The purpose of this review is to evaluate soil and domestic water information provided to this office for assessment as it relates to State and County sewage and water supply standards. After you receive our assessment you can decide whether to proceed with a formal County map application process. This is an initial review of your project for compliance with sewage and water supply standards. Pre -application review of your project by this office does not include other Department's standards. Approval of land use projects is a discretionary action of the Development Review Committee, Plannang Commission, Local Agency Formation Commission (LA14CO), or the Board of Supervisors. Regulations reviewed are tine Butte County Subdivision Ordinance (and subsequent development standards in the Subdivision Improvement Standards), Butte County Sewage Disposal Ordinance and the Butte County Well Ordinance. This will require either a "Storm Drainage Trench•Permit'from this Department to install infiltration galleries or connect to existing infrastructure. The installation of drainage trenches.may conflict with sewage disposal lines, water wells, water lines, and other development. To facilitate your development and avoid unnecessary delays with.your project, you should contact the Department of Land Development Services at 7 County Center Drive, Oroville, CA, (telephone 530-538-7266), to determine your status. If it is determined that you will need to provide an - - on=site solutibri - dr storm water, -you s 6u anticipate providi ig t 6- ollowing: Plot Plan: Accurate to -scale drawing depicting proposed development (building footprints), wells, proposed sewage and storm drain display. Engineering Core: This should include perc tests, estimates of drainage flows, and resultant capacity calculations. Basic Design: Trench length and depth, construction materials, and inlet specs. 4. Permit Fee: $138.00 payable to Butte County. Storm drainage trenches are required to meet the same setbacks'from wells, distance to groundwater and many other restrictions common to leachfields. Therefore, these trenches may be as deep as nine (9) feet but in no way be less than five .(5) feet from maximum seasonal groundwater. If you feel that groundwater may be a problem, have your engineer contact this Department about, depth limitations as soon as possible. Your drainage plan must be approved by Land Development Services before this Department can issue your "Storm Drainage Trench Permit". In order to help assure you the shortest time possible for our processing of Soil Waiver requests for pre -application approvals we will now collect the same processing fee we would receive for the project if it were a normal pre -application. This fee is still .one-half of the total fee collected by the Department of Development Services for our portion of the project processing upon your full application with DDS. Collecting this fee sooner in the process will speed our processing of your request in several ways without any additional cost to the applicant. This procedural change will: ® Help to eliminate questions clerical staff may have about the proper fee to charge when accepting 'a soil waiver application. e Immediately provide us with the entire processing fee we require to fully process the request whether the soil waiver is granted or whether a complete soil review is necessary. Upon submitting a soil wavier request the applicant must also provide a map of the proposed project with the application. In addition, it is to the applicant's advantage to provide a written summary giving the reasons we should provide a waiver and not need to do a complete soil review for the proposed project. Of course all portions of the processing fee not used are completely refundable upon withdrawal of the project and request for a.refund. No herbicides shall be used in the elderberry basins and no herbicides shall be used on adjacent areas if the soil temperatures exceed 70 degrees Fahrenheit. The Department of Development Services will respond to complaints. 8. _Mitigation #7: Should grading activities reveal the presence of cultural- resources (i.e., artifact concentrations, including arrowheads and other stone tools or chipping debris, cans, glass, etc.; structural remains; human skeletal remains), work within 100 feet of the find shall cease immediately until a qualified professional archaeologist can be consulted to evaluate the remains and implement appropriate mitigation procedures. Recommencement of development activities shall not occur until clearance is provided by the Butte County Department of Development Services. Should human skeletal remains be encountered, State law requires immediate notification of the County Coroner. Should the County Coroner determine that such remains are in an archaeological context, the Native American Heritage Commission in Sacramento shall be. notified immediately, pursuant to State law, to arrange for Native American participation in determining the disposition of such remains. Clearly marked signs shall be posted to instruct commercial