modeling effort prepared for this project. If the measured noise levels exceed the recommended project standards of significance, additional noise control measures 2 shall be implemented to reduce the noise levels to a state of compliance. Such measures shall include 1) lining hoppers and chutes with heavy urethane sheets, utilizing urethane screen decks (rather than steel), and 2) suspending acoustic curtains around specific equipment which is found to be the source of the noise level. b. The proposed earthen berm comprised of topsoil/overburden materials shall be erected as proposed. c. Hours of operation, and project related construction activities, including improvements to Canyon Shadows Road, shall be limited to 7:00 a.m. to 5:00 p.m., Monday through Friday, with no crushing or blasting operations allowed on Saturday or Sunday. Only maintenance operations shall be allowed on Saturday or Sunday. d. Use of explosives shall be limited to the hours of 10:00 a.m. and 3:00 p.m., Monday through Friday and limited to two times per year. All explosive detonations performed for this project shall be conducted within the same'one-hour period, No explosives shall be used during the fall or winter periods of the year, unless -a 'qualified survey is conducted which concludes that salmon are not present in Little Chico Creek!" A minimum of 24 hours prior notification of blasting operations shall be made to the Planning Division, Sheriff, and to all residences within one (1) mile of the quarry site. e. The blasting contractor shall design the shots so as not to exceed maximum noise levels of 70 dB at existing residential areas. (Mitigation Measure #10) 10. The following measures regarding the intersection of Humboldt Road and State Route 32 shall be carried out to the satisfaction of the California Department of Transportation, in order to improve site distance and safety of the intersection: a. Trees shall be pruned and brush shall be removed on the south side of SR -32 to clear any obstructions within the 800 -foot intersection sight line. The existing sign located east of the intersection shall also be removed and replaced at a location agreeable to the owners and CalTrans. b. A temporary "Truck Crossing" sign shall be placed on a barricade to advise drivers of the new type of truck traffic accessing the intersection. C. The Centerline of Humboldt Road shall be striped to allow for truck turns at the intersection. (Mitigation Measure #13) 11. A bond or other form of acceptable security shall be established for the purposes of fulfilling the financial assurance requirements of the California Surface Mining and Reclamation Act in the amount of $20,587.30. Said security shall be made payable as follows: "Chair, Butte County Board of Supervisors or the Department of Conservation." All securities shall comply as to form and content with the latest financial assurance guidelines provided by the Department of Conservation. This amount shall be reviewed annually by the County pursuant to the Surface Mining and Reclamation Act. 3 12. Revegetation Plan After final earthwork is completed and plan grade is achieved, the quarry floor will be ripped and the stockpiled topsoil will be reapplied over the extraction area and the cut bank. The site shall be reseeded in mid-October with the following species: • Zorro fescue, @ 3 lbs/acre • Bland brome, @ 10 lbs/acre • Rose clover, @ 10 lbs/acre • Burr clover, @ 5 lbs/acre • Lana vetch, @ 15 lbs/acre Fertilizer will be applied at a rate of 50 lbs./acre at the time of seeding. The entire site will be covered with a straw mulch to enhance propagation and limit erosion. Additionally, blue oaks (Quercus douglasii) removed during mining will be replaced on a two-for-one basis on 15 foot centers. The performance of revegetation shall be monitored over a three-year period. An 80 percent cover of three of the five listed species shall be required. All revegetation activities will be in accordance with the approved reclamation plan. 13. No water shall be drawn from Little Chico Creek for use in the mining operation. 14. Applicant must also comply with all other applicable State and local statutes, ordinances, and regulations. Public Works 15. In order to ensure that truck traffic does not interfere with local traffic flows on Canyon Shadows Road and the surrounding residential subdivisions, all truck traffic accessing the mine site shall be restricted from using Canyon Shadows Road northeast of the mine site. Trucks accessing the mine site shall only utilize that portion of Canyon Shadows Road southwest of the mine site. (Mitigation Measure #9) 16. No truck traffic shall be allowed on Humboldt Road west of Canyon Shadows Road. (Mitigation Measure #12) 17. The applicant shall rebuild Humboldt Road from Canyon Shadows Road to State Route 32 to an RS 3A RS -3C County Improvement Standard, to the satisfaction of the Butte County Department,of Public Works. (This condition is shown as amended by UP 04-09, which amended this condition and no others) 1. 18. Obtain encroachment permit for all new or existing driveway approaches and construct them to County standards, as specified in County Improvement Standards. 19. A permanent solution for drainage shall be submitted to and approved by the Department of Public Works. The drainage plans shall specify how drainage waters shall be detained on- site and or conveyed to the nearest natural or publicly maintained drainage channel or facility 4 and shall provide that there shall be no increase in the peak flow runoff to said channel or facility. Environmental Health Department 20. Prior to installing any fuel at the property, a Hazardous Materials Business Plan shall be submitted to, and approved by, the Butte County Environmental Health Department. Potable water shall be provided at the mine site from an approved source. This may require piping water from the well located approximately 3/8 of a mile from the mine site. In order to reduce the risk of accidental wildland fire, spark arresters are required on all internal combustion engines used during mine operation and reclamation, in accordance with the Butte County Fire Department and Public Resources Code Section 4442. The Condition Amendment pertains to the section of Humboldt Road between Canyon Shadows Road and SR -32. EXECUTIVE SUMMARY: The Deer Creek Mine was approved by the Board of Supervisors on December 11, 2001, subject to 26 conditions of approval. Condition #17 requires the mine operator/applicant to improve 800 (+/-) feet of Humboldt Road from where the mine