March and Ron Sullivan. The applicant received a home occupation permit back in March of 2003. Based on our Home Occupation Section (BCC 24-270) if a home occupation becomes objectionable, a use permit shall be required. There were complaints filed by neighbors and Butte County Code Enforcement went out and did not identify any problems. There was a lawsuit between the original complainant and the applicants. Apparently a settlement was reached last week. The application was discussed at the Inter -Departmental Review meeting on 11/19/03. It was determined that the application would need to be reviewed by County Counsel. I have included all relevant information from the building file. In response, we wish to supply you with the following: 1) A print-out of all truck traffic movement in and out of our place since May of 2003 to the present and a statement from the drivers indicating the time spent here and the fact that no truck enters our property is, available and will be supplied to you:. This shows the infrequency of truck deliveries to Oroville Plastics, and also shows that on virtually every occasion the delivery trucks park outside of the subject property in a generous wide spot across the street, walking their deliveries into the property.; 2) Noise. Oroville Plastics is a business that does not create noise that even begins to approach noise levels set by Butte County for residential areas. Statements from visitors to the Sullivan -March property conclude that Mr. Burrows walking his garbage can down the drive -way creates more noise than any operation associated with the Oroville Plastics business; and, 3) According to Mike Vierra, in a letter dated July 2003, there exists an allegation that Oroville Plastics releases noxious orders. Be assured that Oroville Plastics does not release any noxious orders. This has been confirmed through inspections by Butte County officials. Mr. Durling, I believe you are aware of the endless telephone calls to. Butte County from Mr. Burrows. It is my understanding that Darren Jones of the Environmental Health Department has experienced the same problem. Employment and work on Home Occupations shall be limited to members of the family residing on, the premises and shall be conducted entirely within their dwelling and auxiliary buildings, except for agricultural uses. B. On -premises advertising for home occupations shall be limited to one (1) unlighted sign with not more than three (3) square feet of display area, and such sign shall not be located in any required yard. Parcel 8 (Home) Oroville Plastics was founded in 1990 and has evolved to the point where 90% of the revenue is generated by the design of point-of-sale plexiglas stands for companies such as Hewlett Packard, Verifone, Rite Aid -Longs and Taco Bell, etc. Typically a request is received to design a product for a particular unit. The credit/debit/electronic unit is shipped to us. I then design a product using the computer, build a prototype, email a picture to the customer. After several changes a small run of 100-200 units are produced here. If larger quantities are required I send the design to a supplier in Fresno. When it is delivered Susan & I cut, bend, rout, package and ship with instructions to customer. I contract a lot of work locally.
