Planning Division
1. The building permit site plan shall conform to the site plan approved by this Use Permit.
2. An erosion control plan shall be submitted and approved by .Butte County Public Works
Land Development Division prior to any land disturbance.
3. The applicants shall comply with all other applicable State and local statutes, ordinances,
and regulations.
Public Works
4. Prior to establishing use, obtain an encroachment permit and improve all new and existing
driveway approaches to publicly maintained roads as specified in the county improvement
standards and the terms of the encroachment permit.
5. Prior to establishing use, a plan for a permanent solution for drainage shall be submitted to
and approved by the Department of Public Works. The drainage plans shall detail existing
drainage conditions and shall specify how drainage waters shall be detained or 'retained
onsite and/ or conveyed to the nearest natural or publicly maintained drainage channel or
facility and shall provide that there shall be no increase in the peak flow runoff to said
channel or facility.

6. Construction, installation or development of buildings and/or roads, driveways, gates and
bridges on parcels/lots shall comply with the latest California Fire Safe Regulations—Public
Resources Code 4290, 4291, as applicable, and current Butte County Improvement
Standards, whichever is stricter.

T ' If this entire matter or any finding, action or condition of this matter is appealed to the Board
of Supervisors, the applicants or any other developer/operator other than the applicants agree
to indemnify the County of Butte from liability or loss related to the approval of this project
and agrees to sign an indemnification agreement in a form approved by County Counsel
before the Board's appeal hearing. If the application is not appealed, 'this. condition is
deemed satisfied.

The Upper Ridge Volunteer. Fire Company wishes to add a 1,200 square foot
vehicle storage building to the existing DeSabla Station #31 on APN 065 — 090 — 019.
The Upper Ridge. Volunteer Fire Company is a private, non — prof t, community based
entity with a board of directors, which provides fire protection services- under the control -
and. direction of the Butte. County Fire, Department.
'The Upper Ridge Volunteer Fire Company is submitting.a use permit application
4o -build a +-/- 1,200 -square foot fire truck storage building -on -the vacant eastern half of
the existing DeSabla Fire Station .#.31.property'(APN 065 — 090 — 019), The site is
north
of Magalia in the Agricultural Residential ,(AR) `general plan designation and -the Timber
Mountain (TM —5) zone adjacent to the Skyway. The existing -47 2,519 equate foot fire'
station facility, is, composed of a garage/engine room, misc. storage, recreation hall,
bathrooms; and a water: tower. ,
The company requests that the Board make the necessary findings for the granting
of a waiver of fees (under Butte County Code 3-40.5), as the company is a quasi - public
entitiy providing an important benefit to the public. The expansion of the current
facilities will allow us to continue providing services for many years to come.

ITEM DESCRIPTION: Consideration of a request submitted by the Upper Ridge. Volunteer
Fire Company (Station 31) for the waiver of use permit fees, building

accessory building on the existing fire station property. Theprojectsite
(APN 065-090-019) is on the east side of Skyway approximately 3,330
feet north of Nimshew Road and Columbine Road in 'Magalia. The
approximate amount of fees associated with this project is between
$14,800 and $18,100. Staff recommends the Board grant this request.

1. The building permit site plan shall conform to the site plan approved by this Use Permit.
2. An erosion control plan shall be submitted and approved by Butte County Public Works
Land Development Division prior to any land disturbance.
3. The applicants shall comply with all other applicable State and local statutes, ordinances,
and regulations.

4. Prior to establishing use, obtain an encroachment permit and improve all new and existing
driveway approaches to publicly maintained roads as specified in the county improvement
standards and the terms of the encroachment permit.
5. Prior to establishing use, a plan for a permanent solution for drainage shall be submitted to
and approved by the Department of Public Works. The drainage plans shall detail existing
drainage conditions and shall specify how drainage waters shall be detained or retained
onsite and/ or conveyed to the nearest natural or publicly maintained drainage channel or
facility and shall provide that there shall be no increase in the peak flow runoff to said
channel or facility.

