The existing structure is located within a required building setback on property zoned C-1 (Light Commercial). The property is located at the southeast corner of Palermo Road and Lincoln Boulevard, at 7415 Palermo Road, Palermo.'APN 026- 144-029 (MM) (UP 05-07) Mr. Michelena gave a brief summary of the project. Answering a question from Commissioner Nelson, Mr. Michelena described a pole barn. The hearing was opened to the public. Tom Hill, general'contractor, said when this application was applied for two years ago, they got a permit for a septic system and then learned that the Use Permit was required for the restroom after the septic was already installed. He said all the applicant wants is to add a restroom. The hearing was closed to the public and comments confined to the Commission and staff. Mr. Michelena corrected Condition 1 by deleting the word "also." Commissioner Lambert corrected Condition 3 changing "encroach" to "encroachment." It was moved by Commissioner Leland, seconded by Commissioner Lambert, and unanimously carried to approve the Use Permit for Rajinder Randhawa subject to the following findings and conditions, changing Condition 1 to delete "also" and changing "encroach" to "encroachment" in Condition 3: I. Find that this project is exempt from the provisions of the California Environmental Quality Act under Section 15303(c), which states that the California Environmental Quality Act exempts the construction or conversion of small structures for a store of less than 2,500 square feet. The payment of fees pursuant to Fish and Game Code Section 711.4 and 14 CCR,753.5 is not required. H. Approve Use Permit UP 05-07 for Rajinder Randhawa for the conversion of a legal nonconforming structure in the C-1 zone, on APN 026-144-029, based on the following findings and the conditions found in Exhibit "A": A. The location, size, design, and operating characteristics of the proposed use will not conflict with, and will not adversely affect, or be materially detrimental to adjacent permitted and conditionally permitted uses, residents, buildings, structures, or natural resources. B. Prior to issuance of building permits, obtain an encroachment permit for all new or existing driveway approaches and construct them to County standards, as specified in the County Improvement Standards. 4. The right-of-way shall be sufficient for the installation of standard No. S-5 at all street intersections. 5. Prior to the issuance of building permits, establish 100 year floodplain elevations and the lowest floor elevations for any structures. Show on the site plan map for building permits the elevations (by contours) and the location of an accepted NVGD benchmark and a temporary benchmark on-site. County Counsel 6. If this entire matter or any finding, action or condition of this matter is appealed to the Board of Supervisors, the applicant or any other developer/operator other than the applicant agrees to defend, indemnify and hold the County of Butte harmless from liability or loss related to the approval of this project and agrees to sign an indemnification agreement in a form approved by County Counsel before the Board's appeal hearing. If the application is not appealed, this condition is deemed satisfied. ANALYSIS Land Use and Zoning •' Butte County Code 24-75 (d) states the minimum front yard setback shall be twenty (20) feet from the edge of the ultimate right-of-way from all public or private roads except where the road is classified as a federal aid road, in which case the setback shall be twenty-five (25) feet from the right-of-way. • Butte County Code -305.391 defines front yard setback, as an area which extends a specified distance from the edge of the ultimate right-of-way and which may not be occupied by buildings, accessory buildings or other structures. The existing structures are located seven feet from the property line (right-of-way), instead of the required 20 feet, as per Butte County Code 24-75 (d) • Lincoln Boulevard has an 80 -foot right-of-way and is not designated as a federal aid road south of Palermo Road. The parcel is located in Flood Zone AH as identified on FEMA Panel No. 06007C0995C, dated 6/8/98. A condition is included to address the requirements of conversion of an existing structure in a floodplain. �l Nonconforming uses (BCC 24-35) include existing uses, structures and buildings, and lots or parcels which do not conform to the regulations of the zone in which they are located shall be subject to these specific regulations. • Nonconforming uses include several types of nonconformities pursuant to BCC 24-35. The one that applies to this application is BCC 24-35.10: (a) Nonconforming building. Several distinct types of nonconformities can be distinguished from one another. These include: (a) Nonconforming building. That situation which occurs when a building or structure does not conform to the zone'regulations because of size, height, location, materials or proximity to other buildings; and (b) Nonconforming use of a building. That situation which occurs when the use of a building or structure does not conform although the building or structure does; and (c) Nonconforming uses of land. That situation where the use of the land regardless of any buildings of structures does not conform; and (d) Conditional use without use permit. That situation where a use which is listed as a conditional use of the zone in which it is located does not have a use permit. When considering a use permit for a nonconforming use, the planning commission shall grant the use permit when it finds that the change, expansion, enlargement, extension, reconstruction, or structural alteration of such use will not conflict with, impair or be detrimental to the uses both permitted and conditional of the zone in which it is located and/or adjoins. Pursuant to section 24-45.15 the planning commission may impose conditions upon the issuance of the use permit which are reasonably related to the use of the property for which the use permit is requested. A nonconforming use shall be abandoned when it is voluntarily discontinued with the intent not to resume it. There shall be a presumption that a nonconforming use which has been discontinued for a period of twelve (12) consecutive months has been abandoned; however, the property owner, occupant or other part asserting the right to said use may submit evidence to rebut the presumption including evidence that the discontinuance was not voluntary. The property owner, occupant or other party asserting the right to a legal nonconforming use has the burden of proving the legal and continuing existence of the use. Once abandoned, a nonconforming use shall no longer be a legal nonconforming use entitled to the rights and ,privileges described in this chapter and thereafter shall be made to conform to the uses, standards an, d requirements of the zone in which it is located. (b) Determination of abandonment; appeal. The issue appears to be whether the buildings are in a front yard setback. As I indicated at, IDR, while other setbacks are discussed in the zone, there is no mention of the front yard setback. We need to decide what to make of this silence. We also need to determine how other commercial projects have been treated. Looking at other jurisdictions, there are often no front yard setbacks for commercial projects. Think of shopping streets. If there are some setbacks, they appear to be for a reason, such as locating parking. After you have had a chance to review the issues and compare how other commercial is treated, let me know your views and I am willing to discuss them with you.
