Attachment to Project Information
The North State Rendering plant currently accepts and processes, biological
waste materials, including dead livestock, restaurant grease and discarded prison food.
The plant's processes the materials into yellow grease, a product used in various
industries, and animal feed. The proposed plant would divert some of the feedstock
through anaerobic digester where bacteria would convert some components of the
feedstock into methane and carbon dioxide. The plant would further process the
methane into a usable fuel for operating an electrical generator to provide for the
electrical needs of the plant, fueling the plant's collection trucks and heating appliance
cooking vats. Methane not used in the operation of the plant would be available for sale
to PG&E. The new capacity would allow the plant to continue to accept its current types
of feedstock, thereby avoiding diversion into landfills.
The biogas digester consists of two large tanks, 40 feet in diameter and 40 feet
high, with a fabric roof, which would contain the feedstock being processed and keep it
heated to approximately 130 degrees. The plant would also include equipment to clean
and compress the gas to specifications necessary for using as a fuel to fuel vehicles
and the project's generator.

2. Related Permits: The project may require a modification of the existing permit
with the Air Pollution Control District.
3. Site Description: The site consists of approximately 25 acres located at the
northeast corner of the intersection of Highway 99 and Shippee Road. The
improvements include a rendering facility, shop, office, and mobile home residence.
Holding and settling ponds have been constructed to treat the waste water stream
produced by the rendering facility. Most of the storm water is discharged at a location at
the southern border of the property into storm drains, which drain through an unnamed
tributary to Gold Run, which in turn flows into Dry Creek and, ultimately, into the
Sacramento River Delta. There are no streams or wetlands onsite. The proposed
facility will be installed on the unimproved portion of the parcel. That portion is currently
vegetated with non-native species and is disked annually for weed control and fire
prevention.
4. Surrounding Properties:
The parcel is surrounded to the northeast and west by commercial orchards.
The property on the south is used for grazing. A portion of the unnamed tributary to the
south is being restored to garter snake habitat.
5. Special Studies:
The applicant does not anticipate preparing any special studies relating to the
proposed project.

In an April, 11, 2011., email on behalf.ofNorth..State.Rendering, Inc., you notified staff that North State
had. determined that. a 1 MW CHP .Generator would be more advantageous to the bio -fuels project
permitted by UPI 0-0004 than the .250 kW_CHP Generator considered in the use permit approval process.
As indicated in our April 19;2011- email response;. staff considered the proposed change to be minor as
provided for.in UP10-0004,standard'condition 3. As required by special condition 3, staff subsequently
circulated the proposed change to the: Department of Public Works, the Environmental Health Division
and Butte County Fire/CDF: All. agreed with the Department of Development Services that the proposed
change would be consistent withthe: application; fees paid and environmental determination for UP10-
0004 and minor in nature. Thus. no f irther discretionary action or environmental review is necessary.
-Accordingly, .your request to install a l MW CHP, generator is approved. This letter will be placed in the
-project tfile; no change to -UPI 0-0004,permit:is required as it does not reference a specific output for the
generator.

Shippee Road and H. 99 (APN 041-200-023) was approved by the Planning Commission on January 27, 2011.
The Use Permit provides for the diversion of some of the rendering plant's waste stream town anaerobic digester
to create biogas for the generation of approximately 250 kilowatts of renewable electricity and vehicle fuel
(compressed natural gas) for the facility's vehicles and for sale to PG&E via a pipeline which crosses the project
site.
The project description includes installation and operation of a 250 kW Combined Heat and Power (CHP) generator.
Subsequent to approval, the applicant, North State Rendering, has determined that a 1 MW CHP generator would be
more economically feasible and notified Development Services that they would like to modify the project description
accordingly.
In regards to minor modifications, UP10-0004 Standard Condition #3 states:
"Minor changes may be approved administratively by the Directors of Development Services,
Environmental Health, or Public Works upon receipt of a substantiated written request by the applicant, or
their respective designee. Prior to such approval, verification shall be made by each Department or
Division that the modification is consistent with the application, fees paid and environmental determination
as conditionally approved. Changes deemed to be major or significant in nature shall require a formal
application for amendment."
UP10-0004 was approved with a categorical exemption from environmental review under the California
Environmental Quality Act. Categorical Exemption No. 15329 ("Cogeneration Projects at Existing Facilities") allows
the installation of cogeneration equipment with a capacity of 50 megawatts or less at existing facilities. The proposed
modification is well under the 50 MW threshold.
According to the applicant's engineer, the 1 MW CHP generator will be housed in a container Oust like the 250kW
CHP generator) but some 10 feet longer (45' long by 10' wide instead of 35' long by 10' wide). There will be no
appreciable change in noise or air emissions: the generator must meet OSHA noise requirements and receive an
applicable permit from the Butte County Air Quality Management District (see Condition of Approval #1). Similarly, it
does not appear that there would be any other environmental impact associated with the proposed CHP generator.
With the proposed modification, Development Services finds that the project would remain consistent with its
environmental determination as conditionally approved and represents a minor modification to the approved permit.
At your earliest convenience, please let us know if is your Department/Division's determination that the modification
is consistent with the application, fees paid and environmental determination as conditionally approved and thus
may be administratively approved.