6. Construction, installation or development of buildings and/or roads, driveways, gates and
bridges on parcels/lots shall comply with the latest California Fire Safe Regulations—Public

Pursuant to the provisions of the Zoning Ordinance of the County of Butte and the special
conditions set forth below: DeSabla Community Volunteer Fire Co. is hereby 'granted a Use
Permit in accordance with application filed consisting of a 1,200 square foot fire truck storage
building on the vacant eastern half of the existing Upper Ridge Fire Station #31 property.
1. Failure to comply with the conditions specified herein as the basis for approval of
application and issuance of Permit constitutes cause for the revocation of said permit in
accordance with the procedures set forth in the Butte County Zoning Ordinance,
including Butte County Code Sec. 24-45.65.
2. Unless otherwise provided for in a special condition to this Use Permit, all conditions
must be completed prior to or concurrently with the establishment of the granted use.
The use granted by this permit must be established within two years of the date of
approval.
3. Minor changes may be approved administratively by the Directors of Development
Services, Environmental Health, or Public Works upon receipt of a substantiated written
request by the applicant, or their respective designee. Prior to such approval, verification
shall be made by each Department or Division that the modification is consistent with the
application, fees paid and environmental determination as conditionally approved.
Changes deemed to be major or significant in nature shall require a formal application for
amendment.
4. If any use for which a Use Permit has been granted is not established within two years of
the receipt of the Permit by the Permittee consistent with conditions of approval herein,
the Permit shall become null and void and reapplication pursuant to Section 24-45 (of the
Zoning Code) shall be required to establish the use previously granted under the expired
Permit unless, 30 days prior to the expiration date, a request for a one year extension is
submitted to the Planning Commission together with sufficient evidence that the time
limits for processing development permits require time limits which exceed one year.
Upon application, and for good cause by the Permittee, at a public hearing, the Planning
Commission may extend any time limitation previously made a part of any condition to a
Use Permit.

5. The terms and conditions of this permit shall run with the land and shall be binding upon
and be to the benefit of the heirs, legal representatives, successors, and assigns of the
Permittee.
6. Neither the applicant, nor any agent nor representative of the applicant shall intentionally
omit or misrepresent any material fact in connection with the application. Any alleged
material misrepresentation shall constitute grounds for the Director of Development
Services to commence a revocation hearing, and, if proven to exist, shall constitute
sufficient grounds to revoke a Permit.
7. The Butte County Planning Commission hereby reserves ongoing jurisdiction over this
Use Permit. The Commission may, at its own discretion, and following a noticed public
hearing, revoke this Use Permit, and/or add additional conditions of approval, or modify
existing conditions of approval, upon receipt of written complaints or other evidence of
adverse impacts upon surrounding properties or the public health, safety or welfare.

Analysis
• The parcel will remain in a quasi -public use. The storage building
will not alter the overall land use of the property.
• The storage building will be used to store fire fighting equipment.
As required by the project site's Timber Mountain 5 -acre (TM -5)
zoning, the quasi -public use requires a Use Permit under Butte
County Code 24-190(c)(10).
• The General Plan designation is Agricultural Residential (AR). The
General Plan Land Use Element includes a list of Primary and
Secondary Uses. Primary uses include agricultural and single-
family dwellings at rural densities. There is a range of uses listed in
the Secondary Uses section including "public and quasi -public
uses".
• No trees will be removed as part of the project. Minimal grading will
be required. A 3 -foot retaining wall is proposed as part of the
project.
• An erosion control plan is required since the project site is located in
the WP zone.
Analysis
The use permit process allows the County to consider site specific
issues in a discretionary process to evaluate consistency with the
Zoning Code and the General Plan. In considering approval of the
use permit, the Planning Commission is required to make specific
findings under BCC 24-45.10 Criteria for Granting. That section
states that the Planning Commission may grant the use permit
when it finds that... the proposed uses of the property will not impair
the integrity and character of the zone in which the land lies and that
the use would not be unreasonably incompatible with, or injurious
to, surrounding properties or detrimental to the health and general
welfare of the persons residing or working in the neighborhood or to
the general health, welfare and safety of the county...