access road (Canyon Shadows Road) enters Humboldt Road northeasterly to SR -32 to Butte County Improvement Standard Road Section RS -3A. The mine operator/applicant requests to amend Condition #17 from the required RS -3A Improvement Standard to an RS -3C Improvement Standard. This reduction in standard will lessen the required road width by 12 feet, but will not alter the required surfacing, which will remain at 2 - inches of asphalt concrete. ■ BUTTE COUNTY PLANNING COMMISSION ■ AGENDA REPORT ■ PAGE 1 ■ Condition 417 was imposed by the Public Works Department. Public Works was consulted regarding the reduction in the standard and indicates that the proposed reduction to the 24 -foot wide roadway is adequate for the proposed traffic. Staff is therefore recommending that the Planning Commission approve the amendment to Condition # 17, reducing the required road standard for Humboldt Road, as requested by the operator/applicant. PROJECT DESCRIPTION/SITE CHARACTERISTICS: 1. Applicant requests an amendment to the Deer Creek Rock Mining Permit. This amendment involves modifying Condition #17 by reducing the required road standard from an RS -3A to RS -3C Improvement Standard (ATTACHMENT E) 2. The RS -3A Road Standard requires a 36 -foot wide road with 2 -inches of asphalt concrete. 3. The RS -3C Road Standard requires a 24 -foot wide road with 2 -inches of asphalt concrete. 4. Lane width under the RS -3A standard would be 18 feet. 5. Lane width under the RS -3C standard would be 12 feet. 6. Although no traffic data is available on Humboldt Road, the Initial Study indicates that the road does not serve any major residential areas and has been - observed to have an unrestricted flow of traffic. 7. The Initial Study states that Humboldt Road has been observed to be narrow and poorly maintained, and has been used primarily by sightseers and bicyclists. 8. Traffic conditions on Humboldt Road have not substantially changed since approval of this project's Mitigated Negative Declaration on December 11,'2001. 9. A total of 20 truck trips per day (ten entering and ten leaving) would be generated by the Deer Creek Rock Mine, and 90 percent of this traffic would be turning westbound on State Highway 32 towards the City of Chico. The remaining 10 percent would be turning eastbound on Highway 32, towards Forest Ranch. 10. The Deer Creek Rock Mine project includes entitlements for a Mining Permit and Reclamation Plan to operate a surface aggregate mine for the extraction of basalt from a 5 - acre area within a 326 (+/-) acre property. ■ BUTTE COUNTY PLANNING COMMISSION ■ AGENDA REPORT ■ PAGE 2 ■ ANALYSIS 1. The applicant/operator has proposed this amendment due to complications in developing a 36 foot -wide road section at this location. 2. According to the applicant/operator, a considerable amount of grading would be necessary to develop a 36 -foot wide road section due to slopes in the vicinity. 3. The applicant's engineer estimates a 6-7 foot cut, with a corresponding 6-7 foot fill to accommodate the 36 -foot wide road. 4. The applicant's engineer states that utility poles would have to be moved to accommodate the required road section. 5. According to the applicant/operator additional County road right-of-way would have to be acquired to accommodate the 36 -foot wide road. 6. According to the Department of Public Works, the County's road right-of-way at this location consists of a prescriptive right for an area that is occupied by the road and shoulders. 7. The applicant's engineer indicates that the 24 -foot wide road section could be accommodated without acquiring additional right-of-way. 8. The applicant/operator alternatively proposes the 24 -foot wide road section to provide for the width necessary for additional truck traffic posed by the Deer Creek Mine, and thus avoid the additional grading, relocation of utility poles, and acquisition of additional right-of-way. 9. The Department of Public Works reviewed the proposed amendment to Condition #17 and indicates that 24 foot wide roadway proposed would be adequate for the proposed traffic. 10. The Department of Public Works provided the attached Memo (ATTACHMENT F) dated February 23, 2004. 11. The memo indicates that the July 29, 2003, request from the applicant prompted further review of the condition of Humboldt Road. 12. Public Works indicates that although improvements to the roadway structural section are necessary to support the increase in heavy truck traffic, and an increase in road width is necessary to maintain traffic flow, low traffic volumes and lack of residential structures on this section of the roadway provides that an RS -3C standard is appropriate. ■ BUTTE COUNTY PLANNING COMMISSION ■ AGENDA REPORT ■ PAGE 3 • ENVIRONMENTAL REVIEW 1. A Mitigated Negative Declaration was approved by the Board of Supervisors for the Deer Creek Mining Permit,and Reclamation Plan on December 11, 2001. (ATTACHMENT G) 2. The road standard required under Condition #17 was imposed as a condition recommended by the Department of Public Works. Condition #17 is not reflected as a project mitigation measure within the Mitigated Negative Declaration. 3. The road standard applicable to Humboldt Road was not discussed within the Mitigated Negative Declaration and was not considered an environmental impact. The Initial Study/Mitigated Negative Declaration does indicate the following mitigation measure with regard to this portion of Humboldt Road: Mitigation Measure #12 The following measures regarding the intersection of Humboldt Road and State Route 32 shall be carried out to. the satisfaction of the California Department of Transportation, in order to improve site distance and safety of the intersection: a. Trees shall be pruned and brush shall be removed on the south side of SR -32 to clear any obstructions within the 800 -foot intersection sight line. You should indicate why Pub Work believed the existing standard was appropriate at the time it was imposed and wily they believe it is appropriate to modify it now. If the existing standard is required under our improvement standards, you need to follow the exception procedures ender 20-4. In Env Rev section #4, you indicate the mitigation would be modified by allowing the change in standard. Would that be in terms of whether Humboldt Road would no longer be striped for truck turns at the intersection? You need to discuss this modification of the mitigation, i.e.., the extent/impact of the modification will determine if it i3 minor. Then you need to reflect the modification in a new mitigation.