Good Afternoon:
Use Permit 10-0004 for a bio-fuels/cogeneration plant at the North State Rendering.facility at the corner of
Shippee Road and H. 99 (APN 041-200-023) was approved by the Planning Commission on January 27,
2011. The Use Permit provides for the diversion of some of the rendering plant's waste stream to an
anaerobic digester to create biogas for the generation of approximately 250 kilowatts of renewable
electricity and vehicle fuel (compressed natural gas) for the facility's vehicles and for sale to PG&E via a
pipeline which crosses the project site.
The project description includes installation and operation of a 250 kW Combined Heat and Power (CHP)
generator. Subsequent to approval, the applicant, North State Rendering, has determined that a 1 MW CHP
generator would be more economically feasible and notified Development Services that they would like to
modify the project description accordingly.
In regards to minor modifications, UP10-0004 Standard Condition #3 states:
"Minor changes may be approved administratively by the Directors of Development Services,
Environmental Health, or Public Works upon receipt of a substantiated written request by the
applicant, or their respective designee. Prior to such approval, verification shall be made by each
Department or Division that the modification is consistent with the application, fees paid and
environmental determination as conditionally approved. Changes deemed to be major or
significant in nature shall require a formal application for amendment."
UP10-0004 was approved with a categorical exemption from environmental review under the California

Environmental Quality Act. Categorical Exemption No. 15329 ("Cogeneration Projects at Existing Facilities") allows
the installation of cogeneration equipment with a capacity of 50 megawatts or less at existing facilities. The proposed
modification is well under the 50'MW threshold.
According to the applicant's engineer, the 1 MW CHP generator will be housed in a container Oust like the 250kW
CHP generator) but some 10 feet longer (45' long by 10' wide instead of 35' long by 10' wide). There will be no
appreciable change in noise or air emissions: the generator must meet OSHA noise requirements and receive an
applicable permit from the Butte County Air Quality Management District (see Condition of Approval #1). Similarly, it
does not appear that there would be any other environmental impact associated with the proposed CHP generator.
With the proposed modification, Development Services finds that the project would remain consistent with .its
environmental determination as conditionally approved and represents a minor modification to the approved permit.
At your earliest convenience, please let us know if is your Department/Division's determination that the modification
is consistent with the application, fees paid and environmental determination as conditionally approved and thus
may be administratively approved.

This letter is written on behalf of our client North State Rendering. North State
Rendering suffered a fire in the summer of 2003 which destroyed 75% of its production
capacity and most of its main building. In May 2004 North State submitted to Butte
County a permit application to rebuild its facility and restore its capacity: On
September 21, 2004, when North State's contractor arrived at the Building Department
expecting to pick up its long-awaited approved construction drawings, he was instead
advised that the project may require a use permit. This letter will describe the reasons
why the project is entitled to proceed without any such use permit.
North State's activities are unique in Butte County. North State Rendering
receives Butte County's wastes and processes them into useful products. The wastes
include restaurant scraps, cooking oil and grease and, yes, animal carcasses.
Agricultural counties such as Butte County, if they wish to continue accommodating
livestock agriculture, must have a way to promptly deal with dead animals. North State
Rendering provides that service to the county by recycling those animals into useful
products, and employing twenty-two people as it does so.
The North State Rendering facility is located at the intersection of Hwy 99 and
Shippee Road, with good highway access in an agricultural area of very few residences,
the nearest of which is more than a mile away. The rendering plant was established at
the current site in 1943 and has been in continuous operation ever since.
The zoning history of this parcel indicates an intention to preserve the use rather
than phase it out. As a part of the last general rezone in the 70's the county changed
the parcel's zone'to M-2 Heavy Industrial. Although the zone text authorizes a
rendering plant only with a use permit (Butte County Code 24-180(c)(2)), the Board of