Required Findings
The proposed location, size, design, and operating characteristics of the
proposed use are in accordance with the purpose of the Butte County Code,
the purpose of the zone in which the site is located, the Butte County
General Plan, and the development policies and standards of the County
because:
The parcel will remain in a quasi -public use. The storage building will not
alter the overall land use of the property. The TM -5 (Timber Mountain, 5 -

existing volunteer fire station facility, Development Services considers this

adverse health, safety or welfare impacts.
Required Findings
The location, size, design, and operating characteristics of the proposed use
would be compatible with, and would not adversely affect or be detrimental
to adjacent uses, residents, buildings, structures, or natural resources, with
consideration given to:
- Harmony in scale, bulk, coverage, and density;
The proposed project is consistent with the buildings in the area. The
building location is among other buildings concentrated in the northwest
comer of the property.
- The availability of public facilities, services and utilities;
No additional public facilities, services or utilities are needed to
accommodate this project. The building will store fin: fighting equipment.
- The harmful effect, if any, upon desirable neighborhood character;
The site is already developed with an existing volunteer fire station and
accessory building. The additional storage building will not impact the
surrounding neighborhood character.

The suitability of the site for the type and intensity of use or proposed
development;
The site can accommodate the additional 1, 200 square foot storage
building. The building will not need a wastewater disposal or domestic
water. The site is approximately 1.5 acres and is developed with a 2,500
square foot building.
Any other relevant impact of the proposed use:
Responses from County agencies regarding this application indicate no
evidence that the proposed use, with appropriate conditions, would cause
impacts.
Use permits run with the land. The planning -related impacts of this
project are considered to be minor in general, assuming all conditions are
executed.
Required Findings
Based on the above findings, the proposed location, size, design, and
operating characteristics of the proposed use and the conditions under
which it would be operated and maintained would not be detrimental to the
public health, safety, or welfare, or injurious to properties or improvements in
the vicinity.
An erosion control plan is required to reduce potential soil runoff. No
impacts to public health, safety or welfare have been identified in the review
of the project.
The project does not require the removal of any trees or riparian vegetation.

Subject: Request for a waiver of County fees for Use Permit (UP09-0010),
building permit and impact fees for an accessory building for Upper
Ridge Volunteer Fire Company (Station 31).
Requested Action:
Staff recommends that the Board of Supervisors grant the request to waive fees for UP09-
0010 and. the associated building permit and impact fees together with a finding that the
requested relief from the otherwise required fees is in the public interest.
Analysis:
The Upper Ridge Volunteer Fire Company has requested a waiver of all fees, including the
use permit, building permit and impact fees, associated with an expansion (a 1,200 square
foot accessory building) of the existing Station 31 Volunteer Fire Station. The fire station is
located on the east side of Skyway, approximately 3,330 feet north of the intersection of
Nimshew Road and Columbine Road in Magalia. (APN 065-090-019)
Section 3-40.5 of Butte County Code provides all or part of any fee associated with
projects or permits processed by the Department of Development Services may be
refunded or transferred "if the applicant is a public entity or nonprofit charitable
organization or if the Board of Supervisors finds that it is otherwise in the public interest to
do so."
Development Services staff has investigated if the fees that would not be realized could be
recovered from another source to minimize impacts to the County's General Fund. Butte
County Fire/CaIFIRE Battalion Chief George Morris has indicated Station 31 is not a
County facility and is under the control of the Volunteer Fire Company. Because the
Request for Waiver of County Fees for Expansion of the Station 31 Volunteer Fire Station

improvements are entirely funded by volunteer donations, the fees cannot be reimbursed
through use of Community Cost Share Funding.
Fees:
As shown on the attached spreadsheet and summarized below, the approximate amount
of fee that would not be realized is between $14,799.37 and $18,052.34.

to build a +/- 1,200 square foot -fire truck storage -building -on the vacant eastern half of
the..existing DeSabla Fire Station .#31 property.(APN 065 = 090 =019). The -site is .north
of Magalia in the Agricultural- Residential *(AR) general-plan.designation and -the Timber.
Mountain (TM --5) zone adjacent to the Skyway. The' existing':+% 2,519 aquaTe 'foot' fire

Protection overlay zone, which will require that an erosion control plan be approved

site has gated "pedestrian" but no vehicular access from Dayton Hupp Mill Road, on the

proceed with the request for waiver of fees. Chief Morris indicated Station 31 is not a County facility and