truck drivers when they enter an area that contains idling restrictions. B. The proposed expansion area will not impede possible future clean-up of the toxic solvents dumped on the project site. C. With the project expansion, the total number of weekly trucks trips, to the site, will be reduced by approximately 10. D. Trucks will not be able to idle within 100 feet of the northern boundary. II. Upholds the applicant's appeal on the required sound wall based on the following findings: A. The elimination of the truck circulation route through the new employee parking area. B. A sound study prepared by Eco -Analysts determined that a masonry sound barrier will provide little attenuation and will not eliminate noise. C. In order for a sound barrier (wall) to function it must be continuous and not .have gaps (e.g., gates) that allow sound to transmit (called "windows"). Gates are required for PG&E access and for residents to • 0 continue authorized disposing of vegetative waste. This renders the sound barrier nearly useless. D. Sound data does not support the fact that noise levels exceed, or will exceed, County standards (Standards are based on average daily noise, not peak incidental noise). E. Construction would require the removal of the only remaining wildlife habitat. III. Adopts a Mitigated Negative Declaration with the following findings: A. An Initial Study was completed in compliance with the California Environmental Quality Act. Said study identified significant environmental effects and included mitigation measures that would mitigate such effects below significant levels; a Mitigated Negative Declaration is proposed. B. Based upon the Initial Study, Draft Mitigated Negative Declaration, and all oral and written comments and responses thereto, adopt the Mitigated Negative Declaration of Environmental Impact and certify that the requirements of the California Environmental Quality Act have been satisfied. C. I. CONDITIONS OF APPROVAL: Planning Division: The Butte County Planning Commission hereby reserves ongoing jurisdiction over this Use Permit. The Commission may, at its own discretion, and following a noticed public hearing, revoke this Use Permit, and/or add additional conditions of approval, or modify existing conditions of approval, upon receipt of written complaints or other evidence of adverse impacts upon surrounding properties or the public health, safety or welfare. 2. Mitigation #1: All exterior lighting required for the proposed project shall be composed of 12 -foot high Sternberg (or approved equivalent) with shielded downward focusing fixtures. Project lighting shall not exceed an average illumination level of 0.1 candles at the edge of the development area, and shall be spaced at intervals of not more than 300 feet. Plan Requirements: This mitigation shall be placed as a condition of the Use Permit, and on all building permit and site development plans. Timing: The provisions of this mitigation measure shall be complied with at all times. Monitoring: Building inspectors shall check and ensure compliance on-site. The Development Services Department shall investigate and respond to any complaints of excess glare or light originating from the project site. 3. Mitigation #2: All automobile and truck headlights in proposed expansion area shall be screened so as to confine direct lighting to the premises so as to not impact adjacent residential parcels. Plan Requirements: This mitigation shall be placed as a condition of the Use Permit. Timing: The provisions of this mitigation measure shall be complied with at all times. Monitoring: The Development Services Department shall investigate and respond to any complaints of excess glare or light originating from the project site. 4. Mitigation #3: Dust generated by the development activities shall be kept to a minimum with a goal of retaining dust on the site. Follow the dust control measures listed below: a. Water shall be applied by means of tfuck(s), hoses, and/or sprinklers as needed prior to any land clearing or earth movement to minimize dust emissions. b. Haul vehicles transporting soil into or out of the property shall be covered. c. Water shall be applied to disturbed areas a minimum of two (2) times per day or more as necessary. d. On-site vehicles shall be limited to a speed of 15 mph on unpaved roads. e. Post a publicly visible sign with the telephone number and person to contact regarding dust complaints. This person shall respond and take corrective action within 24 hours. The telephone number of the Butte County Air Quality Management District shall be visible to ensure compliance with BCAQMD Rule 200 & 205 (Nuisance and Fugitive Dust Emissions). f. All visibly dry disturbed soil surface areas of operation shall be watered to minimize dust emissions. g. Existing roads and street adjacent to the project shall be cleaned at lease once per day unless conditions warrant a greater frequency. Plan Requirements: This mitigation shall be placed as a condition of the Use Permit, and on all building permit and site development plans. Timing: Requirements of the condition shall be adhered to throughout all grading and construction periods. Monitoring: Building inspectors shall check and ensure compliance on-site. Butte County Air Quality Management District inspectors shall respond to nuisance complaints. 