UP07-0004 PERMIT NO. 028-076-012 ASSESSOR'S PARCEL NO. Pursuant to the provisions of the Zoning Ordinance of the County of Butte and the special conditions set forth below: Daniel Pritchard is hereby granted a Use Permit to construct a single family dwelling, garage, septic system and well consistent with the Site Plan dated August 24, 2007. 1. Failure to comply with the conditions specified herein as the basis for approval of application and issuance of Permit constitutes cause for the revocation of said permit in accordance with the procedures set forth in the Butte County Zoning Ordinance, including Butte County Code Sec. 24-45.65. 2. Unless otherwise provided for in a special condition to this Use Permit, all conditions must be completed prior to or concurrently with the establishment of the granted use. The use granted by this permit must be established within two years of the date of approval. 3. Minor changes may be approved administratively by the Directors of Development Services, Environmental Health, or Public Works upon receipt of a substantiated written request by the applicant, or their respective designee. Prior to such approval, verification shall be made by each Department or Division that the modification is consistent with the application, fees paid and environmental determination as conditionally approved. Changes deemed to be major or significant in nature shall require a formal application for amendment. 4. If the Use Permit has not been substantially established within two years of the receipt of the Permit by the Permittee consistent with conditions of approval herein, the Permit shall become null and void and reapplication pursuant to Section 24-45 (of the Zoning Code) shall be required to establish the use previously granted under the expired Permit unless, 30 days prior to the expiration date, a request for a one year extension is submitted to the Planning Commission together with sufficient evidence that the time limits for processing development permits under federal or state regulations require time limits which exceed one year. Upon application, and for good cause by the Permittee, at a public hearing pursuant to Section 24-45.25 above, the Planning Commission may extend any time limitation previously made a part of any condition to a Use Permit. 5. The terms and conditions of this Permit shall run with the land and shall be binding upon and be to the benefit of the heirs, legal representatives, successors, and assigns of the Permittee. 6. Neither the applicant, nor any agent nor representative of the applicant shall intentionally omit or misrepresent any material fact in connection with the application. Any alleged material misrepresentation shall constitute grounds for the Director of Development Services to commence a revocation hearing, and, if proven to exist, shall constitute sufficient grounds to revoke a Permit. �urrul7 �, APR 10 2009 1rsEv—VLOP SERyjc�IVT Conditions of Approval: Planning Division 1. Applicant shall apply for and have approved and recorded a Certificate of Merger to merge the four underlying lots into one lot prior to issuance of any building, septic or well permit on the property. 2. The residential dwellings and accessory structures must meet standard building setback requirements for the R -I (Residential single family) zone. The R-1 setbacks shall apply at the time a building permit is filed for the single family residence. Currently, the setbacks are: 25 - foot front yard setback from the ultimate -edge of the right-of-way on Lower Honcut Road, 10 -foot side street setback from Longman Lane and Neighbor. Street, and 15 -foot rear yard setback from the southern property line. 3. Applicant must also comply with all other applicable State and local statutes, ordinances, and . regulations. 4. All outstanding application processing fees shall be paid prior to issuance of the Use Permit. Public Works 5. Prior to establishing use, obtain an encroachment permit and improve all new and existing driveway approaches to publicly maintained roads as specified in the County Improvement Standards and the terms. of the encroachment permit. 6. . Prior to establishing use, deed to Butte County in fee simple 40 feet of right-of-way from the centerline of Lower Honcut Road and 25 feet of right-of-way from the centerline of Longman Lane and 30 feet of right-of-way from the centerline of Neighbor Street along the entire property frontage. The right-of-way shall be sufficient for the installation of Improvement Standard No. S-5 at all street intersections. 7. Prior to establishing use, a plan for a permanent solution for drainage shall be submitted to and approved by the Department of Public Works. The drainage plans shall detail existing. drainage conditions and shall specify how drainage waters shall be detained or retained on- site and/or conveyed to the nearest natural or publically maintained drainage channel or facility and shall provide that there shall be no increase in the peak flow runoff to said channel or facility. Environmental Health Division 8. Prior to the issuance of a.buildmg.permit for construction of the residence/garage, obtain a permit for a septic system through the Environmental Health Division. 9. Prior to the issuance of a building permit for construction of the residence/garage, obtain a permit for a well through the Environmental Health Division. Pacific Gas & Electric 10. Any relocation or rearrangement of any existing PG&E facilities in the area to accommodate this project will be at the expense of the developer. 