24-235 "WP" (Watershed Protection Overlay) Zone.
(a) Purpose and intent. This district classification is intended to be utilized as an
overlay zone which shall be overlaid onto other zoning districts to establish the
boundaries of a watershed, and for the following purposes:
(1) To protect the county's surface and ground water resources.
(2) To reduce future governmental costs by preserving public water supplies.
(3) To recognize the essentially public nature of the land and water resources of a
watershed, and that their continued vitality is directly related to the social and economic
welfare of the county and its communities.
(4) To protect the public health, safety. and welfare by requiring such additional
restrictions upon the use of the land as are necessary to retain the natural balance and
integrity of a watershed.
(5) To recognize the uniqueness of each watershed by basing the selection of the most
effective measures for their protection upon an evaluation of the soils, climatic
conditions, topography, vegetation, drainage patterns, and any other specific conditions
unique to the watershed.
(6) To allow the county or its citizenry to identify watersheds where a natural or man-
made imbalance in the environmental system occurs and provide a means for repairing
or restoring the natural functions of these watersheds.
(b) Adoption of policies, procedures and standards:
(1) In recognition of the unique characteristics of each watershed and the need for
individual evaluation, the policies, procedures and standards for each watershed shall be
adopted on an individual basis by ordinance in conjunction with adoption of a "WP" Zone
for a watershed. The procedure for adopting said policies; procedures, and standards
shall be in accordance with sections 24-25.20 through 24-25.45 of this chapter.
(c) Application:
(1) The "WP" appearing after a zoning designation on the comprehensive zoning plans
indicates that the property so classified is subject to the provisions of this article in
addition to those of the underlying district onto which it is overlaid.
(2) The regulations of the "WP" district specified within this Article and as specified in
an ordinance adopting policies, 'procedures and standards shall prevail over any
conflicting regulations of any zoning district onto which the "WP" district is overlaid.
(Ord. No. 3176, § 1(Exh. A), 1-24-95; Ord. No. 3431, § 1, 6-9-98).
24-235.10 Policies, procedures and standards for the Firhaven Creek,
Paradise Reservoir, and Magalia Reservoir watersheds.
(a) Land use:
(1) Current lot or parcel sizes in the Firhaven Creek Watershed shall be stringently
maintained. No further division of lots or parcels shall be permitted.
(2) Current zoning shall be maintained within the Magalia Reservoir, Paradise
Reservoir and Firhaven Creek Watershed. Consideration of zoning proposals to a -larger
minimum parcel size is allowed.
(3) No change in zoning shall be made and no use permit shall be issued unless and
until the individual and cumulative impact of additional sewage disposal and surface
water runoff, created by new development which such zone change or use permit might
allow can be proven to the approving authority by the applicant(s) to have no adverse
effects upon the water quality of the watershed.
(4) Notwithstanding the permitting requirements in any zone district which underlies the
watershed protection zone, a second dwelling unit pursuant to section 24-280. shall
require a use permit within the boundary of the watershed protection zone.
(5) Notwithstanding the provisions of any zone district which underlies the watershed
protection zone, the use of the flexible lot .size provisions in section 24-82 shall not be
allowed within the boundary of the watershed protection zone.
(b) Sewage disposal:
(1) A one hundred (100) foot sewage disposal setback from a perennial stream, a fifty
(50) foot setback from an ephemeral stream or drainage way, and. a two hundred (200)
foot setback from a lake or reservoir shall be strictly enforced for all lots or parcels within
the Firhaven Creek, Paradise Reservoir and Magalia Reservoir watersheds regardless
of the date the lot or parcel was created.
(2) Appendix VII of the Butte County Improvements Standards for Subdivisions and
Parcel Maps and Site Improvements pursuant to Chapter 20 of the Butte County Code
which now applies only to single-family residential lots or parcels created after April 4,
1974, shall also apply to all other development, including multi -family residential,
commercial and industrial, on all lots or parcels regardless of date of creation. The
gallonage of sewage application shall be pro -rated in proportion to the usable area of the
lot or parcel as determined in accordance with Appendix VII, using the Table I value of
three hundred fifty (350) gallons/day area requirement.
a. A variance may be granted, pursuant to section 19-21 of the Butte County Code,
only on an existing lot or parcel when special circumstances are applicable to the
property involving the soil characteristics, topography or surrounding property
characteristics. Variances may be granted only to the usable area requirements of
Appendix VII, Table 1. Cumulative effects within the hydrologic basin shall be considered
prior to issuance of any variance. In no event shall a variance be granted that would
provide less usable area than the requirements of Butte County Code, Chapter 19,
section 19-12.
b. An application for a variance shall be made in writing on a form prescribed by the
health department. Upon receipt of the application, the health officer together with the
manager of the Paradise Irrigation District and the chairman of the water committee of
the Upper Ridge Coordinating Council, shall make an investigation to determine whether
a variance should be granted. At the conclusion of the investigation, the director of
environmental health shall prepare a written order granting or denying the variance, and
shall include in such written order specific findings of fact and reasons for its granting or
denial.
c. If the environmental health division of the health department denies the application
for variance, the applicant may file an appeal with the state regional water quality control
board within ten (10) days after denial. The decision by the state .regional water quality
control board shall be final.
(c) Erosion control measures.
(1) All driveways for new home sites on new or existing lots shall be surfaced with at
least two (2) inches of Class 2 aggregate base, unless required to be developed to a
higher standard.
(2) All roads created as a result of any land division shall be surfaced with a minimum
of two (2) inches of Class 2 aggregate base, to a minimum width of twenty (20) feet,
unless required to be developed to a higher standard by other code requirements. This