Supervisors' action in establishing the zone for the plant shows the intention of
accommodating the parcel's use as a rendering plant, and therefore is the functional
equivalent of a use permit. If the Board's intention were to eventually eliminate the use,
the county would have made the zoning for the parcel the same as the surrounding
area. The Board of Supervisors did not do so. It established the M-2 zone there, not
because in its regional plan it decided that would be a good place to establish an
industrial area, but rather it established the zone to accommodate the use that was
already there. This non -conforming use is different from most because the county
intends this use to remain instead of gradually changing to other uses consistent with
the surrounding area.
The county has also accommodated the use at this location by issuing it
permits. The county authorized an expansion of the facility in 1978. The county
granted a second permit to replace its gas plumbing in 1981. The county
accommodated the facility for good reason - it provides an important service in an
appropriate location.
In Butte County legal non -conforming uses, such as North State Rendering's, are
allowed to continue (Butte County Code §24-35.15). In general they cannot be
expanded, enlarged, extended, reconstructed, substituted or structurally altered without
a use permit (Butte County Code §24-35.20). In a special case where the proposed
work is. the result of a catastrophic event, restoration is allowed. Butte County Code
§24-35.55 reads:
"A non -conforming use, building or structure catastrophically
damaged or destroyed totally or in part, may be restored to a
total floor area or to the same extent as the original without a
use permit." (emphasis added)
The fire was a catastrophic event. The section therefore allows a restoration
measured either by matching the pre-existing square footage or matching the pre-
existing extent of use. The proposed project will do no more than restore the pre-
existing use and the square footage dedicated to it. The project will not expand,
enlarge or extend the non -conforming use. The capacity of a rendering plant is
measured by the amount of water it can boil off, its evaporation capacity. Before the
fire the North State Rendering plant had four "5X16" cookers capable of evaporating
2000 pounds per hour, for a total of 8000 pounds of water per hour. The proposed
restoration would result in two 1700" cookers having a total evaporative capacity of
3000 pounds per hour and one "5X16" cooker, for a total of 8000 pounds per hour. By
this industry measure of plant capacity, the use is not being expanded, but is merely
being restored.
The plan proposes a modest increase in floor area. According to the demolition
plan dated February 24, 2004, prepared by Russell, Gallaway Associates (copy

attached), the new construction totals 6,400 square feet and the building to be
demolished is 4,246 square feet for an increase of 2,154 square feet. The increase in
building size does not increase the square footage of the building area devoted to the
non -conforming use. The increase in building space will only accommodate a pre-
existing operation that was previously performed in the open air, one that does not
involve the activities requiring a use permit. The westernmost 54 feet of the proposed
building, a space 40 feet by 54 feet or 2,160 square feet, will cover the receiving area.
The receiving operation is authorized as a matter of right under the MT -2 zone as a
recycling facility (24-175(a)(1)), a warehouse (24-175(a)(3)), or a freighting or trucking
yard or terminal (24-175(a)(4)). No fat rendering operations are proposed for that
section of the building.
In analyzing this project the county should recognize the unique nature of this
beneficial use, observe that neither the function of the plant nor the square footage of
the building dedicated to the non -conforming use is increasing, and conclude that no
use permit is necessary because this proposed project is merely a restoration of the
non -conforming use.

This office represents James Errington, operator of
Butte Tallow Co. , bordering Highway 99 at Shippee Road.
Mr. Errington has learned recently that 200 acres
be:Lind his property has been purchased by persons who seek
to introduce single-family resiliences to the land. You are,
of course, aware that this area is presently in an A-2
classification, which would permit such use. Residential
development in that area would be far away from present
urban development and would be a highly questionable activity
from the standpoint of efficient county government. Of still
greater concern to our client, however, is the probability
that residents introduced to that land would complain of the
presence of his rendering plant. Though the plant has been
there for many years, persons moving nearby may .cell be dis-

