As a result, the Use Permit is no longer required. Building Department records show that on June 2, 1975, approval was given to move the original building to its present location. The property at that time was zoned A-2 which had a side yard setback of 5 feet. An aerial photograph dated September 25, 1975, shows an agricultural building in the same location as the present building, and within 5 feet of the property line. It was further determined the original building was reconstructed in place after being destroyed by fire on July 28, 1976. Replacement of the building is allowed under Butte County Code Section 25-32.55. What this all means is that the building setback of 5 feet is a legal nonconforming setback. Today's A-40 zone would normally requires a 25 -foot setback. As long as the building remains in its present location and size, the building is permitted to remain 5 feet from the property line. However, our records show that the building was converted from an Agricultural Exempt building to a shop building without a building permit. This means that you must continue processing your building permit for the shop building, and conform the building to the building code requirements as determined by the Building Division of Development Services, if you intend to use it for non-agricultural uses.