5. Mitigation #4: Prior to commencing grading activities, excavation and construction, the applicant shall obtain a Fugitive Dust Permit form and submit a construction emission/dust control plan to the Butte County Air Quality Management District. Plan Requirements: This mitigation shall be placed as a condition of the Use Permit, and on all building permit and site development plans. Timing: Requirements of the condition shall be adhered to throughout all grading and construction periods. Monitoring: Building inspectors shall check and ensure compliance on-site. Butte County Air Quality Management District inspectors shall respond to nuisance complaints. 6. Mitigation #5: The primary contractor shall be responsible for ensuring that all construction equipment is properly tuned and maintained. When feasible, existing power sources, such as power poles, or clean fuel generators should be used, rather than temporary power generators. Minimize idling time for construction equipment to 10 minutes. Plan Requirements: This mitigation shall be placed as a condition of the Use Permit, and on all building permit and site development plans. Timing: Requirements of the condition shall be adhered to throughout all grading and construction periods. Monitoring: Building inspectors shall check and ensure compliance on-site. The Department of Development Services will respond to complaints. 7. Mitigation #6: The elderberry bushes shall be surrounded by a low wall that extends at least 12 inches above the level of the parking area surface to provide for complete separation. The wall shall be placed no closer than five (5) feet from the drip line of each shrub. No herbicides shall be used in the elderberry basins and no herbicides shall be used on adjacent areas if the soil temperatures exceed 70 degrees Fahrenheit. Plan Requirements: This mitigation shall be placed as a condition of the Use Permit, and on all building permit and site development plans. Timing: Requirements of the condition shall be adhered to at all times. Monitoring: Building inspectors shall check and ensure compliance on-site. The Department of Development Services will respond to complaints. 8. Mitigation #7: Should grading activities reveal the presence of cultural resources (i.e., artifact concentrations, including arrowheads and other stone tools or chipping debris, cans, glass, etc.; structural remains; human skeletal remains), work within 100 feet of the find shall cease immediately until a qualified professional archaeologist can be consulted to evaluate the remains and implement appropriate mitigation procedures. Recommencement of development activities shall not occur until clearance is provided by the Butte County Department of Development Services. Should human skeletal remains be encountered, State law requires immediate notification of the County Coroner. Should the County Coroner determine that such remains are in an archaeological context, the Native American Heritage Commission in Sacramento shall be notified immediately, pursuant to State law, to arrange for Native American participation in determining the disposition of such remains. Plan Requirements: This mitigation shall be placed as a condition of the Use Permit, and on the building permit site plan. Timing: This measure shall be implemented during all site development activities. Monitoring: Should cultural resources be discovered, the landowner shall notify the Planning Division and a professional archaeologist. The Planning Division shall coordinate with the applicant and appropriate authorities to avoid damage to cultural resources and determine appropriate action. 9. Mitigation #9: Idling of commercial trucks will be prohibited within 100 feet of the northern property line, which includes the employee parking lot. Idling between 100 and 120 feet of the northern property line shall be limited to a maximum of 10 minutes. Clearly marked signs shall be posted to instruct commercial truck drivers when they enter an area that contains idling restrictions. Plan Requirements: This mitigation shall be placed as a condition of the Use Permit. Timing: The mitigation shall be applicable at all times. Monitoring: The developer and the Disturbance Coordinator shall be responsible for ensuring compliance with this mitigation and shall respond to all complaints of noise. Department of Development Services shall investigate all complaints. 