standard shall apply from a maintained county road, or existing road of a higher
standard, through the parcel being divided.
(3) All roads and driveways shall meet the minimum requirements as prescribed by
Public Resources Code 4290 and 4291 and Butte County Fire Safe Regulations, or as
prescribed by the Butte County Department of Public Works.
(4) Erosion and sediment control plans, including provisions for wet weather conditions,
shall be submitted with all building permits, discretionary development projects, and
grading plans, excluding structures that fall under the provisions of section 26-3.1 of the
Butte County Code. The erosion and sediment control plans shall include both.
temporary (first year) and permanent erosion control protection measures that prevent
sediment and other pollutant discharges from reaching watershed drainages and
streams. The erosion and sediment control plans shall comply with the
recommendations of a qualified professional involved in the preparation of erosion
control plans. Said plans shall be reviewed and approved by the department of
development services.
(5) The erosion and sediment control plan shall include the time of year for construction
activities. No soil disturbance shall occur after November 15 or before April 1 unless the
director o development services, or his or her authorized agent, determines project soil
conditions to be adequate to accommodate development activities. All such areas where
land clearing has been completed —between April 1and November 15 shall
revegetated, hydroseeded,1 mulch protected or otherwise stabilized no later than
December 1. Should grading be permitted during the rainy season, the smallest
practicable area of erodible land shall be exposed at any one (1) time and the time of
exposure shall be minimized. Temporary erosion control measures shall be in place on a
daily basis.
(6) No structures shall be placed within two hundred (200) feet of the high water mark
of the Paradise or Magalia Reservoirs or within fifty (50) feet of the top of the bank of any
perennial or ephemeral water course, as shown on the most recent edition of USGS 7.5
minute topographic maps, in the Firhaven Creek, Paradise Reservoir, and Magalia
Reservoir watersheds. This provision shall not preclude development on a parcel that
would otherwise become undevelopable due to this provision.
(7) The location of homesites (building envelopes) shall be shown on all future parcel
and subdivision maps in the Firhaven Creek, Paradise Reservoir, and Magalia Reservoir
watersheds.
(8) Erosion and sediment control plans prepared by a qualified professional involved in
the preparation of erosion control plans shall be submitted for all three (3) acre
exemption conversion timber operations in the Firhaven Creek, Paradise Reservoir, and
Magalia Reservoir watersheds.
(9) Three (3) acre exemption conversion timber harvest operations shall 'not be
conducted in the - Firhaven Creek, Paradise Reservoir, . and Magalia . Reservoir
watersheds during the period from November 15 to April 1.