Dear Mr. Lawson:
Thank you for the opportunity to review the applications for
the proposed rezoning of parcels of land near Terrace Drive,
Cohasset Road near Lupin Avenue, and State Highway 99 at
Shippee Road. We have no objections to the proposed rezonings.
Planned future development of the parcel east of Route 99
should take into account that an Hicroachment Permit issued by
the Department of Transportation will be required for any work
to be done on State Highway 99 right of way. r
The proposed -heavy industrial zoning appears compatible with
the close proximity to the highway.
If the planned development should involve a noise sensitive type
of use, any desired sound attenuation would be the responsibility
of the developer.
Future development should take into account the drainage patterns
mo the vicinity of the State runoff patterns thatosals wouldfor affectothe
accom-
modating flows or changing
State highway should be coordinated with the Department of
Transportation.

examining the official maps and records for archaeological sites and surveys in Butte
County.
RESULTS:

In response to your request, a project review for the project cited above was conducted by

Prehistoric Resources: According to our records, no sites of this type have been recorded
in the project area or vicinity. The project is located in a region utilized by, the Konkow

consisting of a canal. Unrecorded historic cultural resources may be located in the project
area.
The USGS Oroville (1942) 15' quad map indicates that Shippee Road and a dirt road are
located in the project area, while Gold Run Canal, Dry Creek and a structure are in the
project vicinity. The project is located in the historic Oroville gold mining district.
John Bidwell made the first gold discovery in Butte County on the west bank of the Feather
River in 1848. News spread and miners soon began to arrive in the area to mine the
riverbank. In 1850 the Ophir City mining camp was formed a few miles to the north and in
1856 the name was changed to Oroville. 1898 saw the introduction of bucket dredging and
by 1908 there were 12 mining companies operating 35 dredges on the Feather River south
of Oroville. The vast historic dredge fields are the result of these operations which brought
in an estimated 1,964,000 ounces of gold.
Previous Archaeological Investigations: According to our records, the project area has
not been previously surveyed for cultural resources by a professional archaeologist.
Literature Search: The official records and maps for archaeological sites and surveys in
Butte County were reviewed. Also reviewed: National Register of Historic Places -
Listed properties and Determined Eligible Properties (Computer Listings 1966 through
8-09 by National Park Service); California Register of Historical Resources (2010);
California Points of Historical Interest (2010); California Inventory of Historic
Resources (1976); California Historical Landmarks (2010); Directory of Properties in
the Historic Property Data File for Butte County (2010); Handbook of North American
Indians, Vol. 8, California (1978); Historic Spots in California (1966).
RECOMMENDATIONS:
Based upon the above information and the local topography, the project is located in an
area considered to be sensitive for prehistoric, protohistoric, and historic cultural resources.
Native Americans used the local region for seasonal and/or permanent settlement, as well as
for the gathering of plants, roots, seeds, domestic materials, and hunting seasonal game.
Historically, Euroamericans utilized the region for farming, ranching, and transportation
operations.
Therefore, we recommend that a professional archaeologist be contacted to conduct a cultural
resources survey of the project area. The project archaeologist will be able to offer
recommendations for the preservation or mitigation for any new cultural resources
encountered as a result of field survey. The project archaeologist should also contact the
appropriate local Native American representatives for information regarding traditional
cultural properties that may be located within project boundaries for which we have no
records. The project archaeologist may also want to consult the local BLM office
regarding historic General Land Office (GLO) plat maps in order to aid in the

identification of unrecorded historic sites, which may be located within project boundaries.

During any phase of parcel development, if any potential prehistoric, protohistoric, and/or
historic cultural resources are encountered, all work should cease in the area of the find
pending an examination of the site and materials by the project archaeologist. This request
to cease work in the area of a potential cultural resource find should be made a condition of
project approval. This condition is intended for accidental discoveries made during
construction activities, and does not replace the need for a Phase I investigation that assists
planners and developers in meeting CEQA obligations during the Initial Study planning
phase. The recommendation for a Phase I Cultural Resource Evaluation enables the lead
agency to fulfill their obligations under CEQA to identify potentially significant historical
resources. A Phase I investigation includes background research (record search), a field
inspection, and report documenting the presence or absence of prehistoric or historic
features, buildings, or archaeological sites. If potentially significant sites are identified
during the Phase I investigation, further work may be necessary to determine site
significance as well as appropriate protection or mitigation measures.
The fee for this project review is $75.00 (1 hour Project Review Time @ $75.00 per hour).
Payment for this project review was received on October 26, 2010 (Check # 10343).