10. Mitigation #10: To reduce construction -generated noise the developer shall implement the following measures to mitigate construction noise throughout all construction periods: 1. Limit construction activity to daytime hours (6:00 a.m. to 7:00 p.m.) with no construction activity on Sundays or holidays; 2. Use best available noise suppression devices and properly maintain and muffle diesel engine -driven construction equipment; 3. Construction equipment shall not be idled for long periods of time; 4. Locate stationary equipment as far as possible from sensitive receptors; 5. Designate a Disturbance Coordinator and post the name and phone number of this person conspicuously at the entrance(s) to the project site so it is clearly visible to nearby residents most likely to be affected by construction noise. This person would manage complaints resulting from construction noise. The Disturbance Coordinator shall contact noise sensitive receptors and advise them of the schedule of construction." Plan Requirements: This mitigation shall be placed as a condition of the Use Permit, and on the building permit site plan. Timing: The mitigation shall be applicable during all construction activities. Monitoring: The developer and the Disturbance Coordinator shall be responsible for ensuring compliance with this mitigation and shall respond to all complaints of noise. Department of Development Services shall investigate all complaints of excess construction -related noise. 11. The proposed expansion shall be developed in accordance with the approved project site plan, as modified by the conditions contained herein, and all applicable County codes and requirements. Said site plan is on file in the Planning Division. 12. The proposed cold storage building shall be located a minimum of 60 feet from the north boundary line. 13. The building will have no doors or entrances on the back of the building that faces the residential development. 14. The building will be designed to exceed insulation requirements to further reduce noise. The refrigeration equipment will be located in an enclosed structure at the farthest point from the residential zone. 15. The building will be designed so the loading docks will be located over 150 feet from the property line and on the side that faces the interior of the parcel (away from the residential zone). 16. The building shall be painted a natural tone to reduce visual impacts. 17. The truck circulation for the new cold storage building shall be accessed from the existing driveway off of Speedway Avenue. Up to 15 trucks per day will be allowed to circle behind the cold storage building (no closer than 25 feet of the residential zone). No scheduled truck trips will be allowed behind the cold storage building between the hours of 9:00 p.m. and 6:00 a.m. Speed limit for trucks, within 100 feet of the residential zone, is 5 mph. 18. No truck circulation is allowed through the new employee parking lot. 19. The speed limit for the new employee parking lot shall be 10 mph. 20. A minimum 8 -foot tall privacy/security fence, approved by the Director of Development Services, is required along the entire north boundary of the project site. The fence shall have access gates to PG&E poles. 21. Preserve, if possible, existing trees and vegetation located in the proposed improvement area. 22. Landscaping shall be provided to create a partial screening of the existing building and the proposed building, access way and parking area. Landscape plans shall be approved by the Director of Development Services, or designated representative. 23. Bottles are not to be recycled during the night, only during peak hours. 24. Smucker Quality Beverages shall inform employees that the proposed parking area and access way is a quiet area. 25. Smucker Quality Beverage shall provide after hour contact numbers to neighbors to address noise and other issues. 26. All buildings shall be setback per Butte County Code requirements at the time of building permit application. 27. Applicant must also comply with all other applicable State and local statutes, ordinances, and regulations. 28. All outstanding application processing fees shall be paid prior to issuance of the Use Permit. 0 • Public Works 29. Mitigation #8: Prior to issuance of building permits and/or setting up models, a plan for a permanent solution for drainage shall be submitted to and approved by the Department of Public Works. The drainage plans shall detail existing drainage conditions and shall specify how drainage waters shall be detained or retained on site and or conveyed to the nearest natural or publicly maintained drainage channel or facility and shall provide that there shall be no increase in the peak flow runoff to said channel or facility. Plan Requirements: Submit drainage plans and calculations to the Department of Public Works for review and approval. Timing: The drainage plan shall be submitted and approved prior to issuance of building permits. Monitoring: The Department of Public Works shall ensure that the required plan is submitted and ensure that the drainage improvements are constructed or bonded for construction. 30. Prior to the issuance of building permits, obtain encroachment permit for all new or existing driveway approaches and construct them to County standards, as specified in County Improvement Standards. 