Based on the information you have provided, I am comfortable with a Class 1 CEQA exemption'for this
project. While the project suite is located in the. WPZ, the requirements for erosion control measures are
specified requirements'in County.Code, and therefore are not mitigation measures under CEQA.
Two questions to contemplate as, to the issue of negligible or no expansion of an existing use: Is the
building intended for storage of existing equipment? Are their any other contemplated uses of the 1,200
SF building beyond storage of fire trucks?

Yesterday I opening a new UP project (UP09-0010) for the Station #31 new parking garage, and I'm
wondering how to approach environmental review and F&G fee exemption. Here's the project
description:
The De Salba Community Volunteer Fire Co. Inc. is requesting use permit approval to build a
1,200 SF fire truck storage building on the vacant eastern half of the existing Upper Ridge Fire
Station #31 property (APN 065-090-019). The site is north of Magalia, in the AR/TM-5/WP
adjacent to the Skyway. See proposed site plan here attached. Site has been zoned TM -5 since
1974. In 1980 the County granted UP 81-7 to add a 1,200 SF attached garage/engine room.
The same year the County issued a building permit for a 12'X 12' bathroom addition. The
existing +/- 2,519 SF fire station is composed of a garage/engine room, misc. storage, recreation
hall, bathrooms, and a water tower. The +/-1.5-acre site is relatively flat. The eastern portion of
the site on which the new building will be constructed has been graded flat and has been kept
clean of vegetation. The De Salba Volunteer Fire Co will be applying to the BOS for waiver of
fees. The new metal building has already been ordered. They want to break ground ASAP and
have dirt work done before potential October rains.
They are applying for and will receive a waiver of our fees, so it'd be nice to keep this down & dirty. I'm

wondering about using Cat. Exemption 15301(e) (1):
15301. Existing Facilities
Class 1 consists of the operation, repair, maintenance, permitting, leasing, licensing, or minor alteration of
existing public or private structures, facilities, mechanical equipment, or topographical features, involving
negligible or no expansion of use beyond that existing at the time of the lead agency's determination. The
types of "existing facilities" itemized below are not intended to be all-inclusive of the types of projects
which might fall within Class 1. The key consideration is whether the project involves negligible or no
expansion of an existing use.
Examples include but are not limited to:
(e) Additions to existing structures provided that the addition will not result in an increase of more than:
(1) 50 percent of the floor area of the structures before the addition, or 2,500 square feet, whichever is
less; or
Maybe we could get CoCo advance buy-in.
With the "Lambert" Office UP, how did we handle F&G exemption?

Gentlemen,
Cletus Gerber of Tru-Bilt Construction in Bangor (679-0217) came to the counter on Fri.
Aug. 7 to ask about a 1,200 SF Fire truck storage building for the De Salba Community
Volunteer Fire Co. Inc. at Upper Ridge Fire Station #31, on APN 065-090-019, north of
Magalia, in the AR/TM-5/WP adjacent to the Skyway. See proposed site plan here
attached. Site has been zoned TM -5 since 1974. In 1980 the County granted UP 81-7 to
add a 1,200 SF attached garage/engine room to the existing +/-2,519 SF fire station,
which appears to have been composed primarily of misc. storage and recreation hall. The
garage permit was finalled in 1989. The same year the County issued a building permit
for a 12' X 12' bathroom addition (see attached floor plans). They will be applying to the
BOS for waiver of fees.
New metal building has already been ordered. They want to break ground ASAP and
have dirt work done before Oct. rains. Except for a water tower serving the facility, there
appear to be no other structures on the +/-1.5-acre site, which is relatively flat. There is
no DDS microfilm or hard copy of this UP file. The PW file has only the UP and site
plan (here attached) and gives no indication of environmental review.
This old UP does not contain the standard COA that allows the Director to approve minor
changes:
Minor changes may be approved administratively by the Directors of Development
Services, Environmental Health, or. Public Works upon receipt of a substantiated written
request by the applicant, or their respective designee. Prior to such approval, verification
shall be made by each Department or Division that the modification is consistent with the
application, fees paid and environmental determination as conditionally approved.
Changes deemed to be major or significant in nature shall require a formal application for
amendment.
I looked for but did not find this standard COA in Chapter 24.
Please advise me how to proceed.