11. There shall be no building of structures, or the storage of materials allowed over or under any existing PG&E facilities, or inside any easements that exist which would in$inge.on PG&E easement rights. County Counsel 12. If this entire matter or any finding, action or condition of this matter is appealed to the Board. of Supervisors, the applicant or any other developer/operator other than the applicant agrees to indemnify the County of Butte from liability or loss related to the approval of this project and agrees to sign an indemnification agreement in a form approved by County Counsel before the Board's appeal hearing. If the application is not appealed, this condition is deemed satisfied. Every development project which requires a discretionary governmental approval will require at least some environmental review pursuant to CEQA, unless an exemption applies. The environmental review required imposes both procedural and substantive requirements. At a minimum, an initial review of the project and its environmental effects must be conducted. Depending upon the potential effects, a further and more substantial review may be conducted in the form of an environmental impact report (EIR). A project may not be approved if feasible alternatives or mitigation measures cannot substantially lessen the significant environmental effects of the project. At the state level, CEQA requires that public agencies consider the effects of their actions on historical resources eligible for listing on the California Register of Historical Resources. "Historical resource" refers to buildings, structures, sites (prehistoric and historic), objects, districts, and all manner of properties containing material remains of past human life or activity. The Department of Development Services utilizes the Northeast Information Center (NEIC) of the California Historical Resources Information System (CHRIS) to identify projects that may have archaeological significance. The CHRIS is a statewide system for managing information on the full range of historical resources identified in California. This system is under the authority and direction of the Office of Historic Preservation (OHP), the State Historic Preservation Officer (SHPO), and the State Historical Resources Commission (SHRC). The Northeast Center of the CHRIS system, located at California State University, Chico, manages the historical resource records for 11 counties, including Butte County. The Northeast Information Center will furnish a Record Search to Development Services indicating the archaeological/historical significance and sensitivity of the applicant's project area and additionally providing a recommendation as to whether further archaeological survey is warranted. If further archaeological survey is required, the application would be considered incomplete until the appropriate archaeological survey is completed and reviewed. The Department of Development Services will forward applicant's payment (by check) of $75.00 and relevant project application information required for the Records Search to NEIC. NEIC will provide the results of the Records Search to Development Services. Development Services will notify the applicant if further archaeological survey is warranted. RESULTS: Prehistoric Resources: According to our records, no sites of this type have been recorded in the project area. However, a bedrock mortar site has been recorded in the project vicinity. The project is located in a region.utilized by Konkow Maidu populations. Honcut Creek was named after the Maidu Indian village, Hoan'kut, which was located on the Yuba BUTTE . COUNTY SEP 2 0 2007 DEVELOPMENT SERVICES River just below where the Honcut Creek enters the Yuba. Unrecorded prehistoric cultural resources may be located in the project area. Historic Resources: According to our records, no sites of this type .have been recorded in the project area or vicinity. Unrecorded historic cultural resources may be located in the project area. The USGS Gridley 15' (1952) quad map indicates that the project is located in the town of Honcut and contains structures, while North Honcut, Creek, Wilson creek, Wyandotte Creek, South Honcut Creek, Lower Honcut Road, Honcut Land Grant, Southern. Pacific Railroad, Ahart Road, Butte -Yuba County line; roads, and structures are located in the project vicinity. The project is located in the historic Honcut gold mining district. Daniel Page, husband to Hattie Talbot Merrill; established the first general store and was the first postmaster of Honcut in 1856, servicing local placer mining operations on the numerous creeks in the region. Previous Archaeological Investigations: According to our records, a small portion of the project area has been previously surveyed for cultural resources by a professional archaeologist. The report is listed below: Williams, Scott (California Department of Transportation) 2002 Positive Archaeological Survey Report, Marysville-Oroville Freeway Project, Yuba and Butte Counties. IC Report 5960 Literature Search: The official records and maps for archaeological sites and surveys in Butte County were reviewed. Also reviewed: National Register of Historic Places - Listed properties.and Determined Eligible Properties (1988, Computer Listings 1966 through 7-00 by National Park Service); California Register of Historical Resources (2007); California Points of Historical Interest (1992); California Investigation of Historic Resources (1976); California Historical Landmarks (1996); Directory of Properties in the Historic Property Data File for Butte County (2007); Handbook of North American Indians, Vol. 8, California (1978); Historic Spots in California (1966); Gold Districts of California (1970). RECOMMENDATIONS: Based upon the above information, the project appears to be located in an area considered to be moderately sensitive for prehistoric and historical resources. - The project area is located in a region utilized by prehistoric and historic populations. Native American populations used the local region for seasonal and/or permanent settlement, as well as for the gathering of plants, roots, seeds, and hunting seasonal game. Historically, Euroamericans utilized the region for mining, farming, and cattle ranching. A small portion of the project area has been previously surveyed for archaeological or historical resources. Therefore, due to a lack of prior survey in the project area, we recommend that Butte County planners consider requiring a professional archaeologist be contacted to conduct a cultural resources survey of the project area. The project archaeologist will be able to offer recommendations for appropriate preservation and/or mitigation measures for any new cultural resources encountered as a result of the field survey. The project archaeologist should also contact the appropriate local Native American representatives for information regarding traditional cultural properties that may be located within project boundaries for which we have no records. This person may also want to consult historic General Land Office (GLO) plat maps in order to aid in the identification of unrecorded historic sites, which maybe located within project boundaries. During any phase of parcel development, if any potential prehistoric, protohistoric, and/or historic cultural resources are encountered, all work should cease in the area of the find pending an examination of the site and materials by the project archaeologist. This request to cease work in the area of a potential cultural resource find should be made a condition of project approval. ANALYSIS: • The parcel is zoned C-1 (Light Commercial) and designated Commercial by the General Plan.: • The C-1 zoning of the property was established on June 26, 1990 by Ordinance 2842. • The C-1 zone identifies that a use permit is required for residential uses not in conjunction with a permitted use. There are no commercial or other uses currently located on the property. • The project site consists of four underlying lots of the Town of Honcut map filed in Book 7 of Maps, Page 85. The lots will be required to be merged prior to constructing the home or septic system. • A single family residence typically generates an average of 10 vehicle trips per day (Trip Generation Manual of the Institute of Traffic Engineers). If the Use Permit has not been substantially established within two years of the receipt of the Permit by the Permittee consistent with conditions of approval herein, the Permit shall become null and void and reapplication pursuant to Section 24-45 (of the Zoning Code) shall be required to establish the use previously granted under the expired Permit unless, 30 days -prior to the expiration date, a request for a one year extension is submitted to the Planning Commission together with sufficient :evidence that the time limits for processing development permits under federal or state regulations require time limits which exceed one year. Upon application, and for good cause by the Permittee, at a public hearing pursuant to Section 24-45.25 above, the Planning Commission may extend any time limitation previously made a part of any condition to a Use Permit. 5. The residential dwellings and accessory structures must meet standard building setback requirements for the R-1 (Residential single family) zone. The R-1 setbacks shall apply at the time a building permit is filed for the single family residence. Currently, the setbacks are: 25 -foot front yard setback from the ultimate -edge of the right-of-way on Lower Honcut Road, 10 -foot side street setback from Longman Lane and Neighbor Street, and 15 -foot rear yard setback from the southern property line. 3. Applicant must also comply with all other applicable State and local statutes, ordinances, and regulations. 4. All outstanding application processing fees shall be paid prior to issuance of the Use Permit. • Public Works 5. Prior to establishing use, obtain an encroachment permit and improve all new and existing driveway approaches to publicly maintained roads as specified in the County Improvement Standards and the terms of the encroachment permit. 6. Prior to establishing use, deed to Butte County in fee simple 40 feet of right-of-way from the centerline of Lower Honcut Road and 25 feet of right-of-way from the centerline of Longman Lane and 30 feet of right-of-way from the centerline of Neighbor Street along the. entire property frontage. The right-of-way shall be sufficient for the installation of Improvement Standard No. S-5 at all street intersections. 7. Prior to establishing use, a plan for a permanent solution for drainage shall be submitted to and approved by the Department of Public Works. The drainage plans shall detail existing drainage conditions and shall specify how drainage waters shall be detained or retained on-site and/or conveyed to the nearest natural or publically maintained drainage channel or facility and shall provide that there shall be no increase in the peak flow runoff to said channel or facility.