31. Prior to the issuance of use permit, deed to Butte County in fee simple 30 feet of right-of- way from the centerline of Speedway Ave. along the entire property frontage. The right- of-way shall be sufficient for the installation of Improvement Standard No. S-5 at all street intersections. 32. Prior to the issuance of use permit, submit road and drainage improvement plans for the installation and construction of the street frontage improvements on Speedway Ave. to RS -2A County Improvement Standards. Improve parcel frontage to a '/z -street section (16' from centerline to face of curb) on Speedway Ave. to an RS -2A road standard including, but not limited to curb, gutter and sidewalk. Construct or install the required improvements. California Department of Forestry 33. Prior to construction, a pressurized community water system for fire protection is required. Bonding may be allowed with the approval of the County Fire Chief. Average required hydrant spacing is 500 feet, hydrant size 6 inches, and residual fire flow of 1500 GPM. Fire hydrant identification, road reflectors or post reflectors acceptable to the County Fire Chief shall be installed or bonded. Submit plans to the Fire Department for review and approval prior to construction. Pacific Gas & Electric 34. Any relocation or rearrangement of any existing PG&E facilities in the area to accommodate this project will be at the expense of the developer. • 0 35. There shall be no building of structures, or the storage of materials allowed over or under any existing PG&E facilities, or inside any easements that exist which would infringe on PG&E easement rights. County Counsel 36. If this entire matter or any finding, action or condition of this matter is challenged in any other action or forum, the applicant or any other developer/operator other than the applicant agrees to defend, indemnify and hold harmless the County of Butte from liability or loss related to the approval of this project in the subsequent action or forum and agrees to sign an indemnification agreement in a form approved by County Counsel. Our engineering firm and landscape designer were given clear direction to make every effort in the design phase of our project to minimize any impact to our neighbors while meeting our minimum operational requirements. This shall be validated through the use permit process. The project includes relocation of our existing parking lot and construction of a new 22,000 square foot warehouse/cold storage. Outlined below -is the business case and positive impact the project will have. Business Case This project is the first significant building expansion at the site in 15 years. Our business has grown significantly over this time and we can no longer operate out of our current leased space effectively. Several key design elements, including the project's location on the site, are critical to meet both our long-term and short-term business case. These include: site master planning, employee safety, food safety, legal security requirements to protect our food supply and operational improvement. The location of the building relative to our current manufacturing operation is critical to support our ability to store on site and supply "just -in - time" frozen raw materials and packaging to our existing manufacturing operation. All building setbacks and truck turning radius were designed to meet the minimum requirements. This leaves only about 80' clearance from the south end of our proposed dock to our existing buildings on site, which is bare minimum. SMUCKER QUALITY BEVERAGES, INC. P.O. Trucks are often backed up and idling on Speedway Avenue, which historically has generated complaints from the neighbors that are on the south side of our facility. This will be addressed by adding two truck docks on the interior of our manufacturing complex and providing adequate off-street parking and on-site ` storage. This project will further reduce total traffic by approximately 15 trucks per week eliminating the need to receive raw materials and then ship them off site, only to shuttle them back to support our current 24-hour operation. We are proposing to limit truck traffic to the hours of 6:00 a.m. and 9:00 p.m. through the new parking lot entrance. We will also have a strictly enforced 5 mph speed limit through the parking lot. The new docks will be located approximately 160 feet from our property line and well over 250 feet from our neighbors' residences, and will be shielded by the building itself to minimize noise. Lightinj!Nisual and Environmental We are committed to saving all trees and as much existing vegetation as is possible, including the large oak near the entrance of Speedway Avenue. We are, in fact, proposing to add over 400 new shrubs and trees to further improve the landscape buffer and aesthetics of the parcel. We voluntarily increased the minimum landscape setbacks in the parking area from 6 feet to 16 feet. We are also increasing the landscaping behind the building to 10 feet of dense landscape screening. Additionally, we are paying the extra costs to relocate the existing overhead SBC communication lines underground to improve the aesthetics of the parcel, as opposed to the current overhead utilities. We