Architects I am providing the following information. Rich would you please review and comment as to the Cities acceptance of the proposed drainage solution so that Eric can move the project forward through the county use permit process. 1. On-site drainage shall be collected and treated in an onsite infiltration trench with an overflow outfall to either the proposed new DI on Godman (see item #2) or the proposed removed and replaced DI on Lassen. Please see the attached PDF file showing the proposed extension of the Lassen Ave storm drain to the North end of our project on Godman. My original belief that there was insufficient cover to extend the storm drain was incorrect. Although pipe slope and cover are minimal the proposed 12" HDPE pipe can be placed at S=0.0015'/ft and maintain a 2 ft/sec cleaning velocity with 1 foot of cover at the north proposed DI. I proposed to place the storm drain 2' off the existing lip of curb and construct a storm drain manhole as a turning structure at Lassen Avenue. City Std. S-17 type "A" alt #1 pavement replacement shall be used to bridge the pipe and repair damaged pavement. 3. (addressed by Chris Cunan) 4. The existing septic system, including tank and leach field shall be abandoned in accordance with the Butte county public health department requirements as described by Doug Fogal. (Chris Cunan can address this issue further if additional information is required). 5. NorthStar Engineering is currently under contract with Tower Energy Group and is preceding with the required lot merger and annexation documents. The Lassen Avenue Sewer project placed a sanitary sewer lateral riser adjacent to the project site to allow for the proposed sewer hookup. Sewer service application and fees shall be processed at the time of construction plan review and approval. Eric if you have additional questions or require further clarification of any of the items holding up the use permit approval please call me. Our comments submitted on the preapplication for this project (provided March 26, 2004 via e-mail from Tom Hayes) apply to this formal application as well. They are, summarized: 1. The site is designated Medium Density Residential on'the City's General Plan. Exisiting uses under 2 acres in size may reflect zoning inconsistent with overall General Plan designation. 'There does not appear to be general plan land use issue with the proposal. 2.• The site is contiguous to City boundaries. 3. Sanitary sewer is available in Lassen Avenue. 4. The proposed site plan may not provide sufficient opportunity for landscaping to meet normal city design standards, especially with regard to parking lot shading. Our recommendation is that the property be annexed to the city, connected to sanitary sewer and developed under the City's jurisdiction to ensure compliance with City standards and policies. DATE: January 7, 2005 Planning staff discussed this proposed project at its January 5, 2005, staff meeting. Staff determined that review.of this proposed project -by the Airport Land Use Commission was not necessary due to the following stated reasons: The proposed market is a permitted use within the applicable C-2 Compatibility Zone. 2. The proposed market use would not exceed the density (people/acre) of the applicable C-2 Compatibility Zone, which is 100. The site is 0.66 acres in size, thus allowing for a density of 66. Even under busy conditions the convenience store would not be expected to exceed this amount because of the high turnover of customers, and limitation of parking to 25 vehicles. Section 2.3.2(a) of the 2000 Butte County Airport Land Use Compatibility Plan allows the ALUC Secretary to approve projects -on behalf of the Commission if a project does not contain characteristics likely to result in inconsistencies with the compatibility criteria set forth in that plan. This proposed project does not contain characteristics that are likely to result in inconsistencies with the compatibility criteria of the "C" Airport Compatibility Zone. Timing: The wall shall be installed prior to development or building permit approval of the market. Monitoring: The Planning Division shall ensure that mitigation is implemented. Building inspectors and/or a planner shall spot check and shall ensure compliance on-site and on building plans. Mitigation Measure # 2: Comply with the following dust control measures at all time during construction: "Dust generated by the development activities shall be kept to a minimum with a goal of retaining dust on the site. Follow the dust control measures listed below: a. During clearing, grading, earth moving, excavation, or transportation of cut or fill materials, water trucks or sprinkler systems are to be used to prevent dust from leaving the site and to create a crust after each day's activities cease. b. During construction, water trucks or sprinkler systems shall be used to keep all areas of vehicle movement damp enough to prevent dust from leaving the site. At a minimum, this would include wetting down such areas in the later morning and after work is completed for the day and whenever wind exceeds 15 miles per hour. C. Soil stockpiled for more than two days shall be covered, kept moist, or treated with soil binders to prevent dust generation." d. The developer shall post a publicly visible sign with the telephone number and person to contact regarding dust complaints. This person shall respond and take corrective action within 24 hours. The telephone number of the BCAQMD shall also be visible to ensure compliance with BCAQMD Rule 200 and 205 (Nuisance and Fugitive Dust Emissions). e. The applicant shall be required to submit a Hazardous Materials Business Plan to the Butte County Environmental Health Department as required by Chapter 6.95 of the California Health and Safety Code. Storage of flammable liquids or hazardous materials beyond that normally associated with a residential use is prohibited. Plan Requirements: All requirements shall be shown on building plans. Timing: Requirements of the condition shall be adhered to throughout all grading and construction periods. Monitoring: The Planning Division and the Public Works Department shall ensure that mitigation is implemented. Building inspectors shall spot check and shall ensure compliance on-site. Butte County Air Pollution Control District inspectors shall respond to nuisance complaints. Mitigation Measure #3: Should grading activities reveal the presence of cultural resources (i.e., artifact concentrations, including arrowheads and other stone tools or chipping debris, cans, glass, etc.; structural remains; human skeletal remains), work within 50 feet of the find shall cease immediately until a qualified professional archaeologist can be consulted to evaluate the remains and implement appropriate mitigation procedures. Recommencement of development activities shall not occur until clearance is provided by the Butte County Department of Development Services. Should human skeletal remains be encountered, State law requires immediate notification of the County Coroner. Should the County Coroner determine that such remains are in an archaeological context, the Native American Heritage Commission in Sacramento shall be notified immediately, pursuant to State law, to arrange for Native American participation in determining the disposition of such remains. Plan Requirements: This note shall be shown on all site development and building plans Timing: This measure shall be implemented during all site development activities. Monitoring: Should cultural resources be discovered, the landowner shall notify the Planning Division and a professional archaeologist. The Planning Division shall coordinate with the developer and appropriate authorities to avoid damage to cultural resources and determine appropriate action. The drainage plans shall specify how drainage waters shall be detained on site and or conveyed to the nearest natural or publicly maintained drainage channel or facility and shall provide that there shall be no increase in the peak flow runoff to said channel or facility. Proposed plan covers existing drainage inlet. Runoff currently ponds on the east side of Godman Avenue. Solution to drainage shall include adequate drainage for the frontage along Godman Avenue. Plan Requirements: The applicant shall submit the required drainage plan to the Public Works. Department for review and approval. Timing: The drainage plan shall be approved prior to the approval of any new building permit. Monitoring: The Department of Public Works shall be responsible for ensuring compliance with this mitigation. Mitigation Measure #5 All outside construction shall be restricted to the hours of 8:00 am to 6:OO pm, Monday through Friday, in order to minimize noise impacts to the adjacent residential neighborhood. Plan Requirements: All requirements shall be shown on building plans, and required prior to Building Permit approval. Timing: The required hours of operation shall be in effect during all periods of outside construction. Monitoring: The Planning Division shall ensure that mitigation is implemented. Building inspectors and/or a planner shall spot check and shall ensure -compliance on-site and on building plans. Mitigation Measure #6 In order to improve safety and traffic circulation, reduce the number of driveways on Godman Avenue from two to one, and move the driveway on East Lassen as far away as practical from the intersection with Godman Avenue. Make these changes on the Use Permit Plot Plan and construct the changes prior to operations.
