The property is located at the intersection of Condor Road and Deer Hollow Lane, and just east of the intersection of Cherokee Road and Run Around Road, Cherokee. APN 041-520-030 (SB) (UP 01-19) Mr. Wilson gave a brief summary of the project. Commissioner Leland said the acreage minimum does not fit the ordinance, but is above the General Plan minimum density. The hearing was opened to the public. The applicant had no comments. The hearing was closed. It was moved by Commissioner Leland, seconded by Commissioner Marin, and unanimously carried to approve the Use Permit for Harold and Shirley Prescott, subject to the findings and conditions listed below. Mr. Wilson said there is a 10 day appeal period. Determine the project to be Categorically Exempt from environmental review under Section 15301(e) of the California Environmental Quality Act. This section states that construction of a structure not involving the use of significant amounts of hazardous substances, and not exceeding 2,500 square feet in floor area, is exempt from environmental review. The proposed second dwelling unit does not involve the use of any hazardous substances and does not exceed 2,500 square feet. II. Approve Use Permit 01-19 for Harold & Shirley Prescott, subject to the conditions found in Exhibit A, with the following findings: A. • The proposed use of the property will not impair the integrity and character of the zone in which the land lies, and that the use would not be unreasonably incompatible with, or injurious to, surrounding property, or detrimental to the health, safety and general welfare of the persons residing or working in the neighborhood, or to the general health, welfare and safety of the County because: The second dwelling unit will not create significant amounts of light, noise, or dust. 2. The proposed second dwelling unit will not significantly increase vehicle traffic in the area nor will it create any vehicle circulation impacts. 3. The project will result in an average density of one dwelling unit per ten acres, which is slightly less dense than the average density of the surrounding and nearby parcels, which is approximately one dwelling per 8.5 acres. 0 BUTTE COUNTY PLANNING COMMISSION 0 MINUTES ■ JUNE 14, 2001 ■ PAGE 22■ 4. The Planning Division has circulated the proposed second dwelling unit application to County Agencies and has received no evidence that the use will cause any other relevant impact. B. The project is consistent with the Unclassified zone, which allows multiple dwellings with a Use Permit. Second dwelling units do not have to meet the density requirements of the General Plan'. C. The Agricultural -Residential General Plan land use designation allows single-family dwellings at rural densities as Primary Uses. D. The Agricultural -Residential General Plan land use designation allows a minimum parcel size of one acre. Conditions of Approval: Planning Division 1. Measures shall be taken to control fugitive dust emissions from all civil construction associated with development of the site. Standard Mitigation Measures to prevent or reduce fugitive dust emissions can be obtained from the Butte County Air Quality Management District. 2. The project site shall be developed in accordance with the approved project site plan and the conditions contained herein. Said site plan is on file in the Planning Division, is date-stamped April 3, 2001, and is incorporated herein by this reference. Fire Department 3. Construction, installation or development of structures or facilities on the parcels/lots shall comply with the latest California Fire Safe Regulations, (Public Resources Code 4290), and all other applicable State and County codes, ordinances and regulations in effect at the time of application for improvement permits. 4. Building identification and/or addresses shall be installed in conformance with Public Resources Code 4290 and shall be posted at the beginning of building construction and maintained continuously thereafter. Environmental Health Division 5. Sewage disposal permits shall be obtained prior to issuance of building permits. Other Conditions 6. PROJECT DESCRIPTION/SITE CHARACTERISTICS: This is an application for a Use Permit to allow a permanent second dwelling unit. No dwellings are currently on the site, and the second dwelling unit will be installed concurrently with or shortly after the primary dwelling unit is installed. The second dwelling unit will be located in the north portion of the site. Access for the second dwelling unit will be from Condor Road. Sewage disposal for the dwelling will be handled by an on-site septic system, and domestic water obtained from an on-site well. Vegetation on the site consists of numerous blue oaks, scattered digger pines, manzanita, buck brush, poison oak, native and introduced grasses, and wildflowers. This area gradually slopes down to the southwest and has a slope of approximately 5 to 7%. No drainages are found on the site. The project site is located in a deer herd area, but is within a Designated Development Zone. ■ BUTTE COUNTY PLANNING COMMISSION AGENDA REPORT ■ PAGE 1 ■ The project site is zoned U (Unclassified) and has a General Plan Land Use designation of Agricultural -Residential. Surrounding parcels are zoned Unclassified to the north, west, and east and FR -5 to the southwest. Surrounding parcels range in size from 9 acres to 21 acres. Land uses on surrounding parcels include dwellings at rural densities, some livestock grazing (cows and goats), and horse keeping. This project is being processed under Butte County Code Section 24-230(c)(1), which requires a Use Permit for multiple residences on a parcel zoned Unclassified. The project cannot be processed as a Minor Use Permit under Section 24-280 (Second Dwelling Units) because the property does not have twice the acreage of the Unclassified zone as required by this Section. Under Section 24- 230(c)(1), the applicant is not required to reside on the property and both of the dwellings could be rented. ANALYSIS: The project site is zoned Unclassified, which requires a minimum parcel size of 20 acres. The project will exceed the density of the U zone because the parcel is only 27 acres in size. Butte County Code Section 24-230(c)(1) requires a Use Permit for multiple residences on a parcel zoned Unclassified, and this section states that second dwelling units do not have to meet the General Plan density requirements. The project site