located the proposed warehouse/cold storage building 41 feet south of the property line in an area where there are no homes within 100 feet north of the property line. We are also planning to eliminate all existing exterior lighting on our buildings and upgrade it with a lighting plan that will specifically address any potential light pollution from our facility. Reduced Equipment Noise/Fire Risk The building is designed to have no doors or entrances on the back of the building facing the neighbors. Therefore, the structure itself will serve as an additional sound barrier for our current activities, which include recycling, fresh fruit production and truck traffic. Although these operations currently take place in the center of our manufacturing location, they are visually and audibly noticeable to the neighbors. We will also eliminate the noise generated from several small refrigeration storage boxes currently located on the edge of our property. Fire concerns will be mitigated with the new facility, which will be fully sprinkled. The new cold storage will also utilize the newest energy-efficient refrigeration equipment available. The building will exceed all energy and insulation requirements to further reduce noise, and SMUCKER QUALITY BEVERAGES, INC. P.O. Improved Overall Aesthetics The parcel we purchased has not historically been well maintained and has become a dumping ground for yard debris, etc. We are proposing a visually appealing project that is truly an asset to the neighborhood. The enhanced employee parking lot and building are designed to fit in with the existing structures on-site (a standard steel building with a 24 -foot eave height). The building is located to meet our operational flow and serve as both an aesthetic and sound barrier to buffer our existing shipping/receiving, recycling and fresh fruit operations. The new perimeter will be fenced with an 8 -foot high privacy.fence. Summary We feel this project complies with all zoning requirements under Section 24-175 M-1 (Light Industrial) Zone, and our building and landscape design effectively mitigate all concerns brought by the neighbors thus far. This, coupled with our proposed operational changes, will improve the current situation and provide a valuable asset for the larger Butte County community. This project will generate considerable annual tax revenue, with initial improvements valued at approximately $3.1 million, and future improvements associated with the project at over $5 million. This project should help Smucker Quality Beverages solidify our base as one of Butte County's top employers, with over 140 full-time jobs with full benefits. The applicant proposes to construct a 22,000 square foot cold storage building, a 112 -space parking area, and a new truck delivery route. To protect water quality from potential project impacts, the property owner must comply with appropriate permits and regulations. of the Central.Valley Regional Water Quality Board. These permits and regulations are described below. WASTEWATER The California Regional Water Quality Control Board, Central Valley.Region (Central Valley Water Board) issued Waste Discharge Requirements (WDRs), Order No. 98-050 to Smucker Quality Beverages in 1998. The WDRs regulate the discharge of wastewater generated from the processing of fruit for production of fruit drinks and syrups and canned.fruit. Effluent from the plant is treated using an anaerobic treatment system, aeration pond, and settling tanks; and finally discharged to leachfields and spray fields. Smucker Quality Beverages previously requested permission to abandon a 300 -foot section of leachfield adjacent to the proposed cold storage building. Since this portion of the leachfield was no longer in use, staff -of the Central Valley Water Board had no objection to the leachfield abandonment, as long as the owner was in compliance with Butte County's requirements. No additional wastewater requirements are needed for the proposed expansion. STORM WATER Storm water runoff from the property is expected to discharge to nearby Comanche Creek. Industrial Storm Water Permit Smucker Quality Beverages obtained coverage under the General Industrial Storm Water Permit (No. CAS000001) for the discharge of storm water from the Chico facility. The Industrial Storm Water Permit requires the owner to: 1) implement a Storm Water Pollution Prevention Plan to control pollutants in storm water runoff and 2) monitor and sample storm water runoff. Construction Storm Water Permit If construction activities result in a land disturbance of one or more acres, the property owner must obtain coverage under the state's Construction Storm Water Permit. The Storm Water Permit is. required for construction activities where clearing, grading, filling, and excavation result in a land disturbance of one or more acres. Construction activities that result in a land disturbance of less than one acre, but are part of a larger common plan of development, also require a Storm Water Permit. A Storm Water Pollution Prevention Plan (SWPPP) must be prepared. and implemented prior to construction activities. The SWPPP is used to identify potential pollutants (such as sediment and earthen materials, chemicals, construction materials, etc.) and describe practices to eliminate or reduce those pollutants from entering surface waters. December 11, 2006 .BU1T corimk DEC 12 ;?006 Tim Snellings VE!P� Mark Michelena� N1' Butte County Planning Commission Department of Developmental Services RE: Smucker Quality Beverage Use Permit UP06-0020 Environmental Report Mr. Michelena and Mr. Snellings, After reading over the environmental report prepared by the planning division staff, it is my conclusion that the overall mitigated negative declaration is like closing the door after the horse has already gotten out of the barn; All of the issues looked at in the report should have been evaluated before any soil, trees or other features were removed or disturbed on the site. I am thinking that some of the conclusions in the report were made sitting at a desk and not on site and without consideration of the human inhabitants adjoing the property. For instance, the property that the Smuckers facility sits on had already been identified as a toxic site due to polluted water; in talking to one of the neighbors that was involved in this issue, it appears that there has been no resolution or final word that the problem has been taken care of. In reading through the report I am puzzled by several items and have some information which should be taken into consideration before a decision is made regarding this use permit: • Sampling Process. I am wondering how the topsoil was sampled on the site in question since the topsoil that was removed from the railroad property is now located on the bottom of a very large pile on the open ground on the Midway side of the Smuckers facility. Were these piles sampled as well as the soil left on the site? • Section 4.8 Hydrology and Water Quality. The wells of those of us adjoining the property are at the back of our property. Why would the report indicate that the use of the ground in the manner proposed by Smuckers will have a less than significant impact when to those of us with these adjacent wells the impact will be great? • Section 4.11 Noise, part F. Were noise meters put in place for a significant amount of time (30+ days?) in order to make a determination? Was the testing done blindly or was Smuckers notified that noise was being checked on a particular day so that they could have checked their noise rather than doing 0 • business as usual? Noise is one of the major negative issues I have with this project as I believe that the operation has become increasingly loud over more hours of the day. I am skeptical of testing methods which find that the noise impact is "no impact" since I live next door to this facility every day and hear how loud they are during a normal day and night. Exactly how was this determined? • Section 4.4 Biological Resources. This section must be a farce. How could the biological resources be evaluated when more than half of the trees and bushes as well as several feet of topsoil has been removed prior to it being looked at? I used to walk this area and use it daily. I personally know of raccoons, opossums and an abundance of birds including owls, pheasant and many quail that used to use this area as their home. This environment is now gone, so there is no wonder that the determination for the area left now was "no impact." • Section 4.3 Air Quality. This section, as prior areas of review, should have had designations of "potentially significant impact" in areas B, C, D and E, but they do not. Please explain to me how this evaluation was made. The Air Quality Board for the State of California regulates the emissions from running diesel fueled motors to hundreds of feet from residential areas. This project will bring these emissions within 50 feet of residential property lines. This is a very big impact on us, especially since these emissions are known to be carcinogenic. Why are these standards being ignored? The residences in our neighborhood have had several home invasion burglaries in recent years. Over the past thirty years of living in our home we have had three. Each time it has taken us years to put them behind us. This is the largest invasion yet of our homes and lives and I wonder how we will be able to put this behind us. It is recommended that the leach line be located to conclude whether or not it is less than 5 feet from the proposed warehouse, such that a more conclusive determination can be made. If the leach line is within 5 feet of the proposed building site, abandonment of the line will require review and approval by the Regional Water Quality Control Board. Another option would be to relocate the relative length of leach line, under permit issued by this office. Once the above issue is resolved, we recommend approval of the Use Permit. This review should not be construed as a blanket approval of your project since participation in the County Use Permit process may change the project due to other agency requirements.