is designated as Agricultural Residential by the Land Use Element Map of the General Plan, which allows a minimum parcel size of one to forty acres. The Agricultural -Residential designation list single family dwellings at rural densities as Primary Uses. The project will result in an average density of one dwelling unit per ten acres. This is slightly less dense than the average density of the surrounding and nearby parcels, which is approximately one dwelling per 8.5 acres. There have been two other permanent second dwelling units approved in the project area. In 1995, the Planning Commission on consent approved Minor Use Permit 95-148 (Kuentz) for a permanent second dwelling unit on a parcel located one mile to the south of the project site. That project was very similar to the present project - the parcel is 21 acres in size, is zoned U, and has a General Plan land use designation of Agricultural -Residential. The Planning Commission also approved on consent Minor Use Permit 01-11 (Smith) for a permanent second dwelling unit on a parcel zoned U located approximately 1.8 miles to the south of the site. That parcel had double the acreage, unlike the project parcel. The proposed second dwelling unit is not expected to create any significant impacts to the neighborhood. The second dwelling unit will cause a slight increase in vehicle trips in the area, but this will not have an impact to vehicle circulation. The proposed second dwelling unit will utilize Condor Road for access, which is a dirt/gravel road. Additional dust and noise will be created by vehicles entering and exiting the site, but this is not expected to create a significant impact. The project is located within a State Response Area for wildland fires and construction of homes in this area makes fighting wildland fires more difficult because fire resources must protect structures before wildlands. The Butte County Fire Department/CDF requests that all new structures meet the Fire Safe Regulations of Butte County and Public Resources Code 4290, which includes fuel reduction areas within 30 feet of all structures and specified addressing signs. ■ BUTTE COUNTY PLANNING COMMISSION AGENDA REPORT 0 PAGE 2 ■ E The soils on Table Mountain are generally classified as "scab land" soils, which may consist of thin soils, while cracks and small local pockets or basins may have a considerable depth of soil. The Butte County Environmental Health Department requires that adequate soil for a leachfield must be proven prior to issuance of a septic permit for the second dwelling unit. The Building Division will not issue a building permit for the second dwelling unit without a valid septic permit. The Environmental Health Department did not indicate that there is inadequate ground water in the area. According to the Environmental Health Department, wells in the area may have to be drilled to a depth of 200 to 400 feet to obtain the required amounts of domestic water. ACTIONS FOR CONSIDERATION: Staff recommends that the Planning Commission take the following actions: I. Determine the project to be Categorically Exempt from environmental review under Section 15301(e) of the California Environmental Quality Act. This section states that construction of a structure not involving the use of significant amounts of hazardous substances, and not exceeding 2,500 square feet in floor area, is exempt from environmental review. The proposed second dwelling unit does not involve the use of any hazardous substances and does not exceed 2,500 square feet. II. Approve Use Permit 01-19 for Harold & Shirley Prescott, subject to the conditions found in Exhibit A, with the following findings: A. The proposed use of the property will not impair the integrity and character of the zone in which the land lies, and that the use would not be unreasonably incompatible with, or injurious to, surrounding property, or detrimental to the health, safety and general welfare of the persons residing or working in the neighborhood, or to the general health, welfare and safety of the County because: The second dwelling unit will not create significant amounts of light, noise, or dust. 2. The proposed second dwelling unit will not significantly increase vehicle traffic in the area nor will it create any vehicle circulation impacts. 3. The project will result in an average density of one dwelling unit per ten acres, which is slightly less dense than the average density of the surrounding and nearby parcels, which is approximately one dwelling per 8.5 acres. 4. The Planning Division has circulated the proposed second dwelling unit application to County Agencies and has received no evidence that the use will cause any other relevant impact. B. The project is consistent with the Unclassified zone, which allows multiple dwellings with a Use Permit. BUTTE COUNTY PLANNING COMMISSION To be published in the Oroville Mercury on Thursday, May 24, 2001 Environmental Setting: 32. .The project site currently exists as 27.18 AC SEC 9 T2ON R4E (legal description) of vacant land located on Run Around Road, off CherokeeRd in the Gold Hills Subdivision, as shown on the attached map #1 as parcel 30. The attached topographical map (map #2) shows where the site is located on Table Mountain, as well as its relationship to Hwy 70, Cherokee, Lake Oroville as well as Oroville, itself. As for the parcel itself, it is somewhat sloping. A gentle slope uphill from the access off Cherokee Rd. to the abandoned ranch road, Condor Rd., then a sharper slope down hill to the back of the property. The parcel is mostly wooded with Scrub Oaks, Digger Pine as well as some Manzanita & other brush. There are also large quantities of Poison Oak. The soil is poor & rocky, but there are no signs of slippage or erosion. The land is not.currently being used to pasture any livestock, however deer have been seen on the property and wild turkey sign. As the land is vacant, I'm sure many of the indigenous wild life frequent the parcel. Map #3 shows the proposed locations of the two single-family home sites and the three pages of photographs are all taken on the property. 33. The surrounding properties consist of single-family dwellings (homes & mobiles), although parcel #21 has two mobiles on it. The project site tends to be larger than the surrounding parcels (5 — 15 acres average, as shown on Map #1). Native plants and animals for the surrounding properties would be the same as for the project site.
